we havent received any emails yet. but this totally sucks, the consular should have told you if they needed more proof of your relationship or whoever's identity they are questioning!

after the interview, the consular just informed him that all our documents are complete but we are on review. he gave his address and contact details to air21 and was given the white slip. that was all...no tracking number or anything. our interview was last sept. 25 and on wednesday (philippines time) my husband received a text message from air21 with the tracking number...will call the embassy in manila again...and keeping our fingers crossed!

my husband was also surprised because they didnt ask for any more documents. he was also asking them to look at my tax returns, my paychecks from work and other documents that he brought but the consul said it was okay. they just looked at our pictures and our chat logs and phone logs. the consul asked alot of questions. the consul was pretty nice i guess...when he asked about my son's petition my husband said that we have already processed it and he said, then i guess i will see you again here for your son's interview. about my work he just asked if i work full time as a nurse...and if my husband ever worked in any country before.

ill keep calling every monday and friday though...

if he did not make it to the required income, the consul would have told you so. but since he didn't then you are okay in that area. usually they will tell you straightforward what you need to bring or need to do.

Everyone, I've already met my drama quota for the week. This morning I'm having my coffee and sitting down, with the windows open to let the fresh air in...I start hearing kids screaming. I think "Ah, they always scream." Then I started hearing it like it was in my front yard. I thought, "I hope no one fell in the pond" so I go to the front window and look out. I see 3 kids, an adult and 2 dogs attacking each other and the kids are crying and screaming "He's gonna kill him!!!!" So I run to the phone and call the police. I'm at my window, in pajamas, and the woman sees me and runs over with her kids. Once I see that it's not the kids getting attacked, but the dogs only, I calmed down. She asked if she can use my phone. I hung up with police and said "sure"...the one dog is really mawling the other. I offer her my taser to put down the attacking dog for a few minutes until police get there. She says that she's babysitting that dog for a friend and it's attacking her dog out of nowhere...turns out to be my neighbors dog...the same one that killed 2 of my cats. Obviously this is a vicious dog. If I had known that, I would have told the police to shoot the damn dog, or done it myself. However, I didn't find out until after everyone left. Eventually they stopped fighting. The husband came and they stuck one dog in the back of the car and the other in the front, which they had to take to the vet. The poor kids were crying their eyes out. I didn't know what to do. I made them go upstairs and watch TV until their dad came with the car so they can take the dog to the vet. I didn't tell the lady "Oh yeah, that dog killed my cats" because I didn't want to cause trouble between the two friends. But when my neighbor comes home I'm going to tell her she really needs to get that dog outta here. Next time it's gonna be a child that is attacked...and she has a 3 year old too.

...hi south asians...and to all pakistanis! right now my husband is in pakistan to get his police clearance and to attend his brother's wedding but he currently resides in the philippines with our son...i am so frustrated! he said he has sent his g325a 2 weeks ago and paid $20 to have it delivered to the united states in 5 days...and its been 2 weeks going on 3 weeks! our I 130 package is sooo ready to go, just his signed g 325a is all that i need! he will be going back to the philippines on feb. 15 and maybe if his g 325a from pakistan wont have arrived yet! so he will probably have to send from the philippines from a more reliable service like dhl or fed ex because he lives in the middle of nowhere...(kamra, pakistan)!!!...

my husband is from pakistan but he has been living in the philippines for about 5 years now...that's where we met, we just got our NAO2 approved and last feb he went to pakistan to visit and attend a wedding, he also got his birth certificate and police clearance from peshawer. he scanned the documents and i just saw that the peshawer police clearance looks so simple...it has no expiration date and just an old picture of my husband when he was living there (16 - 19 years old)...is it really like this because i dont want him to go back to pakistan just to get a police clearance...his interview will be in manila philippines

the first thing they asked on the day of interview even before the interview starts, is new original PC.its I guess standard for Pakistani Nationals.they asked new PC to bring on the day of interview,I m telling this with personal experience my mom had interview on july 16th.

