K-1 Fiance(e) Visa Process & ProceduresNeed some advice
I also thought that you can upload everything from the website. That what I've done even though our paperwork is still somewhere between VSC and NVC. Did you check the US Embassy in Romania website?? US Embassy in Ukraine even encourages applicants to download all the forms from their website due to numerous mail deliveries.
I hope you'll solve this issue soon:)

I have a question, too. Why didn't you apply for a visa extention or change of status? I did the last thing right before my F-1 expried and they allowed me to stay for one more year (I didn't use the whole year though and returned after nine months of staying in B-2 tourist status.) And what about that two-year rule all J-1 students usually - and unfortunatelly - have? I guess it doesn't matter if you've filed for Fiance visa???

Good luck for you and your soulmate:)!!! I hope that time will fly for you as it did for us:)
Masha

I needed to finish my school(I'm graduating the University this year), and i wanted to do things right.
Besides, we've thought about that with my boyfriend, and he had no doubt he wanted to marry me, and the sooner i would have leave, the sooner i would have come back.
And i was verry lucky too, cause(don't ask me why) but the two-year rule does not apply for me! kicking.gif
Yep, the embassy issued me a visa with multiple entry and no two year rule!
I'm not even sorry i did things the way i've done them, i'm just happy we'll be together in a few months(hopefully not too many)
Thanks for supporting smile.gif

Oh I got it. Your timeline says 'visa expired' 09/14 or something, that's why I asked about why you didn't get the extension/change of status. It's good you're graduating though! Just don't forget to translate and notorize your diploma when you'll be leaving Moldova for the US. It'll help you when you'll be looking for a job or another school there. Although, I'm sure you'll do great without my sweet advices:) And yes, you've been really lucky when you avoided that stupid two-year rule. The rule is so meaningless... Good for you though good.gif
And good luck with your NO2, too. I've noticed that when they keep forwarding k1 petitions from one service center to another as they did with yours, they process them pretty quick eventually. It sums up in four months in average anyway, but VSC is faster than others, so I hope you'll get yours really soon:)
Take care. I hope that time will fly for you guys as it did for us biggrin.gif

K-1 Fiance(e) Visa Process & Procedurespeople, what do you do?
I just was about to say - keep yourself busy. Get yourself distructed. I found it was a good remedy. It's hard at first but there is no other way to get through all this mess. I help my sister to keep her home nice and neat, I babysit my cousin's daughters, I started aerobics yesterday (who wouldn't wanna get more fit by the wedding:)??? I've read a lot, too. For all those years I spent in the States studying and working, I didn't read a lot of fiction and now I'm catching up on this. See your friends more often, hang out with your family, go to the movies... I did all these things and time flew. (We've waited for our NO2 for 4 months and we just got it Jan7.)

I also thought of all these months as of the last months I'm spending with my family. No doubts that my parents, my sister, and my friends are excited for me to get married and to finally reunite with the man of dreams but they all will be missing you after you leave. And I'll miss them, too. Sometimes I think that I'm so eager to take off that I forget what I leave behind. I'm sure that there are some cases when there is nothing to regret about or to miss in the past, but most of us do have something that we'll be missing desparately. I know I will even though I'd lived in America for five years before I returned to Ukraine last summer and was really happy there.

I have a question, too. Why didn't you apply for a visa extention or change of status? I did the last thing right before my F-1 expried and they allowed me to stay for one more year (I didn't use the whole year though and returned after nine months of staying in B-2 tourist status.) Just courious what is a round trip ticket is going for through your connection USA KIEV. My wife will go to visit her Mom late feb or early march. Thanks. any help would be great.

My only advice would be - if you can, try to avoid flying on weekends. Many people don't know that to fly Mon-Thu can be up to $100 cheaper. I've been hecking flights NYC-Kiev for late February, and it starts aroud $696 to fly on Friday where it's only around $638 if to fly Tuesday. I don't know why but Tuesdays are always the cheapest days to fly:) Either way, I'm sure you'll be able to keep price under one thousand, even flying from West Cost.
Have a good one!

