And then there are the actual instructions which clearly say "all pages" of the passport if being used as proof of US Citizenship. For all passport related purposes, I suggest photocopying all pages. One of the reasons is to clarify any question that could come up about any international travel. I suggest people not get bogged down by asking why to every part of the process they don't understand. It's complicated enough just to understand the "what to do" without all the "why", though often a little thought will answer the why questions for us.

In your case, they may actually want to know how many times YOU have been in and out of Pakistan. Every page of your passport will answer that.

i know it says birth certificate or US passport copy to show US citizenship but must i submit a copy of ALL PAGES of the passport? the first page isn't good enough? the one with the picture and signature on it? i checked USCIS webiste and the Instructions for I-130, Petition for Alien Relative pdf website and it didnt say ALL pages...only visa journey said to include ALL pages of the passport...what did you fellow Vjers do?

i have a question...if I file for the CR-1 now because we are married for less than two years....and by the time the interview and all that comes...it would probably be passed our two year anniversary which is oct. 18, 2009...my husband and son will get the IR-1 and IR-2 already right? because we passed out two year anniversary? or it depends on the date of filing the I 130 if it is after the 2 year marriage anniv?

wait still reading and researching...so people drop the K3 petition if the I-130 NOA2 comes first before the I-129F NOA2? you mean i can just file the I-129 too just in case it comes first before the I-130 NOA2? but what about my son? If I file for the I-129? would I have to add him as my husband son? that would lead to the question of him being a k4? please please help me...i know i gotta sleep...have work tomorrow...but i'm gonna file in january already... how can i sleep?

okay so i was just reading another forum from this guy who has the same situation as me. he ended up getting a CR-1 visa and CR-2 for their baby girl. i think its better that way for me too, the CR route because if my husband and I put my son under a K4 if I do the K3 for my husband then...id have to do the following...

5. While the U.S. citizen must also file an I-130 petition for the alien spouse, there is no requirement "to file a Form I-130 immigrant visa petition on behalf of the aliens children seeking K4 nonimmigrant status, since K4 is merely a derivative nonimmigrant classification," according to the BCIS rule. K4s are dependent on K3s for their status.

6. However, as the BCIS rule explains, the K4 child will not be able to file for adjustment of status in the United States until the U.S.citizen parent/step-parent files a I-130 on behalf of the child. If the U.S. citizen parent/step-parent never files the I-130 petition, the immigrating parent may do so once he/she has obtained LPR status, but the child would have to wait for an available visa number. Finally, according to the BCIS rule, as the immigrating parent, upon adjusting status, "would no longer be in K-3 status, the child would no longer be in lawful K-4 status, since this is merely a derivative classification",
and that child would begin to accrue unlawful presence. As the K3/K4 may not change status in the United States to another NIV category (see below), the continued lack of an I-130 petition will eventually create adjustment of status problems for the K4. K4s who do not meet the definition of stepchild in INA 101(cool.gif(1)(cool.gif because the stepchild relationship was not established before the stepchilds 18th birthday will face the same problem K2 derivative children of fiances have long encountered, i.e., the U.S. citizen spouse will be unable to file the I- 130 petition on their behalf. In these cases, the K3 will have to file the petition when he/she obtains LPR status.

(someones please confirm this for me)...so when they request for an affidavit of support is my case seen as 2 unit family or 3 with my son? not sure about this one...but the other guy who had the same case as me got exempt.

ok so...if i file next month january...I would be filing for the CR-1 since our second year anniversary is still to come october 18, 2009 but if they get their interview after that date, would the Us embassy give them an IR-2 at time?

hi everyone! i am so new to this but im so glad that i found this online. been trying to get help from random people but by just reading everyones forums, im glad that there are couples out there who have or will experience this long journey i am about to embark. but i have a ton of questions! please help me!

ok here it goes...I'm an american citizen. I was born in Long Island New York which makes me an American citizen by birth. My parents are both Filipino. My mother at that time was an immigrant in the United States. When I was still an infant, I went to the Philippines. I never gave up my American citizenship and I never applied for dual citizenship. I grew up in the Philippines and went to school there for elementary, high school and college. I renew my American passport at the US embassy, in Manila Philippines. I would often come to the United States for vacations and holidays. The years and duration of my stay in the United States are as follows: summer (2 months 1993), summer (1 month 1995), summer (1 month 1996), and May – October (2003).

