The one i used was a waste of my time and money.he made many errors and caused delays in my K1 application. I had to refile and pay an extra refiling fee. If i were you I would do it on my own.

This is my experience: I hired a lawyer b/c i had not a clue about immigrations or the forms. Honestly, the lawyer set my case back 6 month by filing wrong facts, misspelling of names, wrong birthdates. My first K-1 was denied I had to filed new one of course i had to pay again. The lawyer i had misrepresented the truth to me told me he could get my fiance back here quicker( i was green of course he took advantage) told me the sooner i pay him the sooner he could check on my fiance interview at the embassy( which was another lie). I had no criminal background never even had a speeding ticket nor did my fiance. After the major screw up with my case I started handling all my paperwork myself and I have never gotten a ref on anything i sent in. One thing i learned from this experience is that I wasted money and time on this lawyer b/c lawyer or no lawyer if uscis want to deny they will deny.

Each case is not the same so it up to the one thats involoved to know whether they need a lawyer or not. My advice would be if one chooses to use a lawyer becareful I think this one saw that I knew absolutely nada about immigration so he took full advantage of the situation.

If I recall correctly, the adminstrators have a note posted that says to always check the USCIS site for the latest forms. This forum is here as a tool and a guide but ultimately the responsibility of ensuring the proper forms are obtained is ours and not the administrators. Just my two cents. :whistle:

I filled out the paperwork for my husband (and he writes and speaks English perfectly). It was just easier for me to complete the paperwork because I like things to have a uniform look. Many people fill out the paperwork for their fiancee or spouse and I'm sure it has nothing to do with the beneficiary's ability to write, read, or speak English. My filling out the paperwork and having hubby sign it didn't delay the processing of our paperwork at all. Good luck on your journey bccrabb

New guy here...

I am just about all set to submit the I-129F and the G-325As.

My question is:

Can I have my Fiancee send me signed, but otherwise blank, copies of her G-325A and I fill out the information for her? It will be pretty obvious that the handwriting is mine and would hate for the application to be delayed or rejected because I filled it out and she "just" signed it.

Other than that - wow! It's great to see that we are not alone and that others are going through this crazy-long process as well.

I see this question alot, my question is, if they have the form and sign it, why cant they fill it out? Am I the only one who made my man fill it out and write his letter of intent (although I think we did this wrong, I said why we are perfect for each other, and his was a drop dead love letter. ....made me cry.. :)...anyway, so whats up, is it the english that kicks them? I am sure it would help to have the form in their own language, translation is really hard.

In the interest of expediting everything (since the mail takes apprx 1 week from Asia) she signed it and put it in the mail so we could compile all the info and double check it before submitting it in the meantime. Her English is perfect but every saved week and day is something.

There would be no problem about it co's i tried to apply for tourist visa while our case(K1) was already filed.BUT be sure during your interview, the consul will ask you about it, and BE HONEST that you tell the truth, won't affect your case, trust me this is base on my experienced.Good luck and merry x'mas kababayan:)

Yes, it is true that Guangzhou takes longer to process visas than many other consulates around the world for the reasons already given by others - namely that it is one of if not the busiest consulates as far as visa processing goes. My fiancee just had her K-1 interview last month and it took just under 9 months, so that does seem to be about the current timeframe.

Yes he will need that as well. He will need to take his National ID card and Hokou (family registration) to the Police station where his Hokou resides in order to get a police certificate. Then he will need to take the Police certificate along with his national ID and Hokou to the Gong Zheng Chu, Public Notary Service where it will be translated into English and notarized. The Gong Zheng Chu will also produce the so called 'WHITE BOOK' (birth certificate) which contains a copy/extract that will attest and say when your fiance was born, that he is a boy, that his parents were XXXXX, and if parents deceased...etc. The Gong Zheng Chu will also produce the 'Unmarried' or 'Marriageability' Certificate for your fiance based upon the information contained in his Hokou.

My wife (then fiancée) signed all of the documents throughout the K-1 process in the Family Name/First Name format and we didn't have any problems. Also whenever her signature was called for she would sign it in both English & Chinese characters but always in the Family Name/First Name format.

