If you have not received this notice within 15 days of May 15, 2013, please call customer service at 1-800-375-5283 for further assistance.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.



Wait until you get the official notice and the reason for denial, then post back with exact details.

See what others who have been successful did to complete their stage of immigration,  You will be fine now with guidance and your buds a VJ.  Remember this is the USG they are not Hi Tec at this stage at all.

All of our relationship photos that we have submitted for all of our encounters with the various immigration entities have been digital color laser photos, printed on 20# regular white photocopy paper. The dates and people identified was noted on the back. The printed photos were placed in Avery Presentation Sheet Protectors. We had no issues, RFEs, nada, zilch, with this process.

 

All of our passport photos complied with DOS requirements:

For the K-1 visa, the "actual" marriage has to occur in the US, within 90 days of the beneficiary's POE arrival in the US (refer to I-129F instructions for details). If they leave the US prior to obtaining either an Advanced Parole (AP) document or a I-551 Green Card, CBP will likely not allow readmission to the US, and USCIS may determine that the immigration process has been "abandoned." You will then likely have to start over with the spousal visa process.

 

There are numerous threads about this very issue, use the forum's search function to find some of the threads related to this often-asked question. 

 

Many folks get married in the US, and then have a ceremony in the beneficiary's country for their family and friends, after receipt of the AP or Green Card.

This is but the most recent of several outstanding answers.  All that I can add is this:  In general, the consul will have made up his mind in a "Refuse visa / Issue 221g / Grant visa" before the beneficiary walks in to the interview.

 

USCIS will not care about evidence of bona fide relationship, in the petition package, that goes beyond its own requirements.  However, the consulate is not supposed to be able to deny the existence of material that it knows that USCIS has seen.  Consulates have, of course, refused to accept evidence brought by the beneficiary to the interview and simultaneously claimed that there was insufficient evidence of a bona fide relationship.

 

Had I known in advance what I learned the hard way about the ####### Guayaquil consulate, I would have waited to file the I-129F petition until after my second visit to Mrs. T-B.-to-be, and front-loaded the holy hell out of the petition with the additional accumulated evidence.

 

The petitioner's presence on the consular premises (or just outside) will score points.

 

Two things have become clear to me during my time on VJ:  (1) New members focus so hard on the initial petition (I-129F, in this discussion) that they fail to look ahead and consider the broader picture.  (2) The broader picture is the consular phase, which is all-important and incredibly hard to straighten out if it's screwed up or if one gets hosed.

I (or anyone else for that matter) cannot accurately predict the likelihood of success or failure of your petition.  What I can and will say is this, have plenty of evidence pertaining to your relationship at the ready and make sure your significant other knows the details surrounding your prior relationship (in case it comes up at the interview).  Being properly prepared reduces the likelihood of failure.
