We are hopefully about 2-3 weeks from our NOA2. We are going through the Vancouver Consulate in Canada which seems to run quite quickly after the case has been forwarded (quick being 3-5 weeks from NVC receiving case in some cases). Does anyone know how far in advance I can request my police check? It takes about 1-2 weeks from date of ordering... Any advice appreciated.

CanadaVehicle Letter of Compliance

I took my BMW 2008 in for inspection here in Phoenix upon arrival. It was required to have a new dash readout installed to read in both kms and miles as the one it had was only kms. It could be reset for other parts of the dash to read kms or miles but the actually spedometer was kms only. Hate to tell you but they aren't a cheap replacement :-( $1200 later it was repaired and was reregistered.


My speedometer is okay, it is just the odometer that says KM only...hopefully that won't be as big of a deal.

CanadaVehicle Letter of Compliance
I am going to be importing my vehicle from Canada to the USA upon POE on a K-1 Visa. I received a letter of compliance back in Nov 2010 (I figured it might take a while to receive it, but I got it right away). I want to make sure that it is recent enough to be sufficient for registration in California. I am going to copy what it states in the letter, and if anyone knows what information is needed to register your vehicle in CA from Canada, please advise. I want to make sure I have my bases covered.

Letter states:
Dear Ms. ********:
We are responding to your request for a letter regarding a 2007
Toyota Yaris HATCHBACK 5DR 4A manufactured to meet Canadian
Motor Vehicle Safety and Emission Standards and compliance with
U.S. D.O.T. Federal Motor Vehicle Safety, Bumper, Theft
Prevention (“FMVSS”) and E.P.A. Exhaust Emission Standards.
An investigation conducted by Toyota Canada Inc. indicates that
vehicle chassis number **************** does satisfy U.S.
Federal Motor Vehicle Safety and E.P.A. Exhaust Emission
Standards, with the exception of certain labeling violations, as
they may apply to your specific vehicle in effect at the time of
manufacture.
Please note however, that the odometer installed on the vehicle
registers in kilometers as required by Canadian Motor Vehicle

I want to note that my speedometer registers Miles as well as KM. The odometer is digital, and does in fact register in KM only (not sure about changing this?)
I have not yet checked my vehicle for CA emissions standards approval stickers. Will do tomorrow.

CanadaCrossing Border to the U.S. from Vancouver, BC

So, we are planning a short trip to the U.S. in the near future.

I personally really do not like going through U.S. Immigration & Customs. I am a Canadian citizen with nothing to hide and still, they kind of scare me even though I have never had any problems going in and out (from other places on the east coast for many years, like Toronto to Buffalo - had a friend there so I went there several times). I find the interrogation-like way that they ask questions intimating and just uncomfortable.

So, I would like to ask the wise folks here - There are four border crossing points from Vancouver to the U.S. by land.
- 99 & I-5, which is the busiest and most major one.
- Truck Route which allows normal non commercial traffic as well
- Aldergrove, which is smaller than the other two, I think
- Sumas, which is too far from me to be practical

Wait time is not really a big deal as we plan to cross it when the traffic is not heavy.

If you could please share which border crossing out of the ones above, and your personal experience on which one is the most friendly one, I would appreciate it!

BTW, we went to the old Costco location near Burnaby in Vancouver and apparently it has become Walmart for almost two years... No wonder we couldn't find it. @@



I cross at Blaine WA (I-5) and I have NEVER had an issue going through there. They usually ask me about 5 questions tops. I have not entered on my visa yet, so this process may be different. I realize this is an old thread, but just a heads up for anyone who comes across it :)

CanadaWhat is the "Checklist" for Vancouver medical?

I can't believe how stupid I am! You're absolutely right--I may be in Vancouver but I'm considered a Montreal applicant because I will be having my interview in Montreal. I just figured this out five minutes ago and came online to let everyone know my mistake. Thanks, Hugglebuggles, for responding.


