The foreign fiance(e) is the one applying for the K-1 visa and they are the one whose documents will be most important at that time. They will need their birth certificate for the interview. You would need to contact the consulate in Australia directly and ask them if they require an original of the USC petitioner's birth certificate or if a copy will suffice. Since your info will already be in their case file, they may not even ask for the USC petitioner's documents again. Different consulates have different procedures and requirements.

Nothing gets sent to the NVC for a K-1, so no need to worry about that one.

 

Some consualtes send out packets with instructions and forms to send back to them or bring with you to the K-1 visa interview. The consulate can ask to see an original of any document you provided a copy of, but does not mean they will absolutely ask to see the original. You do not have to give them your original. They can keep a copy for their file.

What I ended up doing was getting a copy of the legal record from the respective states.  Fortunately, the states where I have lived have this service available. A simple Google search will likely yield some good hits. YMMV. For example, here is the one for Oregon: https://public.healt...ages/index.aspx   It costs a couple of bucks, usually one page. I got a couple of extra copies, since there is often a discount for additional copies obtained at the same time. 

 

To the one poster that didn't get an RFE at the K-1 process, you dodged that one. Maybe you will get lucky again??? ;)   At the AOS interview, I was asked by the IO to produce, for inspection, ALL of my divorce decrees. Thankfully, I was prepared and could easily provide them, as opposed to having a probable AOS approval delay and likely RFE for not having ALL of them. YMMV.

Most then likely you will get an RFE, you won't know until they actually get to your file and start processing it... until be prepared and have copies the complete divorce decree for each ready.   

 

Do not sent the divorce decrees until USCIS sends the RFE.

VJ is a do-it-yourself website. Most people here do it all themselves. If your case is uncomplicated and straightforward, then there is not really need to hire a third party. There are many resources here at VJ, such as guides and example forms. You can also ask questions here if you get stuck on something along the way.

 

If you feel you need a third party, then I would recommend consultations with a few different immigration attorneys to find the one you feel most comfortable with hiring.

Not exactly - we received our NOA1 as normal stating that $420 was received, but about 9 days later our cheque bounced. They don't seem to wait for payment to clear before issuing the NOA1.

What I said was correct, and please notice my caveat was in reference to the fiance(e) visa process.

Technically, the Form I-797c, Notice of Action, Petition Receipt (NOA1), is the official receipt that you will receive from USCIS acknowledging receipt of the petition and the correct payment. Most folks receive one from after successful submission of the I-129F petition and the correct payment.
