Well, I did finally get a letter of consent from my daughters father. My daughters half brother pursuaded him to write one. Only thing is, it isn't Notarised, and he flatly refuses to do it. Now I just don't know what i'm supposed to do with it.

These things are here to test us indeed!

I have a residency order, which is basically custody. He does have parental responsibility. We split up in 1994 when my daughter was 2. I moved to the Isle of man 6 years ago, the year I moved here, i paid for my daughter to go and spend christmas with him. Since that visit, he moved/changed his phone number and hasnt spoken to, or seen my daughter since. She was 9 then and is almost 15 now.

Was only the end of last year that I happened to get his phone number.

He has never paid any child support since we split, we were never married either.

I just have a really bad feeling about it all.

Considering that he doesn't pay child support AND hasn't seen your daughter for 6 years I think you MAY be able to get around this. You have a residency order already, which gives you custody. If you could go back to a solicitors and get them to write a letter outlining the fact that your child's father refuses contact, doesn't pay a penny towards upkeep AND hasn't seen her for 6 years, also adding in info about the custody arrangements, that could be enough.

However, if I was you, I'd contact the embassy with ALL of this information and see what they say. They are the only ones who can tell you what you need, none of us here can really give you a proper answer and this is the only way you will know anything for definite. We can all guess and tell you what they have told us for OUR particular circumstances but, as we all know, every case is a little different.

I can't see how you can be expected to get a letter of consent from him when you don't even know where he is AND he told you to get stuffed over the phone. Contact the Embassy again, see what they say.

Packet 3 information regarding the children of couples that were unmarried is totally insufficient. They actually need/request far more than they mention in P3. This is where London lets itself down, IMO. They need to rewrite that particular part of the information form to give better details regarding this whole area.

Samwatts ~ All Notaries are Solicitors in the UK but not all Solicitors are Notaries. They can also be Barristers of Law, which is a fancy name for someone who practices law at the bar. Before you get your knickers in a twist check that your solicitor isn't one. He/she may have been and you may be worrying for nothing.

If your solicitor isn't a notary I don't think anyone here is qualified or experienced enough to give you information about whether or not a solicitor's signature is sufficient. Email the Embassy and ask them.

Just got off the phone with them, they say I have grounds for an official complaint both to the Faculty Office and the Law Society.
They said the two roles are not in any way related and should be addressed seperately unless of course we had asked him to draft a letter as a solicitor and then notarise it.
Problem being that I leave in two months.
I think what I'm going to do is write an official complaint and have it lie on file....


Definitely follow up on this. Once you move you can always change your addy for the correspondence. If I was you I'd go with the recommendations and make my complaints to the Faculty Office and Law Society. Keep us posted!

I am now foaming at the mouth.
After speaking to the notary, making an appointment with him, my son's dad turns up for him to notarize the letter.
Now, as some of you may know, all notaries here are also lawyers.
Anyway, when my son's dad passes over the letter I typed, the guy reads through it and tells him in his opinion, he advises him NOT TO SIGN IT because if I 'were to disappear' he had 'signed his rights away'!!
He then gives my son's dad a name and number of someone who can 'draft up a proper agreement with all neccessary terms and conditions'....
I'm like #######???????????? What TERMS AND CONDITIONS???
Number ONE, we were NOT married, so as per UK LAW I don't even NEED a damn letter!!
Number TWO, all he has agreed to is that my son can live in the States permanently!!
Number THREE, this appointment was NOT a legal consultation, the CONTENT of the letter was NONE of his damn business and NEITHER was his advice SOUGHT!!

LUCKILY my son's dad still went ahead and signed it.

Called the notary society to make an official complaint, have to call someone back on Tuesday.


It is poor form but, unfortunately, the solicitor felt he was probably only doing his job. But that's the key here, it was his job as a solicitor NOT as a Notary. I'd write/call to the Notaries Society and see what they say. Let us know how it goes?

If they say you need a letter when you call the Emabassy, could you possibly ask them how they want it worded?


My letter, which was requested from the Embassy, said:

I, xxxx, biological father of xxxx, hereby give my permission for him to emigrate to and live permanently in the United States of America.


When the Embassy requested my letter, they specified that it must be clear that he gives permission for my son to emigrate and reside permanently in the USA.

When the letter was signed by my son's father, I gave him two copies to get signed, one for my records and one for the Embassy. I paid for the notary aswell, my son's father did not. In fact, I made the appointment aswell!

Dawny ~ From what you have said I think your solicitors letter will suffice. Take it with you to your interview. When they ask you about it at the interview make sure you tell them he hasn't seen her for years and he is not on the BC.

Personally, I suggest that you contact the Embassy and ask them what they exactly require for you and your particular circumstances. It is the ONLY way to be sure and may just ease your mind a little. Good luck!

Hi there,
I hope you don't mind me jumping in here but I've been worried about this issue with my daughter. Her father is not mentioned on the birth certificate and has only seen her once since she was born (she is now 3). My OH and I are using an immigration lawyer to process our K1 and he has never mentioned anything about getting an official letter from anyone about parental consent... should I get one somehow anyway? I'd hate to trip up somewhere!!! :blink:

If he is not mentioned on the BC and has had no contact with her then I don't think it is a problem. However, seeing as you actually have a lawyer it would be good to mention your fears to him/her and ask some questions regarding this issue. After all...this IS what you are paying him/her for! ;)

You're probably not going to want to hear this, but I was never married to my son's father and the written letter from him wasn't enough. They wanted a notarised letter from him instead.

Additionally, I was told everything was okay during the interview and that the visa was being issued. Two days later I got a letter from them requesting the notarised letter.

I'd say this to anyone, if you still have contact with your child's biological father (and he is approachable to the idea), for the sake of 70 quid...just get a notarised letter done.
