K-1 Fiance(e) Visa Process & ProceduresQuestion about evidence of I-129f approval

Welcome to the forum.

You have essentially answered one of your own questions, use the "actual from I-797 notice of action," assuming it is your visa petition approval notice (NOA2). As mentioned in the K1 Guide, send a copy to the visa petition approval notice (NOA2) to the beneficiary.

As stated by Adam&Laura, all I-129f applications are mailed to the Dallas TX lockbox facility, and this NOT the same as the Texas Service Center.

Choose a mailing address between the 2 given [above] based on your delivery option: http://www.uscis.gov/i-129f-addresses

K-1 Fiance(e) Visa Process & ProceduresLetter Samples (merged)

Thanks A&B, but I thought there was more to the letter? Are we supposed to include a letter talking about our relationship and how we met and trips we've made to visit each other, so on and so forth. Something that our relationship is real?

I've also asked close friends and family to write about our relationship also, will this help? Or is this all saved for the interview?

At the initial stages of the process, letters from friends and relatives about a relationship are of little consequence to the USCIS and would likely carry little weight. (Note the absence of any recommendation in the VJ K1 Guide for letters form friends and relatives.) Follow the I-129F instructions and the VJ Guides to the types and manner of evidence that is preferred by USCIS. The three lines provided on the Form I-129F petition are indicative of the level of relationship evolution information necessary for USCIS. The original signed letters of intent to marry are clearly required in the Form I-129F instructions. Finally, look at the K-1 VJ Guides for concise instructions on the manner and time frame for relationship evidence submission.

K-1 Fiance(e) Visa Process & ProceduresCover letter itemized listing question

Don't make separate entries in your cover letter for all these.  You can just have an entry that says Proof of Meeting and another that says Proof of Relationship, with bullet points underneath.  For example:

Proof of meeting

  • Boarding passes, passport stamps

Proof of relationship

  • Chat logs (Facebook, Skype,...)
  • Emails
  • Cell phone records and call logs
  • Photos of us

You don't need blank papers in your petition. Just assemble the papers in the order that its in your petition.  For example:

Birth certificate

G-325A form with photo (petitioner)

G-325A form with photo (beneficiary)

etc.

Agree. Keep It Simple S...  They are likely going to receive and deconstruct your planned publishing masterpiece anyway and put it in their own format. Save a tree or two.

K-1 Fiance(e) Visa Process & ProceduresFiance lost temporary SS card. Is this a prob?/Are old visas of any importance?

For sure? And this won't raise any red flags with the immigration people?

Welcome to the forum.

Likely a non-event for two separate HUGE government bureaucracies. If it would make you feel better about it, I suppose you could enclose a supplemental letter explaining the circumstances of the misplaced SSN, OR, you could always contact SSA and inquire about getting a replacement card: http://answers.usa.g...l-Security-Card  (Found through a simple Google search. Google can also be your friend.   )

Incidentally, she likely will not have an EAD until she files for her AOS, and the EAD currently takes 1-3 months to process.

BTW, she will be asked to disclose her prior visits to the US later on at the visa application process at the interviewing US embassy/consulate. If I remember correctly, one of the DOS applications asks for that kind of information.

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresDo we need to have a wedding within 90 days or is a legal marriage sufficient?

When your fiance arrived in USA, they will give her 90 days validity of her visa, you guys have to get married and file for adjustment of status within 90 days to avoid problem.

If she didn't get married within 90 days, she is no longer allowed to adjust status for green card and she will be undocumented without a chance to adjust anymore.

That is incorrect.  :protest:  The K-1 visa is a one-time, one-way visa that is null and void once the foreign fiancé(e) enters the US at their POE. The foreign fiancé(e) immigration status is then dependent on their I-94. To fulfill K-1 visa requirements, the foreign fiancé(e) has to marry their USC petitioner within 90 days of their US arrival. There is NO specific timeline requirement for starting the adjustment of status (AOS) process. It IS a general forum recommendation to start the AOS process as soon as possible after marriage. The foreign spouse can start the AOS process anytime after marriage, however, it is advisable start the AOS process prior to the expiration of the I-94, as that you will start accumulating out-of-status days, and that may complicate your immigration journey. There are many benefits for starting the AOS processes, look at the Guides, Flowchart, and forum threads for further details.