My husband and I met in the Philippines in June 2004. He is Pakistani and he was attending medical school in the Philippines at that time. He was on a student visa.

We decided to get married in the Philippines. Since I was an American citizen, I applied for an Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage (http://manila.usemba...v/wwwha009.html) from the United States embassy in Manila, Philippines. And since my husband is Pakistani, he also applied for that certificate from the Pakistan embassy in the Philippines. We got married (civil marriage) in the Philippines on October 18, 2007. My son was born October 28, 2007 in the same city.

I thought that my son would automatically be an American citizen too because I was American. But when I tried to apply for his US passport at the US embassy in Manila, the consular told me that I did not meet the Physical presence in requirement United States of U.S. citizen parent(s)...http://manila.usembassy.gov/wwwha003.html#presence. the consular told me that I had to petition my son instead...i was so sad and angry...anyway so whatever fine i couldnt so anything about it.

My family and I decided for me to finish nursing school in the Philippines and come immediately after to the United States. I wanted to claim residency in the United States, apply for a stable job and pursue my nursing career. I wanted to pave the way for my husband and child to come to America.

So on July, 2008, I bought a one way ticket to come live with my sister in Boston, Massachusetts. I have been living here for about 6 months now. I have been employed for 5 months now too. This makes it my first year to file my taxes.

What my family want is to be reunited. The big questions are:

I am aware of the two visas I can petition for my husband and son. The K3 visa is faster to get to the United States but would require more money and more adjustments to get the green card. The Immigrant Visa (IV or CR-1) takes longer but less money and less adjustments to make once my husband is in the United States.
But what I don't understand is how people shift from K3 to CR-1 or how they drop the K3? thats so confusing! i dont get it! please help me. I understand that i start out with the I 130 then after I get the NOA1, I can sent the I129F form but when i get the NAO2 or when my I 130 gets approved them i can drop the K3? wwwhhhaaattt? oh my gosh i dont get it, please help me.

And I understand that with the K3 there is a K4? but i don't wanna put my son under a k4? because he is also my son! if i plan to petition my son as an immigrant visa, do i have to file a separate I-130 for him?

WHERE DO I GET STARTED? I KNOW IT STARTS WITH AN I 130 BUT THEN WHAT? PLEASE SOMEONE HELP ME...SOMEONE WITH THIS EXPERIENCE!

i was thinking of hiring an immigrant lawyer but so far all they ask for is a large fee for their services and im trying to choose the best one! ugh...its so frustrating...i just want my husband here first to help me get more settled and to help me with expenses in then in a few months, my baby can come too!

hi all...i know this may sound stupid...but did anyone have problems if their spouse was muslim or pakistani or from a muslim country? im just really worried about it...i know its supppose to be land of the free and the sept. 11 thing has died down a bit but im just really worried...my husband is from pakistan and i love him very much. it was not a problem for me that we had different religions...in fact, its one of the things that drew me to him, when we first met, how muslim he was but he was still so normal and was such a nice guy...(when we met in 2004)...because of all those terrorist things people show in the media that sometimes stereotypes people! most aren't true! im just so worried...

thing i am just worried by sons will be ready first before my husband and of course i would want them to come at the same time...how could i take care of my son alone? i am the one supporting the both of them so far. my husband just graduated, no job yet too. also, when they both come here, at least i can work and my husband can take care of our son while they are settling in and eventually when my husband gets a job, i can work less and stay home more for our son.

im sure you both know that life in america is not that easy...esp with kids...having a nanny and day care and all that. its not like back home where you can get help easily. and like i said, i had to do everything for my family...imagine leaving my son back in the philippines because no one wanted to help me with being a co sponsor or fees with the forms because at that time i was still a nursing student? it all goes back to how the family is...well i guess its working out okay because i am now proving myself...that a can do this for my family...and to think im a woman! you guys are just lucky that ur USC spouse's family helped out

also rami filed though the dcf and im so surprised how fast it went. my husband is pakistani and he is living in the philippines...and we will file in the us embassy in the philippines. i hope it won't take that long for him, he might even be put on AP! oh my goodness i really hope and pray not! what i am still deciding is to file I 130 for my husband first then after 2 months my son so my husbands will at least be first in the race because my son's will most probably get his done in 3 -4 months and how can i take care of a baby alone and work? what im saying is i want both of them here and to come at the same time...visas ready same time... i can not do it myself if my son comes first...any more advice brothers?

