No translation needed on the vaccinations. They only need to transcribe them to the correct form. The Civil Surgeon would know the correct form. Go got the USCIS.GOV website and search for the Civil Surgeons in your area. I would call and shop for the best deal. Some will try to tell you he needs the whole medical examination, so tell him he only needs the transcription of his vaccination records. If he is missing any vaccinations, they would let you know.

Just send copies of the documents requested (NOA2 for your I-129 approval), not the originals. Make color copies of all the pages in his passport with information including the k1 Visa and the I-94 he got when he enterred the US. I would call the civil surgion that you will be going to and ask if they need it translated before you go. At the CS they will fill out the vaccination suppliment form that you will send with your AOS package.

Really the only one that could get in trouble would be the employer if they were caught. If they are using a valid SSN for themself and already have a job they may let you work if they don't ask for new documents? If you are trying to get a new job then you won't be able to work because you won't have the needed documents for employment.

The problem with Diana and I is that we are in a no win situation with phone calls because Diana's mom doesn't have a landline, she only has a cell phone. Can anybody answer my question about the boarder office??? if thats the name of it, and if thats where alfredo needs to turn in his packet of papers. Please? All i know is that alfredo has to turn those papers in at his point of entry so that he gets his I-94 stamped in his visa or w/e, im assuming that they are going to give him more information when they give him the packet. Congratulations everyone! I'm glad to hear the new consulate is open, it is a little safer area there. My wife just flew to Juarez Wednesday to visit her family for Christmas. I am driving down on Monday and spending the week of Christmas there. It's sad that it is becoming so dangerous there. I talked to my wife yesterday and her family told her it just isn't the same there, you have to be careful everywhere you go. It is a gray area about K1, according to the rules and some of the other long time members you only have to marry before the 90 days, a waiver is needed only if you marry after the 90 days. Applying for AOS does not have to be done within that timeframe. You wont be out of status as long as you marry within the 90 days but you are stuck at home with no way of working, driving, school, anything until you start the AOS process.

The is not set time to apply for the AOS if you are a K1. The only rule is you have to be married within the 90 days from entering the US. Just make sure you keep a copy of your marriage license with you once your I94 expires because that is proof you complied with USCIS rules. He won't be able to do anything like get a license or work or travel outside the US until you get your AOS, EAD, etc..

Thanks for the advice. When I was in Oaxaca in July/August, I organized all of his stuff very nicely in one of those nice plastic expandable file folder things. He's got everything in order and knows what forms to give them. We (I) organized all the copies of our evidence by year (we have a nice amount of evidence, I think) and included any originals of the evidence that we have in two large manila folders. We've gone over all of the questions that they seem to ask, so he should know all the answers. He's never been to the U.S., never done drugs, never had problems with immigration, etc. and so I can't imagine what they would deny him for. We met over three years ago and I have visited him 6 times since then, including my family traveling down there to meet him. If he doesn't get that visa, I'm taking the next flight to CDJ and doing some serious butt-kicking.

The new consulate isn't open yet, we drove by it a few weeks ago when we were there visiting family. I think it is scheduled to open next summer because of delays but it could be sooner. It is in a much nicer part of town and much safer.
If you are getting a K1 visit you are only allowed one entry into the US so only go to the bridge if you are planning on entering the US and not going back to Mexico until you get advanced parol.
I hope thy aren't making people drive an hour away from Juarez to enter the US. You should be able to enter at ANY point of entry into the US. The 3 bridges in Juarez are the easiest and when we entered after my wife's visa we didn't go to the bridge that was on the paper she got from the consulate, we used a different one without any problems.
There are signs to get to El Paso from Juarez but the streets are confusing, luckily my wife knoows her way around Juarez, a cab to the bridge would be the easiest way to go then get out and walk to the building, don't wait in the cab.

There are 3 bridges into El Paso from Juarez only about 5 minutes from the consulate. The Airport is only 10 minutes from the bridge. Tickets from El Paso would probably be cheaper than from Mexico City. The wait at the bridge may be a while but he would have to go inside at the bridge to get his I-94 anyway and then he can walk out and take a cab to the airport. Unless he needs to go back home it seems easier, faster, and cheaper if he just crossed into El Paso and flew from there to where you live. Southwest Airlines flies into El Paso so they are cheeper than everyone else if they fly close to where you live.