hello everyone! thanks again...my husband and I are making our decisions...although I would want him here sooner and the K3 is the way to go for that, we choose to just go for the CR-1 / IR -1. I am planning to file by january 2009 and I dont think they will get the interview and everything done before our second year anniversary which is Oct. 18, 2009...so after our second year anniversary and they go for interview after that I am hoping they will give their IR1 and IR2 visa for my husband and son instead of the CR1 or CR2 because we are 2 years married already.
plus the issue with my son, I want him to enter the united states as a LPR already so that all we would have to do is give another form i think N400 or N 600 or something like that to get his american citizenship once he enters. (there is this law that states that if he enters on an Immigrant visa and once he enters the united states he can become a USC as long as he will be in the custody of the USC parent)
if my son were to enter on a K4, I would have to make a separate petition, another I-130 for my son when he enters...plus the headaches of changing my husbands status and all that if we go through the K3.
I am also trying to find out how fast they go in the US embassy in the Philippines. I am trying to look at the stats how fast the K3 visa are being processed and also the CR-1 and IR-1. And i Know that my son will get his sooner than his father but thats alright, he will just have to wait until his father gets done and come with him too. But what if I file for my husband first and then my son? but when i file for my husband will i put my son's name already in my husband's I 130? or do i put no or yes in the question in the bottom...have you petitioned for anyone else? because maybe i should process my husband's I 130 first then after one or two months my son so they both get their visas on the same time since my son's will probably take like 3 -5 months only?


I tried emailing the US embassy in the Philippines. See my husband is Pakistani but he has been in the philippines for 5 years now and on a student visa...Can I chose the US embassy in the Philippines to issue his CR/IR-1 visa? because for the K3 it has to be in the place of marriage...but what about the CR/IR-1 visa? can i do it in the philippines...i mean my husband and child are in the Philippines and I would rather they stay in the philippines because a) my husband just enrolled in a master's program after he graduated medical school so his student visa is good for a year and cool.gif my mom takes care of my son mostly and i would rather have my own mom take care of my son rather than my inlaws...

as for me, im here in boston...working hard...picking up shifts at the hospital working almost every weekend just to save up for my family moving here...i miss them so much...thank you visa journey! you save me thousands of dollars from money faced immigration lawyers!

okay so i was just reading another forum from this guy who has the same situation as me. he ended up getting a CR-1 visa and CR-2 for their baby girl. i think its better that way for me too, the CR route because if my husband and I put my son under a K4 if I do the K3 for my husband then...id have to do the following...

5. While the U.S. citizen must also file an I-130 petition for the alien spouse, there is no requirement "to file a Form I-130 immigrant visa petition on behalf of the aliens children seeking K4 nonimmigrant status, since K4 is merely a derivative nonimmigrant classification," according to the BCIS rule. K4s are dependent on K3s for their status.

6. However, as the BCIS rule explains, the K4 child will not be able to file for adjustment of status in the United States until the U.S.citizen parent/step-parent files a I-130 on behalf of the child. If the U.S. citizen parent/step-parent never files the I-130 petition, the immigrating parent may do so once he/she has obtained LPR status, but the child would have to wait for an available visa number. Finally, according to the BCIS rule, as the immigrating parent, upon adjusting status, "would no longer be in K-3 status, the child would no longer be in lawful K-4 status, since this is merely a derivative classification",
and that child would begin to accrue unlawful presence. As the K3/K4 may not change status in the United States to another NIV category (see below), the continued lack of an I-130 petition will eventually create adjustment of status problems for the K4. K4s who do not meet the definition of stepchild in INA 101(cool.gif(1)(cool.gif because the stepchild relationship was not established before the stepchilds 18th birthday will face the same problem K2 derivative children of fiances have long encountered, i.e., the U.S. citizen spouse will be unable to file the I- 130 petition on their behalf. In these cases, the K3 will have to file the petition when he/she obtains LPR status.

ok here it goes...I'm an american citizen. I was born in Long Island New York which makes me an American citizen by birth. My parents are both Filipino. My mother at that time was an immigrant in the United States. When I was still an infant, I went to the Philippines. I never gave up my American citizenship and I never applied for dual citizenship. I grew up in the Philippines and went to school there for elementary, high school and college. I renew my American passport at the US embassy, in Manila Philippines. I would often come to the United States for vacations and holidays. The years and duration of my stay in the United States are as follows: summer (2 months 1993), summer (1 month 1995), summer (1 month 1996), and May – October (2003).

My husband and I met in the Philippines in June 2004. He is Pakistani and he was attending medical school in the Philippines at that time. He was on a student visa.

We decided to get married in the Philippines. Since I was an American citizen, I applied for an Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage (http://manila.usemba...v/wwwha009.html) from the United States embassy in Manila, Philippines. And since my husband is Pakistani, he also applied for that certificate from the Pakistan embassy in the Philippines. We got married (civil marriage) in the Philippines on October 18, 2007. My son was born October 28, 2007 in the same city.

I thought that my son would automatically be an American citizen too because I was American. But when I tried to apply for his US passport at the US embassy in Manila, the consular told me that I did not meet the Physical presence in requirement United States of U.S. citizen parent(s)...http://manila.usembassy.gov/wwwha003.html#presence. the consular told me that I had to petition my son instead...i was so sad and angry...anyway so whatever fine i couldnt so anything about it.

