I am VERY worried - My fiancees Mexican Divorce decree states she can not remarry for 1 year, and her divorce only happened on Sept 17, 2009.


Are we out of luck or does this not apply to a wedding in the US?

I went to my local town and city, and they said no to a marriage license. But other people including 2 lawyers said to go ahead and submit the K1.
Also, I bet if I went to a different town/city clerk and didnt point out the "1 year" statement and ask if that would prevent us from getting a marriage license, they wouldn't even notice it and give us one.

Another option would just head out to Vegas to get married - I am sure they wouldn't care about some pain in the #### Mexican law.

So my fiancée was divorced in Mexico, the divorce decree is complete/final but it states she will regain her right to marry after 1 year per our(*Mexican) law system. Some people say that 1 year has no effect on us getting married in the US, but others that say we can't until after that 1 year.
I am going to assume we can not until after the "1 year" (which expires Sept 1, 2010)

I know upon K1 approval she can wait 6 months to enter the US, and then we have 90 additional days to marry. So that adds up to 9 months. Plus the 6-9 months for the K1 to get approved.

Our I129F is ready but I am not sure how long I should wait to send it in, due to the "1 year" issue on her decree. Any suggestions?

Also, would they approve it before that 1 year is up, being after approval we have up to 9 months to get married?

And, how would you word her letter of intent? I don't want her to perjure herself saying it is legal for to marry now (not that I know for certain if it is or isn't).

Your income for 2 people needs to be at least $19,387 USD. which is 125% of the federal poverty guideline at stated in their website.

Now that is for the I-864 the I-134 is not as detailed as the I-864.

 

With the I-134 I would submit a copy of recent tax return, a letter or recent pay stub from employer and then copies of bank accounts for the past few months.

You need anything to prove the relationship! Its best to show up to the interview with a boat load of paperwork then to show up with nothing at all. The more stuff the consulate official can put their hands on the more comfortable they feel granting the visa. These guys need to be able to justify their decision to grant the visa. The more the better!

I wouldn't bother with the K1. I would just get married in brazil and make sure you meet their guidelines to marry. If I understand the rules correctly you cant travel on the K1, its just a 1 time to get you here.

 

Each country has their own regulations on marriage's. Ecuador for example requires you to be in the country for 70ish days ( I don't remember the exact number) and you have to get a single status affidavit from the US consulate. It was a few hoops to jump through but I was able to marry my wife in Ecuador and bring her back to the states in about 10 months. You can check processing times and averages on the USCIS website for your filing center and application. I think you would be best to just get married and file the I-130 for the green card, ooh and its a lot cheaper and less bull to go through. K1 visa is not work permission, you would have to apply for that while your AOS is processing and the AOS is pricy. The green card is much better and you come here get the green card apply for the SSN and your basically all done. After two years you just do the removal of barriers and your spouse gets their 10yr green card instead of the 2 year CR1

Basically while the I-129F is approved there's nothing to withdraw. By you not getting married to him he is not able to file the Adjustment of Status and he must return to his country prior to the 90 days or he will be come an illegal immigrant and face deportation. So just don't get married. Your not on the hook for anything.

All documents must be translated in to English that are submitted to the USCIS. However I wouldn't send copies of emails to USCIS save them for the consulate interview. There's a good chance the consulate employees will speak Spanish. I would send 5 or 10 pictures but put them on 1 picture. I made a 8X10 collage with pictures and sent that way. The other thing would be to bring a lot more evidence to the consulate because USCIS quickly reviews it and runs the background checks but the consulate will do the actual face to face interview and they will review EVERYTHING you send them. Believe me when I tell you that.. The consulate will review every single piece of paper you give them. There's other evidence you could include with your application such as a copy of the receipt for the ring, copies of passport pages showing trips taken together, and well anything else you can think of showing your relationship. I would include some letters of intent to marry and if you have a wedding planned or copy of a upcoming wedding announcement. I have seen people walk in to the consulate with 2 pictures and they were asked by the consulate officer for email and pw for their facebook account and they were granted fiancée visa's. I have seen a guy go to the consulate with no pictures, didn't know where his "fiancée" worked , lived, what she did for a living and didn't even know her birthday and stuff you really should know about your fiancée and they denied him as he walked out of the consulate.

