In all seriousness Byron..Im not going to say "hang in there"....cause you have been for some time..like a trooper. I WILL say, it is coming. Its just a matter of time. I know you see the holidays coming...and its hard. I know. But always remember, you have us here to talk to. We ALL will support you, Mirla, and ALL the others waiting. Stay focused. This is a hard time for my SO and I. He's lost DSL for 3 more weeks (they are upgrading the system there...although its sucked since I met him 4 years ago) for a total of 5 weeks. Skype blocked our account cause I was stupid to reload it with MY credit card which I had used on MY account...duhhhh blink.gif and our phone service hasn't been the best. My biggest fear is that the holidays will come and we have NO contact. Which can and does happen often to ALOT in Egypt. So, I do understand your pain, fears and dreams. Its as if someone has just stabbed you in the heart...ripped it out while you watch and stomped all over it. You cant breath, you can't focus and all you think of is her. The pain of laying down alone at night is unbearable. You look at her picture before sleep, hold your phone close by and keep the computer sound up..just in case she needs you. After time of tossing and turning, thinkiing of the noa2 and dreaming of the day you can hold her every night beside you..you finally drift to sleep. But then the REAL dreams come. The ones that can terrify even the bravest of us. The ones that make us feel we can lose it all. We wake the next morning, check for approvals, drink our coffee and sigh..for yet another day passed with no word. Can fate play its hand and make it happen? Off to work we go. Our minds still not focused, our hearts with our loved ones, and wondering...will today be the day.

Byron, you are always welcome to vent, cry or talk here...we are with you. Never ever forget you are amongst friends....we hug you.....and surround you with our friendship. I still pray every day for you April and May filers to get your Noa2's. God is great. He knows His perfect timing.

that day will come for us all, my friends.

I actually called yesterday, i got a guy that was very nice and polite...he explained that once the RFE requested returns, they put it back on a shelf until they get a bunch so that an officer starts adjudicating them... blink.gif .....Im tired of calling and getting a run around or someone rude...last time , which was last Friday, i got a rude lady just wanted to know what i was calling for, i explained and then she started telling me how she had a record on her screen of how i have called for the same thing a couple of times...i told her , well of course , im still waiting for an approval..thats why....im just sick of calling that place!!!!!!!!!!!!!!! mad.gif

I sent this email to CIS Ombudsman maybe a day or three ago:


Great effort in contacting the ombudsman.

I dispute the USCIS's claim that September petitions are being approved because they are especially well documented. That is just baloney. What could they have possibly submitted that allowed them be processed before May, June, July and August petitions? I can see that a petition without any complications would be processed before a more complicated petition submitted at the same time, but there is no way in the world that they should be even looking at non expedited September petitions yet.


When I wrote to the Ombudsman today, I pointed out that while there are different variables and nuances which may cause some petitions to be approved before others, I am highly skeptical that the 100s of petitons filed prior to Sept. 2007 are all of a more complex nature and less well documented than the few that have been approved after that time.


Unless they physically stapled their bodies to their applications I can't imagine these September petitions being anymore well documented then ours.

Holy Moly, no touches, nothing. Just an email this morning that an approval letter was sent on November 4th. November 4th, since when do they work on Sunday? Who cares, I have the email and the USCIS website was updated to reflect the same thing.

Those of you counting, USCIS received our application on June 8th and sent our NOA1 on June 11th, touched us on June 13th.... a long 5 months of nothing and then an NOA2 November 4th. kicking.gif

There seems to be no real consistency yet, though. Their approving has been all over the charts lately. Approvals from September, October, and July filers??? I agree the filing dates approved are all over the place. Not sure why..but Im sure there is a reason. I do know the most recent valid June approval is June 4th. Im assuming they are now starting to pull boxes of the first week or so of june. I wouldn't be surprised if they are pulling June more now, in an effort to avoid going over the 6 month deadline. To get the "easy" petitions out of the way first. You know the ones they can do in 15 minutes that they can KNOW dont require an RFE??? Who knows.