Oh, and if you call, don't get Aerosvit-Ukrainian Airlines unless it's a really, really good deal, and there is nothing to choose from (it's fine but not very comfortable.) Try getting Delta or Polish Lot - have lots of flights and good pricing:)

Yuriy,
I honestly don't know if you can use it or not but other members seem being reasonable. And I know it's hard to buy from travelocity or orbitz a one-way from abroad to the US. For my last trip I used Cinderella Travel. They're located in NYC and mostly dealing with Eastern European coutries. Try calling them yet today, I hope that there they'll be albe to offer you a good deal for both round trip for you and one-way for Sasha.

K-1 Fiance(e) Visa Process & ProceduresFiance visa question
That's right! The petitioner has to follow poverty guidelines to find out if he/she needs to a co-sponsor or not. If your household is going to be only two people (husband and wife,) your annual income has to be $17,112 or more. A beneficiary, on the other hand, does not need to work and is not asked to show his/her income. (I'm not working now and haven't been working for a year - I'm a beneficiary; our I-129F petition was approved last week and I'm waiting for my visa interview in Ukraine now.)

So, these guidelines are for 2007. I don't think they've publish a new doc for 2008.

K-1 Fiance(e) Visa Process & ProceduresA few K1 Visa questions
QUOTE (~Laura and Nick~ @ Jan 15 2008, 04:41 PM) <{POST_SNAPBACK}>
Hi and welcome smile.gif

The 90 days starts as soon as you enter the States using the K1. When you receive the K1 visa, you have up to 6 months to enter the States.

You can get a stamp in your passport for work but it only lasts for the 90 days. I think the only POE that issues that is JFK Airport. Then after you are married you file for your Adjustment of Status, you file for your AP (Advanced Parole which allows you to travel outside of the States before you have your Greencard) and EAD (Work Authorization) at the same time. It usually takes 3 months to get EAD and then you can work. Many don't even bother getting a stamp in their passport for work before they get married.

In order to support you, your fiance must be making 125% over the poverty level for the number living in the household.

Click Here for the guidelines that were posted on VJ. There is no 2008 guideline out as of yet but It should be pretty close to this.

Best of luck! smile.gif

Hey, how do you know that only JFK issues temporary work permits? I've read once somewhere that only major aiports do that but is there a list of those or something? I won't need to work right away after I get back to the U.S. but it'd be nice to have this option before my status is adjusted. I always fly to JFK and then we drive up to Albany, NY where we live, but this time we decided to only change planes in JFK and transfer to Albany; now I'm not sure if they'll be checking my visa and everything still in NYC - if yes, I could try to get that EAD - or at my final destination? In any case, I'm sure it's not a 100% that they'd grant you the EAD even if people at JFK are allowed to do so.

Anyway, I"m just curious:) Do you know more about it, or where I could read it?

if you filed back in september, you're very close to getting your approval. it all depends where you've filed your I129F. VSC seems working faster than service center in California. we filed Sept6 (with VSC) and got our approval last week.

K-1 Fiance(e) Visa Process & ProceduresG-325 Address history
David,
You can attach the extra sheet to your petition, it's no problem for them. Don't forget though that your finacee will need to obtain police certificates from Germany and West Africa if she stayed their for 6 months or longer which is the case, I believe. She'll need them a bit later, for her visa interview, but it may take a few months to get those, so she'd wanna take care of it beforehand. They are usually valid for 6-12 months.
Good luck, and have a nice weekend smile.gif !

In my G325 I've listed five mailing addresses I used for my correspondence for last five years (I was a student in the US and moved a lot:) I skipped one address though, just forgot that I used to live there (for about 5 months,) and it didn't make any problem. I believe that if everything else is fine with your documents, to skip some places you lived at it wouldn't be a big deal at all....

Good luck smile.gif !