I believe the checklist is the one in packet 3?? The one you return to the consulate... for Van anyway. Montreal may or may not work similarly. They require that you have a case number from the consulate in order to process you for the medical at woking medical clinic. At most consulates, your packet 3 would be mailed to you (with the checklist). At Van, it is downloadable. You can find this checklist on the Vancouver consulate page on VJ. This might explain more. Make sure you bring your letter with your name and case number on it to the medical or they will NOT process you. If you searching 'Woking'on VJ you will get information regarding the medical. Also be aware that the vaccines required can change at anytime, so keep checking back to ensure you have everything needed. (I noticed a change from a couple of weeks ago even...).

Correct on the Cali thing... you need to retake everything and validation is as long as GC. Not sure how it works for a conditional 2 yr GC...

To even apply in California you need your SSN according to the CA DMV site. I have heard this varies from location to location, but this is the standard anyway. Anyone know how long it takes before being able to get a California license after POE and Adjust of Status? Trying to figure out how long I will be traveling by foot..

Does anyone have experience registering their vehicle in Cali from Canada? I have the letter of compliance and everything is on par with Cali regulations (aside from odometer being in KM). Speedometer has both miles and KM thankfully. I would love to hear experiences with this if anyone has any. Import should be a piece of cake (my vehicle is a 2007 Toyota Yaris) but it is registration I am wondering about. I assume I have to do a smog test, etc. ?? Any other documentation needed?

Aah, that is pretty terrible of the DoS then. I thought they were more reliable for information and accuracy?

What are the negative consequences of sending the Packet 3 forms/checklist without having been issued one from the consulate? Like, if I send one this weekend when really, the consulate hasn't issued Packet 3 yet, is it just going to get tossed when it gets there? The last thing I want to hear is, "we're waiting for YOU!" because I am ready to go!!



You can't sent the packet 3 back as the consulate hasn't given you a case number yet. This case number differs from the one given on your NOA2. You will just have to wait it out. You can, however, prepare for the gigantic burden that is filling out the forms... it took me 3 hours. They ask for employment history for the last 10 yrs and any residence you have lived at for over 6 months since you were 16. You can also go through the checklist and make sure you have everything. You will need to and from dates for both of these, and there is additional info on there that you might not expect, so do a rough copy and have it ready for when the real request comes for packet 3. If your consulate does a downloadable packet 3, which Vancouver does, you can fill it out and leave everything but the case number blank. Then fill that it when packet 3 (in my case, a very short letter telling me to download packet 3 from their website and send it back) arrives.

CanadaPreparing Proof of Relationship and Interview docs

Hi hithalynn,
What you have seems plenty to me. I had all my documents organized in an accordeon folder thingy. Make sure you make copies of everything. They might ask for documents, give them the copy and if they want to see the originals, you'll have them with you (especially with the tax stuff). You seem to have plenty of evidence as well, as a matter of fact, when I had my interview they didn't ask to see any of it! Make sure you have the print-out of the P3 that you send back to the consulate, I know in Montreal I had to give them the confirmation page. It might not hurt to have copies of the USC's ID, such as the bio info page of his passport, his driver's license and birth certificate. I don't remember if I was asked for them, but I know some people have (again, in Montreal).
Hope your interview goes well, you'll see you'll wonder why you stressed so much about it when it's done!

Do you know anything about the I-129f packet? I have been told to bring a copy of it to the interview, but I am not sure if this is necessary. It is like 50 pages worth of proof, etc. so I would rather not if at all possible. Any suggestions on this welcome.

Note: We do not have a ring, and we have not made concrete wedding plans as of yet. Planning to marry at courthouse upon arrival and plan a committment ceremony when the immigration stuff dies down... suggestions regarding this welcome as well :)

Medical is booked as well for the same day, so that will also be included.

CanadaTemporary health insurance

Thanks guys, that's very helpful. Golden - you said you bought travel insurance as opposed to temporary health insurance...didn't think travel insurance would apply to us as you noted we're not really travelling, but you had no problems with it?



