Thanks for your response.

When I say "expeditious manner", I mean that I don't want any self-inflicted delays caused through ignorance on my part. Because of the long waiting periods in between periods of activity, I want to be sure that everything is correct the FIRST time.

At this time, I don't have ANYTHING back from the attorney's office. Last week they received my initial package with the GA-325A forms, the I-129F forms and many other pieces of information documenting our lives and our relationship.

From what you said above, should I ask about my NOA1 date? That is part of my problem, I don't even know what to ask.

As I mentioned, I think I need to stay on top of this because my impression is that my case will sit around unless I stay involved.

Do I understand it correctly when I say I should ask the attorney's office about my NOA1 Date?

Your mention of avoiding self-inflicted delays and doing it correctly the first time is quite consistent with everyone's attitude on this Do-It-Yourself (DIY) site. Of course, that would only make sense. :thumbs: Unless it is a complicated situation, the majority of folks here do not feel the need to expend their precious resources retaining the services of an attorney for this process. There have been reported instances where the paid representative did erroneous actions and caused delays in the visa processing. :bonk: But to each his own.

Sorry, I am a bit confused since you have your attorney in the mix. :blink: When you say, "....Last week they received my initial package...," are you saying that your attorney, or that USCIS has received your initial package? :unsure: If you mean USCIS, then you should have an NOA1 date and a receipt number. Depending on your legal arrangement, your attorney likely has your I-797c, NOA1 notice. You need to inquire with your attorney, and be sure to obtain that information. After you receive that information, you can check your account status here (though it isn't always updated in a timely manner). Additionally, you can set-up an account with USCIS and also check your status and receive email/text updates.

I still didn't change my address because we are waiting for noa2 hard copy , should I change it now? Hard to say, it may have been wiser to change it as soon as you were aware of your Change of Address. We got our noa2 November 27th by text and email.Still no hard copy! Consider contacting USCIS Hotline and inquire about the status of your NOA2. Will your hard copy be delivered to an address that you can receive your official I-797 Approval Notice (NOA2)? Do they only send the packet 3 after we get noa2 in the mail? I'm so confused! Review the K-1 Flowchart.

Petitioner gets the NOA2. Packet 3 is from the interviewing consulate/embassy to the beneficiary.

Sounds like USCIS standard "boiler-plate" -speak. I believe that the pearl of the message is that they are acknowledging receipt of your change of address (COA). They cannot re-set something that they no longer have.

Remember that your approved petition/file was already handed over TO the NVC at the Department of State (DoS) FROM USCIS at the Department of Homeland Security (DHS), for the next step in the process. The COA from you (petitioner) was placed with USCIS. Your fiancee (beneficiary) has been contacted and received information from the interviewing consulate/embassy at DoS. This portion of the visa journey is about and information from the beneficiary, not necessarily you, the petitioner. It sounds like all is going well. Be sure to use your new address when filling out new forms required of you.

Sorry, I am a bit confused… :wacko: Are you referring to the valid dates of the documents required for the visa? Police reports usually have validity dates, typically one year, check your interviewing embassy/consulate info for details. I haven't heard of an expiration date on a birth certificate. There are several documents that are some-what time sensitive, i.e., the supporting financial documents needed for the interview associated with the I-134.

These numbers are only approximate but you have the $340 initial fee for filing, some more for the actual visa given to the embassy ( I think another few hundred), the $1080 for AOS, another $560 or so for ROC. Then medicals, transportation, flights,and the list goes on. It will thousands before you are done so the $340 is NOT a large number in the entire process.



Agree, as I have mentioned before, this whole immigration process is not for the faint of heart, wavering resolve, or light wallet... :huh:

Do you know your receipt number? That is one important piece of information on the I-797C Receipt of Petition (NOA1). You may need to use that number to get information from USCIS, until your approved petition is forwarded to the NVC.

It is advisable to take better care of your I-797 Petition Acceptance Notice (NOA2). A copy of the NOA2 is necessary later on in the immigration process. Some folks have been able to do a work-around. However, USCIS can charge you around $400 to get a duplicate I-797 NOA2.