K-1 Fiance(e) Visa Process & ProceduresDo we receive email notice for the following...?
I see that this thred is sort of old but I noticed that nobody had mentioned an Affidavit of Support, form I-134. I'm telling you this because the Affidavit is the only document you'll have to take care of while in the US because it must be notarized. By April, you'll have your 2007 tax return filed, so you'll have to make a copy of 1040 and bring it here as an evidence required for the Affidavit. With the rest, I hope you've already checked what she'll need for her interview. MOST of it she can get ready right here, in Ukraine. You'll have your passport with you, so you'll just photocopy its front page and the airport stamps from when you travelled. For the interview, my fiance has sent me detailed phone bills, too. You'd wanna take them with you unless you can print them out from Internet.

About the medical. I had it done a few days ago and I cannot say that the experience was not that pleasant. First of all, if you fiancee doesn't live in Kiev, she can surely schedule it a day before the intervies, just come early. It says that medicals are scheduled from 9am-12pm, so come at 9pm. There is a line, lots of people, lots of kids. For me, it took about five hours to register, complete all tests and get the resutls. The secret is that they don't really close at noon;you have to come in and register befor this time but the tests are done as soon as you're registered - even 1pm, 2pm.... Also, if she'll have a medican a day before the inteview, you guys make sure that you have everything else ready beforre that - all pictures taken and developed, all necessary documents photocopied, etc, etc... (The medical costs $100 by the way.)

It's still a bit early for you but you better be ready beforehand. I'd uploaded Information Paked from the embassy's website as soon as my fiance filed I-129F back in early September.

Good luck to you smile.gif smile.gif

K-1 Fiance(e) Visa Process & ProceduresNVC Number Is Different from the Embassy's Numbere??
Friends,

Can somebody explain to me how my NVC case number can be different from the Embassy's number? May be I was understanding it all wrong, but I thought that to schedule a visa appointment I have to use the NVC case number. So I did.

Last week on Thursday I called the Embassy and was told that they didn't have my paperwork delivered by then but that they were expecting some next day, on Friday, so I was offered to call on Monday. I'm calling back today (it's exactly three weeks from Jan7 when our petition was approved) and I'm told that they still don't have it. The guy was kinda nice though and suggested that they might have given our peition another case another, the Embassy's number. He checked what they had using my first name and last name and found it. Needless to say, I got so excited that could finally schedule a visa interview! But not that excited as when he told me that the closest date available would be next Monday, February4 good.gif !!! I couldn't think clear the whole day long... So happy blush.gif !!!

So this is it. I know it's a small issue but I'm thinking now that the girl I spoke to last week might have also used my name/last name to look further but she didn't. If that guy today wasn't that nice and resourceful, I'd be waiting for who knows how long????

K-1 Fiance(e) Visa Process & Proceduresonce k1 application approved with this help speed up embassy appiontment
I had almost everything ready for my visa interview (which is tomorrow) long time before it was scheduled. Our petition was approved Jan 7 and the Embassy recieved it on Jan23. You just try to check how long it usually takes for an approved petition to reach the Embassy in your country and what's the procedure you have to follow after that. I know that in some countries, as soon as they have the petition, they send you an imformation packet, you have to collect all appropriate documents, and let the Embassy know about it. Then, they schedule the interview. In my case, I didn't have to do all this. I just called them and scheduled the interview (since I had everything ready beforehand.) It must be something on India Portal here on VisaJourney, too. I'm sure there is something under the 'Embassy Info'section as well. Check it out! And good luck! My fiance also filed I-129F in early Sept. I'm sure you'll get your approval any day now:)

Side note to the above. Is there a recommended amount of copies of the tax returns (ie 3 years worth) that they want to see? I couldn't find this anywhere.

