Did you marry while she was here in the US? Do you currently have a petition being processed by the NVC? I assume you have USCIS approval since you said the NVC is processing? If this is the case then she will have to return to her country for the interview. If you were married abroad and she traveled her while you are married there is no way she can adjust status here, she will have to return for the interview, get her visa and then adjust status if it is the K3 you petitioned for. If it is the CR1 she will get her greencard after her interview and she returns to the US.

After seeing your timeline, yes she has to return to here country for the interview, make sure she does not overstay her I-94.

If you are filing for IR1/CR1 you still have thinks to pay and submit through the NVC so will you have someone in the US to do this for you?

Is your lawyer and immigration lawyer? It doesn't sound like it because if you are honest with what you want to do he will be denied. The intent for a tourist visa is just that, a tourist that will return home. If they have any reason not to return home like a pending immigrant visa they have every reason to deny. And if for any reason they did issue it he could still be denied entry when he arrived in the US.

It is a chance you could take in trying but it is a risk.

Well his mother is really trying hard but no matter how much she buggs em they procrestinate things. So far they just got really lucky nobody found out yet. She is not allowed to leave the US. They told her that when she last entered the US so she is afraid of that...so she wont go good.gif
Im actually trying to get them setup with an appointment at the local immigration office and see what they advice.

She was very lucky when she entered last that she wasn't deported. If they gave her an I-94 after she was married she still cannot adjust here I dont think. She will have to go to Canada to interview. They won't have an easy time of it but they will have to go through the waiver process.

Someone correct me if I am wrong but entering after you are married there isn't the possiblity to adjust here.

They also need to go to www.immigrate2us.com concerning waivers.


kk wont do that then. Sooooo I just looked in her passport. There is only one stamp for april 14. no date when to leave no I 94, no nothing. No 2 stamps. so no stamp when she visited canada. Is that good or bad?? blink.gif

I think the USC should make sure that USCIS has closed the case first. Then read the guidelines here for filing I-130 and AOS together. She has to be able to prove she was here legally when they married and that she hasn't left the country since she entered and was married. Remember to do this she would have had to enter the US without intent to marry but married while here and did not leave. She will have to convince USCIS of this to be approved.

yes they got that paperwork but did not go any further mad.gif I have no idea why??? Anyway they have all the papaerwork here...I have it sitting in front of me. They just never sent it back...which pretty much means its denied and they have to start over right?

That is no reason to divorce, there has to be more to it than only because your wife would do anything without her mother.

unfortunately the penalties for US born citizens are not as severe as an LPR if one fails to register. Ignorence is not an excuse when it comes to the law. I have a friend that is an LPR but he has 2 strikes against him, one is that he didn't register for selective services and second he owes back child support. Both of these issues he was told could potentially cause him to be deported if he applied for citizenship.
The point is that you have to follow the laws in the US to become a citizen and if you violate any of them it can give USCIS a reason to deny and or deport you. My brother-in-law had his citizenship interview a few weeks ago and for some reason he and my sister both have been filing their taxes and single for the past 25 years they have been married. This caused a BIG problem for him. They had a friend many years ago that told them they would pay less taxes by filing this way and never thought it would be a problem. USCIS was very upset and told him that he had 3 months to fix it and scheduled a new appointment in August. I hope by them filing ammended returns for the past 5 years and pay any taxes due and penalties as directed by USCIS it resolves the issue but who knows anymore what they are capable of.

Who would put on their list - marry a guy who can't support children or provide a nice home?

This is not scamming people, it is just people wanting a better life that they currently have. The US has plenty of room for legal immigrants. I do think the laws should change a little and extend the time people are allowed to get LPR after a divorce and not allow them to petition for anyone from their country for at least 10 years if they divorce.
I think people are naturally jelious if they think someone took an easier route then they had to for immigration. To be honest, I think their sould be a way for people to be together easier if they are going through the Visa process. Why not issue someone a visitor visa once they apply for a spousal visa with the condition that a return flight ticket is purchased upfront and have a bag packed for the interview just in case you are denied you will be escorted to the airport to return home. Or put a tracking device on if denied and give them 30 days to appeal or return home.

If you are already married, the U.S citizen can petition for I-130. Once you get the I-130 receipt in the mail, you can send the 1-129F along with the receipt (with no fees). The i-129F can grant entry to the beneficiary to the U.S on a non-immigrant visa while the I-130 is still pending. This way you both can wait in the U.S. together for the entire CR-1 process.

Yes, it depends on what you want. For me, speed is the utmost importance as I don't want to be away from my wife any longer than I already have. My opinion is that it doesn't hurt to file a K-3 as it gives you options in the event both get approved at the same time. Should you decide with the CR1 route, you still can.


Both options are not necessarily available. CSC has been following the current stated policy of holding the I-130 and only forwarding the I-129F to NVC, while VSC has been forwarding both lately. If that happens, one needs to file an I-824 with a hefty fee to get the I-130 moving again. VSC may change back without notice. We just don't know.

If you want an immigrant visa, don't file an I-129F for spouse.

Continue with the K3 process. The AOS on average is about 6 months but you should get AED to work and get your SSN in about 3 months.

We shouldn't have to use a lawyer for anything except possibly criminal defense. Why does everything legal have to be written in such a way that most people are afraid they will make a mistake? We are forced to follow civil proceedure exactly and if not the judge will not allow it or throw your case out completely. I say let people represent themselves as much as possible and allow them to do things for themselves.
The USCIS is actually easier to do this because they have forms for everything unlike other court systems which scare most people into having to hire a lawyer because they don't have a clue on what to do.

Why has everyone in the post assumed the person visiting the US intended fraud? My wife visited me before we were married and I begged her to marry me here but she wanted to have all her family at our wedding. We did marry in the US just inside the US border and all her family have B1/B2 visas. We went through the K3 process but if I would have known at the time she was visiting me that all I had to do was AOS and not spend time apart I would have done it in a second. It is not against the law, she had no intent when she left home to not go back but if I could have convinced her to marry me it would have been fully legal for her to stay. I spent a lot of money traveling back and forth to visit during the process. If the loophole is only the consulate checking their police records when not have the consulate do this during the AOS stage? Some countries dont even require the police report for K visas anyway. We are all here for the same reason and that is to get our spouse or family here as quickly as the law will allow. If someone finds a faster way within the law good for them, why didnt the rest of us think of it first! Look at tax loopholes, I will bet that every single american that can take advantage of it will. How many people here choose to not deduct things like interest on their homes? We all do because we can and if they took this away we would all scream! Even if we know that we may have gotten a second to pay off credit cards or a car, or a boat that you typically cannot deduct but because of a loophole we do deduct our interest.

I don't know if it will delay it that long, just get the correct forms signed and ready as soon as an RFE comes, if it comes. I have read some threads and they have said they dont always use all the copies? I may be wrong but I would wait and see if you get an RFE or not. I am sure USCIS is backed up a little right now so give the NOA another week or so.

Isn't there another type of non imigrant visa for family membrs available to LPR's or is it for work visa holders?

Can you get you AOS EAD and AP forms filled out and in the mail by Monday? You can save a bundle because the fees go up after that. Even if you cannot get your 693 suppliment for vaccinations, unless you can get it finished Monday try to get it in the mail.
