K-1 Fiance(e) Visa Process & ProceduresPSA: I was given wrong information about visits with pending K-1.

Sorry to hear of your issue with CBP.

When we were going through the K-1 process, we realized pretty early on that it would likely take an Act of Congress for a visitor visa to be issued to my fiancee, a single Chinese female. However, it was relatively easy for me to get a 1-year Chinese visitor visa. So, I did the eleven-hour flight from Seattle to Beijing three times while the K-1 visa was being processed. YMMV

Good luck on your visa journey.

No problemo. That is what is great about this forum. The guides are the culmination of the successful visa journeys of MANY people. A few short years back, we were just like you, starting out on our immigration journey. Remember this journey is not a sprint, but rather a marathon...pace yourself...

Good luck!

K-1 Fiance(e) Visa Process & ProceduresIntent to marry letter does it have to be notarized?

Thank you, I have these forms, however on the instructions for 325A didnt especify if  it had to be singed and dated or not... I know it should be common sense but that post got me confused.

This wesite is the best that could of happend to me during this process!!

Actually, that is specifically mentioned on page 6 of the Form I-129F instructions:

http://www.uscis.gov...i-129finstr.pdf

Bottom line: If you follow the form instructions and the VJ K-1 visa guide you will be good-to-go!

Good luck.

Thank you, that's another thing, I wanted to get letter from my priest stating that we have initiated the process to get married through the catholic church, however I dont know if thats too much to send in....

You can do that. However, it is certainly not necessary. As per page 5 of the Form I-129F instructions, the petitioner and the beneficiary each have to provide a signed letter of intent to get married within 90 days of arrival in the US.

K-1 Fiance(e) Visa Process & ProceduresIntent to marry letter does it have to be notarized?

Welcome to the forum.

Please take the opportunity to carefully review and follow the Form I-129F  and Form G-325A forms and instructions:

http://www.uscis.gov...i-129finstr.pdf

http://www.uscis.gov...form/g-325a.pdf

Paying particular attention to the absence of any requirements for signature notarization and for signature requirements from USCIS. The forms' signature certification statement(s) about US Federal penalties for perjury or document falsification likely carry more weight than a signature notarization.

Good luck on your visa journey.

You really need to receive and review the RFE notice. It is pure speculation at this point trying to figure out the reason for the RFE. Hopefully it will be something simple. At least you now know that your petition is now in the 'active processing' mode...

K-1 Fiance(e) Visa Process & ProceduresHelp! This is all so confusing!

Welcome to the forum.

An abbreviated overview of events for the K-1 Fiance(e) visa program is described in Processing Information, on page 7 of the Form I-129F instructions:

http://www.uscis.gov...i-129finstr.pdf

Basic internet research of the mentioned forms (I-485, I-751) will quickly yield more useful information about the process.

Then, of course, the VJ Guides section, including the K-1 Flowchart, and the various step-by-step K-1/AOS/ROC Visa Guides do a good job of filling-in the blanks:

Welcome to the forum.

I would follow the directions of the letter, send in a copy of the Birth cert, quickly.  Be sure to include a copy of the USCIS letter with the Birth cert. I would also suggest that you keep a copy, or two, of the USCIS letter. IF it is not corrected, your next opportunity to remedy will be at the interview. Hopefully, it will already be corrected.

Be sure to send a copy of the birth cert., not the original. The copy can be checked against the original at the visa interview.

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresRFE NEED QUICK RELIABLE HELP PLEASE!!!!!!!!!

What is the exact language of the RFE letter? Hopefully you will be okay. Like so much in these processes,  a lot depends on the adjudicator.

It sound like you did what I did, I originally had sent in signed divorce court documents. In anticipation of a RFE with my initial I-129F petition, I requested from State Vital Records Dept. a copy of the Decree of Divorce Record. Here is the link for Oregon: http://public.health...ages/index.aspx.  Other states and counties likely have a similar process.  I would suggest that you get a couple copies. Luckily the initial petition adjudicator accepted my signed court documents. However, at the visa interview and the subsequent AOS interview, I was asked to show my divorce records. The State Vital Records Divorce Decree were accepted with no problem.