Only one year of tax return you have to show for I-134, your last year. My fiance sent me his 2006 tax return info and it was enough. Additionally, I had some bank statements and some other savings documents photocopied, and it was ok.
mariapoeFemaleUkraine2008-02-05 17:51:00
K-1 Fiance(e) Visa Process & Proceduresk-1 visa, I-134 question
Agree with the previous post. You'll be filing 2007 tax return anyway - defefinitely before your fiance will need a copy of it for her interview, so what's your concern right now? My fiance is self-employed too, and to supply the Affidvit of Supporrt, I submitted his 2006 tax return copy, bank statements (both checking and saving accounts), and some other savings. Mostly important, that your income should be 125% of the poverty line which is now around $17,500. If you'll going to have only two of your in the household, your income should be at this level or higher. That's it!

GOOD LUCK smile.gif !

K-1 Fiance(e) Visa Process & ProceduresUSCIS Email Address to Request Update?
Unfortunately, I'm not sure what's the 'premium processing' myself. But this is if only you call to Vermont SC. You can use USCIS phone number and can ask them about the status, etc. The only thing is (as I read in some other threads) that they may not give you any info that soon - it seems that your case has been under review for only 3.5 months. They usually ask to call not earlier than after five months, believe me or not! On the other hand, hey, we got our approval in four months, so you must be close, too:) I hope you are...

Thanks for your greetings:)!

K-1 Fiance(e) Visa Process & ProceduresUSCIS Email Address to Request Update?
From NVC, we got an email stating that our NO2 reached them and they'd be forwarding our case to the Embassy within a week. Later, when we were not sure if the petition left NVC or not, my fiance contacted them using this address

NVCINQUIRY@state.gov

He got a reply about a week later that our petition was recently forwared to the Embassy. I hear though that people often call to check on the status of their petitions. It's hard to get through but it's possible...

Hours: Monday through Friday from 7:30 AM to 12:00 AM (EST)
Tel: (603 334-0700).

Oh, one more thing, after your petition is approved and forwarded to NVC, you don't need to login USCIS, it will give you no info. As soon as the petition gets to NVC, it's assigned a different number and unfortunately you cannot track its status online.

GOOD LUCK!

QUOTE (mox @ Feb 5 2008, 02:53 PM) <{POST_SNAPBACK}>
QUOTE (pushbrk @ Feb 5 2008, 07:20 AM) <{POST_SNAPBACK}>
I don't know how unprepared or uninformed people manage to hold things together as they are hit by one unforseen bit of information about the process after another.

Word. (and pushbrk I wish we could talk your wife into posting sometime. You always talk about your relationship in the most clinical terms, but I just know you're a big teddy bear... laughing.gif )

When my OH and I started chatting online, I didn't seriously think I was going to get...well, serious. But as time progressed and we became more involved, I started looking into seeing what it would take for her to visit the US. As it turned out, there's no way in hell she was going to be allowed to visit. But in researching that, I found out just how difficult it is to bring someone over here to marry. That realization was like looking into the maw of a vast empty pit. It seemed to me there was really no future for us, as I couldn't possibly see her wanting to wait so long, and quite frankly, for me to put my entire life on hold for it. But the longer we knew each other, the more I entertained the process. When I finally went to visit her, the deal was sealed. I'd have waited 10 years for her if that's what it took.

If I'd have gone into it knowing nothing, jeez. I honestly don't know what I'd have done. It may not have changed my mind, but I'd be much worse for the wear. The waiting and waiting and waiting is tough, but at least I know about it and can anticipate the next series of delays. She's much better at the whole waiting part thing than I am (I think it's a Russian thing, they're always waiting for things to get better), but I've learned to be a lot calmer about the things I can't really control.

It's funny you wrote about a Russian thing. I just thought about it reading this post about an hour ago. I started typing a comment but then decided not to finish it..... I meant to say that some people, especially from advanced and economically developed countries as US, expect everything to be as fast and as easy as to get cash from ATM. No offense, but many people take lots of things for granted, so when they face a challenge like this, they start panicking and dramatazing a bit. It's hard but it's not the hardest thing in the world. Russians, on the other hand, have had a tough history and especially recent developments have made them even stronger and more patient. We here grew with Russian literature/history full of sad love stories, so suffering of waiting like this, we just follow the old tradition tongue_ss.gif I'm Ukrainian but it's we all stem from the same root. I'm in Ukraine right now and I see people struggling all over the place, so I try not to complain about my waiting situation very much and just be patient.