My family and I decided for me to finish nursing school in the Philippines and come immediately after to the United States. I wanted to claim residency in the United States, apply for a stable job and pursue my nursing career. I wanted to pave the way for my husband and child to come to America.

So on July, 2008, I bought a one way ticket to come live with my sister in Boston, Massachusetts. I have been living here for about 6 months now. I have been employed for 5 months now too. This makes it my first year to file my taxes.

What my family want is to be reunited. The big questions are:

I am aware of the two visas I can petition for my husband and son. The K3 visa is faster to get to the United States but would require more money and more adjustments to get the green card. The Immigrant Visa (IV or CR-1) takes longer but less money and less adjustments to make once my husband is in the United States.
But what I don't understand is how people shift from K3 to CR-1 or how they drop the K3? thats so confusing! i dont get it!
And I understand that with the K3 there is a K4? but i don't wanna put my son under a k4? because he is also my son! if i plan to petition my son as an immigrant visa, do i have to file a separate I-130 for him?
WHERE DO I GET STARTED? I KNOW IT STARTS WITH AN I 130 BUT THEN WHAT? PLEASE SOMEONE HELP ME...SOMEONE WITH THIS EXPERIENCE!
i was thinking of hiring an immigrant lawyer but so far all they ask for is a large fee for their services and im trying to choose the best one! ugh...its so frustrating...i just want my husband here first to help me get more settled and to help me with expenses in then in a few months, my baby can come too!

thank you for putting it that way pushbrk...i guess if needed i would have to go get my son before his visa is expired and let his father wait until the AP will clear up. crying.gif i have to get at least one of them with me here in the united states, im so lonely here...all i do is work and home, it would be nice to have one of them here...better than having zero. most probably my son will not be on AP because I am getting a Filipino passport for him and after all his biological mother is a USC...

Anyway my husband can also change his status in the philippines from student visa to a legal resident, wont be that hard...

its just it will be hard for my son and i to be here without my husband but then again thats whats going on with us now except that its me not with them... crying.gif

so it does not really matter if i file my husbands first because they would clip it together to be processed together? and in the long run my trying to put my husband first in the race so my sons wont end up having his visa done months and months before my husbands will be ready wont actually even work? i just want a head start on my husbands because i know he will face some kind of delay and my sons wont take that long to get his IR-2...how can i do this?

im still so torn about if i should file my husband and my son I 130 at the same time...i am so worried my sons visa will come up first before my husbands and what if my husbands wont even be ready even after the 6 months period my son would have to travel? what if i delay my sons a month or two later just to give my husbands a head start? ugh...

Designation of a U.S. embassy or consulate outside the country of your relative's last residence does not guarantee acceptance for processing by that post. Acceptance is at the discretion of the designated embassy or consulate....thats what it said below Q22...looks like i have to make a long distance call to the US embassy in Manila to make sure...because they never answer my email!
how many photos would be enough? do i have to put a description on the list of contents in my cover letter?

mr or mrs pushbrk...you were right about filing separate I 130's for my son and husband...i cant believe the immigration lawyer said just one only? i called USCIS to make sure i would have to file two, one for each!

and since i have to file one for my son and one for my husband do i put my sons name on my husbands I 130 on these questions:
If separate petitions are also being submitted for other relatives, give names of each and relationship.
(ill put my sons name or my husbands name)

Have you ever before filed a petition for this or any other alien? YES?
Then my sons or husbands name again?

im just putting my I 130 together and i just wanted to make sure. im still waiting for some more documents...anyway i did specify my husbands country of origin and his address is in a different country. also can i include pictures in the I 130 packet as evidence of bona fide marriage...i mean i have all the others but i was wondering if i should include photos too? or can i include photos?

what if your husband is in another country and living there and you want the consulate where he is living in do the visa processing? i.e. my husband is from pakistan but he lives in the philippines and i want the u.s. embassy in the philippines do the interview and medical exam and all that...did anyone else do it this way? i emailed the us embassy in the philippines and they never answer back giving you the appropriate answer...they only tell you they have their website blah blah but i will try to call them...just want to know if anyone else did it this way...spouse is not in origin country and living somewhere else and you want to do it in that country's consulate?