I think it's nothing but I'm not sure.

K-1 Fiance(e) Visa Process & ProceduresFor K1 petition, can I send scanned copies of evidence or do they have to be original?

As the topic titles suggests, I have a multitude of evidence to send besides some photos and passport stamps but I saved them for sentimental reasons and don't want to lose the originals.

Am I good if I scan them and send them or are the USCIS people looking for the real McCoy?

This may be something of personal opinion but any and all positions are appreciated.

Thanks again, guys!

K-1 Fiance(e) Visa Process & ProceduresNo longer Together, How to Withdraw the Application?

Do i contact USCIS or the foreign US Embassy for the withdrawal of the petition?

So sorry to hear about your misfortune. To make sure that you cover all of your bases, I would suggest that the petitioner write a letter of withdrawal to the intended interviewing US embassy/consulate AND to the USCIS service center that processed your initial petition. Be sure to mention all pertinent receipt numbers, case file numbers, A#, etc. If you are still on good terms with your former fiancé, consider sending them a copy of the letter for their files.

Good luck on your immigration journey.

K-1 Fiance(e) Visa Process & Proceduresaddress to use for mailing out I-129F package

Have followed the same successful delivery process though out our immigration journey. USPS 2-day priority mail, certified, return receipt required, sent our package to the PO Box (Lockbox) indicated in the respective form instructions (Lewisville, TX, Chicago, IL, Laguna Niguel, CA).

BTW, last Monday (8/25), we mailed our 3.7 pound ROC petition packet to the CSC PO Box using the same, tried and true method. I checked online on Wednesday (8/27), the package was delivered and signed for at noon that day. Done! Awaiting the signed confirmation receipt and the NOA. Cost: $14.30.

YMMV

Your link shows the TWO ways of delivering your I-129F petition packet to the Lewisville, TX (Dallas) lockbox location (see below).  ALL I-129F petitions go to the same Lewisville, TX (Dallas) lockbox location. The Dallas, TX PO Box is for USPS. The Lewisville address IS the address that is to be used for Express mail and courier delivery services, such as, FedEx, UPS, DHL, etc. Suggest that you contact one of those services and see how many "bones" it would take to get your package there quicker, if that is what you  want to do.

K-1 Fiance(e) Visa Process & ProceduresVisa fee increase

Welcome to the forum.

Thank you for your prompt response, Darnell, but I'm afraid it does not answer my questions. I have studied (and upon your suggestion,re-studied) the K1 flowchart, and nowhere on the page does it explicitly mention any fees (I even searched for the word "fee" after I couldn't find it, and it's not used on the page).

That being said, I do know there are two fees--filing fees for the I-129f and visa fees for the visa itself. That's why I asked if this fee increase will affect the filing fee for the I-129f. Based upon your assertion that there are two fees, I suspect it's safe to assume these increases will not affect the filing fee, am I correct?

My second question was more general: do fee increases happen regularly, and are they something I should plan ahead for? In the three years on my visa journey I have seen fee increases and I have also seen fee decreases, with no apparent regularity. These programs are self-sufficient, depend on the fees for their main source of revenue.

For K1: The first fee is the visa petition fee payable to USCIS (around step 2 in the flowchart), the second fee is the visa application fee payable to the DOS (around step 9 in the flowchart). The recent fee increase pertains to the visa application fee. Uncle Darnell was perhaps being a bit too cryptic in his initial reply. Check out the DOS Nonimmigrant Visa for a Fiance(e) K-1 FAQs for more information about the K-1 Process and associated fees: http://travel.state....fiance-k-1.html

:guides: Provide a good balanced mix of as many of the different types of relationship evidence as possible. Remember that you are trying to paint a "picture" of your bonfide relationship to the petition adjudicator, use as many "colors" in your palette as you can.

K-1 Fiance(e) Visa Process & ProceduresSub for Letter of Intent

I didn't have a signed letter of intent from my fiance (for the I-129 F application packet) so I wrote one from myself and also had the pastor who will be marrying us write a letter stating our intent. Do you think this will be an issue? He was back in Malawi, so it would literally be months before I could get something with his actual signature on it.  Do you think they'll RFE us on that?

