Some embassies/consulates require the USC presence at the interview, some do no allow USC at the interview. It all depends on the specific embassy/consulate.

 

The Guangzhou US consulate (not known to be an "easy" consulate) does not allow USC presence. However, I gave my then-fiancee my passport, with an Explanation of Relationship letter inserted in it. I asked her to pass that along to the  IO at the beginning of her interview. The IO accepted it, glanced at and kept the letter, and slid my passport back to her under the teller window, acknowledging my presence in Guangzhou. I am not sure if it made any difference in the outcome of the interview. However the moral support I was able to provide to my then-fiancee and her son was priceless. We were a team, taking a BIG step in our immigration journey together.

Due to the time frame uncertainty of these visa processes, it is generally recommended that folks REFRAIN from making ANY wedding reservations/deposits/payments that are non-refundable. Many people hold-off from making any reservations of ANY kind until the visa is in the beneficiary's passport in the beneficiary's possession.  Check it out yourself using the forum's Google search function with the terms "Visa wedding plans."

 

Your K-1 fiancé will be able to legally work in the US after marriage, after filing for Adjustment of Status (AOS), and concurrently applying for (and receiving) the Employment Authorization Document (EAD), or receiving his 2-year Conditional Green Card.

As baron555 noted, the beneficiary's birth cert. will be necessary after the I-129F approval by the USCIS, during the interview phase of the visa application process at the interviewing embassy/consulate.

At the K-1 visa petition phase of the process, the beneficiary and the petitioner have to include a letter of intent (refer to Page 2 of the Form I-129F instructions for details) with the Form I-129F petition submission. Read Part D of the Form I-129F about penalties, certification and petitioner's signature. That and your other evidence is usually enough for USCIS at this stage of the process.

While I, in general, agree with Darnell. As he mentions, the Evolution of Relationship (EOR) letter can be quite useful at the Department of State's Guangzhou consulate interview phase of a visa journey. However, it may be a bit premature, at this stage of the process, to include an EOR with the initial I-129F petition submission to USCIS. Front-loading of the initial petition is recommended for Guangzhou-bound petitions, but that should include a thorough and balanced blend of as many as possible of the types of documentary proof of having met and of having an on-going relationship mentioned in the K-1 step-by-step guide:

With regards to "proof of relationship" in these visa processes, pictures and documents often speak much larger to the USCIS than mere word statements. Are you speaking about the required "Fiance(e) letters of intent?" If so, become acquainted with the GUIDES section (located at the top of the forum page), and the Example Forms section.

Once the baby is born I would need to include the child to the I-29F correct ? The baby is not mine and we intend to file a K-2 . When we are doing this is not decided yet . Is it possible if the baby is born before the approval to do this and have the baby fly with us ?

You are providing too little fragmented and speculative information to be able to give you clear advice. 

 

For example: Who are the parents? Will you have sole legal custody of the child? Your next course of action will likely depend largely on what is stated on the birth certificate of this unborn child. Though, as you say, you have yet to make decisions.

I forgot to include that the child is unborn at this point . It is possible that she may give birth before the K-1 is approved . I was told that you can not inclue a unborn child on the I-129F .

Here are the form numbers for the usual steps from AOS to citizenship using the K-1 visa route: I-485, I-751, N-400.

Of course, that doesn't count other "incidental" fees, such as, medical exams and vaccinations, document preparation and certifications, licenses and fees, copying and mailing fees, transportation costs, etc. In conclusion, this endeavor is certainly not for the faint of heart, or light of wallet.

Getting the appropriate immigration permission from the father is important.  There doesn't seem to be anything different with a K-1 Fiancee Visa and two K-2 Child Derivative Visas. Be sure that the children have all of their appropriate documents. You are correct in saying that there will certainly more paperwork and expenses with three visas. :time: when you get your I-797c (NOA1) petition receipt. If you do, you will get a VJ date estimate range of your visa petition approval (NOA2).

 

Your receipt will contain a number with a three letter prefix, EAC = Vermont Service Center, WAC = California Service Center.
