K-1 Fiance(e) Visa Process & ProceduresProof of Meeting in Person

Welcome to the forum.

USCIS isn't interested in what occurred greater than 2 years ago. What USCIS is interested in is you having adequate proof that you and your fiancé(e) have met in person within 2 years before filing the I-129F petition. Your evidence should be less than 2 years old. The types of necessary evidence is described in the VJ K-1 Guide.

There have been cases of petition rejection by USCIS over this very definite point.

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresHow to mail I-1129F

I just mailed ours off in a flat-rate priority envelope with delivery confirmation. Worked just fine. If you include the G-1145, then the USCIS will also e-notify you when they receive your petition.

Agreed!  That is what we have done for all of our petition/applications sent to USCIS.

K-1 Fiance(e) Visa Process & ProceduresDid you book your fight before attending the interview?

Not really a good idea. It's highly suggested to book flights only when the visa is at hand. Some may say when the ceac status says "issued", but never ever book a flight so soon.

Agree!  Only make reservations for dinner after the interview  , refrain from making any definite travel or wedding reservations prior to having your passport in your hands with the visa enclosed.

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresDo i fill I-129f in Ukrainian or English

If it were me, I wouldn't translate the address, it'll be needed for when the embassy sends out their part of the documents, and you'll need the (Ukrainian) postal service to actually be able to find the address to be able to deliver it. I can't see any point in translating the address.

Edit: looking at my form, I'd write the mailing address (part 2 question 3) in Ukrainian, then where it has "your fiancé's address abroad (question 29) transcribe in English, and in questions 31 and 32 do it in Ukrainian again.

Yep, re-reading the I-129F will reveal several interesting nuances. We were able to successfully navigate those nuances with my Chinese wife's address during our visa journey. BTW, her address in Mandarin characters was much shorter than the Roman character equivalent, requiring me to add supplemental pages to my petition, as needed.

???????????

It is likely that they will accept transcripts. The US Consulate in Guangzhou accepted my tax transcripts. However, at that point of your visa journey, instructions and requirements can often be embassy/consulate-specific, and therefore your question might best be asked at your regional forum.

Misinformation was posted above.

Passport photos do not have to be originals. You can have them emailed to you and print them in out in the correct 2x2 inch size yourself. You can even use a service such as https://www.epassportphoto.com/

Plain paper is absolutely fine. No need for photo paper to be used.

K-1 Fiance(e) Visa Process & ProceduresNot sure

We had good luck when we submitted certified divorce decrees from the State Dept. of Vital Stats. In Nevada you have to apply for certified divorce decrees at the county clerk office where the divorce was granted.

http://health.nv.gov...ssess_marri.pdf

This was for AOS, we submitted front and back copies of the certified divorce decrees. The IO asked to compare the copies with the originals at our interview, no problem. We bought several certified decrees, sometimes there is a deal if you buy multiple decrees. YMMV

HTH.

You really need to receive and review the RFE notice. It is pure speculation at this point trying to figure out the reason for the RFE. Hopefully it will be something simple. At least you now know that your petition is now in the 'active processing' mode...

K-1 Fiance(e) Visa Process & ProceduresI badly need your assistance

It is my impression that USCIS is currently overwhelmed with work and underwhelmed with enough staff. It is good that you do have your delivery receipt. Did they cash the check?

Over two years ago, our experience was that we received our NOA1 in about a week. I am not sure of the current timeframes for NOA1 on the K-1 visa. Hopefully, others with more recent experience will offer their advice about current conditions.

You could try to inquire at the USCIS Customer Service line, maybe you will get a real person and an appropriate response.....

K-1 Fiance(e) Visa Process & ProceduresTranslate Conversation/evidence

Refer to page 2 of the I-129F instructions about document translations: http://www.uscis.gov...i-129finstr.pdf

What you can do is redact sensitive portions of conversations. We did that and also only included a selected sampling of our Yahoo and Skype conversations.

There are several types of acceptable documentary evidence mentioned in the VJ Guide: http://www.visajourn...content/k1guide

Try to send in a good mix of all types of acceptable documentary evidence.

Good luck on your visa journey.

K-1 Fiance(e) Visa Process & ProceduresImmigration with Children

Kiwinyc makes some very good points about the paperwork and documentation necessary for the children (and for you) later on in the consulate phase of the K-1 visa process. At the consulate phase of the process, instructions and requirements can differ between consulates.  Here are the links to the Montreal consulate K-1 info page and for Montreal's "Packet 3 for K-1 visas" instructions. Also consider checking out the Canada Regional Forum, for country-specific information.

K-1 Fiance(e) Visa Process & ProceduresImmigration with Children

Welcome to the forum.

The immigration laws can be byzantine for adults, but they can be even more so for children. By listing the children, as instructed, on your fiancé's I-129F petition, your fiancé has done all that is necessary for the children at this time. Be certain to have the complete certified divorce agreement allowing permission to immigrate available for inspection. Send in a photocopy when requested, not the original. It can be difficult to get original documents back from USCIS and DOS.  If you can get another complete certified copy, it might not be a bad idea to obtain one. There will be more forms/applications (and accompanying fees) required for the children when you get to the interview phase at the consulate.

Take a look at the DOS Nonimmigrant K-1 Visa FAQs for more information about children and K-2 visas:

http://travel.state....nce-k-1.html#15