oh yeah and one more thing... "In my case I applied for IV for my child thru the US embassy- Jordan and it took almost a 25 days and finally they came to the US" so it only took 25 days for your daughter to get her visa...i was looking thru your timeline...wow...it was so fast and quick for you! i really wanted to file when i was still in the philippines with them but like i said i was still a student and no relatives wanted to help with the financial support. i had to show them and do it on my own and i thank GOD everyday for at least letting me find a job very quickly here in america...

so please answer my ??? since your wife did your visa and daughter's visa together...it went faster?

Hi rami! How are you? Thank you so much for replying...i have a couple of questions more...

1. Did your wife file at the same time with you and your daughter? same time right? and you said only one (1) I 130 form for both of them since i would have to list my son's name under my husband's I 130...? someone suggested i file one I 130 for my husband and one I 130 for my son? so that means two payments of the I 130...i will try to call the USCIS to find out.

2. Since you and your daughter filed at the same time...did you have any problem with her immigrant visa coming first? or yours and your daugther's came at the same time? what I am very worried about is...if i file together my son and husband...my son's IV will come first...and the processing of my husbands will take longer...and when my son's IV will be issued he will have to travel within 6 months too right? what it is passed that 6 months and they have not given my husband's visa...my son would have to travel to the US without his father...and it would just be me and the baby and i have to work...OR since yours and your daugther I 130 were together...it speed up the process? because of your 10 months old daughter? where is she now? is she in the US with you? and your wife here too?

3. I understand that my son is exempted in that I 184 thing...but what will be the total income required that i have to show...for me and my husband only (2 household members only) since my son is exempted?

My husband and I have decided...we will do the IR-1 route...we are not married for 2 years...we will still be two years in october 2009. which is in 10 months...i plan to file in january only for my husband...because if i file same time...my son's might come up first and i can not take care of him alone here while working...and my husband will be very sad that me and my son are together and he is still waiting for his visa. but if i file theirs together and by doing that...it will make things faster...i will file them together...i just need to know from your experience.

actually my husband just graduated from medical school last oct. 2008...he is doing more studies...he is in his master's program in public health which will finish in november 2009...and he is also doing his internship in internal medicine which will finish in november 2009...so i hope the visa and everything will be ready by then...

we were deciding that my hysband come first...find a job too so that i will not be the only one working for our son...but maybe after 1 -2 months my husband arrives and he has a job, my son can come so i will not be working so much...

Hi rami and everyone! wow, im so glad you logged in through visa journey...anyway, please take the time out to read my situtation. it very similar to yours. unfortunately, i already came to the united states without my family. My parents and relatives told me i had to come first and get a job and make everything stable for my family blah blah. and no one wanted to help me out when i was still in the philippines with them. anyway i was a new graduate that time and i also did want to prove i can work and support my family and bring them to america myself...so i guess its working out well. im a professional now and i have a steady job...
the thing that is going through my mind is whether i should do the K3 or the CR1 for my husband. I am planning to file by january 2009 and I dont think they will get the interview and everything done before our second year anniversary which is Oct. 18, 2009...so after our second year anniversary and they go for interview after that I am hoping they will give their IR1 and IR2 visa for my husband and son instead of the CR1 or CR2 because we are 2 years married already.
plus the issue with my son, I want him to enter the united states as a LPR already so that all we would have to do is give another form to get his american citizenship once he enters. if my son were to enter on a K4, I would have to make a separate petition, another I130 for my son when he enters...plus the headaches of changing my husbands status and all that if we go through the K3.
I just want to ask you what you did...did your wife have to send two separate I130s? one for your son and one for your husband? I know the I129F does not ask for any fee and I could go for the route K3 because It might come up before the petition for the CR-1 gets approved but Ill have to see how it is being done in the Philippines. I'll have to call them and ask too if my husband can get his visa thing done through the embassy in manila because after all he is in the Philippines but he is from Pakistan.
The embassy in the Philippines did not even reply! the one in pakistan that i email everyday, replys to me and answers my questions!

