K-1 Fiance(e) Visa Process & Procedures	Visa Denied today!!! HELP!!!!	My fiance went this morning and did everything through fingerprinting. Then he was called to number 17. First let me tell you, my fiance is 12 years younger than me and this is not my first 129F application. Back to 2008 I filed for a sucker (excuse my french) then he came in March 2009, he took off after getting his 2 years green card. I sent a certified letter to CSC that approved the AOS and one to VSC which is my jurisdiction and one to my local office (Boston). I even went to Boston office twice to let them know that I don't know his whereabouts and the copy of my divorce filing. I met my fiance now, we are so much in love. We went in Dominican Republic for the first time 10/06/11 and went again 05/15/12. That same day I arrived at the hotel, I received a call from my sister in Boston, that my mom passed away with heart condition. I couldn't find a flight back on AxA to Boston right away, I bought another ticket through Jetblue to proceed with mom's funeral arrangements. I filed for my fiance on 07/10/12 which I thought the process will go faster and VSC took forever. I thought of traveling to Haiti but I said what about if NOA2 showed up...all these crazy thinking. To get back to the interview process today, those are the questions: 1. Who's sending for you? My fiancee so and so 2. How did you guys meet? Social network... 3. How many times that you saw your fiancee? 2 times in Dominican republic October 06, 2011 and May 05/15/12, we stayed at this hotel..... The CO said I see 4. She didn't come to see you in Haiti? No, because we chose to go exploring somewhere else(DR) 5. Have you met her family? Yes, I met her brother (first and last name) who came to Haiti in July 2012 6. Did you know that your fiancee was married twice before? Yes, and she got divorced 7. So what happened to the second marriage? The guy took off and she never know his wherabouts then she got divorced Then the CO said "Ok Mr X(my fiance), you are not qualified, this not the end of the world. You can still get married. I feel that this is very insulting. Does Immigration can tell me how many times to get married? Does Immigration can tell me "Hold a gun on your fiance's head to stay with you? Does Immigration can tell me or my fiance "Marry someone your own age? Does Immigration can tell you to look for someone in the states and make sure that someone has a green card? I only filed I-129F once and the relationship went bad. I worked in my job for 23 years, I paid taxes and never been in jail or either been accused for domestic violence. Never, Never, Never so I leave any comments or suggestions from you VJers for me what's the next steps...Thank you and I am very Saddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddd. Should I go to Haiti and get married? but my fiance said to me" Baby, I am afraid if we go the I-130 process, will they look at it the same way. He said again "Baby I swear that I answered everything, all questions" He added "I feel bad that outsiders look at Haiti as a poor country that people might use other people to enter the USA but one thing, the CO deny the real lovers" That breaks my heart and my fiance said to me "What about if you come to leave with me because I know in my mind, there was no such thing and I want to prove them that Denying us can't break our relationship. I am very sorry you all are going through this. I know what you are feeling. My fiance now husband and I was apart over a year. Find out if you can the reason for the denial and go from there. K-1 Fiance(e) Visa Process & Procedures	Do my own background check?	After reading your prior posts at some of the China specific sites, I would say that Marc has probably given you some sage advice. There are a couple of big red flags in your case that Guangzhou will focus on and including the death certificate of your fiancée’s former husband in your initial petition will help address one of those at the very beginning. My guess of Marc's recommendation to perform your own background check is just to rule out any other red flags - not sure if he actually wants you to include the results in your petition but rather just to rule out any other potential/unexpected issues. The csr was very nice to me and said my case is pending for another 33 days and to call back then. He also said the uscis has bumped the processing time for I130 to 6 months. I told him how come their web site says 5 months but he assured me I could hear something before the 33 days. K-1 Fiance(e) Visa Process & Procedures	Driving in the US	Hi guys, sorry to make this almost-certainly duplicate topic, but I wasn't sure what phrase to search for. I'm moving from the UK to the US in about a month. I've never driven before, but I will really need to where I am moving. I know I can't work until I get my EAD, so the need to drive is not immediate, I just need to know what path to start on. What documents do I need to take a test/start driving in the US, or at least get a learner's permit? At what stage can I start? Do I need my SS card first, need to get married first, need to have applied for AOS/EAD first, etc? I'm moving to Texas, if that is important. K-1 Fiance(e) Visa Process & Procedures	can someone please give me some advice?...or at least calm me down :)	ok...here's what's going on...on may 20 my fiance paid for the interview fee at BPI...may 25th, made online appt for our K-1 interview...our appt was scheduled for June 24th. i get a confrimation letter with UID # and date and time of interview, etc......all is good so far...ok, then we decide to change the delivery address of the visa after it is approved, so we call the embassy in manila, and they have no record of our interview appt....nothing..nada....and said they could set us up an appt in August...???????????, now i expalin how i have a confirmation number, not to mention i have already booked a flight to attend the interview with her, and made hotel reservations, and taken vacation days from work...what should i do??...i emailed them a copy of the letter and they give me the same reply( we have no record of it in our system)...any suggestions?..i want that appt on june 24!! K-1 Fiance(e) Visa Process & Procedures	Question about Notarization of the Affidavit of Support...	