I'll just say what I usually say when asked this question. It depends on YOU. Some people are great at filling in paperwork, others not so good. We all have strengths and weaknesses and we are all different. What one person thinks is easy another might find really difficult.

So, OP, you are the only one who can truly answer this question really. If you feel confident enough (and your case is straightforward) and you are good at paperwork filing then you might be able to do it yourself. If you don't feel confident enough then a lawyer might be the course for you.

One thing I am going to ask you to consider is "aging out". Many children of K-1 applicants, when applying for AOS, "age-out" before the card is issued.

This is something I recommend looking into before you bring the son over here. There is a member here who had to fight tooth and nail through the courts to keep a child here who was under 21 at time of application, but over 21 during AOS. I'll see if I can find it.

Filing for a K1 considering with what you said above constitutes fraud. And if you plan on going back to the Ukraine, come to the US, do the class, then return to your girlfriend and the Ukraine.

If you do file for a K-1 you have to get married within 90 days of her arrival into the USA. If you don't she has to leave and return to the Ukraine.

Nope. Unfortunately, USCIS do not have a "boyfriend/girlfriend" visa, so you have the option of getting married, returning to Canada and filing a K-3 or proposing and filing a K-1.

Perhaps you could have a word with your work and get them to sort out additional paperwork for your work in the USA which would enable you to to continue to cross the border for the duration? I would have thought you'd have a work type visa already?

If that can be arranged then I would have thought you could continue to travel back and forth for your work.

No one on VJ should ever tell another person to NOT use an attorney. Everyone has different cases and different abilities - some of us are good at paperwork, others are not. We don't know a persons strengths or weaknesses and thusly shouldn't tell them what will be best for them. Only THEY themselves can judge that. wink.gif

To tell someone outright that a lawyer will screw them over is just plain wrong. VJ is not against anyone using legal advice regarding immigration at all - in many cases it is the only route to go.

I think her problem is that she doesn't have a job now as she has just resigned her position. She hopes to get some work when she gets back from visiting her fiance in August.

Like Devilette, I suggest bank statements, but I'd also suggest credit card bills and a letter from your mother, saying that you are living with her and will be returning to the UK after your August visit. Make sure you put in dates aswell.

Your fiance will have the NOA1, so it might not be possible to get it over to you in time for your trip. So, have the case number handy incase they ask for it (probably won't happen, but it's a good idea to be safe).

Actually, marrying your cousin isn't quite the same as marrying your mom/dad/brother/sister. By the time you get to cousins the genetic similarities are "watered" down to an extent where you are not genetically similar enough to cause many (if any) problems.

Well if you only browse the most recent pages, its probably going to be fairly civilized....because its just a bunch of crying and whinning babies that have been reminding everybody everyday at what day in there process they were, and its the 5-6 same names all the time...

Most of them have received a sign or an approval so it has calmed down, but for the last 2 month until 3 weeks ago it was pretty much pathetic. I did make a final post to try to wake them up from their stupidity ( like bashing people that filed after them because they were first in line or claiming the unbearable wait after 6 weeks blink.gif ) and all I got is stupid replies like a bunch of girls smoking weed hallucinating butterflies in their fairy world. Yeah this site is meant to support people, but they are not even opening their eyes on this immigration process, they are just crying like a bunch of babies in a kindergarden.

Of course now no one else posts in that thread anymore other than them, few rare posters do but you can tell they just give update and don't read them, and its pretty much a yada-yada thread now. Even the number of pages they have compared to the other months shows the huge amount of insignifiant posts...