My wife came to the US on a K-1 so I can't speak definitively about the vaccination series requirements for the CR-1 however we were able to file for Adjustment of Status after only receiving the first of the Varicella doses. The rule for AOS is that the applicant must have just started the series of doses so I think that it is probably the same rule as far as the CR-1 goes as well.

And to answer your other question - yes the CDC has dropped the HPV & Zoster vaccination requirements for immigrants starting Dec 14 which is really good news.

As pushbrk has already indicated to you there are no vaccination requirements for the K-1 interview itself - your fiancée would only need to have the vaccinations administered before you file for her Adjustment Of Status. So there is no need to get the vaccinations prior to the interview or even before entering the US. With that being said, you are right the document that GUZ sends out listing the 15 different vaccinations is very confusing. The fact of the matter is that almost all of the 15 vaccinations listed on that document are age specific meaning that most people only need to get 3-4 of them. Most people fall into the age group (27-64) in which only 3 of the vaccinations are required, with those being:
1. MMR
2. Td/Tdap
3. Varicella (chicken pox)

If your fiancée is 26 years old or younger then she would also be required to have the HPV vaccination in addition to the 3 listed above.

Check out page 12 of the Vaccination Requirements for Immigrants Document below that is issued by the CDC - page 12 has a chart which breaks down each of the vaccinations and which ones are required based upon age. I actually took this document with me when I took my wife to the Civil Surgeon here in the US to have her vaccinations administered and I-693 completed as he was a bit confused as to which ones were actually required as well.

The timescale will depend on the Service Center you're using. As an example, the Vermont Service Center is currently saying 3 months to issue work authorisation.

You'll save a lot of time, just reading the guides here. Decide if you want to jump through the hoops to marry in the PI take the Fiancee visa route and then learn and follow the applicable spouse or fiancee path including careful study of the guides here and the actual form instructions. In either event, unless you plan to move to the PI for a year or more, you'll be filing a petition in the USA and waiting 5 to 8 months for a visa interview.

Bear in mind USCIS doesn't issue visas.

:unsure: There are many who are registered on this site as having a K1, K3 or some other type of petition, but despite the seeminly large quantity of people registered here at VJ, is there a way to know how many people are really being processed at CSC? I'm not happy with the results of CSC as they seem to be very arbitary in how they handle each case choosing people who filed in September to approve while making some May, June, July and August filers wait. In talking to some of the "left-behind" filers, there doesn't seem to be any known pattern as to why they've been overlooked and others have not. Some have prior marriages, some have prior K-1 submissions.... and others are first-time filers. A few have minor police records such as parking or speeding tickets. Most sent in their applications with tons of evidence and so far only a few of those who are still waiting for approval, actually have RFE's pending. Most of us who are still waiting are a mixed bag of filers who for one reason or another... or for no particular reason.. have been laid aside by CSC while they focus their attention on September and soon October filers. This is great for those who filed in September and October but it leaves those of us remaining with alot of whys that can't be answered. And calling the 1-800- HELP line is only a frustrating adventure into Alice in Wonderland. I think that we all realize that some cases might take longer if there was some special reason for itt and if having read and heard most of the pending cases stories... if there was a common thread as to why all of us are still waiting... none came up during my minor investigation. I thought maybe certain countries were targeted. Communist countries for instance. Nope. Someone from Cuba got processed lightning fast and many from China and Viet Nam have rolled through in as fast as anyone else. Surprising to me was how many of the pending cases are from Great Britian. Probably means nothing but it was interesting. And while this small disertation by me doesn't get mine or any of the other pending cases approved, it did distract my mind from the horrible waiting and wondering while I did the small investigation. Maybe the folks at CSC will feel some sympathy in the following couple of weeks and will process some of the pending applications that have been overlooked for whatever the reason.

:protest: It's been 120 days for me and NO TOUCHES. I wonder every day if they've lost or misplaced my application. But then there are a few others still waiting for a touch from June and July. For some reason some cases get touched alot and others that get approved within a "reasonable" amount of time, while a few cases each month seem to get left behind for one reason or another. I've tried to figure out if there's some type of pattern such as country, age, divorces, prior K-1's, etc. No pattern at all. Just the way it is. Hopefully your petition will be one that gets approved quickly and you won't have to wonder about it much longer.

Last week I was touched twice (Nov 14 & Nov 15) but no change in the the online status. This happened to at least 2-3 other VJers and on Monday the NOA2 came in the mail for them while still showing case pending on the online status. I checked my mail Monday Tuesday and today, but nothing.