I think I would not take chances on them questioning anything. I would look for another notary. My work notarized the documents for me free of charge. Most banks will do free or very small fee. BTY I am switching to Wachovia cuz I had to take my statements to my bank for them to prepare the letter then they did it free of charge but for the one month I had misplaced they charged me $1 per page. $5 total but if I had not had all my statements it would have been around $100. K-1 Fiance(e) Visa Process & Procedures	Plane Ticket	Just FYI from Egyptian Air......It does not say that a round trip is a requirement..but it says if you fail to comply with the laws and regulations of the departure country they can refuse you carriage. My Fiancee had his Father call and check and was told with a K1 visa you are REQUIRED to purchase a round trip ticket. Maybe they lied to him I do not know but I will pay the extra $400 for the round trip rather to take the chance they refuse carriage and a refund of the ticket you already bought. I know his Fatehr was told it is a require ment of the government not the airline. But of course it is not written law anywhere. SO maybe the one way will work. My personal choice is I have waited this long I will pay the extra $400 to make sure nothing can stop or delay him. Cheryl That's interesting to me, and I'm curious to understand how that works. While I've been to several countries, I've never been to Egypt. And of course I always see things from a USC perspective. I didn't realize that some airlines actually look at the documents you would need to legally enter the destination country. When you buy a ticket from an airline, you are basically entering into an agreement that they will transport you from one airport to another. I didn't think that they concerned themselves much about what happens after you deplane at the airport.....they've fulfilled the agreement. Yes, they provide forms that you can complete and give to Customs, but that's about it. And if you are denied entry to the U.S. Are you saying that you are required to show the airline the visa that you will be using to enter the U.S. before they will allow you to get on the flight? I guess I'm not understanding what interest the airlines have in what type of visa you have or even if you have one. Or, am I missing the point? When you say "Egypt", are you referring to some governmental regulation or requirement? I'm just a slow country boy, so I apologize if I'm not as worldly as some, but I'm interested in learning! Well I am not sure of all the details....but from what I am told it is an Egyptian Government regulation. But that is what we are trying to clarify.....to make sure. He said since Ahmed is not required to go to military maybe he can get one way ticket. I told him call airport anyway to make sure. SO have your Ahmed check with militray people too I guess. K-1 Fiance(e) Visa Process & Procedures	Plane Ticket	Sorry Lynn I was preoccupied yesterday and did not look to see where I had seen that info before. I will look tonight when I am off work. If you have not heard from me before tonight remind me. But as I told you the other day I saw a few posts a while back about it being required to be round trip for K1 visa in case the wedding does not happen after all........the immigrant has no excuse of not having passage way back to Egypt. One post said she even called the airlines. I think the place to start is to have Ahmed call the egyptian airport and ask them if there are any such regualtions even if you are planning to buy the ticket on your end. Just to be safe. In the posts I read before I read they will not let them board the plane without the round trip one. I am also going to call our airport that Ahmed will be flying into to make sure it is not an issue here on the USA end. Another place that may know is the National Visa Center or USCIS. I just remember reading about it somewhere. I just cannot remember where. But I will need to make sure also............so I will be looking into it. Just had no time to do it yesterday. I included pictures of me with his Family so they would know i had met them and they approved of our marriage. Emails we sent around 3 to 4 for each month. Also we included our skype call log. I read the fine print on the forms and it said if it does not fit when you type then you can print them without the names and use black ink to fill the names in (Print) so they fit better. I am not sure if 5 will fit or not. Print extra forms in case. We dropped some of his. But all 3 of his middle names are the same. So we used his first name, one of his middle names and his last name. We had no problems for doing this at the USCIS or NVC level. However, to prevent problems at the embassy level we sent his birth record with translation to the Consular with our packet 3. Good Luck ! Hope this helps you. K1 costs around $455 right now to file.....then there is the medical exam and the costs of translations required by the Embassy you will have to do there in Egypt.....then once you receive the visa you will have to buy the ticket to USA and then once here you will pay $1010 USD for AOS Greencard. I think you writing a letter telling you met on a game site which does not allow you to save conversations and explaining how your skype account got hacked so you both closed them is okay. However, I think you need to include your flight proof and lots of picures from your three trips to Egypt. Also I think you need to make it a point to get online and chat from MSN, skype, yahoo etc. to have some records for later. Also we had the call logs from our skype account where we used it to call eachother. However, during his interview my SO was asked if we had an Orfi and he told them yes and from that point on they called him my husband in all emails. But he is here now in the US with me since April and we have filed our AOS and just waiting. Basically all they want is you to prove you have a realtionship. Three trips to Egypt is good. If you still have your proof of them. We had all.....2 trips to Egypt, phone logs, letters, emails and chat logs. Also, we made sure to include pictures of me with his Family so they had no doubt that the family knew and approved of our marriage. I hope this helps you and I wish you luck. The people here will help you with everything and you let me know...we can have the papers filled out in a day...just go ahead and tell your husband to go print out the biographic forms and sign them...he needs to get them to you asap....may cost a little bit, but it will save you a little time...also, make sure you have everything from your husband, marriage certificates (in english)...birth certificate (english translated)....just talk to me...and i will give you a list of everything... oh and guys...yes, she WAS married when she went to the lawyer and told him that she was married...she had no idea of anything else other than what the lawyer was telling her. hugs Tiff	jade2004	Female	Jordan	2007-08-29 20:47:00
