So, my fear was a little justified, as the officer saw I was returning on a visa waiver for the second time after only being out of the country for two weeks. I was sent to secondary inspection (a horrible place, I felt like a criminal almost) and they just ran a check on me and then said it was ok and I could travel on (phew). However, they told me to stay out of the country for as long as I had been in it, before returning on a waiver.

I left the USA on July 12th 2008, so more than 7 months ago. I would like to go back over there early April for a week or two, to have a look at wedding venues, apartments, etc., and of course to see my guy, who I miss terribly. I've never overstayed any visa or anything like that, but somehow (after my last experience) I'm a little worried about going back while the K1 is pending. What do you say when they ask you what you're doing there? Do they see you have a visa pending? I've read stories about people being refused if they say they're visiting their boyfriend/fiance.

Is a return ticket enough proof that you're not there to stay (yet)? I also have a job I need to be back for, maybe that helps?

Yes it is possible to travel, but can be a big challenge. You absolutely have to have ties to your country with you when traveling during the process of your K1 They might not ask (which I doubt), but at least you'll have it if they ask. So I would strongly suggest a letter from your employer showing that you are expected back at work, your lease or mortgage if applicable, etc.

I would also expect to be questioned, because of of what you said...but it has been 7months so I wouldn't be worried about it too much, just something I'd keep in mind! Hope it helps...Good luck!

Rich, I agree with posters who say that the child needs a passport to travel. Since you did say that in Russia, children do not get a passport until 14yrs-old, maybe she could be included in her mom's passport? I know that's how they do it in certain countries. Also, if the mother has full custody of her daughter, I don't think she would need a letter from the father but I could be wrong....Good luck!

Hello and welcome to VJ and especially in the October group! Yup you are at the right place. VJ looks at the date on NOA1. I'm not sure what you mean by your 1st question so I can't help you with it. All I know is that sometimes the petition get lost unfortunately....but if you got your NOA1 chances are that you're right on track! Good luck in your journey!

BTW, are you the one from DR? I'm asking because I worked in Cabrera for 3 months...some of the best times of my life!!

Yeah I will continue updating as well for the ones after us!

As for the embassy (well consulate in Montreal), some say it's between 4-6months...way too long!!!! but luckily, most get after 2-3months. You know how they sometimes give a longer waiting time just to cover their butts!

Well that's what everyone would think...everyone BUT immigration....the problem is that a piece of paper doesn't prove the paternity...anyone can sign it...for that reason, it is not enough evidence...but maybe we'll get lucky. But yeah I have everything ready and waiting: passport stamps of our trip to the Bahamas, pictures, e-mails relating to the time we spent together, and I also have a line-up of people (all USCs) willing to write affidavits to testify that they saw us together....We'll see what happens. I'm just mad at the fact that an RFE will slow us down, and unlike you, I'd move there today if I could! I already sold my apartment and moving in 2 weeks (an aquaintance was willing to pay a VERY good price for it so I couldn't wait) and raising 2 babies alone is tough!

I just can't wait for us to live as a family! We're all in the same boat (minus the kids maybe!) so I know I don't have to explain...that's what I love about VJ!

Because I was soooooo stupid and didn't put enough evidence that we met inperson within the last 2 years. All we put was the birth certificates of our daughters. I don't know what I was thinking....I worked in the immigration field up to the birth of my last daughter, so I KNOW what immigration wants to see....I really don't know where my head was at...lol I think it was the lack of sleep...LOL

I'm so glad i can laugh about it now, cause I was soooo pissed off about it....still am sometimes.

Yeah I read in a very old post from someone who actually worked for USCIS. He said that some petitions are used to train people so they are usually approved very quickly since they are being worked on quickly for pupose of training. But I agree, I don't think any "regular" October petition has been approved yet....but it's coming!!!!

The more I read about people who got married in the US THEN filed the paperwork, the more I think that's what we should've done...especially with how slow VSC is moving now! From what I've read from other VJers, it is not fraud if it's an honest and true loving relationship. My finacé kept on telling me that it would be better that way (non-K1 way), but I kept saying "I'm not about to move to the States and become an 'illegal alien'!!!" I can be soooo hard headed!

oh well too late now! Any one else have or had that debate?

But....it's kind of bittersweet for us Oct VSC filers seeing all the Oct CSC filers getting approved too. We'd love nothing more than to be getting our NOA2s as well. It's just disappointing to see people announce in this thread that they were approved, only to find out its not from VSC where we are all focused. Most of us follow both threads - but would also still keep an prefer to keep the progress of each center separated. Otherwise it could be passed for gloating which I am sure was never your intention.