HHHIIIII RAMI! oh my goodness, i thank the heavens above that i read your post! i hope you still check your VJ! we have the exact same situation! i totally can not believe it! our stories are very similar and for months now I have been trying to look for answers for my child and husband. ok so here's my story!

The same with your wife, I was born in the United States, my mother was only an immigrant visa. then when i was still an infant, she decided to go back home to the philippines where my parents are originally from. so basically I grew up in the philippines, went to school there and everything. but i did come to the united states for holidays and vacations, during summer but basically grew up in the philippines. i never let go of my united states citizenship! i never got any dual citizenship so i was never filipino, always american and everytime my passport expired, i just went to the embassy in manila to renew it.

ok so i got married in the philippines to my wonderful pakistani man! (he at that time was a medical student in the philippines and on a student visa). our baby came too early...hahahaha...we were both very young me 24 and he 24 also. but we thank GOD for our wonderful bundle of joy. then came disastrous news! i thought my son would also get america citizenship through me, his mother but the consul at the us embassy in the philippines said i also did not meet physical requirements in the united states (5 years). she advice that i will petition my son instead. i then asked, how long that will take...and she said 1 year? what the hell right! i was so mad and i was crying! a year to have my son to come to the united states? but im his mother! im american? shouldn't a child a year old child be with his mother and she says one year!
so i said forget it, fine, let me finish school...because that time i was a graduating student of nursing school....so after graduating nursing school, i left the philippines...i left the love and light of my life...my husband and my child...i left them, the most painful and hardest part i had ever gone through. but i gave them my promise that i would work all my bones, sweat, and tears to bring them to america!
i know i could have petitioned them through the us embassy in manila but i was unemployed, no tax returns, and just graduated...i needed to find stability and residency here in america. and besides, no relatives willing to help for co sponsorship....that totally sucked...but so what...i told myself i could do it all for my family!
i am now here in the united states, i found a job, been working 5 months now...and i have been away from them for 6 months! ....how time flies...
so my questions to you rami are:

what petition did your wife do for you? i am doing my husbands petition here...through the USCIS because obviously i am here...i want him here soon...i miss him very much and i am torn between K3 and CR1...please tell me how you did yours!

also for my son...do i file a separate I-130 for my son? (another fee of 355$...one for my husband...one for my son? 355$ +355$ for husband and son)? also, my son is not elegible for a K4 right because he is also my son and not only my husband's son...

after filling I 130 for my son...what are the next steps? you are right, they don't put much info for CR2 or IR2...and i didnt even know there was such a thing as CR2...I mean what i know is IR2 for the child only...how did you end up getting a CR2? all i know right now is after the I 130, they give you a receipt and they do the visa processing at the embassy in manila and my son is suppose to go there? but thats all i know...i need more info...

also, its such a relief that my son doesnt need the Affidavit of support!...so that does mean for my husbands Affidavit of support...i should only calculate for 2 family unit? for me and my husband only since you said your daughter was exempted?

BCIS will determine whether your child is eligible and approve the application, then forward you a letter and naturalization appointment date. You present the BCIS approval and appointment letter to the U.S. Embassy or Consulate.
The U.S. Embassy or Consulate will issue the child a B-2 visa. This procedure allows parents to make a one stop visit to the United States for the purposes of naturalizing their child as a U.S. citizen.

also...how come your wife is not in the united states? if she comes to the united states with her us passport and your daughter's visa...your daughter will come in as an LPR and then just file for citizenship. i will look into this more...i cam across it a couple of times...i even book marked it but have to look for it because my son's situations is still the same...

hey all...this came very strange to me...one of the immigration lawyers who i asked a question with gave me a wrong answeR? i asked if i had to file separate I 130's for my husband and son? and she said no? then i called the USCIS and they told me i have to file one I 130 for each...one for my husband and one for my son (im his biological mother) and one check for my husband and one for my son...also when i posted my case...someone did say yes, file separate I 130 for your husband and your son...very strange...she made a mistake?

