K-1 Fiance(e) Visa Process & Procedures	where to get married	You can use your one-time, one-way K-1 visa to come to the US and get married in the US,  You can then apply for AOS and Advanced Parole (AP), upon receipt of your AP document (usually processed in 60-90 days), You can then return to Mexico for a family wedding/ceremony.   You can not use your one-time, one-way K-1 visa to come to the US and then get married in Mexico.  Should you do that, USCIS will consider that you have abandoned your case,  You will then have to remain in Mexico and start the immigration process again for a CR1 spouse visa.   That is the reason why many K1 visa-holders do a simple courthouse (or Las Vegas-style) wedding in the US, then upon receipt of the AP document, have a formal, large, family-style wedding/ceremony back home. A consular official can extend the validity of the approved petition if it expires prior to completion of the visa processing. There is no mention of a specific time period, nor is it mentioned that the processing will only take place at the end of the extension. It sounds like someone is a bit confused, or over-thinking the process a bit. Refer to the DOS Nonimmigrant Visa for Fiancé(e) (K1) FAQs for actual information about the topic. Better to say, "The USCIS would consider it fraud."   I had no intention of hiding anything; if I were, I would have just done it, and not asked the question.  So, I don't know how you can say "fraud is fraud" when I had no intention to hide it.     Frankly, I don't see why the USCIS would care about this, anyway.  It is a personal issue as far as I can see.  Some people are not married legally or religiously, but they live together like husband and wife before marriage.  Does the USCIS see if they did this and then deny them a fiancee visa later?  It doesn't add up to me.  Seems really illogical.     Besides the fact that the USCIS knows that they are horribly backlogged and that the long delays are based on administrative overload rather than any law. That determination could be be made by USCIS, or it may more likely be made by the DOS consulate/embassy official(s) during your visa interview. It is not necessarily a matter of caring or not, it is a matter of them doing their prescribed duties, as part of the executive branch of the US Federal government, in their enforcement of the INA and its associated rules and regulations. K-1 Fiance(e) Visa Process & Procedures	how long from nvc to embassy	well the delivery time differs prob cause of all the diff locations in the world but i guess what im asking is, how long does it take for the nvc to mail it to a certain country after they get the petition? our situation is different cause the petition got sent to records center instead and the senator took care of it and it is mailed to the nvc...at least thats how my fiance understood it. dang, ive read that people's petiitons get sent back to the USCIS for review and new approval after they accidently end up in the records center....   Sure there are a lot of variables involved in the transfer process. For example, diplomatic pouches from US are often held up "awaiting clearance" in a "diplomatic limbo" in a Chinese Customs warehouse upon arrival, sometimes for months. The petitioner's presence on the consular premises NEVER hurts and can help. There's nothing quite like being refused the visa because the petitioner wasn't on the premises.     Si, Man ! Agree with TBone.   I was in Guangzhou for my wife and stepson's visa interview (third trip). The US consulate does not permit the US petitioner to be in attendance at the interview. The visa petition has to be filled out in English, except where specifically noted in Part 2 of the petition. If the requested information won't fit in the given space, follow the form instructions about the use of supplemental pages.