Your friend needs to get a form called a Certificate of Disposition from the court. It indicates the arrest date, charge, outcome of the charge. They may need a copy of the accusatory instrument which is just the formal written charge and you can get that from the court also.

 

Some courts actually charge you for them....

 

Never lie on the form its better to list everything and just be prepared to explain your self.

 

 

It sounds like your friend was given an ACOD, or Adjournment in contemplation of dismissal where he behaves for 6 months or 1 year and providing there's no issues it gets dismissed in any case the certificate of disposition will show Dismissed-ACD or Dismissed it doesn't really matter it shows the case was handled and closed.

They will not look at CD's. Theres too much security for them to put other peoples CDs in to their system.

 

Best to send them hard copies. Theres never too much proof you can send them but make sure you show them a lot of information proving you guys met and did things together.. Copies of boarding passes for joint trips, tickets to movies.. Then the stuff showing your engaged, letters from both of you with intent to marry, all of your proofs showing you guys are legitimately engaged like a copy of the receipt for the ring..

 

Most of the proof will be needed for the consulate. For the Fiancee visa I personally seen a consulate officer ask for the persons login information for facebook 5 minutes later they came back and said all approved go pay DHL and you will get your visa in a week.

Can I travel to the U.S. while my application for an immigrant visa is being processed?

If you intend to take up permanent residence in the United States, you are required to wait until the immigrant or fiancé(e) visa is issued.  You cannot reside in the U.S. on a tourist visa or travel there visa free under the Visa Waiver Program while awaiting the issuance of an immigrant or fiancé(e) visa.  However, if you wish to make a short visit for business or pleasure at the end of which you will return to your permanent residence outside the U.S., you may travel on a tourist (B-2) visa, or visa free under the Visa Waiver Program, if qualified.

If applying for a B-2 visa, you are required to furnish evidence of your residence outside the U.S. to which you intend to return at the end of your temporary stay.  Although a pending immigrant or fiancé(e) visa application is not necessarily conclusive evidence of intent to abandon your overseas residence, it is certainly a factor considered by consular officers reviewing a visa application.  If you are unable to convince the consular officer reviewing the application that you do not intend to abandon your overseas residence, you will not be issued a visa.

When traveling to the U.S. either with a visa or visa free under the Visa Waiver Program, you should be sure to carry with you, for presentation to the U.S. Immigration Offier, evidence of your residence outside the U.S.  If the Immigration Officer is not convinced that you are a bona fide short term visitor for pleasure, you will be denied entry into the United States regardless of whether you hold a tourist visa or not

Sorry I didn't see the post about the dialysis until recently... I don't know too much about dialysis except one of my "older friends" has to do every night. They leave tubes in his stomach and he just "plugs in" every night. He still goes on trips and travels but he can't miss his nightly dialysis or he dies. With that being said a short trip to the Bahamas or some 3rd party country on a cruise would be fine. You would have plugin just bring bleach/water to clean your room. If there's a will there's a way. There is also a battery operated dialysis machine you can bring where ever you go.  People actually bring their dialysis machine with them on flights also. http://www.davita.co...dialysis/s/9046

 

So basically your options are to apply for the waiver and just give them a ton of documentation and prove your case as to why it would be a hardship for you to meet or you fight man.. You fight hard and do what ever it takes to meet your fiancée some where.. You find a way and man up and just do it..

internship thing is over it was last year now i am a graduate. For now we have applied for K1. My fiance lives in Florida and I had an accommodation at his place as were related his dad is my uncle 


 

So your fiancée is also your cousin? And your fiancée is unable to move to visit you.. There has to be another way for you to come to the USA to meet him to satisfy the requirement.  But you have been denied tourist visa's... This is quite the complicated case. If you were able to go to a 3rd party country (Bahamas or something) and your fiancée could take a cruise to the island you could meet then but he's not movable. There's cruises from FL going on basically every day. You too could meet up there.. How long is your fiancée non movable, is this permanent or will he get better?

