Thanks alot my good VJers i will get back the originals this week God willing.... But still why did they say i will get back my original documents back at the time of interview that baffles me alot.

They say they will give you the originals back that you bring to the interview, not the originals that have been sent to USCIS. My wife just had her interview last week and this is what they did. Where the consulate asks for an original they also need a copy. The copy is put together into a packet that you turn over at your POE. The originals you get to keep but you will need later possibly in your never ending processes with USCIS. Most US county offices that have your marriage and birth certificates have a website or a phone number you get get vital records sent quickly. Order two copies of each so in the future you will always have a spare?

Our I-130 was approved and sent to NVC and then about 2 weeks later the NVC sent me and my wife letters from NVC about naming an agent for sending documents and the fees and such to process the CR1. At about the same time our I129 was approved and the NVC sent it to the consulate. This is why we went the K3 rout becuase it was faster to bring my wife here. Anyways, for the CR1 you should have been getting information from the NVC to continue with the CR1 process.

Your medical report will be sent to USCIS from to POE officer so dont worry. All you need to do is call a Civil Surgeon and discuss your immunization requirements. I have also read that the TB skin testing may be required now even if you had an x-ray but we are waiting to see if we get an RFE from our AOS on this. You can go to https://egov.uscis.g...office_type=CIV to locate one near you. I would call them and they will explain where to get your vaccinations and which ones are required as well as answer your questions about the TB testing.

The NVC does charge for processing the 864 becuase i did get a bill when my i-130 got there before my i-129 and I started paying the fees. My i-129 got there a month after my i-130 and I it went to the consulate very quickly and an appointment was scheduled. We chose the K3 because it happened very quickly once the USCIS approved it. I wanted my wife with me right away. I called the consulate and they were processing K visa faster than CR1 and I chose the faster route.

I had questioned my congressman office about when the I-130 is approved before the I-129F. But, can someone explain to me for entering the US as an immigrant rather than a nonimmigrant. If they enter as an immigrant I guess we do not have to change the status. I'm confused. Can someone help me on this?

Also, here is their response:

The K3 visa (I-129F) was created to help reunite families more quickly than the immigrant visa (I-130) process usually permits. Many of the I-130 petitions have been transferred to other Service Centers to reduce the processing time on these applications. Many I-130 petitions have been processed more rapidly than anticipated.

If your I-130 petition is processed more quickly than the I-129F, then this is good news. If your husband has his I-130 interview before his I-129F interview, then that is good news. It means he would enter the U.S. as an immigrant rather than a nonimmigrant.

I will continue to monitor your applications. The California Service Center states in emails to me that they process everything within 6 months of receiving the application. I am seeing them move more quickly than this.

I cannot at this point give you a more accurate estimate of timing on either petition. It is a very fluid situation within USCIS as they seek to process all application types at all Service Centers as quickly as possible.


From this email they stated appointments for each but not applications for each. They did not say that if one is approved before the other they would stop processing the one not yet approved?

I would never trust what USCIS information tells you. My I-130 was approved a month before my I-129 but we still had our K-3 interview go through. The CR1 still takes longer than the K3 because of the processes with NVC. Another thing to ask your consulate is interview dates based on what type of visa recieved. CDJ said 30 days from time of receipt on K visas and 9 to 12 months on CR1. Why this is I do not know. The NVC issues different case numbers to your CR1 and your K3. I wonder if USCIS isnt sending K3's to the NVC if they have an approved CR1?

Have you filed everything with the NVC yet?

An immigration lawyer should know this but a lawyer that is not familiar with immigration laws would not know anymore then the average person on the street. Ok they don't have the money for a lawyer, I understand. $500.00 for a K3 from a Lawyer is too cheap, they may have been told that was only for the I-130 application only or not?

They can file the rest themselves once the I-130 is sent to the NVC and pay the fees without a lawyer. If I were them I would be focusing on the 601 waiver letter because it will be what will determine if he is allowed to reenter the US. He will have to leave for his interview, it is his only option if he enterred illegally. Check out the link in the previous post from me and they are all going through the same process.

Our I-130 was approved in 66 days from time of filing but if you take the CR1 route you will still have a few mor months dealing with the NVC and then waiting on your appointment with the consulate. We chose the K3 visa because my wife is pregnant and getting her here ASAP was the most important for me. I am not sure why people say the CR1 is cheaper than the K3 because what I have seen they are within a couple hundren dollars of the same cost. The only extra costs I see are the EAD and the I-129 fee that is needed for the K3 but the NVC has a few extra fees. With the fee increases I am sure the cost differences will increase. Maybe with new technology the USCIS can speed up the paper process here on the US side and then the wait will only be will the consulates.

