K-1 Fiance(e) Visa Process & ProceduresHelp Me

Thanks Guys.. Also i ask my fiance to call again and this time got a woman on the phone who told her that they have not started working on july filers but she should expect a decision yesterday 15 dec 2012 or on the 29 of this month. so am confused guys and is the automated voice system wrong or whats going on???Need Help

Need Help?

IMO: Yep, the entire mmigration process is certainly in need of help. :help:

The accuracy of the automated system has always been a bit suspect. However, recently, many folks have reported spurious messages and updates. The forum is loaded with such threads, review some for details. Due to issues of veracity, when I have had the need to contact the immigration bureaucracy (USCIS/NVC/DoS/CBP), I have taken to the practice of calling them three times. I then take the best two out of three answers as being the likely correct response. :wow:

As with this whole process, believe it when you see the actual document, i.e., I-797, I-797c, RFE, visa, etc., in your hand.

YMMV.

Happy trails on your immigration journey.

K-1 Fiance(e) Visa Process & ProceduresADDRESS OF FILING LOCATION?

This might be a really silly question but I want to confirm the "filing location" below as outlined on the sample cover letter means the address of the lockbox facility you are sending it to correct?

It’s not the service center, because the service center is decided by the lockbox facility based on volume and workload when its processed, right?

K-1 Fiance(e) Visa Process & ProceduresI-29F Form assistance please? (Helping my US finacee)

Hello A&B and thank you,

I have printed one photograph from each time I have visited my fiancee (March 2011, October 2011, January 2012 & March 2012), one will be a picture a professional took when I proposed to her and then another one would be a random one from one of the other dates. I will sign them just before I send it off to my fiancee. Do I need to date it when it was taken or the date when I sign it?

Ummm....look at K-1 Guide on documentary proof of relationship. B-)

Hard to say If an RFE will result, it appears that you will have to write "Unknown" or "Not available" and see how it goes.

K-1 Fiance(e) Visa Process & ProceduresNOA

I sent in the documents for a I-129F on December 1st, it made it to the Texas Lock box P.0. box on the 7th and was picked up and forwarded to the California office, it was entered into the system on the 13th (my girls birthday) and I received the NOA on the 17th, I went online and it says it is in the initial review stage, I am guessing now we have a 5 month wait? Has anyone had any recent success with the California office getting anything done ahead of schedule or are they running behind?? I am really hopping that we can be together here in the USA on the 4th of July or sooner if possible,,,,,

Welcome to the forum.

If you put the correct Service Center in your timeline, you will get a VJ estimate of when your petition may be approved at the California Service Center. The Texas Service Center (the one currently in your timeline) does not process I-129F K-1 petitions.

I also hope that you will be able to celebrate the 4th of July together. However, that is not likely the case, not intending to rain on your parade. The time between NOA1 to NOA2 alone may take 5-7 months, then there is the processing at the NVC, and then the processing and interview at the embassy consulate. That is assuming there are no delays or RFEs in the meantime.

Check the "Processing Times" button at the top of the forum page, for recent events.

Good luck on your visa journey.

K-1 Fiance(e) Visa Process & ProceduresVisiting while waiting for NOA2 ???

My fiancée would love to visit me in February for two weeks but I'm sure it would be next to impossible for a tourist visa to be approved considering he
is middle eastern and 26 ?? Does anyone know if our having filed for the K1 visa would make it easier or harder for him to get a tourist visa ?

Does anyone knows it would help if I sent a letter to the consulate , like an invitation letter , explaining we are in the K1process and he would be returning to graduate by summer and hopefully be eventually approved so we can be married ??

I have been to Jordan 4 times since October 2011 and I can't keep making this journey - I would love for him to visit

Any advice would be so appreciated !

You ask a very, very frequent question. Please refer to the sticky at the top of this forum page, "Yes You Can Visit," for more information.

We faced the same issue this past year. In our case, we finally determined it wasn't worth the grief, the K-1 process caused us enough stress. I kept visiting her in China (four times).

K-1 Fiance(e) Visa Process & ProceduresNOA2 Approved! Question about scheduling interview - South Korea

You cannot get married in Korea. The K1 is a fiancee visa, one entry, to get married in the United States. If you get married while you are waiting for the K1 Visa, it will be of no use to you, and you will have to begin all over again with the spousal visa.

Agree!

OP:

Welcome to the forum.

You can call it what you like. If the Consular Official (CO) has any hint that any type of wedding/marriage ceremony has occurred, you could be determined to be no longer be eligible for a K-1 visa and denied. Most folks either get married first in the US using the K-1 visa, then later have a ceremony in the beneficiary's native county; OR get married in the beneficiary's native county and then apply for a CR-1/IR-1 spousal visa,

This topic has been discussed numerous times before on this forum. Review any number of previous threads for details.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresI134 help required

Hi people i recieved my NOA2 on 6 Dec 2012 and now waiting for the packet 3 to arrive. My fiancee is about to send me all the documentation along with NOA2. Now we have a couple of queries regarding I134:

1: Q-11...should we answer it as NA(K1 Visa to Permanent residence)or we should write intend to and give details as all expenses to cover including boarding lodging, incidentals etc.

2: My fiancee has a employement verification letter from her employer stating she makes abt 38k a year which is above the poverty line. We showed the money in the bank account too which is not a very big amount, just a couple of thousand dollars. Also we have all the tax returns and pay stubs.. Now do we need to still get a letter from the bank stating the account opening date ,the balance in account and the amount credited during the year together with showing the credits in the account from the bank statement or only the first documentation is enough.
3: Do we still need to show bank statements for the entire year?

Please help us as we are really worried about it and need to prepare our packet asap.

K-1 Fiance(e) Visa Process & ProceduresWhat color pen to sign on the forms?

Hi co-VJers,

This maybe a silly question but what color pen should I use to sign on DS 230 and DS 156? Blue or black? I"m asking because for my medical checkup for the visa I had to use a black pen only.

Are consular officers picky about pen colors in the DS forms too?

Thanks!

There are no such requirements.

However, I used blue ink when signing applications and documents, to easily tell an document original from a document copy.

K-1 Fiance(e) Visa Process & ProceduresRFE Proof of meeting

Ok guys I really need your feedback. After six months of waiting we finally got an RFE. I had hired a lawyer to help me out with this process. He never mentioned that I was to send supporting evidence we had met, and we got an rfe.Technically we would have been approved if everything was done right.I have gathered a ton of evidence showing that we have met together and we even have a daughter. My lawyer right now, only wants to submit my boarding pass and travel information from when I travelled in Dec 2010. I also have my itinerary and visa information for my trip in 2011. All of which are within the two year timeframe. He also DOES NOT want to include PICTURES we took together, as well as letters of Intent we both have written. All he wants to include in the rfe is my travel info and visa for 2010, some emails between us, and he is also going to write a letter addressing our circumstance.I am skeptical of this. I do not want my petition to get denied for not showing enough evidence. The rfe mentions that we have to submit primary evidence(travel tickets, boarding pass, visa stamps) and are not required but not limited to submit secondary evidence(pictures, affidavits, hotel receipts etc). I need you guys advice before I make a stupid move. What shoudl I do?

Welcome to the forum.

The Guides state very well what evidence is necessary to bolster your claim of relationship:

"Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)"

Good luck on your visa journey.