lucky you! and lucky your son too! i couldn't do the CRBA for my son although his mother is a USC, i was born in the US but i grew up in the Philippines and went to school there. I didn't meet one requirement...which was to have lived in the United States for 5 years before my son was born. I even talked to the consulate in the US embassy in Manila before I left for the United States but she said I would have to file for a petition for my son.
So now my son has to get a filipino passport and I have to petition him...the IR-2 route...but its all good, i mean he would eventually get his US ctizenship once he enters the US and lives in my custody...I also wanted to file thru DCF at the US embassy Manila when I was still in the Philippines but i didnt have a job, no financial support and no one wanted to be my co sponsor...anyway not bitter about that...at least i fought through for my family, graduated, got my a$$ back to the US and found a job...SUPERMOM and WIFE huh?

i currently signed up for life insurance with my son and husband as the beneficiary...only 9$ a month and the insurance is 150,000$...not much but its just for now, another evidence for a bona fide marriage. also i just sent 100$ to him...not that i do that and he needs money from me but just to show we have co mingling of finances since i can not add him into my accounts here in america (ING and checking accounts) because he has no SSN, i'm including that and maybe 4 -5 pictures or him, me and my son before and left and pictures with me meeting up with his uncle in the United States and him with my parents.

i was just reading some timelines and i noticed CSC give away NOA2 after 3 -4 months while VSC gives it after 7 -8 months...whats wrong with Vermont? but i dont think we can choose which service center...sad.gif depends where you live i think, but sometimes people get transferred to CSC from VSC...can we write a request letter for this?

hi VJer's...need a little help here. Im about to send the I 130's of my husband and my son...I just need to double check with anyone who has time to browse through this...so here is what I am going to put IN ONE PACKET
for my husband:
1. Payment: Check for 355$
2. I 130 beneficiary: my husband
3. copy of my birth certificate (from the REGISTRAR’S OFFICE of my town in New York)
4. marriage certificate - in this case the NSO copy because we got married in the philippines
5. my G325a
6. husbands g325a
7. photo of me
8. photo of my husband
9. our evidences of a bona fide marriage: our son's birth certificate (NSO copy)
Life insurance I got from them
a copy of me sending money through western union
4 - 5 pictures (still choosing which ones)

for my son:
1. his I 130

3. NSO copy of his birth certificate since he was born in the philippines
4. a copy of my birth certificate

I think I shall include a cover letter too indicating which papers are for which I 130 and i think I need to paper clip my husbands papers together and paper clip my son's as well... did i leave anything out?
i am concerned about my birth certificate, my mom gave my a copy of the one she had ever since i was born but it ripped so i ordered from the town that i was born in in new york, through the REGISTRAR’S OFFICE...i hope that is okay.
and also if anyone knows about the NSO copies from the philippines, I will send the original marriage certificate and birth certificate for my son but will just send a copy of our proof of bona fide marriage og my son's birth certificate...

american citizen...i was born in the united states...i did not grow up in the US...i grew in the philippines. my mom was

working in new york when she had me but decided to live in the philippines when i was still an infant.

i never gave up my american citizenship and i never got filipino citizenship. so basically i was an american growing up

in the philippines. i only spent vacations, holidays and summers in america while i was growing up.

i am married to a pakistani...we met in the philippines ( he is on a student visa). i gave birth to our son last 2007 in the

philippines. i tried to get CRBA and a US passport for him because i am am american citizen and I am his biological

mother. but the consular in the us embassy in manila, philippines said my son can not claim his us citizenship because i

have not been present in the united states for 5 years prior to his birth...she adviced that i should petition my son if he

wanted to come to the united states with me, meaning he should get a filipino/pakistani passport for his immigrant visa.

well, my family and i decided for me to come to america first and establish domicile here. so i left my husband and son

back in the philippines. i got a job and i have been away and living here for 7 months now. and i want to petition my

husband and son.

i know that i have to file separate I 130's for each, one for my son and one for my husband...the thing that worried me

the most is that my son's will probably take only a couple of months and his visa will be ready much earlier than his

fathers...after all my son is only a child...and i researched that it would not even take more than 5 months for my son

to get his immigrant visa. and when he does get his immigrant visa, and enters the US it will not be very hard to get his

citizenship because he will be in my custody (USC parent custody). of course i want my family here but i am working...i

work at hospitals and if my son's visa comes earlier than his fathers...how can i take care of him (a 1 year old) alone

and go to work. i wanted my husband to come first and maybe after 3 months my son...so i will see if my husband can

get a job here too and so we can manage out finances before my son comes...of course we want a place well establish

for my son when he enters the U.s.