So I called USCIS, using the RFE prompts to get a person at CSC. I acted confused and told a little white lie. I said I was confused because my case was updated online and for a breif moment showed I was getting an RFE , but minutes later the status was back to case pending.



She then volunteered that I was approved on the 14th but the notice had not been sent out. That she would have it sent out. Without the NOA2 in hand or an update on the system I am nervous about celebrating just yet, but I think I"VE BEEN APPROVED! :dance:

Would you mind teaching me your trick of getting someone on the phone that would actually tell you something more than "you case isn't past 6 months yet so please call back when it is"? I've only called two times and both times I got the same song and dance from them. Even though my application is over 100 days old and not yet approved, they will only tell me to wait until my application is 6 months in their system.

:hehe: If we are all to be honest with each other about this process.. we all want OUR applications approved. If you're a September or October filer you really don't care if there are any applications still open in front of you.. be they March, April or August. You only want your application approved.. and this is a normal way to think about it. I don't fault anyone for wanting their applications done as quickly as possible. I don't really care if USCIS is already approving September applications. But why not finish up the remaining people from the previous months BEFORE you start on a new month. There's nothing special or even unique about my application. My fiancee and I have no police record. Our names are not common names like smith or jones or brown which might take a name hit. While we all can speculate on why some cases are approved faster than others.. the bottom line is that there is NO rhyme or reason to it. Most of the delays are a result of stupid mistakes USCIS makes. A man posted here yesterday that his application is held up because USCIS is saying they will deny his case unless he provides a waiver to explain why he's applying for a second K-1. The poor guy has NEVER applied before. This is his FIRST time. So he's delayed because he now has to explain to USCIS that they made a mistake... and we all know that USCIS doesn't make mistakes, right? My point is.. Any application still pending should have priority over any of the new ones. Sorry.. but that's the only fair way to do it.


That's a bit of an unfair assumption. Just because a person wants their own petition approved does not mean we don't care about the applications infront of us. The simple fact is, we can't do anything about the applications infront of us. We can cheer you guys on, we can offer support, but in the end, that's all we can do. It doesn't mean we don't care.

And you're right, there is no way of knowing why something gets held up. You are right that there are mistakes, but what isn't right is the assumption that they should sit and twiddle their thumbs rather than continuing to process other applications in the mean time.

So an approvals officer is sitting with an application on his desk pending a name check or an RFE. Well, it's unfair to do anyone who came after that application, so he just sits there until something happens on those applications. We'd have an even worse back-up than there already is with applications if the world worked that way.

Sometimes it isn't about being fair, but being efficient. If that officer can finish five other applications in the time it takes to get information back on the first application sitting there... more power to him. That's five other people who got their approvals and one person waiting.

Edit: I do agree that if an older application has all the information and isn't waiting on something holding it up, it should have priority over new applications.





:blink: Good points but please tell me what's efficient about USCIS? There are enough applications still pending from March, April, May, June, July and August to keep everyone busy at USCIS. All of those pending applications aren't in name check and all of them aren't being investigated for this or for that. Some of those applications are just sitting there with no attention to them at all. That's the part that irks me. There are enough applications pending to keep USCIS busy without inducting more applications into the process. I agree with you that if all of the pending cases have something special about them that needs to be checked, then there's no reason to have USCIS twiddle their thumbs while waiting on a reply back from someone or somewhere.. BUT... we both know that all of the cases pending do not have anything special about them that would cause delays other than USCIS just being not efficient. I want to see what your attitude will be and what your patience level will be when almost all of September's applications have been approved and yours has not. Just imagaine for a moment how you might feel as you see all of those who filed with you and after you being approved and there you sit, waiting and waiting. So all "assumptions" aside... cheering me and other pending applications along does not get our N0A2's sent to us. I appreciate your comments and your thoughts. Best wishes for your future.

I also noticed that some countries get through faster then others.... but on the avg it seem around 60 days from NOA1 to NOA2 ...

