Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

i dont know the photos might be considered in number 6?

definitely do the CR-1...i was torn between the K3 and CR-1...but finally decided on the CR-1. i know the K3 makes it seem faster and easier but its not as i have read in the threads here...i know you want your husband with you really bad...but in the long run, the CR-1 will be better for you guys plus he can help you out and work since you're still a student...

i dont think photos of you together is okay to show a bona fide marriage? double check it...statements from people is a good evidence to show the bona fide marriage thing but i dont think photos of you together are...thats for the interview i think

No, your money would not be wasted.

I just called NVC today. They explained that a person can either adjust status once in the US on a K3 visa OR continue with the I130 immigrant visa process. If you choose the latter, you will have to travel back to the country of origin for the immigrant visa interview at the US embassy.

...i have a question about this, so its obivous for the K3 to be filed in the country of marriage meaning the interview for K3 would be at the US embassy of where the marriage took place? what about for the CR-1 or the IR-1? does the interview have to be in the spouse's country of origin or where our marriage took place (you see our country of marriage is in the philippines and my husbands country of origin is pakistan). in my I 130...to that question...i put US Embassy, manila philippines as our consulate...we prefer that he does the interview in the Philippines rather than going back home to pakistan...anyone have any idea?

hi VJer's...need a little help here. Im about to send the I 130's of my husband and my son...I just need to double check with anyone who has time to browse through this...so here is what I am going to put IN ONE PACKET
for my husband:
1. Payment: Check for 355$
2. I 130 beneficiary: my husband
3. copy of my birth certificate (from the REGISTRAR’S OFFICE of my town in New York)
4. marriage certificate - in this case the NSO copy because we got married in the philippines
5. my G325a
6. husbands g325a
7. photo of me
8. photo of my husband
9. our evidences of a bona fide marriage: our son's birth certificate (NSO copy)
Life insurance I got from them
a copy of me sending money through western union
4 - 5 pictures (still choosing which ones)

for my son:
1. his I 130
2. check for 355$
3. NSO copy of his birth certificate since he was born in the philippines
4. a copy of my birth certificate

I think I shall include a cover letter too indicating which papers are for which I 130 and i think I need to paper clip my husbands papers together and paper clip my son's as well... did i leave anything out?
i am concerned about my birth certificate, my mom gave my a copy of the one she had ever since i was born but it ripped so i ordered from the town that i was born in in new york, through the REGISTRAR’S OFFICE...i hope that is okay.
and also if anyone knows about the NSO copies from the philippines, I will send the original marriage certificate and birth certificate for my son but will just send a copy of our proof of bona fide marriage og my son's birth certificate...

i have a question...what envelope did you use to put all your documents in? just a regular brown envelope and addressed it to the USCIS? i stopped by the post office today to ask what type of package shipping they do...i think ill go with the one that has the confirmation delivery receipt...the lady said they would let me know if they have sent it already...its only a additional 60 cents...i just want to make my documents are received...is the tracking number for priority mail only?

everyone her ein Vj is going thry some stress one way or another. look at me, i am away from my husband and son...sometimes i hate my job and i have to drag myself to go to work each day...plus im also studying for my boards...and i cant afford to fail it because everything will be much better when i do pass it. i can make it to the 125% poverty line for 3 people but how can i let my family live on 23,000 dollars a month? what will i feed my baby with that kind of money? i dont want him to chew on the cheap cuts of meat from the supermarket! NO WAY! so i have to be strong...but sometimes i have relapses and it goes on for days...

since everyone here is mostly from pakistan...well could you guys help me out? my husband is from pakistan...at the moment he is in pakistan for a 2 month vacation to attend his brothers wedding. but he will be returning to the philippines at the end of january. he lives in the philippines, been living there for 5 years now because he studied in the philippines and is still on a student visa. also, our son is in the philippines and my mom takes care of him (my parents are filipinos but I am a USC by birth and I live now in boston). We are unable to predict how long it will take to process the case to conclusion. The time required to process a visa application varies from case to case depending on the complexity of the case itself and the number and complexity of other cases awaiting review. i called the embassy in manila to find out exactly what is happening. they said it is just a standard procedure at the consuls to review my husbands case over. and that the maximum is 6 weeks. i hope this is true. she said that if they don't do anything by 6 weeks, no updates or if we dont hear from them...i should call back...the exact status is under review at the consul in manila...
do you think i should still call the DOS to ask what's up with our casE?

WAIT UNTIL YOU HEAR FROM US: your case requires further administrative processing/ review. wait for a letter telling you when to return to the embassy with the documents marked above. this was on our white slip

and did they mark any documents for us to give them? no they didn't...so i really dont know why the hell we are on AP/AR...sorry guys just ranting! i am really pissed off right now.

In manila they give white slips for AP but at ISL they have either green or blue letters,i got a green one saying i am in admin processing.Its pretty common for paki males to put under AP or AR.Doesnt matter where they file their cases at like in ur case its manila.I was reading another forum admin processing/admin review and all of the members are from philippines and received white slips,u shud check it out.I had the similar experence at the interview, CO kept my passport and told me the same thing that everything looks good but we need to do some office work.My point here is you dont need to cry you just have to wait and hang in there theres nothing can be done to expedite the admin process.....I have been in AP since last 2 1/2 months and counting... by the way do u know how to make adobo? smile.gif .... Hang in the there everything will be fine IA.

and yes i can cook adobo...my husband loves it very much...i am missing him so much. he isnt feeling as bad as me and he is so optimistic and positive. he said why are u crying like we got denied or something. =( oh well...