I am assembling our package and i have most documents with me already. but i am torn about whether i should

already do my son's with my husbands I 130...im sure my husbands will be a longer journey because he might run into

some A.P. (administrative processing) and i dont want him to be left behind. i tried asking some immigration lawyers

but they did not give me an good answer...most of them just commercializing for me to hire their law firm...

i asked that if my send both I 130s at the same time...would my son's affect his fathers by maybe speeding up the

process? or what if i send my husbands now and my son's 2 -3 months later so their visa will be issued together?

please help and advice....i know its a little personal but i want to hear your opinions...

also have a couple of questions regarding filing out the I 130...if i decide to do my husbands and son's I 130 and send together..one for each...in the last question...

1. If separate petitions are also being submitted for other relatives, give names of each and relationship.
(for example this is my husbands I 130)... Name of son...(my son/child)?????

2. Have you ever before filed a petition for this or any other alien? YES (obviously my son)
If "Yes," give name, place and date of filing and result........
Son's name, (place)--don't know yet because im still sending the initial I 130's for each, both of their I 130's going together...(date...the date when i signed their I 130;s??)

so the stamps on my US passport would be a problem? it could provide an bona fide marriage because i have stamps there when i left the philippines and came back to the philippines. and thats where my husband and i met...in the philippines. Copy of the full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship.... i was thinking of just sending my birth certificate but maybe i should send my US citizen passport too...do the visas of the countries i have travelled to for vacations/ tourist affect my petition? i.e. ive been to brazill and hong kong...

thank you geezer...my son and husband live with my mom and dad in the philippines and my mom takes care of my son while my husband does his rotations at the hospital. i think it would be better for my son to get a philippine passport, my parents can do that, my dad works in the government in the philippines, and you know how it its in 3rd world countries, as long as you know someone in, then youre good.
we will file through the US embassy in manila philippines because that is where my husband lives and he will be working there this whole year...

What passport did you enter the US on?...Like I said, I am an america...of course I entered the U.S. with my american passport.

That is the countries passport you should use for your because you are in the US and from a practical standpoint you need to file for the passport here. Were you married to your husband when you had your son?...yes I was married to my husband when i had my son. american at that time too but gave birth in the philippines

I take it your husband has a Pakastani passport? yes but he lives in the philippines with my son.

You need to file a CR-1/2 the K-3/4 will not work in your situation no matter what passport your son and husband will enter on because once you meet the residency requirements to obtain US citizenship you cannot pass derivative citizenship onto your son with a k-4...i know and i understand that i need to file separate I 130s for each.

You will want to file both petitions together, they will be processed together which is what you want, if your sons is approved first you simply request the interview not be scheduled until your husband is approved abd his interview scheduled.

i see...a VJer suggested that too... and where would i request this? when do i request this? at NVC? do i include it in my letter to USCIS with their I 130s?

The 1-130 you file for your husband should include your/his baby son, so long as it can be proven that you are the mother and they are father and son. That way, everything happens together. There is no other way to handle it. The real question is what country's passport will they have? That's an issue that can't be resolved in the U.S.A. Perhaps your husband could talk with the Pakistani Embassy in Manila and get one for the son.


Thank you...I have been advised from an immigration lawyer, fellow VJers and i think i called USCIS before the holidays if i need to send one for each...one I 130 for my husband and one I 130 for my son, i will call and double check again. i asked one of my co workers and he said he send only one I 130 for his wife...and them when his daughter was born he called and asked them to put his daughter too...but he was not a citizen but an LPR only.

my son can get a pakistani or filipino passport but i think better to get a filipino passport...

any one else?
