IR-1 / CR-1 Spouse Visa Process & ProceduresPetitioner's migratory Movement Letter.
Dianita, I understand your concern. I have also read of the Consular Officer asking for a Migratory Certificate from the Petitioner. In that case, the K-1 visa was approved but the additional requirement of the Migratory Certificate caused a substantial delay. One very knowledgeable poster here on VJ has said that the instances when this is requested are so few that it doesn't warrant the additional hassle and expense of getting the certificate. I understand and appreciate this viewpoint, but I would prefer to have it and it not being needed than to not have it and it is requested. My interview is on a Wednesday and I plan to be in Bogota to request it the Friday before.

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion !!!!!!!
Come on guys, lighten up! She said that he's been coming a lot; and while some of you are still snickering, I'm sure that she means that he has been visiting her a lot. This I can relate to. I had to account for all of the times that I have visited my fiancee and discovered that in the last 3 years, I have visited her 13 times. If you ask her, she will tell you that I don't come enough. Stop snickering.

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical in Bogota

Hello there!

My husband and I just received news last night that he will be having his interview on Feb. 1 in Bogota. We are starting to make plans for the medical exam. I know that he has to have his blood work and x-rays done before the physical. I was just wondering if he can do them on the same day or if there has to be a day in between the two.

Thanks! Any kind of input would be greatly appreciated!

Heather

Most people have the two appointments on the same day. Keep in mind that you have to select the physician first. The lab only does appoitments at 7:00am and only the visa applicant (beneficiary) is allowed in to the office. You should be able to schedule the physicians appointment for late in the day. This allows the lab to get the information to the physician.

In our case, we have the lab appointment at 7:00am and the physician's appointment at 4:00pm. We still left a day open before the interview for any unforeseen contingencies.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical exam?

I have received the letter sent from NVC indicating that I'll have the interview at Montreal Consulate on 01/27/09.
Is there an medical exam appointment letter expected to be sent? I know the place in Montreal for the exam. But I don't know I should go now or wait for that appointment letter (if it exists)
NVC provide the site www.immigrantvisa.state.gov for instruction. Somehow, I cannot access this page. Thanks

Hey, I'm not there yet in the process and I'm not even doing the same process as you, but I believe you have to book the medical yourself. I called the clinic myself in Montreal just to get info on the fees and delays and stuff. The receptionist was really nice and told me that one should MAKE an appointment a week prior to the interview date (at the latest) to make sure to have the results in hand for the interview. You could call them to make sure.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresQuestion about K1
QUOTE (raymaga @ Oct 15 2008, 12:32 PM) <{POST_SNAPBACK}>
Welcome to VJ!!! Hope you can find some answers to any of your questions and also provide some answers for other who follow you.

In the past, things were a lot different. Around 20 years ago, one of my friend's Mother moved to the U.S. to marry an American, and didn't require any kind of visa to do so. She just simply drove across the border with her fiance and her van loaded with her belongings. It's changed a lot since then (unfortunately for us!!!!).

So, perhaps the rules regarding SSN's were different 15 years ago as well, because I can't understand why your Mother would have been given a SSN just because she owned a home in Florida. My former in-laws owned a home at Mt. Baker (in Washington state) and they certainly were not allowed SSN's. They were always considered Canadians and were only allowed to spend 6 months a year at their home in Washington state.

Good luck for a speedy approval!!!!

Thank you for your reply. I agree...I don't why she was given a SSN. All my mom remembers is that she filled out a form and got the cards, one for her, one for me. I wrote it on the forms because I didn't want to hide anything. I just hope that USCIS doesn't see it as something bad.....

An SSN wil neither help nor hurt... Providing or not providing the required evidence is what will help you or hurt you. Since a SSN is not a required piece of evidence, it never comes into play...

Thanks for your reply. That's what I thought and tried to explain to them.

I have another question for people....I just saw the guide about sending I-129F package. We did not put a cover letter and did not put a lot of evidence that we met personally besides our daughters' birth certificate. We figured it was enough but now I'm afraid we should've put more. Given that we sent everything yesterday, is there a way to send more info? To same address?