I know this is an old thread, but for people reading it, travel insurance does NOT apply in most cases to a move to the USA. Travel insurance is only valid with a return date with most companies. Temporary non-us citizen insurance is your best bet. Or being placed on your spouses plan. You do not need a SSN to obtain health care in the USA, so if a company will take you before residing in the US for a certain amount of time, that will work too.

Canadian health care will cover you for one month but the coverage is equal to what they charge in Canada. A doctors visit in Canada technically costs $30. In the USA it is a minimum charge of 100, just for regular physicians, so if something bigger happens, such as a hospital visit, you are screwed. Plan ahead. Nobody expects accidents to happen. That is why they are called accidents.

CanadaVehicle Import - Duties on CDN Market Vehicle?
I have a Toyota Yaris which has a VIN starting with the letter J, which supposedly means my vehicle was made in Japan for the Canadian auto market. My vehicle was purchased used, but is originally from Toyota Canada, purchased in BC in 2007. When I entered at the POE I did not expect to be charged duties on my vehicle ($250!) as it is a Canadian market vehicle. I am curious if anyone has experience with this, as I want to get my money back if at all possible. If it was an import class vehicle, it would make sense, but stating that the vehicle is Japanese, not Canadian seems crazy to me. The car has only ever been registered in BC and was purchased there. Any advice welcome.

When you go to book your appt you can pick an exact date. you book it directly online and pay in advance.



Not sure if the process has changed, but I had to book via packet 3, by selecting dates that I could request (no guarantees as they only process 2-4 K-1's per day). I also paid with US cash (exact change) in person and was told this was the only method. You can email Vancouver and they are quite good with responding in time. My interview date was 4 weeks from packet 3 I believe and this was the soonest they could offer based on my chosen dates.

I did a ginourmous review of the process at the Vancouver Consulate in March, so if anyone has questions about the process once you arrive, take a look :) I believe my experience was fairly typical.

CanadaCanadian Tax Question
I moved to California on May 1, 2011 and got married immediately upon arrival. I was a full-time student in 2011, in addition to having tuition credits still on my file from previous years due to how little I made during University. I am now getting ready to file my Canadian tax return using my tuition credits from last year. I did not gain residency until late 2011 in California so I am filing as a married person here, but unsure about what to do in Canada.

Basically, I am curious about general info for filing your first tax return abroad, as well as wondering what happens to those existing tax credits if I stop filing after the 2011 return. Is there anything specific I need to notate on this tax return due to my leaving Canada to live in the USA? Should/Can I still file in 2012 due to the existing tax credits and the fact that I maintain my Canadian passport, travel to and from as well as a Canadian credit card and bank account with high interest savings?

Any information is appreciated. I am clueless as to what needs to be done right now. Eeek.

CanadaSeparation and Taxation (US and Canada)

My husband and I separated on February 3, 2013. I was living in California and worked for 3 weeks before moving back to Canada. We have not yet divorced but plan to file for that shortly. 

 

I got a call from him today in California and he is doing his taxes and wants to include me on his taxes in California. I worked a lot in Canada in 2013 and paid a lot of taxes in Canada. I am listed as separated for taxation purposes, however he never changed his status in California. After filing as married by separated, and not claiming me as a dependent, he is noticing he owes money on taxes rather than getting a refund. He is frustrated and called me saying he may have to include me on his taxes for 2013 as a result. 

 

My issues are as follows: 

- I am not claiming him on my Canadian taxes as I am listed as separated.

- I am not filing US taxes as I know there is a tax treaty and was simply going to include out of country income on my Canadian return.

- I am fearing he will file for both of us in California and have it mess up my taxes and return here in Canada. He insists on "asking someone to see" even though I told him to absolutely NOT file for me there. 

 

Could someone shed light on what will happen in either situation and what my best option is with this? I thought you could only file in one country due to the tax treaty but I want to provide him with this information so he leaves me out of it all. I don't want his slacking off on changing his status and wanting to pay his taxes owed to affect my taxes in Canada and cause headaches for me. Please help :S

CanadaTaxes - Canadian Citizen/Resident Separated from Non-Res American Spouse

I am a Canadian citizen and I was married to an American citizen until Feb 4, 2013 when we separated. I worked in the US for a month then returned to Canada. I have been working in Canada since Feb 2013 and he has been working in the USA. He has never lived in Canada. 

