My fiance live in Houston and he sent the I-129F application directly to VSC and we receive our NOA1 after 7 days! You don't need to send your application to texas!

This information is incorrect. See the link below from USCIS for the correct information.

K-1 Fiance(e) Visa Process & ProceduresRFE Question

Thank you for the response! I am still worried though whether they will require the birth certificatee as a proof of citizenship, because my fiance's birth certificate is local, so that's not going to prove anything. :(

My fiance has his local certificate I believe. I suppose we should have sent it with the package.

I'm a naturalized USC. I also do not have my Naturalization Certificate available. I visited the local USCIS office on an InfoPass and requested the information to request a new Naturalization Certificate. After they verified that I was who I said that I was, they gave me the form to apply for a new Certificate and gave me the Certificate number. I used the certificate number and submitted a copy of all pages of my passport with the I-129f petition.

If you don't have your Naturalization Certificate available and had at one time applied for a passport, it's a good idea to always make sure that your passport does not expire.

I have question - how did they stop her BEFORE she boarded the plane? I've flown internationally many times, and I've never had a customs agent go through my bags before I boarded a plane. I'm just curious how they found these documents....

Flying from Canada is very different from flying from Tokyo or Paris. When you fly from Canada, you go through Immigration and Customs before you board the plane. This way when the plane lands, it would be the same procedure on arrival as if it were a domestic flight.

K-1 Fiance(e) Visa Process & ProceduresCan't find certificate of citizenship

i'll trust pushbrk's word and apply with just the US passport (crossing fingers). Perhaps I should do what Rober de Bonda did and retrieve my old A# and certificate # or is it futile?

As Pushbrk said, it's not necessary. My fear has always been trying to replace a lost passport without a Naturalization Certificate. It's pretty hard to do. Hard but not impossible. But who needs to do things the hard way. I have the forms to replace my Naturalization Certificate and will do so after I complete the visa journey.

K-1 Fiance(e) Visa Process & ProceduresCan't find certificate of citizenship
I submitted my petition in July. Like you, I have no idea where my Naturalization Certificate is. I submitted copies of all pages of my unexpired passport as instructed and we were approved in November.

One thing that I did, though, was to make an InfoPass appointment and ask for the information to request a replacement certificate. They gave me the Certificate Number as well as my old A#. I submitted both with my petition. It's probably overkill, but them having the information I believe enabled them to put my existing file with the new petition and they only needed to update it as opposed to doing whatever it is that they do for background check from scratch.

K-1 Fiance(e) Visa Process & ProceduresComplicated Love Story - Help!

So just to follow up....we realized that back in April, my fiance had popped his arm out of its socket (I know, ick), and I had to take him to the emergency room in the city where I was living. I had filled out the paperwork for the address, etc. He is in France right now again for a week, and said he would go to the hospital next week and see if he can get a copy of the records.

Would this be sufficient?

This puts him in the same place as you within 2 years of submitting the I-129F Petition. Even better if your name appears on the documents that you filled out for the hospital.

Go for it!!!!

K-1 Fiance(e) Visa Process & ProceduresComplicated Love Story - Help!
I would recommend that you mention all trips that you have taken and met him whether in France, Italy or whereever. If the letter from your friend in Paris was in the nature of an affidavit, I would think that that would more likely to be primary evidence. The fact that you were briefly in Italy is more importnant than you think. You have the stamps, he has his papers, there are photos and thi trip itself goes towrds establishing the ongoing nature of your relationship.

As others have said above, the fact that he hasn't worked in 3 years is not a determinant. If that were the case, many of us here on VJ would never get to be with our loved ones.

Good luck!

The instructions for I-134 will tell you exactly what you need from the bank. Check the regional forum (Asia: South) for answers that are specific to your consulate.

In general, they are not looking for proof of engagement but for proof of an existing and ongoing relationship. As jkelly07 said above, those items will help to establish the bona fides of your relationship.

K-1 Fiance(e) Visa Process & ProceduresK-1 Denied

When I met my now husband 8 years ago, it didn't occur to me to think "oh gosh, I need to start gathering evidence of a bonified relationship!!!" It wasn't until 7 years later when we decided to get married that we looked into what it took to get a Green Card. Luckly, we had plenty of evidence because I am sentimental and I keep things like cute emails and plane tickets. I don't think it's fair to expect people to collect these things throughout the course of dating just because one day, they may get married and want to apply for a Green Card.
However, normal things like phone records and credit card statements, and photos which show an ongoing relationship are easy to get in today's digital age, so it's not too hard to retrace your steps once you decide to file.