Good luck.

I guess that was part of the confusion. Honestly, that's really ridiculous. There should be at least one place that has all that and the fees listed right by it (or an estimate or some indication its a relative amount in the case of the medical, etc) because this hunting and pecking information out is just plain absurd. Maybe this is their way of weeding out the weak <_<

Agreed, sometimes it does seem ridiculous. This current instance is just one good example of your bureaucratic government at work. As is often the case in these visa processes, you have two huge federal government bureaucracies, the Department of State & the Department of Homeland Security, administering their particular section(s) of the Immigration and Nationality Act (INA).

If you ever have any trouble sleeping, try reading this : http://www.uscis.gov...nationality-act

Each of these federal departments set their own fee schedules, make their own forms, policies & procedures, etc., related to their particular responsibility for enforcement of the INA.

I was pleased to find the DOS FAQs link, at least it tended to give an overview of the K-1 visa process and some good working links to other federal agencies/posts, such as, USCIS, CBP, SSA, NVC, US Embassies/consulates.

It's their ballgame, their field, their rules, their equipment... What else can I say?

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresPetition Cost

Here is the pertinent section from the first link, the DOS Nonimmigrant Visa for Fiance(e) (K-1) FAQs:

http://travel.state....fiance-k-1.html

Fees

Fees are charged for the following services:

  • Filing an Alien Fiancé(e) Petition, Form I-129F
  • Nonimmigrant visa application processing fee, Form DS-160 (required for each K visa applicant)
  • Medical examination (required for each K visa applicant; costs vary from post to post)
  • Other costs may include translation and photocopying charges, fees for getting the documents required for the visa application (such as passport, police certificates, birth certificates, etc.), and travel expenses to the U.S. Embassy or Consulate for an interview. Costs vary from country to country and case to case.
  • Filing Form I-485, Application to Register Permanent Residence or to Adjust Status

For current fees for Department of State, see Fees for Visa Services. For current fees for USCIS, see Check Filing Fees on the USCIS website.

It can be confusing, one has to try to become familiar with their bureaucratic jargon.

I have heard of some confused folks printing out the above section from the DOS site; then going to the other links  noted, finding the particular form, and penciling in the fee from the corresponding USCIS or DOS site.  I figure, whatever will work for you....

One thing for sure, this entire process is not for the faint of heart, nor light of wallet.

Good luck on your visa journey.

K-1 Fiance(e) Visa Process & ProceduresPetition Cost

Correct, one is the visa petition fee to payable to USCIS during the initial petition submission, the other is the visa application fee payable to DOS during the interview phase. You will be paying both of those fees, and more, during the course of your K-1 visa journey. That is the reason I included the first link, because it gives you a general overview of many of the varied fees that you will incur during this process.

Good luck.

Welcome to the forum.

You can address the initial letters of intent to the Texas lockbox, the address is really of little consequence. What is of consequence is that the actual original, signed initial letters of intent from the petitioner and the beneficiary are included in the initial Form I-129F packet sent to the Texas lockbox.

Thanks for everyone's replies! Sounds like the easiest thing to do would be to mail my package to my parents home (as was suggested above), and then have my parents insert the check. My only worry is that in this case the package would be sent from my parent's home, not from the China address listed in my I-129F, this isn't something to worry about, is it?

K-1 Fiance(e) Visa Process & ProceduresWow! How to pay USCIS fee in China?

Welcome to the forum.

The info that you were given from the Guangzhou consulate and CITIC bank does indeed relate to the visa application fee and the associated process at the consulate phase of your visa journey.

If I recall correctly, many VJ folks in the past have had the best results when the check or money order comes from a US-based bank or company.  Do you have a relative, family member, or friend in the US to send your petition packet to? Have them enclose a check (in the USCIS described manner) with the petition packet and mail to the Texas LOCKBOX facility. YMMV

Good luck on your visa journey.
