Ok :-) . yes there are lots of different options and processes ppl do. We ( me and my husband ) recently started cr1 process so  still many things are not that clear. However, it is clear they can be slow. 

 

Joaonzinho - based on what i see from your post, are you waiting 4 months for 1-130 form approval? are you also doing cr1 visa and , if i may ask, why did you have senators call uscis for you? it should be soon approved , 4 months is long for only i-130 form.

 

i still have no idea if i-130 form we sent is at National Benefit Center ( becuase it says MSC on receipt number) or some other center ( like California Service center ) as i-130 form is sent from Washington state

Lost at Sea- i see from your timeline your 1-130 from was approved in 21 days??? it is super fast !!:-) and all the process in your case was very fast, it is great!

i guess it is not always like that to be approved really quickly? i wish it was like that  more often!

 

maybe adding 129f could make it all shorter in time

Yes we are doing CR1 visa and we recently got only noa1. On receipt number it says MSC and next several numbers- im not sure if it is National Benefit  Center but according to what i was reading it is national benefit center.... which is in Misouri but i.130 form is sent from state of Washington so it is not completely clear to me why National benefit Center, maybe it should be California Service center becuase it is closer? well receipt number has MSC mark before numbers. 

Which is the fastest center for i-130 form? i also have no idea is it good to send 129f form in addition to i-130 form, maybe it will be faster ( then it will be K3 , for which i read is not much faster than CR1 ) ?

Hi everyone :-) I have several questions i would like to know about i-130 form and timeline for it .

 

I wonder if anyone knows which dates of i-130 forms are processed at the moment by USCIS? can that be known? 

 

If someone sent i-130 form recently, in July 2013, what would be approximate time of approval? Receipt number starts with MSC, i guess it is National Benefit Center? Is this center slower or faster than the other ones or just same like the others, based on your experiences ?

This form isn't that important.  All it does is trigger the IV bill to be invoiced.

 

Put your married name if you're using it.

 

 

Visa in passport name

Green card in visa name.

Hello everyone,

 

Well, we got case number today ( our case arrived at NVC at 6th of march and at 9th of april we got case number :-) - Thank you GOD and Jesus!! ).

 

I would really be grateful if someone could answer me on one important question with ds 261 form ( choice of agent )

 

Well that form does not have section " Other names used" , next to Last name section. only Last Name and Given name of applicant . Well i changed my last name into my married name several months ago ( while we were at uscis stage ) and when i want to fill out ds 261 form there already writes my last name . i can of course correct it , by deleting and entering my new last name, which is married. I thought this form will have "other names used" section also but it does not. So , i wonder if this will be confusing to them. I can leave there my maiden last name but now it is not what writes in my passport now ( when we were sending I-130 form i had there my last name maiden in passport and all documents but in the meantime i changed it  so my passport has my married name now)

 

 

Advices would be of help really...i dont know if they will be confused now when see i deleted my maiden last name and write now my married last name...( they still dont have my IV package and docuemnts there  of course to see where all it is visible from my marriage certificates and such that i change it )

Base on my experience I submitted two police clearances, 1 from my country of origin that I live before and 1 clearance from my country that I presently residing. Those two clearances doesn't show period on how I long I live in such countries. Hope this will help you and think positive. Good luck to your journey!

I had no idea about that period of time.  I thought it has to have only purpose of it , that is clear.  I really hope it wont be problem for nvc , because it does show the purpose of it , which is, i guess, the most important for such document .

Hi there! It doesn't matter if it not show in your police clearance how long you live there as long as you are cleared and no criminal record.

i would really be grateful on answer about this- my police certificate in a country where i lived before too and in which im citizen too ( i have 2 police cert therefore , in country which i reside now and in which i lived before) - well the police cert in country in which i lived before does not show the period of living there- how long i lived there ( i lived there a couple of years). it only says no convictions . But it lacks how long i lived there.



I wonder if this is really problem for NVC? i did not know it before. Will they see it as a problem?



I would appreciate really if someone can answer. someone who already sent these police certifocates to NVC and knows if their cover period of living in a certain country too.

i wish i knew this.....or we need to wait for NVC to send us instruction when to send packages?...we would send them both together .  i read that once both fees show as "paid" one can send packages...i wonder if it is possible even before ds260 form is completed? it would be good.

in one section of ds 260 form , they ask to select travel document- i put Passport of course. And then it is asked for Document ID - HM? my passport only has Passport number and my Personal Identification Number ( personal ID ) - but there is not any Document ID written there ( like special passport ID- only passport number and my personal ID) - I wonder which they mean by document ID between these 2? is it passport number or my personal id? im not sure and i wanted to ask here before i select it...