I agree wholeheartedly. It wasn't until 2 1/2 years into our relationship that we considered the possibility of her moving to the US. Luckily, I'm a packrat and had most of the evidences somewhere around. I glad that I didn't one day wake up and start changing my packrat ways. I have phone bills from when we were merely talking on the phone. Receipts for little birthday gifts that I sent and don't even start talking about fotos.

I think that once the OP puts his mind to it, he'll find many of the things that he needs. He might even be able to get them from others who were at family gatherings and took fotos etc.

K-1 Fiance(e) Visa Process & Procedurescertificate of citizenship number

i'm a naturalized citizen. Do I put my old A# or unknown? This is confusing.

I'm a naturalized citizen and I put the A# in the section provided. But I also did an InfoPass appointment to get the number from my Certificate of Naturalization. I believe that a Certificate of Citizenship is a document for individuals born outside of the United States to US Citizen parents and is different from a Certificate of Naturalization. If you have your Certificate of Naturalization that is the number that you should use. If not, you should be able to get the number from USCIS through an InfoPass appointment.

Definitely call and talk to someone higher than the phone answerers. If I were in your position and couldn't get through to anyone higher, I would send the package that you have, certified mail or overnight mail with a copy of the NOA1 on top to them. On the envelope remember to describe what is inside the envelope using the receipt number. I don't know if it would help you or not, but that is what I would do.

Also only send copies and make sure you still have a package that you can copy again if needed.

K-1 Fiance(e) Visa Process & ProceduresInterview Scheduling Question........

Hi everyone :)

The embassy finally has our case/documents and we are ready to proceed with packet 3. I want to go to Colombia and be with my fiance for the interview and hopefully we can return together. My question is: after filing the forms for packet 3 how is the interview scheduled? Do they pretty much give you a date and that's it, or do we have a choice from availabale dates? My teaching contract doesn't end until mid March and I'm thinking if we file packet 3 now we might be given a interview date before my contract expires. I am specifically talking about the Colombian embassy as I'm not sure if the scheduling process is the same with all embassies.

Thanks for you time!!

If you haven't already filed Packet 3, they will not schedule an appointment. When tryting to get an interview scheduled, it is usually said that if packet 3 gets in before the 15th to the 20th of the month, they will schedule you for the following month; in this case March. So if you want a date after March, it would probably be good to send in packet 3 as close to the end of February as possible.

Alternatively, they do take phone calls on Wednesday afternoons. You could call and ask them.

K-1 Fiance(e) Visa Process & ProceduresI129F ? (Approved petition sent directly to Embassy/Consulate?) [edited title]

Thanks as I also thought that it would go through the NVC first but for what ever reason no one knows where the petition is at this point the USCIS cant tell me if it was sent and the NVC cant tell me if it was received there

Try calling the Department of State (NVC is a part of the Department) at 202 663-1225. Do not use the automated system as it will not have information on K-1 visas. When you speak to a human, ask the visa specialist for the case number and the date that it was received at NVC as well as the date the at it left NVC. If still feeling courageous, ask them whether it has been received at the embassy and then if the package has been sent to the beneficiary yet.

K-1 Fiance(e) Visa Process & ProceduresDo we have to wait for Packet 4??

After the embassy recieves your DS-2100 & DS-230, you can schedule the lab appointment and the medical appointment by giving them your BGT-XXXXXXXX number. They might ask when your appointment is so you should look that up in the list of scheduled appointments posted on the embassy website.

My fiancee, now my wife, never received her Packet 4 letter. I can only imagine the problems that we would have had, had we waited for it.

Good luck!!!

If your fiancee does not live in Bogota, you should try to have the lab and the medical done on the same day two business days before your scheduled interview. If she lives in Bogota, she should be able to do them at any time convenient to her: but the lab has to be done first.

K-1 Fiance(e) Visa Process & ProceduresDo we have to wait for Packet 4??

I was checking out the embassy information for Bogota and it said that once you know the embassy has your case, immediately send them via email or fax forms DS-2100 and DS-230 before we even recieve packet 3 in the mail (since you can just download it anyway).

After that, can we immediately start working on the medical exam stuff by just downloading and printing packet 4?? Or is there a specific paper called "the appointment letter" that we have to wait for to proceed? I'm just a little confused on that. It would be great to be able to go ahead and get all of that done if we can.

Thanks for the info! Any tips would be great! :star:

K-1 Fiance(e) Visa Process & ProceduresInterview At embassy
The process that your are describing below is the process for IR-1/CR-1. It is very different from the K-1 visa process.

