Yes, you can reapply for the same person. I don't know how soon though, seems like I saw a post in another thread saying there could be a law about a 2 year wait between applying for a K1 visa for someone again? Might want to be sure about this though!

Did your fiance overstay the 90 days or did they simply leave before the 90 days was up without marrying you? If they overstayed there could be problems as an overstay is illegal. If they did leave before the 90 days was up then there shouldn't really be problems but there may be questions as to what happened.

No, it won't help, sorry. Keep in mind that this process can have its ups and downs as far as delays, so if you have planned a wedding and invested money in it be careful because if there is a big delay in your application this can put a big kink in the plans! Just a word of warning from someone whos mother almost lost her mind worrying we would lose money on what we've invested in for the wedding if the visa didn't come in time :)

Yeah, I think all documents have to be submitted in the mail but I only base this on the fact that I've never heard of anyone faxing documents to London. Like Adele said, they won't start processing your Packet 3 until they have all of your documents so you're best waiting anyways.

Well, in order to give you the best advice it is helpful if you could give information as to the previous petition and how long ago it was filed. I'm assuming since your fiance faxed information to Manila that his previous fiance had already received their NOA2 and an interview at the Embassy? If so then the NOA2 approval will expire four months from its issue date and if his fiance did not attend their interview the Embassy would have just let it expire (I don't think I explained this well so someone correct me if I'm wrong!). Faxing a letter was a good idea as there could be serious questions at your interview as to why the first petition was cancelled and what happened and these could be worse if no notice was given about the first petition. I would try to call and email Manilla about this.

People don't get denied just because they forgot to write names on pictures, etc, they simply receive RFE's (or request for evidence) to fix these problems. If they are fixed then that person will get an approval from the USCIS and will be able to proceed onto the NVC and Embassy stage where hopefully a visa will get issued. It is absolutely worth it and if you follow the guides on this site you have greatly helped your chances at a less stressful and hopefully easier approval. I used the guides on this site to avoid making common mistakes and we got our visa without any issue. Our case was uncomplicated though and some people do have cases that are more difficult and may require an attorney but for most the process is far from impossible and while sometimes very stressful is absolutely worth it in the end! :)

EXCELLENT point. If you want her to come here on the K1 visa the only way she can work is to get a temporary EAD at her POE, and even this will not work until she gets a SSN (can take upto four weeks to get I hear, maybe longer). So, she would be able to be here working for approximately two months, if that.
What you are suggesting sounds very much like fraud to me. The K1 visa is for people who intend to marry, it isn't a try things out for awhile visa.

Hi,
I am filling out the G-325A, Biographic Information form using Adobe Acrobat 6.0 professional on my computer. Since this form contains four set of the same form to be fill in, I was able to completed filling in the first set with Acrobat. However for the next three set of the same form, I am unable to fill in the information with Acrobat. Look like I have to hand write in the information which will not be as neat as typing them in using Acrobat. Does anyone have this problem with filling out the G-325A? Is there a way which I will be able to type in all the information for the four set form within the form?

When I filled out my G-325A forms it automatically filled in the other forms. They are the same after all. Suggest if you are still having problems just print out the first form 4 times or make copies. Not exactly brain surgery.

Each of the forms may have the same information about the petitioner typed in but if you look at the bottom of the forms there are different things written on them (page one has (1) Ident, page two has (20 Rec B.R., page three has (3) C, and page four has (4) Consul). So, the pages are NOT all exactly the same!

While all the information that the petitioner/beneficiary are required to fill in is the same on all four pages of the G-325A, they are not all identical. You'll notice the bottom of each form (parts not to be filled out by those applying) are different from page to page. I wouldn't expect USCIS to accept four copies of the first page only... has no one had problems because of this?

Yeah they're people but you're also paying them big bucks to not make the mistakes when you could have very well made the same ones yourself for free! :P I'm just not all for lawyers unless your case is unusual or very complicated, with the right advice from somewhere like VJ you can do it yourself (for free!) :)

Others have obviously answered that it is NOT ok to get married while filing the I-129F. One thing that I'm not sure you're aware of (but you could be) is that once you are married you will have to file for Advanced Parole, which could take 2-4 months or more to get, so she will not be able to leave the country until she has this. So, any weddings in Cambodia would have to wait a few months after your legal wedding here in the states.

Hi everyone,

I am really confuzed about the processing timelines. After over a month, Nebraska updated its page yesterday.. but for only 2 weeks, from Dec 21 to Jan 7!

We received our NOA1 on Feb 22nd so given this pace, that would mean that we can expect our NOA2 in about 3 months? On the other hand, visa journey gives an average of 70 days from filing to NOA2 (link below) and I noticed that some people that filed past the date given online, already received their NOA2..
this is really confuzing and frustrating, we can't plan anything.. I need to give one month notice at work so I would love to at least have some kind of idea. does anyone know how this really work and what timeframe to expect?

You will know plenty in advance to give your one month notice because NOA2 is not approval, it is merely a step in the chain of events. Once you have your NOA2 and have passed through the NVC you'll go on to the Embassy stage, and the embassy will assign you an interview date (the date for the final approval of the visa) and you should hopefully have this date awhile in advance before the actual interview. However, I don't know anything about the Croatian Embassy. If you are worried about knowing in advance you should research timelines for Croatia to see how far in advance people were notified of their interview date. If worse comes to worse you have upto 4 (or maybe it's 6?) months to use your visa once you have gotten it approved at the Embassy, so you can always get your visa, give a one month notice at work, and then leave for the USA after that month.

We did not have an attorney and got approved without a hitch. I also had to have a cosponsor, it really was not a difficult thing at all. All you do is have them fill out an I-134 along with you and submit the evidence required for it (along with your evidence). You can do it without an attorney, all we had was this site! :) Oh and no, your parents will not be interviewed. All that is required of them is the I-134 and the supporting evidence with it (the evidence is listed on the form but some Embassies ask for other stuff but they will let you know about this).

All documents, except passports and photographs, must be submitted in single copy, with the original document or certified copy bearing the appropriate seal or stamp of the issuing authority. If only the original of the birth, marriage and/or other certificates is available, the applicant may submit one photocopy thereof but must bring the original(s) with him/her to the interview for inspection by the consular officer.

You can just contact the Dept of Health (at least that's where I got mine) and they will give you a certified copy, this is what would be considered "original" (the real original is locked up in a vault somewhere unaccesible to you). He may not be asked to present it but it is always a good idea to be sure that your fiance has originals of all official documents you sent photocopies of for your original petition :)