After dithering around for a couple of weeks, I discovered that my fiancee had sent me everything that was needed from her to file the petition. I scrambled today to pull all of the other documents together. I have been assembling them for almost a month now. It's amazing how much of a trail is left by two persons who share a life for, now almost three years. I enjoyed looking at old fotos and old receipts. The memories alone are sufficient to make this process worthwhile.

In the end, I submitted a package that weighed 1lb 8.4ozs and sent it off to Vermont.

During this process, I was back and forth as to whether, we would be approved or was there a reason that would be found for denying our petition. In the end, after haveing gone through stuff that accidently got left behind over the last three years, I had to think that if we had saved every item that indicated that we ever knew each other or was ever in the same place or shared the same hopes and aspirations for the future, we would have to kill a few small forests just to accomodate the paperwork needed for this process.

Now, like so many others before me, I wait. Either patiently or harriedly; but I wait.

An update to my earlier post here on this topic.

After 15 long weeks of waiting and having no "touches" on our case since April 12th, 2010 we finally received a text and an email today saying that our K-1 Fiancee Visa is APPROVED. The email said the letter was mailed on August 5th, 2010. I hope to have the NOA 2 approval letter in my home mail by next Friday August 13th, 2010. I also logged on to the online case status and checked it. It was "touched" today and changed to Post Decision Activity. We are so happy that this part of the journey is over. We are not done yet and we know we still have time for the other processes to be completed but we are one step closer.

We now have to wait on the actual letter and then the approval and letter from The NVC.

I also want to add that the date of the approval letter being mailed is noted in the email and also in the online status as August 5th. That is the date of my 50th Birthday. I got my birthday wish and it was an awesome birthday gift.

Do not give up. True the wait will drive you nuts and make you thing you were lost in a hole somewhere. When it is your time, it is your time.

Hi Caribbean Lady. Welcome to Visa Journey. I am a naturalized citizen from St. Kitts. Hi neighbor. When I filed my I-129F, I did not use a lawyer. I found lots of information readily available on this site and knew that I could ask a question whenever I needed to and get quick, considerate and logical answers.

As to your question regarding question #18, I submitted a typewritten page. I had recently read of the advantage of front-loading the petition and used the opportunity to talk about the reason for me being where I was when I met her and what we did after that; how many times we have been together since then; vacations that we have taken and people that we have met. In te end I had to delete a lot of what I wrote as I did not want it to exceed 1 page. I believe that my page will give the Consular Officer fodder to ask questions. And any questions asked from these trips etc are well known to both of us. Maybe, just maybe they won't have time to ask trick questions that might be more difficult to answer.

I agree with Thanhphong. I'm from an island close to Dominica and consider myself of the same cultural heritage and I can tell you without a doubt that his behavaior is not what is expected nor tolerated in our islands. Think about your children. If you believe even a tiny bit that they can have a better life in the US, go to the interview. When you get here, try or not as you poease to work things out with their father; but do your utmost to try and ensure that they have the life that they are entitled to.

We just wanted to say "Thank you!" for all the help and advice; we definitely could not have made it this far and are really grateful for all the help and are hoping we will be able to help others in the future. :thumbs: They ended up not checking the I-129F copy I sent here, but I'm not complaining at all. :no:

One thing we were wondering about is if it's necessary for her to bring along with her the I-129F I sent her when she goes through the POE next month. She'll be bring a lot of things over with her and I don't want to add any extra things she has to carry with her on her way here. Thank you again for all your help! :)

Man what an experience!! We had spent months preparing, and liteally the past few weeks, I was stressed worrying about little details that I may had overlooked.. You all know, that this whole thing nearly tops the list of the most importing things you'll do in your life.. And I put a ton of pressure on myself because I did not want to let me or my fiancee down by overlooking something critical.