 

He filed our US taxes jointly for my income for Jan 2013 only, and I am now filing my taxes in Canada, however I am confused with how to file given our situation, I am unsure whether I need to file as married, separated or single on my taxes, as he has already claimed our US income on his taxes and it shouldn't be doubly taxed through CRA. I also don't want his yearly income affecting my return as we are no longer together and were not for most of last year. When I file separated or married, it asks for his Net Income and his date of birth. 

 

I am also unsure whether I need to include my US income as it has already been taxed in the US and accounted for on the US forms when he filed jointly. Just VERY confused. I contacted CRA and HR Block in Canada but nobody has a clear answer on this. Please help!!!

CanadaMoving back to Canada - Border Questions

I moved back to Canada to work in February of 2013. My husband and I did long distance for a while and decided to separate after many issues in December. He had planned to come to Canada, so our shared belongings and some of my personal items remain in the USA. I am flying to California in May 2014 to retrieve these and driving back with a uhaul through Washington/BC. We will process our divorce while I am there.

 

I drove back last year with just a car load. We had anticipated moving together at a later date. I did not provide an inventory and simply changed my status with CRA and the government after arriving. I did not do an import of any kind at the border. Basically I drove to the border and came across on my passport.They asked why I was coming back, I said to work, no more questions asked. I have flown back a few times bringing a few things with me each time. I then forfeited my green card in November of 2013 once I had gotten established and decided I was staying in Canada after gaining employment and accommodations securely.  I filled out my Green Card Termination paperwork at the airport in Edmonton upon re-entering the USA in November as it had expired. I had visited a few times in 2013 so I have returned regularly to handle my affairs there. This will be the final time I go and bring items back. I will enter on a new passport with no green card this time around. 

 

I lived in the USA from May 2011-Feb 2013

 

I have returned numerous times. Initially with my green card, then as a visitor last time after forfeit. 

 

No items worth 10,000+. No money totally 10,000.

 

 

 

I assume I will have to inventory all of my items upon return. They also may ask for the green card to forfeit, but I will have paperwork for this on hand. Just curious what else to expect. I will also peruse the website provided. Thanks so much!

When you got back to Canada last year did you provide CBSA (Canadian CBP) with a list of all your belongings that you were bringing back at the time of entry that were in your possession and the ones you were bringing back later with the moving truck?

have you returned to the US since you moved last year?

 

Do you have any single items that are worth more than $10,000 (jewelry or anything)?, i'm pretty sure you don't with your description but please answer anyway

CanadaMoving back to Canada - Border Questions

My husband and I are divorcing (I have since moved back to Canada as of February 3, 2013. I am going to California on May 9 to move my things back to Canada and crossing through the Huntingdon border crossing in Washington/BC. I am no longer a resident of the USA and I am simply moving my belongings home. I need advice as to what to expect when coming back into my home country with these items. I have established residency in Alberta as of February of last year, and I am not importing a vehicle or anything. Just taking a uhaul and driving it home. 

 

I don't have expensive belongings, mostly books, furniture, etc. Any warnings or any idea of what to expect time wise for paperwork, any duties etc? Help!

Has anyone dealt with Toyota Canada about the letter of compliance? I have a 2007 Toyota Yaris and I emailed them about it about a month ago. I got an immediate response from someone stating that I needed to include a ton of info about my vehicle, copies of my registration, photocopies of my license and the co-owners license, VIN number, etc. I was prompt in my response, and they have not even wrote back to confirm receipt of this. I am wondering if I should call them (and if anyone knows where to call for this?)

Also... I am co-owner of my vehicle with my ex bf (still..). When leaving Canada, my ex will be taking his name off the vehicle and it will be in my name fully. He drives it more than me right now, so the insurance is in his name. I am curious if anyone knows whether they will include his name on the letter of compliance because of this, and if this will be an issue when importing or registering in California when I immigrate? We plan to transfer it all over on May 1 when I finish college and will need full use of the vehicle. Will be immigrating after this point (whenever K-1 is approved).