Thanks again

My evidence was relatively minimal for meeting in person: dated boarding passes, credit card statement for flight, about 6 dated pictures, and a photocopy of the used visa and entry/exit stamp into the country. It's usually for the final interview at the embassy when people bring a lot of evidence to prove a real and true relationship.

If you only put your daughters' birth certificates, it may or may not be sufficient. Strictly speaking, they have no way of verifying with the birth certificates that your fiance is your daughters' biological father. I guess it depends on the person reviewing the case.

I would not recommend sending information on its own. There's a very good chance that it'll never get "united" with your I-129F filing. If they require more evidence, they will send you a Request for Evidence (RFE).

Point well taken...I guess we'll have to wait and see....we were so stupid not to send more....we see each other about twice a month so we have PLENTY of evidence!!!

Oh well...you live and learn!!

FYI: I (we) spent a lot of time on the proof of relationship documents, I'd say around 150 pages worth and at the interview - they did not ask to see any of it!! Not sure that is normal in Juarez?? Frustrating after spending so many hours on it but.......it really doesn't matter being we pick up her visa in a hour!!!

My fiancee moved inbetween when I submitted the I129F and rx'ing the NOA2, so I called NVC yesterday to see about updating her address:

"We process these pretty quick, yours was sent to Juraez consulate yesterday but I can update her address here and then you can contact them"

So it only took NVC 3 days!

one question, I thought it went to the NVC 1st, but this says has been forwarded to the listed consulate

note: Important to me being my fiancee moved and there is a consulate right in her new city, but we picked a different consulate thats hundreds of miles away. Hmm, looks like we need to do an I824. Not sure if I still need to contact NVC about her new address?

I was on a "skype date" with my fiancee Friday night and I told her I bet that on Tuesday, supervisor Sam noticed Frank the forgetful USCIS worker hadn't approved any K1's lately so he went over to his cubicle to chat:

Sam: "Hey Frank when is the last time you hit submit on all of those November K1's you were assigned?"
Frank: "Oh #######, I knew I was forgetting something!! Sorry, it's been since before I came back from XMAS but I'll do it now - I hope no one noticed the long wait"

K-1 Fiance(e) Visa Process & ProceduresNewbie with some questions
Hello all!

I've read and read and read and read, and I still have some questions, mostly about fees. My apologies if I should've been able to find the info elsewhere, this is all SO overwhelming!

We just got our packet from NVC. (yay!!) The DS-230, is there a fee involved? The DS-156, is there a fee involved? Last thing I want is to send the packet w/out the fees, god knows the Montreal wait time is long enough as is. I know fees increase in July, I'm just not clear on which fees go in now. And, I think I'm right on this.......both the D230 part 1 and DS-156 and the checklist get sent in?

The doctor's office says they need "the letter" when he gets there for the medical. I'm gathering that's the front page of the packet where the case ID is listed? Should he also take the NOA2?

The DS-156K goes with him to the consulate, correct?

There are probably a few more that are escaping me at present, so I'll add them as I can recall them. I appreciate all your guidance!

Thanks very much!!

The consulate should contact you directly. In my case they sent me a letter and my wife was sent a letter by the consulate as well. I lived stateside while my wife lived in her country. The best thing to do is just wait. That's something I learned during the whole process. It took me 10months from beginning to the interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130/1-129F HELP!!!

The whole K3 visa is useless honestly. Before you would file the I-130 and submit documentation once you have the receipt notice then you would simply file the K3 information with a copy of the I-130 receipt notice and there would be no fee. However my I-130 was approved and my K3 was canceled, even though I filed the K3 as soon as I got the I-130 receipt notice. The only bad part is the K3 visa is not a green card, it is a non immigrant visa which means you will need to pay a lot more money for the adjustment of status once the I-130 is approved and its a lot more bull to go through. Just be patient it took me 10 months before my interview.

Your best option would to ask your family members or a very close friend that has the required income level as per the I-864P.