K-1 Fiance(e) Visa Process & ProceduresHow In The World Did It Come To This?
You see, my fiance didn't realise that it'd take so long and he wouldn't listen. He's is a stubborn man and sometimes he overestimates his own powers tongue.gif jest.gif . I was in America for five years studying/working(02-07;) for last two years we were first dating, then living togeter. In any case, he wasn't in rush to propose and I didn't mind but my visa was about to expire, so in June I eventually left for Ukraine. Without a ring. We agreed that he'd come to visit me in two months and he did. He proposed, too. I always knew that he'd do that but of course I had no idea when, so I kinda felt like I had put my life on a hold for him/us. Anyway, while in Ukrarine, he proposed, and only after he started gathering papers to file I129F in September, he realised how hard and long it'd take. And he was furious! He is an independend man and has been independend since he turned 14. As a result, he doesn't really require anybody's approval on his decisions; he's always been on his own working hard developing his own business, etc. So, with the USCIS he felt that it was a nonsense that the goverment has to basically give him an approval on the most important decision in his life he's already made.

We all go through this and it sucks! To be totally honest, now, after my K1 visa was approved yesterday, I don't feel all this waiting wasn't THAT horrible and unbearable. May be, because once Nick and I broke up for five months without knowing that one day we'll be back together. That pain when I thought I had lost him forever was so strong and destructive that this inconvinience of separation feels like a small teaser for me. Just comparing... smile.gif

From my fiance, I had the Affidavit+photocopies of his tax return/bank statements/other investments. Everything else he provided me with was the evidence of ongoing relations - aiport stamps from his passport when he travelled to Ukrine, phone calls, etc. Your finacee, on the other hand, will have to fill in two and get all other documents requested such as a birth certificte, police certificate, etc, etc, translated and, probably, notarized. (You could check on the US Embassy in Ecuador website or here on the Ecuador portal.)

I don't think it should be taugh. I agree, just read the JFK's reviews. They don't seem scary at all. I've entered US through the JFK gates twice - both on student visa though. It wasn't a big deal! I thought that may be you can send them an email, too? You'll get their response who knows when but, at least, you'll have a documented proof that you've contacted them about your situation? I know it's a dumb advice but, if I were you, I`d surely do that. Also, are you checking for your status going to the USCIS website and entering your case# or you`ve registered for it? I think that for K1 visa interview which will be scheduled after the I-129F approval, your fiancee will probably have to go back to her country. Your fiancee will be having a K1 visa interview, right? For this, you do not need I-864 form (you'll have to submit it later when file AOS.) For now, you need the Affidavit of Support, I-134. Prepare it right before you leave - I believe that it's better for the Affidavit to be notarized closer to the interview (by a US notary public.) You'll have your 2007 Tax Return filed by then, so you'll just bring a copy of it with you. Don't forget any other evidence of financial support - bank statements, retirement savings, etc: the more you have, the better.
The rest is up to you. Have your pics, emails, Western Union receipts if you're sending your fiancee money, airport stamps, hotel receipts if you traveled together, stuff like that. I also had two letters of support for us - one from my parents, and one from my fiance's brother and sister-in-law. Generally, people in the Embassy are nice; if you have enough evidence of your ongoing relationship/financial evidence, you'll be fine. If you fiance has children, make sure that all required documents are translated and notarized.
Contact me if you have more questions. I'm in US already, arrived only few days ago, so happy jest.gif !!!
Good luck!

K-1 Fiance(e) Visa Process & ProceduresService Center priorities
QUOTE (AnewKINDofFEELIN @ Jan 16 2008, 06:29 PM) <{POST_SNAPBACK}>
No joke, I would definitely think that them approving 22 October filers before June and July filers would definitely fall under USCIS error. Unfortunately, they'll never admit that they're processing October petitions.