But really, Congrats again!

yes that's all you have to do...wait wait wait! people who applied for I129 and I130 are already married and are applying for the K3 visa. What you have receive is a notice that VSC has received you petition. It is what we refer to as NOA1....now we are all waiting for NOA2 which is the notice that you are approved.

yeah the timelines have changed quite a bit. i don't know if it is still because of that person who wrote 2009 instead of 2008. I'm hoping for an approval in February although my timeline says end of March, beginning of April. Happy Holidays to eveyone! I just made it again to the US. This is my 2nd trip so far since filing K1 and no problems. Maybe the customs people at the Champlain, NY border are extra nice or maybe I'm just very lucky! I guess it is truly possible to travel while awaiting a K1 visa but I also think that it might be dofferent for different countries and/or people!

I'm just happy we made it! It makes the wait eaiser when we are able to see each other. I don't mean to rub it in the face of those of you who are not able to see their SO as often as i do....just wanted to share my happiness with people who understand how hard it is to have a long distance relationship!

Yes we are looking forward to next year as well! New years in Paris sounds soooo romantic! And don't feel that you wanting to spend time just the 2 of you isn't selfish. It's perfectly normal! I'm sure your freinds and family will understand. Once you 2 live together than you'll be able to be all over the place! lol

Dex is driving up on Christmas eve to pick us up and we are driving back to Albany on the 26th. We will celebrate his b-day on the 27th, but it's actually the 31st (ol' year's day as he calls it! lol)aand driving us back on the 28th, then leaves back to Alabny on the 29th ooof! I feel so bad that I don't have a car.....and he barely has days off over the Holidays....

I'm excited about Christmas though cause we decided to start a tradition. Every Christmas Eve from now on, we will wear a new pyjama! That way I think it makes Christmas morning even more special. I only have one for the baby...still need to get 3 more! I can't wait to see how our oldest will react opening the gifts and everything. She'll be 17months...I hope she understands! I'm aslo glad to spend Christmas here in Montreal, since it will be my last for a long while....

I was looking through the medical questionnaire the other day and came to the question 'Have you ever had any mental disorder or depression?'

A couple of years ago I went to the doctors with symptoms of depression so he asked me to complete a questionnaire. After that he told me he thought I had mild depression and referred me to a young persons counsellor for a couple of sessions. Because I wasn't put on medication and not officially diagnosed (I don't think it went on my medical record) should I answer yes to this question?


Yeah I don't think it'd anything to worry about. I went to the doctors too with PTSD after my mum died and he referred me to a counsellor. I had one session and never went back, and I don't think it went on my record. At least I hope not, because the last thing we need is to be accused of lying. tongue.gif


I think I'll check about it when I go and get my vaccination records. If it did go on my record I'll get them to write a letter or something.

Where did you get the info on the medical, I'd like to see it? Also about the shots, anyone know where I could see the list? Another question about the shots, in the province where I live, we have a booklet with all the shots we recceive. Is that enough to show at USCIS medical exam? I takes forever to see a doctor here so I want to start and get ready now.

as for wedding bands we are both very simple people so we will probably both get simple gold bands. Wow, our ceremony is practically tiny then lol. Only about 12 people and some of those will be base personnel as its expected that you invite the base commander. The reception will be bigger though. About 30 lol.

as for wedding bands we are both very simple people so we will probably both get simple gold bands. I'm thinking of having his name engarved in mine with the date and vise versa...is that corny?it seems like a great i dea when i think about it, but now that i wrote it down, it looks a little corny....LOL

we also want something small with close family and friends...i'm hoping for 50-60 people

The sooner the better....my time line is down to mid to end of March....I sure hope it would happen in January. I'm actually expecting to receive a RFE so I think it's gonna take a little longer. sad.gif It would make me happy to see all of you get accepted in January!!

Lucky indeed!!! Although I bet that on some small level, its also frustrating being so close yet having to jump through the immigration hoops as well.

It's a good thing I don't mind flying (used to it as I fly a lot with my job), so a 9.5 hour flight isn't too terrible.

In the end, its all worth whatever we each have to deal with.


I fell really ill on my last flight to the US and spend the whole flight back sleepy as I took calming pills. Now I'm a bit of a nervous flier and am dreading the 9/10 hour flight to Atlanta.

RBAL_TN : you are right I do feel lucky to be close, but it kills us the fact that we are so close yet so far and that we have to go through all the paperwork craziness.....aaargh! sad.gif