To the OP. In ur process, we knew in November that our interview would be in January. It had a lot to do with Christmas holidays; but we had a lot of time to plan ahead. I don't know if things have changed much since then but I would refer you to a thread in the US Embassy and Consulate Discussion called Club Colombia Part III. Click on the link below. My experience has been that they are always helpful and will oftentimes research a topic if there are no answers forthcoming.

http://www.visajourn...30#entry4756479

Good Luck on your journey.

Colombia is strange on that area
for K1 Interviews the embassy schedule the interview

USCIS then NVC usually 2 weeks case # your case is BGT , PAy , It will go to embassy .

As soon as you pay all fees you may take a month for actuall interview . The shedulling can take a litter as 2 weeks after you finish payment and all document are done

Good Luck

K-1 Fiance(e) Visa Process & ProceduresQuestion about K1
I'm reposting this because I was moved to introduction because of title.

Hello all,

I've been reading some of the discussions and thought I'd join in. I wish I knew about this website earlier....I think it's great to be able to communicate with people with similar situations. We just started the fiancée process (K1). My fiancé put the application in the mail yesterday.

He is the American citizen, I'm a Canadian citizen. We have 2 daughters together who were born in Montreal, where I live. My fiancé will do dual citizenship (born abroad) for both of them, so they are not included in this process (although we did write their names of course).

About 15 years ago, my mother got us SSN that are not valid for employment. My mother is also canadian and never lived in the States, but she bought a house in FL and was able to apply for it somehow....I don't know the details and she doesn't remember. My fiancé and his mother seem to think that the fact that I've had a SSN for roughly 15years will help. Is that true? Anyone knows?

Also any inside info that anyone has on K1 and Montreal processing will be greatly appreciated!!

Hopefully as I go through this process, I will be able to help others.

Thanks

This may be a silly question, but here goes....

Whilst completing the section regarding my employment history, the 'From' and 'To' boxes aren't big enough to contain the spelling of certain months. For example, 'September' becomes 'Septem+' with the plus being an indicator on the Pdf form that there is additional information to be seen. This also happened with my full address so I edited it down a touch to sit nicely in the box. However, in terms of the dates, will it make a difference that the full spelling of the month is not seen? The last thing I want is to get an RFE!!

Also, I have a US social security number from when I studied in the United States although I have since forgotten it and can't seem to find it anywhere amongst my records. Is there anyway I can find out what it is?

Thanks in advance!

Hi,
regarding the form, I don't think it would be a problem since they make the forms available online, they must know that stuff like that happens. Besides, there's enough letter to figure out that it's September! Good luck!

The I-129F has a multiple filing restriction, but you dont fall into that restriction because the resturction has to do with 10 years 1993 is well outside the restriction.

Hello VJ,

Here's the situation: In 1993, my guy (US citizen) filed for his ex-wife (divorce final in 2007, had been seperated since 2000). I was wondering how and if this could affect our K1 application? Could USCIS think that he's just making people come to the US? What should we get ready for?

Anyone in this situation? Did it get complicated? I would love to ear from you!

Hello VJ,

I was just wondering if some of you "aliens" (hate that term with a passion!! LOL) have children with your US citizen partner AND applying for K1?

This is our situation: we have 2 daughters that are in Canada with me. Just wondering how it went? How many of you had to go through DNA testing?

Also, I was under the impression that my fiancé could apply for them before we move to the States, but according to the USCIS website, they have to enter the States as immigrants 1st...If this is so...that means that I would enter the US as K1 and our daughters as K2s; then they could get their citizenship certificate while I apply for AOS....Man I hope that the citizenship thing is free! LOL rofl.gif

Any thoughs? Or care to share experiences?

Your daughters are already citizens. He can report birth abroad

Really? so they don't have to reside in the US? That's not how I understood the info on the website, but that's great news!

Here's what I read:
Frequently Asked Questions

1. Does my child qualify for automatic citizenship under the CCA?
Under the CCA, your child will automatically acquire U.S. citizenship on the date that all of the following requirements are satisfied:

At least one parent is a U.S. citizen,
The child is under 18 years of age, and
The child is admitted to the United States as an immigrant.

If things progress, would filing a k-1 visa be the best way to go. Also, do they include SSI money when adding the income requirements? Thanks.

Hi and welcome to VJ...I'm also fairly new but it's a great place to be!

To know which is best for you, you could go to the "Guides" section. It helps to make that decision.

I'm just curious to know when's the 1st time that we are asked to provide a copy of our passport? My passport expires in Sept. 2009, and I was wondering if I should renew it before the end of the year of if I can wait till further in the process? Because of the new law between Canada and the US, it takes longer to get a passport so I wouldn't want that to slow us down.

Thanks for your inputs