GOD, EVERYONE keeps mentioning the AP and im so worried it would happen to mine...most probably it will...if we file for DCF this will lessen the chance of having an AP...??? ugh...or the fact that we wont do it thru the islamabad embassy but in teh philippines? ugh!

you are a grown woman and you are married, you are very capable of making decisions for yourself and your husband and the future family you will both start. you made the decision to marry this man, it is what it is. and what is done is done. its going to be a long journey and a tough one but if you know yourself you can make it work then nothing is going to stop you.

when i met my husband...and we started dating...i knew it was against his religion and his pakistani culture to 1. have a relationship 2. have a relationship with a non muslim and non pakistani...but i said to myself i want this man as my husband and i can do this and i can make it work for us. it didn't end there, my father hates him and i know he still does even though his grandson brings joy to him. people (and yeah even my family members) make fun of my husbands religion and that he just came from a third world country who is on the brink of poverty. and that he probably wont be able to make it here in the united states...his family never talks to me or never gives an a$$ about what's going on with me here in america but you know what...he is my husband and i decided for him to become part of my life and will join my life here in america. remember mumtaz money comes and goes but education will stay (i hope i don't sound like your mother or sister now) but its just another advice from a pakistani's wife to another.

mumtaz, i agree with rahma...sorry i know you probably hate me already...but i did exactly what she did...i finished school and got through...every single criticism my parents and my family say about him and every single criticism his family says about me. if i stayed behind with my husband and begged someone to be our co sponsor just for the sake of staying and being together would not be very mature for us. we decided to marry which means the both of us can stand without any help. and the fact that i left my son and my husband alone to come to america and to work, be a nurse and be established here made our relationship stronger. yeah i could have filed through dcf and that would probably mean more time spent with my husband and my son but i was thinking of our FUTURE and not just thinking of the present so we can be together at that time.
i didnt mean to say that you are doubting your husband. alls im saying is when people say they might assume he is using you for the visa, dont act all defensive. he is not period...
and about being the woman not being able to work because pakistani women are not suppose to work and your father or husband is against it well that is your call...

asking you to get a job doesnt mean you are doing all the work or whatever, its just so you can have something to show for the AOS. that you are stable and you have a job. believe us when we say it is going to help and you guys really need it.
well mumtaz you have to get on your feet on this...you cant just be saying oh yeah my husband will do this and that...you are the petitioner which means it is your responsibility.if you really want your husband here then it means breaking out and getting your own life. if your parents want you to continue studying then good but you can still hold a job on the side. as for visiting him...i suggest you save that money.
if you have known each other for a while now even before you were married then it wouldn't be so hard to show your bona fide marriage. trust in your marriage, it seems to me you are having doubts that your hubby is using you for the visa?

hey mumtaz...relax and read everything, all the information you can find on this website. seems to me you are really anxious! much of what everyone says here is opinion and it all depends on what you want...which is obviously to be with your husband.

but anyway...you said you are in school or something like that? and what i have read in your thread so far is that the most likely problem that will arise is proving a bona fide marriage...what i would suggest is stay in america and file in america. im not quote sure if you said you are studying right now but i would finish up with that. or if you have your GED...get a job! any job, that could help you with your financial support that would help you and your husband. plus it wouldn't give you so much pressure on the financial support thing you would have to present. i'm sure you could get a job that pays at least 10$ an hour! and why do you worry about how to mail the forms and recieving your forms...yeah rent a mailbox at the post office if you have issues with receiving your mail. and if you have problems with going out on the streets to the post office because you don't drive or have a car...well for christ's sakes im sure you can take public transportation like the bus or the subway to go downtown to a post office nearby.

as for taking pictures to show evidence and all that...like i said get a job...work for about 5 months...save up then go visit your hubby in pakistan. the proving of the bona fide marriage (pictures and stuff) will come later in the interviews to show the consular. in the meantime get Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship from anyone...like a cousin...a friend to help you...maybe the witnesses at your wedding (you did have witnesses didnt you?) or you can get from your husband's family to make those documents for him.

i know it's very hard for you. i know how you feel. i went through the same thing. when i was still a student, my family didnt want to help me...all it took for them was to sign a couple of papers (affidavit of support) so my husband and son could have come with me here to america. but they didnt even lift a finger...so you know what i did...i graduated and i had to leave my 6 months old son with his father...(imagine a mother leaving her child) got a job here in america and work my ### off...to prove that yeah i can feed my son and my husband and put a roof over their heads...

you're 20 years old...you are old enough to petition your husband and you are old enough to get a job...besides it's only two households...a 10$ / hour job would do. if your family dont wanna help you then help yourself if you really want your husband with you. this is america girl...remember that...the land of oppurtunities.

Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

i dont know the photos might be considered in number 6?

definitely do the CR-1...i was torn between the K3 and CR-1...but finally decided on the CR-1. i know the K3 makes it seem faster and easier but its not as i have read in the threads here...i know you want your husband with you really bad...but in the long run, the CR-1 will be better for you guys plus he can help you out and work since you're still a student...