I'll pay them a couple of thousand dollars (maybe yen? or yuan? hehe).. if they can approve the visa in a week.. :angry: This will benefit both sides, will it not? I get to meet my baby soon, and they get more money (to buy their gold toilets with) to spend.. ^_^


I think we all would pay whatever it takes to get the ones we love here as quickly as possible. I hope USCIS will come into the 21st century and allow applicants to file everything electronically in the future. This would expedite the process and allow software to process applicants much faster and without human error. The only thing humans would have to do is deal with the issues like screening the attachments like marriage certificates, birth certificates, etc to make sure the are legit. The would have to reenter all the data from forms sent in because the application data entry would fill in the database. Maybe someday they will utilize the technology as well as keep up with overstays.
The problem with immigration isn't from families trying to be together in the US it is EWI's and overstays. This is what needs to be addressed. Technology can at least address the overstays by having their passport and visa data in a national database that if they are overstays anytime the show an ID they get located immediately. I think the general public would support easier means of entry in the US if they felt the government had control over who is here.

What you guys need to really compare is interview dates and not the actual approval dates. Everyone needs to remember the NVC has to process CR1/IR1 and the K-3 only passes through the NVC and gets to the consulate much faster.

I looked around the site and may have missed this question, so I will state it here as I really do not have a clue as to how to approach my questions/problem. Here it is: My fiancee (who is from Serbia) will be coming to the United States the later part of Sept on a work Visa (I think? as he will be working for the Serbian govt at the NY consulate). We then plan on getting married before the year is out. I gather I will then have to file for a k-3 Visa, but will that then supercede his other Visa? and will it be easier for us to get the K-3 one because he is working here under the auspices of his govt? I am like sooooooo confused, hence any help/advice will be greatly appreaciated.

PS. One more thing... there is a large age gap between us (me being the older one), so will this add to our problems? We have been together for two years and to be honest, he may not even want to stay in the states once he no longer works for his govt., but we do not know when that would happen, so I do not want our govt to think he is marrying me to escape his country.


You will be able to file AOS and I130 at the same time. Just plan ahead and put together all the needed information to prove your marriage is real.

FINALLY!!!! I just got off the phone with NVC and they received my 129F today! My approval notice was 4/17/07 .... hopefully things are starting to move!

I recieved my NOA2 for my I-130 in March and my NOA2 on my I-129 April 19th. On April 15th the NVC sent me the Affidavit of Support fee and a copy of the DS-3032 Choice of Agent form that was also sent to my wife in Juarez on the same date. I sent the fee in and my wife sent the DS-3032 form in. I called the automated system at the NVC and used the case number to access the status today. They say the received the DS-3032 but that is all. My question is does the NVC assign only one case number or is it different for the I-130 and the I-129 or are they tied to the same case number?

I noticed nobody mentions recieving their Affidavit of support fee or the choice of agent form DS-3032 that you should receive from NVC once the receive the approved case. I received a letter from NVC with these forms and my spouse also received the DS-3032 at her home in Juarez, MX. I sent the Affidat of support and the Fee to NVC in St Louis and my wife sent me the DS-3032 choice of agent form and I sent it overnight to NVC in NH.
The question I have is did the NVC send the the approval to the consulate right away or do they wait until they have the I-864?

I read the istructions and it said that only after July 30 you could direct file. I would be afraid that it would slow the process instead of speeding it up.

The ask for a copy of your divorce decree but it needs to have the clerk's stamp on it where it was filed. You will need the original later in the process when you have an interview and make sure it it is official one from the clerk's office. I have read where interviewers will question it if it does not have the official stamp from the clerks office.

FBI name checks should be a national security issue. Someone can come here on a K visa and be a terrorist and the FBI would not finish checking them out for years sometimes. Why can't they get a system working that can check fingerprints and names in seconds? Any data on a computer has global access. Once biometrics are done why can't the data be processed in seconds and if there is a hit on a name or fingerprint then a human can review the results if needed and done quickly so we don't have potential terrorists running around in the US.

There is a reason - the USCIS' current system would not support that. That's what they're supposed to be working towards after the fee increase, but the wheels of govt turn slow. We'll have to see how that develops over time.



Just Reading Reports doesnt mean its true. Bush's Sources reported that IRAQ had WMDs, but I guess they were wrong..... And Ombudsman is just a non working agency.... kinda like BBB for corporations, good in theory bad in practice...

Just think of the time it takes for people to get the mail, open the mail, enter data into the computer from the petition, make sure everything is correct on the form, make sure they sent the correct fee, and so on. This time and cost would be eliminated. Time also would be saved in transferring and reviewing documents because a central dadabase could be used. The savings in employees for data entry could then be used for more adjudicators which also would speed up the process.

All supporting documents could be scanned as attachments when submitted. This would give everyone their NOA1 instantly. Just think how many jobs could be cut at USCIS just by this process? The time in the current process spent transferring documents also would be eliminated. This would allow USCIS to focus on hiring and training adjudicators and not so much support staff that would no longer be needed.

If your US spouse dies before you complete your AOS and you haven't been married 2 years you will be deported.
