K-1 Fiance(e) Visa Process & ProceduresPaperwork at wrong US consulate

Welcome to the forum.

Yep, it happens all of the time. I would suspect the bureaucratic NVC has a bit of trouble figuring where is the correct location to send documentation....lol.... laughing.gif

Good luck on getting it sorted out with the powers that may be....

K-1 Fiance(e) Visa Process & ProceduresHelp request RFE confusion

Welcome to the forum.

:guides: easily accessible at the top of the forum page. In particular, the K-1 Visa Guide Documentary Proof section:

http://www.visajourn...content/k1guide

That section speaks about the types of evidence necessary for successful visa petition acceptance. A primary requirement of the K-1 visa is that you HAVE to have met your fiancé(e) in the two years prior to the I-129F petition filing. If you have yet to comply with this initial requirement, you should consider withdrawing your current petition and refiling after you have met this requirement.

Good luck on your visa journey.

The scenario of the petitioner sending money to the beneficiary may not be a wise thing to voluntarily disclose. Some consulate officials could interpret that as supporting a family and rule you as ineligible for a fiancé(e) visa.

K-1 Fiance(e) Visa Process & Procedurescopies or original

I have gotten into the habit of putting all original documents in plastic page savers (ACCO), available at many stores. I have made good color laser copies  of all of the originals. Submitted copies, when appropriate. At visa and AOS interviews, brought ALL of the original docs and copies, and any other evidence. The IO can examine the original, compare the copy to it, and keep the copy for their records as necessary. It has served us well thus far.

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresI 129F Trouble with question 14a

Don't write 'NONE'. None means there is no A# in existence. There is an A#, the OP just does not know it.

Leave it blank. If you feel the need to put something there, then it would be 'Unknown'.

That makes common sense!

The GUIDES say it best, guides6ly.gif :

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file. 2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a local photo store such as Walgreens (if at all possible) or if not on a high quality printer. Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back. 3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

(Emphasis added)

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresK-1 Interview after Wedding What do I do?

We just received our interview opportunity for the k-1 in Montreal but its 2 and a half months after our wedding. Should we still go ahead with the fiancee visa or just get married and file for the spousal?

To get married and attempt to get a K-1 fiancee visa is immigration fraud. If you get married, file for a spousal visa.

K-1 Fiance(e) Visa Process & ProceduresGot the K-1. Now what are our options for getting married?

Thought I would put it all together.  TBone and others have each laid the process out:

Start making plans for your marriage now, you can shop for ideas, places, just don't make a  hard and fast money down option you cannot change if their is a delay in the arrival date.

Two weeks after you arrive go and apply for your social security card, why wait two weeks, their will be no information in their system for them to reference.  You can get the form on line and pre fill it in.

Once the social is in hand, get your drivers license or state id,  depending on your state regulations and square away the banking and financial stuff.

Their are lots of nice simple quick options to make sure you are inside the 90 day window; Las Vegas everyone likes to go there, the local court house, or your local and or frequented church.

For example we invited or people showed up in Las Vegas about 20+, had a beautiful ceremony at Las Vegas Weddings in their chapel (holds about 150), spent a few days and had some fun.

Got her on my medical plan at work when we returned, completed her medical for AOS at a Civil Surgeon..

Filed for the AOS in the 90 day window, and had a very nice reception at our ranch about a month after we got married i.e., wedding cake, BBQ everyone attended even the guests who went to the wedding.

Just because the government has a time line does not mean you can adapt and overcome.  Take lots of photos, save everything for your AOS filing and interview.

Order your wedding certificate(s)  etc. on a rush and get an Apostille if needed from the secretary of state.  Oh yea have fun and congratulations.

 Agree, basically what we did quite similar (except hold the ranch, we opted for O&V, instead. ). My then-fiancee and step-son got into town and we were off to the races.  We rushed to the courthouse to purchase the marriage license as that there is a 3-day waiting period before the marriage license is active. The next day went to the CBP Deferred Inspection Office to get step-son's I-94 error corrected.headbonk.gif  Got her signed up at SSN, got married at the courthouse 4 days after POE arrival, had a small dinner reception at the Space Needle restaurant. In the ensuing days, picked up multiple copies ($3/copy, a real deal!) of the certified marriage record from the county recorder's office 10 days later.  It wasn't the "first rodeo" (marriage) for either of us, and we had to get the son enrolled in college, health insurance enrollment, ID cards, medical exams, etc. Sent in the AOS paperwork x 2 [K-1 & K-2], with a wad o' money, seventeen days later dancin5hr.gif ..... So, we opted to have a nice quiet, secluded and romantic belated-honeymoon on the Oregon coast the following year, sent the son to visit relatives in the other Washington. Well worth the wait....heart.gif heart.gif

Like bigdog said, adapt and overcome. We tried to make it fun getting all of the bureaucratic BS taken care of ASAP.  Luckily, it paid off for us,biggrin.png  our AOS took 105 days to complete, even with a 'screwball' AOS interviewer. ph34r.png

Remember, this whole process is not a sprint, but rather a marathon, pace yourself. The end results are well worth the effort. yes.gif kicking.gif

K-1 Fiance(e) Visa Process & ProceduresDo I need to put the date we got engaged when applying for K1

Engaged isn't always a definable status. You don't need a ring, or to get on one knee to be engaged.

The main proof of engagement is your signed letter of intent to marry that each of you should submit in your I-129f. But it helps if you can supplement that with emails or letters, facebook status updates, etc that show you are engaged.

Agree, that is the intent of the evidence of relationship information that is posting in the Guides. good.gif The Guides are the cumulative efforts of MANY folks that have successfully completed their immigration journey. You need to show that you have met within the last two years and that the relationship is genuine.

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE.