Any help is appreciated.

At the risk of sounding rude (not my intention at all), I think anyone filing through VSC should count their blessings. I filed 2 months to the day after you, and my estimate right now is February! So is the case for many people. The process isn't done by machines, and cases are handled by a variety of different people, who all work at different rates. Everyone's petition looks a little different as well, so the process is highly subjective. As a result, estimates in time frame are just that, loose estimates. VJ'ers represent a miniscule portion of people who file, so we can't take the estimates on here as gospel. If you want to keep your sanity through the process, you MUST relax so early in the game. I stressed for the first month and realized quickly that this process does not need to have power over my life. Be grateful we all have love in our lives and be patient. Good things come to those who wait. (us CSC filers are really hoping this is true!)

Basically, select portals at the top, then look at VJ Timelines on the left, click on your type of Visa.
Then you can filter by your own service centre, and include just your country's results, or all countries. Same deal as these in forum things without the work :) It updates when you update your timeline on your profile page.

If you are in fact going through the California Service Center, one month is a pipe dream. Just a heads up so you don't get discouraged or think something is wrong. CSC is still processing May and June filers, and very few have been approved this month, so the wait is looking closer to 5 months from your NOA1.

For all you VSC filers, patience is a virtue ;) Us CSC filers are in total agony over here with 5+ months waiting times. If your wait is anywhere from 1-5 months, consider yourselves blessed! :)

US Citizenship General Discussiondual citizenship confusion!

So, we call the U.S. Embassy in Calgary (in which we must PAY to make this phone call), and the consular officer there told us that under no circumstances does the U.S. allow dual citizenship, that when we get our son's Record of Birth Abroad he MUST renounce his Canadian citizenship and that the consulate office WILL make sure they let the Canadian government know that he has renounced his Canadian citizenship if we get his ROBA!!!!

Renouncing Canadian citizenship is more than a phone call from the US Embassy to the Canadian Embassy saying these parents are making their child a US citizen. A formal application has to be made and I really really doubt that the Canadian embassy would even accept it for a child by the parents.

But like zyggy said when you have "dual" citizenship you are recognized as a US citizen not Canadian or "dual" and vice versa for Canada. So when entering into the US you say you are a US citizen and when entering into Canada you say you are a Canadian citizen. Just ensure that you have proof of both when crossing back and forth between the US and Canada, ie, passport and birth certificate, etc



I agee that it is bullshit. I would love to get proof of both for my son, but I've come across this snag. And I can't get him a passport without his ROBA :( The only thing I can think of doing is getting permission from a friend to use their credit card again (since we don't have one of our own and you cannot call the consulate without paying for the call and you cannot do that without a credit card), call again, and hope we get a different person with more accurate information.

And to clarify: the officer stated that after we file for our son's ROBA in person, the consulate sends a form off to the Canadian government stating that our son has renounced his Canadian citizenship. So, according to her, the renouncing process does not happen with a phone call, but she made it sound like a simple, standard part of the process to get our son's ROBA.

US Citizenship General Discussiondual citizenship confusion!
Hi :)

I'm an American living in Canada, married to a Canadian. We have an infant son, born in Canada.

We're planning on taking a trip to the States the summer for our son to see my parents. I want to get his Record of Birth Abroad first.

So, we call the U.S. Embassy in Calgary (in which we must PAY to make this phone call), and the consular officer there told us that under no circumstances does the U.S. allow dual citizenship, that when we get our son's Record of Birth Abroad he MUST renounce his Canadian citizenship and that the consulate office WILL make sure they let the Canadian government know that he has renounced his Canadian citizenship if we get his ROBA!!!!

I'm in tears, saddened, and so greatly confused right now. The AMCITS site on dual citizenship says differently, so I don't know who is right, or what to do to get official, correct information. What should I do? I always thought my son could enjoy the best of both countries without border issues, but now it seems that he can't!

Any help would be appreciated, and thanks in advance...