Byron...make them hurry...please...the tension of waiting for yours and Mirlas and other earlier May filers is KILLING me. I can ONLY imagine what it is doing to you guys. Im still praying.

BUT good news is it does seem VSC is picking up..at least for the moment..even I...yes positive pom pom faith..was starting to lose faith (no pun intended...or was it??)

I am really down on this today. I just booked my million dollar flight to England for Christmas. I wasn't expecting to celebrate Christmas there because I thought my fiance would be here by now. No, I don't think you are off base at all.

The problems currently being experienced by USCIS were to a great extent self generated. They were not caused by an cataclysmic event such as 911 or by unexpected legislation action such as the IMBRA regulations. Instead the current situation was caused by a management decision that created an avalanche of petitions without having the manpower in place to handle it. This should have been anticipated and could have easily been mitigated by phasing in the price increases so that an overwhelming surge of petitions was avoided.

Obviously an ajudicator requires training and it is not possible to just call up a temp agency and order up a few dozen extra for the month. I assume that USCIS management was aware of this fact before they took the steps they did. However, not only did they not have enough adjudicators in place when they announced the price increase they did not even have enough low level contract employees to do the receiving.

When I began investigating this process VSC was consistently adjudicating K1 petitions within 30 to 60 days. It is now approaching 6 months and there is no sign of improvement. What has actually changed to cause this huge deterioration in service? The adjudication process is no different today than it was 9 months ago. Employment visas have priority over K1's & K3's today but I think that was the case previously also. There may have been more than anticipated employment based petitions due to some decisions outside the control of USCIS but those petitions should have been absorbed and processed by now. The government emphasis on Iraqi petitions may have caught them by surprise but they already knew how many Iraqi petitions were pending and that they had the obligation to process them.

As I see it the problem comes down to this. USCIS management decided they needed to upgrade their systems and they needed more money to pay for the upgrades. I have no objection to that. Obviously their systems are antiquated and need to be updated. But by the same token the existing systems were providing decisions in a reasonable amount of time. What bothers me is that management put in place a plan that was destined to cause delays and hardship for thousands (or is it millions?) of their current so called customers in the hope that 4 or 5 years down the road their service will improve.

Is this good management? I don't think so.

At this point USCIS customers are arguing about who should have priority and wondering when they will be with the ones they love. Meanwhile the people in management who created this mess go home to their families every night. I think that we have the right to be upset.

I know all of you must have this same connection with your fiance(e)s/spouses. So chill out. Some of you act like you're gonna kick the bucket sometime soon, leaving you only days with your lovers. So pessimistic! Try to focus on all of the wonderful years you will have together and not the painful months that you were apart. Besides, what good are you doing by pissing other VJers off? You make an interesting parallel in your post. You talk about we are asking a favor of Uncle Sam. I completely agree, but the conotation of "Uncle" means that Sam is family. I would think that Family would treat me better than Joe Schmo from a foriegn country who wishes to ask for a favor as well. I would think that my "Family" would treat me better and give me preferential treatment. That is the crux of every arguement on this subject.


I am so TIRED of people saying the government is doing me a "FAVOR" by allowing me to PAY them to have my fiance live near me. Its called Freedom. Ya know, that thing people died for. They are not doing me a favor. I am a citizen of a country that states this process is allowed. If it is not allowed, change the law so we wouldn't expect to get what we derserve. I have only been waiting 3 months (not quite) and I have sent out probably around 5 or 6 letters to important people. So far, I've had one returned (That'd be the Aguilar one) and one reply from one of my Senators.

I completely agree. I wrote a bunch of letters to the news media as well as my local politicians. As I mentioned before, I am VERY cynical towards the government and did not expect any response. I was proved wrong however. My local mayor (Brian Stack of Union City) had his assistant call me and discuss my issue. She said they could not get involved in immigration issues so she forwarded my complaint to the Senators office. I have been playing phone tag with the Senator's office ever since. You know she actually called me back to find out whether the Senators office did in fact get a hold of me? I am not sure whether they can do anything, but it did make me feel like they cared a little bit.

