Assembling the I-130 Package: Checklist


1.Payment as required by USCIS. Use a personal check if allowed by the Service Center (as of 4/2005 they do allow this). If not, use a money order so you can track the payment.2.Cover Letter. Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1.Documentation showing joint ownership or property; or2.A lease showing joint tenancy of a common residence; or3.Documentation showing co-mingling of financialresources; or4.Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or5.Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or6.Any other relevant documentation to establish that thereis an ongoing marital union.
Attach "E-Notification" Form (Optional)

Clip a completed G-1145, E-Notification of Application/Petition Acceptance, to the first page of your application (on top of the cover page). By completing this form and attaching it, USCIS will send you an email and/or text message to alert you when your application was received.

You are right Pushbrk, they are agency of the state and me and my wife didn't know that they are not associated with USCIS as my wife told me that they may cause us problems but now that we know they can;t do anything, we are very happy and she said that she will send them a certified translation copy of our marriage certificate to them also thank you so much pushbrk. @QueenE Our marriage is legal. we got married legally here in Russia .and my wife was afraid and thought not living together for 3 months has invalidate the marriage because of a document that she collected which was in her former name that is why and VJ members have explained to us now that common law can not affect us since we didnt marry under common law. If you are legally married in Russia with the applicable government issued marriage certificate, the USA will recognize your marriage for all purposes including immigration, regardless of how the Government of the nation of Georgia regards your marriage. If you mean the US State of Georgia, the answer is the same.

Today my wife called me and she was crying and very sad. she told me that she wanted to do some documents and that after she finished doing it, they did not put my last name( Oyetunji ) instead they put her former name Peete, And we have changed her name and all details including SSN after our marriage because we got married here in Russia where I live. She got a reply after she have asked why they p0ut his former name and the reply was that they did not recognized our marriage under Georgia common law marriage since we have lived away from each other up to 3 months. Now my wife is crying that this may make USCIS not approve us. I tried to tell her that we did not get married in Gerogia or USA in general that USCIS should be able to know that we need to follow the protocols and we can't just jump the hurdle like that and they should respect that, but she is adamant and believed it will destroy everything. my question goes thus, is this really through ?

Yes they are not required at the USCIS state and we have made mistake by sending it together and we thought we might have problem but they said it wont affect our petition. and also about the CR-1, what i meant was now we know that once we get approved at the USCIS stage and we are in the NVC stage, we know now that it is I 1864 we are going to fill and send and not I 134 . thats what i was trying to say

Yes that means you were transferred to the service center in Missouri.

No worries about denial. You just sent them what you will have to send them when you get to NVC. Just have all your I-864 at the ready. More than likely you will get your NOA2 soon. NBC has been approving pretty fast. So rest your mind. It is well.

Why would they deny you for sending in another petition and extra paperwork? They'll probably just ignore the extra paperwork, tie in the i-129f to your i-130 and approve both at the same time, which means that when it's sent to NVC you'll go through the CR1 path instead of the K3 path.

On your timeline you put your service center as Vermont, are you sure about that? What does your number start with? Could you post the text of your NOA1? The reason I'm asking is that most who applied i-130 were sent to the National Benefit Center in Missouri and if you were sent there, you need to update that on your timeline.

When we sent our petition on sep 11th , we sent it to USCIS chicago locker box because I live in Georgia and on 13th of september , i received an email from USCIS sayingYour case has been accepted and routed to the USCIS Vermont Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number EAC---------. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. And on the 19th of September , I received a hard copy of the NOA1 in the mail , when says The I 130 Petition for Alien Relatives has been received by our office for the following beneficiaries and is in process. they quote my husband name and his date of birth and country.
On the September 17th, USCIS sent us another notice, they said form i-797 c notice of action, the receipt number is there, receipt date which is 12th September , petitioner name , beneficiary name and they said notice type : transfer notice. they said this is to notify you that we have transferred the above application or petition to the USCIS office at USCIS -NBC, P.O.BOX 648005, Lee's Summit, Mo 64064.We transferred this case because the record indicates that office has jurisdiction over the case , that office will notify you of subsequent action taken on this case
does this mean that my petition is with the NBC ?

There is something bothering me and I would like you all to please help me resolve it, when we wanted to submit our petition, we thought we will be moving through the K3 line and when we read the details about K3, sending first I 130 and then after NOA1 then we will send out the I 129F, this is what we thought of doing before and when we sent our petition, we sent all the required evidence, but we put copy of my last three years IRS tax there and also fill form i 134 and put it there altogether, after submitting it , we learnt that K3 is no more functioning, so we had to rely on our i 130 petition, and my concern now is that sending together IRS tax and I 134 with our documents at the USCIS stage, won't these things damage our petition by making them to deny us ? we know now that for CR 1 petition we will need I 184 and not I 134 which we will do if approved at the NVC stage

If you are talking about marriage certificate, you have to do the apostille. because we did apostille also for our wedding certificate, they told us at the Zagc that is very important, so that is why we did it. But the Police certificate, we only did the translation and get it notarized, there is no apostille for that. Apostille only for the marriage certificate

Dont send in your orignial marriage certificate. just send a copy of the marriage certificate and the translated copy. because the original marriage certificate is needed during the NVC stage. during uscis stage is only certified copy and other things you have like skype, facebook, phone records, text messages, pictures and so on. This is what i did and we have no rfe and got approved even though it took us 8 weeks and 1 week.

We sent 45 photos size 4x6 and also a dvd of our marriage . Although i later realized that i should not have sent the dvd. but they did not returned back the photos nor the dvd. .and we put the photos inside an envelope and also the dvd inside another envelope. but i think maybe the person handling your petition think is of no use but am sure he will still ask for the photos again. so get ready to send the again soon.