And don't worry about the AOS process, if you made it through the K visa process the AOS is easy because you are already in the US and don't have to worry about not getting approved. The only people I have seen not getting an approval is if they have come her on a different visa and try to adjust, even then they usually get approved.

We just came back from Juarez visiting my wife's family and baptism for our baby. We drove by the new consulate which is a very nice area of the city. All the hotels are very nice and new. There is a new mall, VIP movie theator, and a bowling alley. Once it opens it will be alot nicer than where the old one is.

The reason there is a month between Packet 3 Received and the Interview is because my fiancee had put in a notice to quit her job, and we took our time preparing the forms. She also made three separate bus trips from Torreon to Juarez for the medical exam, TB exam for child and finally the interview (She preferred to do this rather than stay in Juarez). That alone took over a week.

I will have her leave a review of the consulate. She said the interview went very quick and her interviewer was very friendly, but she had to wait another 5 hours just to get the visa.

We didn’t encounter a single problem through the entire process. The information we received from this site was extremely helpful, so thanks all.

The airport is not far from the bridge, take a taxi to the bridge and then walk across, then take a taxi to where you want to go.

I'm curious how this would be worse than someone entering the US on a tourist visa, failing to return and then getting married to a US citizen? Is there something specific to a K1 that bans them?

I have read that some visas require a 2 year return to their home country but i have also read there are ways around that even.

Here's the situation. Met a gentlemen in 2006 while he was visiting his family here in U.S. His aunt was my neighbor and always thought I was friendly, nice, etc etc and wanted me to meet her nephew when he came to visit. We met and were instantly attracted to one another. His initial plan was to visit the U.S. for only 2 month, however, he stayed 6 months for us to get to know each other (but did not stay beyond approved time). Well we kept in touch via phone calls and emails and knew we wanted to be together. Long story short. He attempted to come back to U.S. this past July but was denied entry. He was told that on his original application for a visa in early 2006, he omitted that he visited Italy once and was asked to leave due to overstaying his visa in Italy. He stated to the officer, that yes, he did overstay his visit in Italy (about 6 years ago), but he never was arrested, just asked to leave. Well, we married last month, and just sent off paperwork for K3 visa. We feel so alone in this process. Our families love and support us, but they have no idea what we are going through. My husband is very happy that the process has begun, but I on the other hand expect him to be told at the interview that he will need a waiver. Again, am I being proactive to prepare for this or pessimistic? Should I need one, the option for an attorney to file for us is out of the question right at the moment due to finances. Any advice or support will be appreciated helpsmilie.gif


I can't believe an overstay it Italy caused a denied entry in the US but no where have I read in the petitions or posts that it is asked if you have had any issues with immigration with another country. It is my opinion you should not have any problems as long as you are honest.

A lawyer is not needed just follow all the guidelines here.

So we understand clearly, has your wife gone back to Mexico yet? If the lawyer has told you her chances of getting a waiver are slim then why even try at this time?

I have no recourse for that, as immigration law is above the law, it cannot be taken to court! Now I not only pay for my mistakes in 2003, I pay for a mistake the United States made in 1996!


While I can *feel* for your dilemma, assigning blame to CBP or the Immigration Service for your situation is not only improper, but will get you nowhere. Every tourist entering this country is presumed to have immigrant intent. That is the law. The fact that you were not able to overcome that is not a fault of the border agents, it is your issue. You had a husband and child in the USA at the time. Entering the country with a tourist visa in hand, yet your immediate family already in California shifts the burden of proof to you to demonstrate that you were not using a visa inappropriately. However, I do wonder if there would not have been a way for you to appeal their actions after you were released and get your documentation back. But, I suppose that is water under the bridge. The problem is that after such an unsuccessfuly attempt, you chose to circumvent the law and enter again in 2003. Once again you were unsuccessful.

Immigration law is not above the law. There are ways and means for aliens to hold the Service to task. I think in view of the fact that the USA is the palce your family chooses to reside, you might wish to change your tune as to how you perceive American immigration law, and the manner in which you allege the United States is inclined to evade facing mistakes made on its part! Some CBP officers do think the are above the law because they can get away with crime against people who are not citizens. It happens all the time. The same applies to some ICE officers because they think they can get away with it.

I have seen how differently CBP treat me, a USC, differently.