The I-864 is a big deal that means who ever signs that is financially responsible for your spouse.

You can travel by Boat using the VWP if they are an approved carrier.

http://travel.state....er-program.html

If you try to get a tourist visa they ask if you have a pending I-130 or other file you must be honest. Ultimately its up to the consulate officer if you can show to him you intend to return then who knows...

That's right! Upon endorsement the visa stamp in your passport serves as temporary evidence of permanent resident status for 1 year. Once he gets his passport back from the consulate and he gets it stamped by the POE then he is all good to go!

IR-1 / CR-1 Spouse Visa Process & ProceduresWELLCOME LETTER.
I was shocked at first, over 2 weeks after my wife got in the USA, INS had no reccord of her getting in the country. But I guess what happens is when you arrive at your POE and after you put ur finger print on that sheet and sign it, all that paper work gets sent back to the Service Center who processed your case. In my case we arrived in NY and my stuff had to get sent to Cali. So a few days ago I called, and magic they had her information and gave me the reciept number for her : OS155A IMMIGRANT VISA AND ALIEN REGISTRATION: which is the ordering of her green card. I havent gotten the welcome letter yet, and I called up the SSA and they said if my wife checked that they wanted USCIS to order her SSN it would be an automatic process and we should have the SSN card around the same time as the green card. I have called a few tiems and no number has been issued yet, but they just put the notice for the Green Card on 11/10/2010 so its only been 6 days. I will check back next week. Remember @ uscis.gov you can get mobile or email alerts!!!!! This way I dont have to keep checking their website, as soon as it changes my wife will get a text message and I will get an email! Thank god for e alerts :) I will keep yall posted.

IR-1 / CR-1 Spouse Visa Process & ProceduresNEED HELP WE ARE STRESSED!!!!!!!
What you could do, is scan a copy of a new DS230 and mail them also. Be sure to write your case number in the upper right hand. Also a good option would be call the NVC and politely ask them for a Supervisor. They will transfer you to some one, and tell them what is going on. If you sent it in, and you are sure you did then tell them that. They will review your stuff, keep in mind once they get your mail it takes them a while to review it. They get mail by the truckload, not by the individual letter. I had my packet get lost, and it wasnt lost. They recieved it but did not review it, they only logged what came in and told me it took 2 weeks to review once logged in. The NVC is a private company contracted by the DOS to do their work, so you will have a better time dealing with these people then the other gov't agencies. My advise is call the NVC around like 5:00PM EST and ask for Supervisor Sophia, she helped me out with my case, and the next day she called me back and let me know it was all fixed.

You will find, as I have, that it's not such an onerous task. I actually appreciate having had the opportunity to dig through 3 years of our history together. There are so many things that are not remembered on a daily basis and many more that are prompted by looking at something else. I remarked on a different post that if I had kept copies of everything that we did over the past 3 years, a few small forests would have to die to provide the paper to complete this provess. My only regret is that my SO and I did not get a chance to do it together.

Hi, everyone. My name is Alex. I like the idea of having company in the Visa journeying. I am brand new to this forum, but found it during the last several months when Alan and I were discussing how best to be together in the US. He is in the UK. After numerous back-and-forth discussion about what would be best for us, we finally made a decision...the I-129F! Got his bits in the mail yesterday, and was able to mail off our completed I-129F today to Vermont!

Hi Alex, good to have company on this journey. Let's see what happens from here on out.

so happy to hear about all the great news! I have some to share as well....we are out of AP at NVC, and they corrected their error so our file is on its way to Montreal as of Monday!! So now we're looking at an end-of-July/August move, since there's about a 4months delay in Montreal for an interview....
I'm going to Albany this week for about 10days, so we'll start to put everything together. I hope they won't give me too much of a hard time at the border!

To all still waiting, I'm sending positive vibes your way and hope you'll be on your way soon!

It's true not much movement here. That's excatly what's happening to us right now: NO MOVEMENT!! We are still stuck in AP at NVC. Seems like the average delay is 50days, so we still have a long wait if it applies to us. I'm secretly hoping a release this week! smile.gif