Anyhow, it's was really great how smoothly the interview went, but seriously in some respects, I was ready to throw down some serious evidence.. Each time my fiancee went up to one of the Windows, I was nearby with My hands on all the proof and ready to fight to proove our relationship.. It's kinda like comming to a football game and the other team doesn't show up..

Well, Ultimately the goal was to get the Visa Approval and Thank God we have it..

After yesterdays experience, Maritza and I just felt extremely wore out and tired from all the preparation and litteraly the weight off our shoulders that had lingered thoughout the process and more-so the closer the interview came the heavier the weight became.. So after the interview, it seems like our energy plumetted and we slept most of the day. When evening came we looked at each other, and although every-once-in-awhile, we both shouted a said "we're approved" the enthusiasm for a night out celebrating was overcome with fatigue.. We did go out for while, but we ended up at Exito (kinda like a Wal-Mart) and then Maritza had a Craving for A Sundae from McDonalds, so that was the extent of our celebration..

All-in-All we're both excited and Happy, but there is a lot to prepare for now with the "wrapping up" of our apartment in Medellin, Packing her stuff for her entry into the USA and, planning that trip. I will fly down here and Accompany her back to the US.. I am considering booking first-class just to add a little token to show her how I appreciate the Sacrifice she is making to leave everything she knows to come to US with me... Not nearly what she deserves, but a little something..

I have one more week in Medellin, Myself, Maritza, Valentina (Fiancee's daughter) Maritza's mom and Maritza's sister and Brother along with one of Maritza's Uncle are escaping for 4 days to a little house in the country for some relaxation, food, and just enjoying each other's company. No phones, email, or television...

There were 3 big things I had been dreaming about since Beginning this process.. One was Maritza's and my first plane ride together for the Interview, second was the interview and Approval. Those dreams were realized this week.. That was huge for me, since it's not always that dreams come true..

Third, is Maritza first steps into the USA and our drive from the San Antonio Airport to Del Rio (150 Mile Trip) together. I beleive realizing that dream is just around the corner.. Basically I've decided not to preasure Maritza to make that trip. I am letting her take whatever time she needs to leave Colombia.. But she knows, it's not that she's leaving permanently, however the mindset is it's not just a new chapter in her life, it's kinda like ending one book, and starting a new one... But I promised her, that Colombia is basically a 3 hour trip from the US, and not to think of it as leaving forever..

We're blessed to have gotten this far in this process with relatively few obstacles, thank god.. So I really hope the best for everyone who is still waiting for this day to happen.. Today, MAritza and I will head to the church and give god the thanks he deserves.

Great news, after 4 hours at the Colombian Embassy today, Our K1 Visa was approved..

They asked for no additional evidence and I was never asked any questions.. Maritza was only asked about the dates of my last trip and how we met.. They told her the paper work looked good and they were approving the Visa..

I cannot possibly tell everyone how much the VJ Community has helped, but, there is no doubt in my mind we would not have been able to get through this without all of you..

Read the guides that are found here at Visa Journey. All that is required is that you comply with the filing requirements. My personal recommendation is that you be thorought and complete in providing supporting documentation for the fact that you and your fiance have met and that you have a real and ongoing relationship.

I might be late here, but the last I heard his passport was lost.....did he get it back as of yet?


Yes! His school called to say that they had found his passport before they began the processes to replace it.

I just checked the USCIS website about the Service Center...I saw there's a 4 Service Center.
California Service Center
Nebraska Service Center
Texas Service Center
Vermont Service Center

The Vermont Service Center usually handles I-129F petitions for US citizens resident in New Jersey.