 

because at the end of ds 260, there is section where they spefifically ask for passport number. which i wrote...

 

i want to be very sure what to write as document id for passport in 1st section of ds 260- is it my personal ID or passport number?

You need a case complete before you get an interview date.  Look at Saylin's spreadsheet to see the times and also go to the interview thread to see how long people are waiting from your country.  There is a large country variance in this.

it is really important  to know- when i fill out ds 260, it wont accept me addresses where i lived several years ago( while i was studying). it says :

 

 

"There is a gap greater than a month in the dates you have provided. Please include ALL addresses where you have lived since the date you turned 16 years old."

 

i try to do it but when i enter i get this message. i lived for several years in another country for study and when i write it , i get this message. it was several years ago and from then, im at country of the birth. 

 

how do they sort those dates? why i cant enter the dates and i get this message? ( plus saying it would delay interview schedule becuase of gap in dates) .

 

ugh! anyone knows how to write those dates thee if lived in another country for several years so that dont receved that gap of time message before wanting to move to another section for fill out?

 

plz it would be lot of help if someone answered!!

From the payment portal, yes, but not the receipt.  Download the applicable document cover sheet.  Like I said, it will have the correct address AND the bar-code.  The "receipt" does not.

Those are the correct addresses, but what you do, is download the applicable document cover sheet for each package.  You'll see not only those correct addresses but the needed bar-code.  Do not send either package until their associated cover sheet is available for download.

 

You mean the bar-coded sheet from payment portal? ( the receipt that one downloads after fees are paid and send in the package too).

well today my husband ( petitioner) received email from NVC - they say that i ( beneficiary ) need zo fill out AOS form!!! HM. im not US citizen, im the beneficiary and i dont think i can fill it out. why would they ask from me to fill it  out?

 

Also, husband called nvc after we sent both packages and they said they have both IV package and AOS form received  ( from my husband - he filled it and shipped it to them as he is US citizen). 

 

i dont know why they ask from beneficiary to fill it ? is it some error or they really want it from beneficiary?

 

This is very important to know and i would appreciate the answer, this is so confusing

Well it happened that petitioner lost the job at NVC stage , after aos and all needed documants are already sent and case is almost completed ( final reviewing).  

 

So i guess Joint sponsor is needed at this point , even when new job is found.

 

I dont know should we call and inform NVC now at the end of reviewing phase about job lost - or tell it later- at interview?

Also , also it is unclear section " dependent children"- if Joint sponsor has children but are not financially dependent and not in same house, should they be listed too? or only the one who lives with Joint sponsor in same house ?

 

i assume Joint sponsor will need to enclose birth certidficate , last 3 year taxes documentation too , enclosed to aos?

The information that was on the I-864 that was previously submitted has fundamentally changed by the petitioner's job loss. Failure to submit a new form reflecting this is Material Misrepresentation (very serious offense that can and will cause major problems for your case). If the petitioner is not employed at interview time, the new I-864 must reflect that; if the petitioner has a new job at interview time, then the new I-864 will reflect that information. Regardless of what the petitioner's employment situation is at interview time, the I-864 that is in front of the CO must accurately reflect it.

We would submit new aos of petitioner and bring it at interview, along with Co-sponsor aos.

 

I just dont understand what to write in new aos of petitioner if at that time job still is not found? We are at end of nvc and interview is getting closer so until then i still not sure new job will be gottten. So in that case, that new job is not gotten until then- what to write in aos of petitioner? there would not be tax documents or numbers of income there i assume....eh this with job lost really was not needed for our situation now, but what to do, it happened.

 

although i hope that new job will be obtained until inteview, i dont know what to write in new aos of petitioner in case it is not gotten at time of interview - and if that aos dont have  needed numbers even at that time, will Co-Sponsor aos would be of more help?

Bring an updated I-864 to the interview along with the I-864 completed by the joint sponsor.

 

 

Well i cant know if that the petitioner will have 100% new job  that soon so that new aos will be updated. We can get Joint Sponsor aos but for new aos of petitioner im not 100 % sure as i dont know if new job will be got that soon really. 

 

Does anyone know is new updated aos by petitoner is really necessary at interview? I cant know if there will be job gotten that soon when interview happen....i think it is understandable as it does not depend either on me or by petitioner. On the other side, we can get Joint Sponsor and show aos of Jonit Sponsor at interview.