Yes, most of those were affected by the IMBRA fiasco but many of them are still waiting even though they've sent in the information on IMBRA. And while many of August filers have been approved already, not all are there yet, including mine. My N0A1 date is 10 August 2006 and I've watched as many who filed after me in August have been approved and moved on. Heck, some of those who filed at the same time as me have already cleared NVC and have their P3 and P4 and interview dates already. I've been very anxious as I've watched my fellow August filers get approved while my case lies dormant. No touches since filing. And now I'm seeing September filers being approved. Hmmm.... seems a bit like standing in line at the grocery store waiting patiently to be checked out while others who came into the store after me are being pulled to the head of the line. Am I ticked off about it? Sure I am, but I'm not mad at the people who file their applications. I'm upset with USCIS for not having some type of system that allows for a first in, first out instead of just grabbing any application and approving it, with no regard to when it was filed or who's being bypassed. I'm at day 90 and still waiting... although I'm not as patient as I have been and I'm getting less and less patient as I continue to see people who filed after me being approved. Nothing personal.. this is just human nature.


Yes, there are March, April, May, etc applications still waiting, but bare in mind that the Feb, March, April filers now can complain because they are rightfully outside of the processing times. Yes, there are June, July, and August filers still waiting. All we can do is speculate as to why some applications get through while others are held up. It could be an infamous 'name check' or it could be a more complex case, or it could be any number of anything.

I did a quick lookup yesterday of March-September on how many applications sent in and how many approved. There were 130 applications currently in the VJ system for August. Of those, 103 are approved NOA2 as of this morning checking. That's 79% of all August applications. As you go backwards into June, July, etc, they are generally over at bare minimum 75% complete with each month. Of those left, I'm sure a handful of people just don't update on VJ anymore or have left and never will. So really it isn't unrealistic to start looking at when early September approvals will be going through.

Thanks for your response. Yes, I can call the NVC myself and have. They don't have any receipt of my petition in their system yet. I was just asking my question to find out if anyone else had gotten an N0A2 that said something similiar to mine. A couple of people have already told me that their N0A2's said that their petition was going to the NVC and gave guidance to that effect. Mine did not. Thus my question about it.

I was approved by email on 27 November 2006. A week later I got the hard copy N0A2 in the mail. My N0A2 says, "The above petition has been approved and forwarded to the listed consulate. Please contact the consulate with any questions about the visa issuance or if you would like them to forward the petition to a different consulate." Has anyone else gotten an N0A2 like this that says your petition was sent to the consulate, or do all of your N0A2's say they were sent to the NVC? Does this mean my petition has gone directly to the consulate and bypassed the NVC? Thanks for any responses... because based on what I've read here on VJ, it seems most petitions leave CSC and go to the NVC, right? :unsure: :unsure:

There is nothing in the rules/laws that state that. Where did you hear about this?


I have a friend that was going to try to go thru the K-1 visa process and went to an immigration attorney. He told her about the large savings amount that the foreign fiancee must have so she is getting married and then applying for the K-3 instead. I was just wanting to know if that was true. I have never heard that. My fiancee does not have the $10,000 pounds in the bank that she mentioned. I don't want to get denied because he does not have that kind of money in the bank. He lives in England and we are anxious to start the visa journey but don't want to get held up because of that. Any help anyone can give us would be great. This forum has been a great help to us.

I have a strange question that I am sure has been asked many times before. My fiancee is coming for a visit in May after coming for 3 weeks in March. We are going to get all of our documents together for our K-1 package and mail it off. My question is this...does he have to fill out the Dept of Homeland Security form online again?

Hi there! I am new to VJ and I can sympathize with what you are going through. We are filing for K-1 in May when my fiance returns for another visit. He has only beeen gone 3 1/2 weeks and it feels like 6 months! He is coming back on May 22...33 days from now. It feels like an eternity. I want to get this process started, but he needs to get his new I-94 number when he re-enters the US from England and bring all the stuff we need to copy to submit the paperwork. I am going to the UK in August and hopefully by next spring we can be married. You guys here on VJ are great for information and support! And yes Skype is fantastic! it is not the same as being there in person, but it will have to do until we can be together forever. Plus we can print a call log off to prove an ongoing relationship. Yahoo Messenger doesn't do that and we kept getting booted from there anyway. We met in Yahoo chat so we still have a soft spot for Yahoo, but Skype is so much better. If we all band together and be strong we can all get through this. Thanks to everyone for all the great help and support! Hang in there everyone!