I think that you two are as close as ever:) I was always curious about their priorities seeing them approving October's and even some Nov/December's filers before us - NO1 was dated Sept10. We got our aproval ten days ago, Jan7, so I wanna believe that your case is being reviewed right now and you'll get your approval very soon. I know how annoying it feels. Fortunately, Vermont Center seems working faster than any other center, so I'm pretty sure that you'll get your approval any day now:) Good luck with this!!! Take care!!!!

K-1 Fiance(e) Visa Process & ProceduresPOE
I entered the US on Feb23 at JFK. Honestly, I don't think your presence would help your fiancee a lot. If her English is not that good, I'm sure the officers in the aiport will assist her. I had NO problems with anything. The only thing is that the guy forgot to put the EAD stamp in my passport, so I had to ask him to do it. For me, the whole thing took less than 30minutes. I understand that this experience can be intimidating especially for people who don't fly into the US a lot, and I totally undersrtand the frustration of some American fiances after they are separated from their SO at the port of entrance, but there is absolutely nothing there for you to worry about. They are not rude or anything, just doing their job. I was so happy to be back to the US after the eight months my fiance and I had spent apart, that those few minutes at the customs were of no problem for me. I was so happy to be home again, so nothing else mattered biggrin.gif ! I'm sure your fiancee will feel the same excitement smile.gif ! Congratulations guys, and good luck smile.gif !

K-1 Fiance(e) Visa Process & ProceduresQuestion about NOA2
They don't require a copy of NOA2 in Kiev. I had it with me but I don't think it mattered. Actually, I was surprised to see the whole file from the NVC at the interview; it had a big stamp saying 'APPROVED' on a top of an original I-129F that my fiance had filed. I didn't know that they send the whole thing to Kiev; I thought it would only b a duplicate of NOA2 or something. Anyway, I think that the copy of NOA2 is the last thing you have to worry about smile.gif .

Good luck, and have a great trip to Ukraine smile.gif !

K-1 Fiance(e) Visa Process & ProceduresMedical
I didn't have my KEV# when I scheduled my medical. I also didn't have it when I went for my medical. If you don't have it, it's fine. They officially require the KEV# but they'd schedule an apointment even if you don't have it. I tend to agree with the other posts though that the later you do it, the better because the medical is valid for 12 months, so the later you do it, there is more chances that you'll be able to use its results for AOS. Besides, your fiancee'll always be able to schedule a medical a day beforer the interview, it's pretty convinient! No requirement to have a vaccination record for K1 interview either.

Good luck smile.gif !

K-1 Fiance(e) Visa Process & ProceduresNaples..Sounds Strange..Please Help!
Sorry to hear about all your troubles.

I don't know about Naples but are you sure you have to physically receive package 3 and then fill it in and send it back to the Embassy? I know that in some countries (including mine), you can upload all the forms from the Embassy's website, fill them in, get all the documents ready, and then to call to schedule an interview. I had all my paperwork and supporting evidence ready long before my NO2 was approved, so I scheduled the interview the day the recieved my approved petition from NVC. I wish it was that easy everywhere including Naples.

Good luck! I hope your situation will get resolved soon!

K-1 Fiance(e) Visa Process & ProceduresWould this cause any problems..?
Scott,
I think that your fiancee can visit Thailand either prior or after the interview (it'd be rather hard to do it after because they may need ten business days to print the visa and deliver the passsport; however, the visa is for six months, so she'd have six months to enter the US.) In any case, I don't think that the US Embassy cares about where people travel before the interview, and why would they? Just get everything ready for the interview, make it all well-organized (they love it well-organized there biggrin.gif !) And of course, if her interview will be scheduled, say, for Monday, she shouldn't fly back to Ukraine on Sunday, the flight delays may happen, etc... Just usual precautions, that's it!
Good luck smile.gif !