  2. Mirla is told that she only needs to wait a few more weeks which if it is true means that she could be the first of the group to hit the 6 month mark.
  3. There have been only 3 VSC approvals in the last 7 days. 2 of those were expedited mid and late September submittals while early May filers are still waiting.
  4. VSC can't even do the email and hard copy notifications properly when there is a rare approval.

Call me negative. I don't care. When there is good news out of VSC I will be as positive as anyone else. In the meantime the reality is that VSC is doing a terrible job for us and unless they change soon most of us will be waiting a very long time for our approvals. ClockWatch2.gif

Please don't get me wrong. I am hopeful. I hope that Mirla is approved today and I hope that Byrun's RFE does not delay his processing by more than a few days. I hope that VSC gives us back our adjudicators very soon. I hope that May filers are all approved by the end of the month and I hope that June filers follow soon after. I also hope that I am not missing too much as my baby girl grows and learns every day while she is 5,000 miles away. I hope that my fiance's son is not becoming too old for us to form a close father/son relationship as we wait for VSC to finish processing petitions for employment visas. I hope I do not go bankrupt buying airline tickets so that we can be together as often as possible. I hope that Bella does not ask me tonight how much longer it will be because I do not want to see the tears in her eyes when I tell her that it looks like it might be a very long time.

I hope all of these things and many more. Unfortunately I am not sure of any of it because what I observe at VSC is not encouraging.

Hopefully things will improve soon. In the meantime, whenever I see those pom poms I find myself wishing VJ had a machine gun emoticon. devil.gif

Yesterday my adjucation date was 10/27, today it is 10/18 (which is in the past). Just in case I needed one more thing to be pissed off about.... ohmy.gif

Got my second NOA2 yesterday. Remember how I said I got two emails... now I have two NOA2s.

The one on Friday said the Notice Date was Oct. 15th, and the one yesterday said it was Notice Date Oct. 18th. Everything else is the same.

I also got the NVC letter stating they approved the visa and it is dated Oct. 22.

I only needed one NOA2. I wish I could give the second one to someone else!




I'm happy for you empr! biggrin.gif Wilson got 2 NOA2 emails from them too. I think there were many who got 2 NOA2 emails here.


Maybe if they did it correctly they could get more approvals complete.

I just spoke to Jim Webbs office....(Virginia Senator) HE says they are SWAMPED with ins issues...and I explained that the backlog isn't the issue WE are concerned with. Its the petitions that were filed in April, May and June that are not touched or completed....that is our concern. That we are promised to be worked first come and that isn't happening.....not if they are JUST getting to ours while July and Aug HAVE been worked already....I stated we paid for this service and I really sort of rambled. But asked WHAT is going to be done from a congressional view? We have no where to go...no one to help us. Our files sit and its impacting us as humans. It tears us apart. I asked what do we need to do to be heard. He said keep doing what we are doing...writing, calling....he said its getting attention..they are noticing it. I said great...but what can we do NOW. I said I wont be happy til Senator WEBB himself is on the phone with Vermont getting my petition moved. whistling.gif whistling.gif whistling.gif (like THAT would ever happen)

Has anyone gone ahead and filed the DHS Form 7001? They say to send this in if you are experiencing process delays that extend past what they promote.



Well I just got off the phone with "customer service and was told that I have to wait 17 more days before they will do a service request for me because they are process petitions from May 19 so mine is stll within there service time.....You see the 6 month on the website is the time frame they pull out of their ###*s when they feel like screwing with people's lives.....This little person reallt pissed me off today....so I asked her if Margaret #***** was lying to me on Friday or is she today....and get this she told me that the processing date could of backed up so if I could of filed on Friday then they could of processed it then but I was one day shy of 6 months but today my petition is within there processing time......but her is the kicker....If 17 days from now they are only processing say May 25 then I will have to wait 10 more days......so the 6 months is a joke......I hate them......


I got the same scripted bullshit information when I called last week. The idiot told me they were up to May 24th. Thats when I knew he was seriously just looking at something scripted. It isn't accurate as you know since people on here from July and August are approved.