 

Are you sure for the above written sentence about updated aos of petitioner?

 

It confused me really now...the interview is getting closer and i really dont know if new job will be obtained that soon. Possible but not 100 % possible. 

 

The whole process already is not easy and this confused me in addition

Hi just sent our package on the second, we did leave some areas blank if they were not applicable...now that you are steps ahead what is the answer is it a worry? we haven't received any notification back makes us wonder what we did wrong, we also used personal checks, and did not have all the bona fide labeled...how long did it take before you heard from them? :unsure:  :unsure:  :unsure:  :unsure:  :unsure:  :unsure:  :unsure:  :help:

We heard back from Uscis after 5 months since we sent our 1-130 form to inform that  our case was transferred to TSC and from there it was approved in next 1 month and few days.....so our 1-130 form was approved in 6 months.

Well i was reading now at uscis.gov site that fields  MUST NOT BE LEFT BLANK if something is not applicable - one has to still write something there: None or N/A.....in some fields where were n/a - we did not it. Great. Now more waiting for corrections probably.

 

I wonder if anyone every left blank fields instead of putting there "none " or "n/a" if  question does not apply to applicant ?

Thanks for suggestion....it is not easy not to worry knowing there is an error in i-130 form- i just hope it is not too important error.... so they can see foreigner is NOT in the usa if left fields blanks there instead of putting n/a in that field- as well as writing foreigner's employment address in country of residence in field asking if there is present employment in the us- it also should have had n/a...but ok we did not know it.

 

the thing is that thinking that errors could make delays and such if they are not understood well by uscis - it could mean more  waiting again and this process is already too long - when someone is in love it is difficult to be apart from loving person that long. 

 

Im not sure if we should call uscis and tell them about this error on the phone...

Then stop worrying about it.

Well there is only one section for it- that one you are talking about- when it says "if foreigner is currently in the us , fill the folowwing: " then it asks for date or arrivals, ways of arrivals and such- after it, it says" name of present employer" - the thing is we had no idea they mean to name present employer in The US ( if foreigner is in the us) - we thought they mean on employer in country of residence - so we put there foreigner's employement date and name - in that field- no other fields for it - well we ledt blank asking question if foreigner is in the us - we also did not know we need to but n/a as foreigner is NOT in the us at the moment.

 

Other fields i was talking about is not in 130 form, it is in G-325a form - there they ask for employment data of foreigner's IN the country of residence - we also wrote there name and dates of employment - which is correct employer but wrong date of employment - for Outside of usa.

 

This G-325a form is attached to i-130 form and it goes in package so we sent both of them.

Now i hope they will figure "if applicant in usa is currently in the us , complete the following " - we left it blank , no writing there N/A as we thought if leave blank it means n/a - well they hopefully can easy see and check if foreigner is in usa and in this case - foreigner is not in the US.

Now you're confusing me.  Where did you find a place to enter a date of employment on the I-130 form, other than the section directly under whether it asks if the foreigner is in the USA now?

Well im a bit confused - i had no idea that question in 130 form about employment is actually question about working of foreigner who is currently in the U.S- i thought they ask for present employment in country of residence- we left field "if applicant is currently in the U.S complete follwing , he she arrived as " - we left that field blank as foreigner is not currently in the U.S - well we did not put N/A , we did not know we need to write that- but in next field when they ask for present employer - we wrote foreigner's empoyment is country of residence !

 

 I hope they will figure it is actually employment outside of usa, it did not happen in the U.S .

 

 Hmmmm i really had no idea they would ask for employment in the U.S - anyway same thing is written on G-326a form but there they ask for current employment in country of residence, and we wrote there the right employer ( there is only 1 employer through whole process ) - but we put there different dare of employment than in 130 form , that was worry as i thought what they will think is see 2 different dates for same one employer.

 

I really hope they will ignore this error that i wrote name of present employer in 130 form instead of putting N/A there as foreigner is not in the U.S currently . Huh.... is it ok to leave field "is foreigner currently in usa " - blank if is not? we somehow did not put anything in there as foreigner is not in the Us at the moment

There's only one place to list employment for the foreigner on the I-130.  It does not say "employment in the USA" but the question is only applicable if the foreigner is currently in the USA (see the check box above the question about employment) and working in the USA.  This is not clear from what you see on the form, but I'm telling you the answer should have simply been N/A.  If you filled anything in that spot, they will ignore it entirely because unless the foreigner is currently in the USA on the filing date, the answer is NOT APPLICABLE.  It's a common error that will be ignored.  Don't worry about it.