Welcome to the forum.

Due to the vagueness of the new Form I-129F instructions, http://www.uscis.gov...i-129finstr.pdf , it may or may not be acceptable. A lot may depend on the rest of your relationship evidence, and on the individual USCIS adjudicator. Agree with previous poster that suggested that you still get your fiancé to send you an original letter of intent in anticipation of a possible RFE.

Good luck on your immigration journey.

They want more evidence relating to your I-129F petition (RFE). It could be due to many things. You have to wait for the actual letter detailing what supplemental information they require. Until you have actual receipt of the letter, it is pure speculation as to the nature of the RFE. What it is important now is that after receipt of the letter, you respond fully and promptly return the evidence to USCIS.

K-1 Fiance(e) Visa Process & ProceduresFiance's kid

Welcome to the forum.

Let's start off with the correct form.

I-129  = Petition for a Nonimmigrant Worker

I-129f = Petition for Alien Fiance(e)

I believe you are speaking about an alien fiancé(e)?

Yes, you do have to start the dependent child visa  process (K-2) for the child by placing their name and associated information in the appropriate spots on the initial I-129f petition as per the official instructions. That is all that is necessary at this stage of the process. There will be much more documents/forms/fees necessary to complete the K-2 visa process later on at the consulate/embassy interview phase of the  immigration process.  Review the DOS Nonimmigrant Visa for a Fiance(e) K-1 FAQs for more information on the K-2 process: http://travel.state....fiance-k-1.html

K-1 Fiance(e) Visa Process & ProceduresUnexpectedly got our NOA2 early, can we do our interview in the states?

I booked a trip to the states in October thinking that our NOA2 wouldn't arrive until like December at the earliest, from looking at processing times I thought they were still months behind us. But today my fianceé texted me out of the blue saying the NOA2 had arrived. I'm kind of in shock, it's less than a month until I'm supposed to go and visit (October 10th) and now I'm supposed to be doing my interview within the next month apparently. We haven't been able to look over the letter yet because it arrived while my fianceé was at work, she is still at work as I write this.

Is there any form I could file or something I could submit to ask to do my interview in the states while I am with her? No, the interview will be done at an overseas US embassy/consulate There are NO US Embassies/consulates in the US. Or is there some way to suspend the process until I arrive back to England in January?Contact the London embassy. What should I do? Halp guise. I really don't want to cancel my trip to see her but I might have to now if I'm supposed to be getting started on the visa process? I don't know what to do and I'm kind of frantic right now. Read the links provided, check out the UK Regional Forum. Remember, this whole immigration process is on their timeline, not yours. To attempt to do otherwise is an exercise in futility.

K-1 Fiance(e) Visa Process & ProceduresE-REQUEST .....I-129F

Welcome to the forum.

Sounds like another questionable dubious response from the infamous USCIS Customer "Mis" Information Center.  I would have serious reservations about the veracity of the information provided.

In the almost three years that my family has been our immigration journey, the processing speed of ALL of the various service centers has been akin to the ocean tides. Sometimes it is high tide and processing is quick, sometimes it is low tide and processing is painfully slow. The difference is that a person can read or predict with good accuracy the tides of the ocean, not so with the service centers. Sometimes a certain service center is fast, and the other(s) are slow, or vice versa. There is no apparent rhyme nor reason, just the luck of the draw.

BTW, when we originally filed our I-129F petition at the CSC in Oct 2011. At that time, the VSC was blazing through the petitions, the CSC was barely coming in at a very poor second place, and the TSC wasn't even processing I-129F petitions. All we could do (and did) was to sit tight, avoid any RFEs (and the associated self-inflicted delays as a result) and wait for the NOA2.

in February 2012, I did make another  trip China to visit my then-fiancee, we had a great time, sightseeing in tropical southern China (~50km from the Laotian-Burmese border). In other words, we went on living our lives, getting our immigration affairs in order, looking forward to the next step in your immigration journey.

YMMV

Good luck on your immigration journey.