I have a question about the wedding. The brother of my fiancé got a license so he can marry us when I arrive there. Is this going to be a problem (valid)or should the wedding be performed by a judge or a priest? We are both not religious so we thought either a court house or a beautiful ceremony at his garden. Also, one more quick question. None of the guides seem to explain the timegap from marriage, to approval of the AOS/Greencard. I read that it can take a year or two in some cases depending on where you live... so does this mean her status here in the US is okay until that time? Should I be going for something else other than the AOS? I know i need to get her a social security card and some other documents but not sure if there is something I need to keep her here until we get the greencard.

I submitted the 129f in mid October this year, and of course my fiancee and I are waiting for the approval. Now, we are both gathering all of the required documents for the embassy interview and hoping for a swift processing time. I have a question about the financial documents that she will need for her interview at the embassy. I am visiting her in late December, and we were thinking that it would be good if I brought all the documents with me. Since our petition hasn't been approved yet, is it too soon to get the required financial documents? The signed letter from my employer, bank, and bank statements might be somewhat dated if our processing time is long, and I do not want my boss and bank to have to do this again if our petition is not approved until March or later. Thank you in advance to anyone who replies!

Welcome to the forum.

The documents that you mention are somewhat time-sensitive, and should be as current as possible. It would be a real bummer if you got a RFE or rejection simply due to "stale" financial documents. You still have a lot of "waiting time" ahead of you. For example, petition approval times seem to be taking a little longer than usual , then you have the NVC processing time, then the transit time to the interviewing embassy/consulate, then processing time at the interviewing embassy/consulate, then packet 3 documents receipt/completion/submittal, then setting of the interview appointment, then?.. , and that is assuming no other issues or RFEs along the way... Be patient, it will pay off in the end.

Those are good signs, USCIS acknowledges that they have your petition (you have a receipt number), and you know that they have your money. It sounds like you just have to hang tough until the rep calls you back within 48 hours. If they don't call back in that allotted time, call the USCIS hotline, ask for a Tier 2 rep and get the explanation of the issue.

I submitted my I-129f 37 days ago and roughly received my electronic NOA1 a week later. However, I never received my paper receipt and my case never showed up on the website. So today I called and was given to a tier 2 representative. She said the application is on file and in process, but that a representative would call me back in 24 to 48 hours to explain the problem. I asked, "was their a problem with the application" and she said no, but a rep. would call me to explain why its not in the system. Should I be worried about my application. FYI, it was sent to the Vermont processing center.


Hard to say if you should be worried…. Do you have a receipt number? A receipt number is generally included on the electronic NOA1 and also the official Form I-797c Receipt.

Get back with more details as they become available.

I redacted several things on the evidence I provided to USCIS. This included: intimate talk that we had on Skype and Yahoo IM, all but the last four numbers of my SSN, financial account numbers, etc. We experienced no issues from those actions.

The CO said that your fiancee needed to get a job that pays 21k a year and that's what they want from you. I don't see how sending a different form with a co sponsor will change their decision.

Your best bet? Get a hold of the embassy, tell them that she's got a new job and ask if they would re consider taking a co sponsor.

They are the only ones that can say YES or NO.


Oh, and I suggest that your fiancee's employer doesn't lie and say that she makes more. That would be fraud, you know?

The packet was sent and delivered the next day. We sent it by courier to the Islamabad embassy. They received it on December 7th. How long until we hear about an interview date? And do you guys know how they contact us back for the interview? Via email, phone or regular mail??

Hey everyone, So I've been referring to this recent post, HERE to prepare for the next step of the K1 visa process. NOA1 was received in early November, we now wait for NOA2. I'm going to visit my fiancee in January and I wanted to bring all the paperwork she would need so I don't have to mail it to her. Few questions though,

1. Employment Letter: What should this say ? What are the reviewing agents seeking to learn upon reading this letter ? Review the step-by-step K-1 guide, located in the "Guides" section, accessible at the top of the forum page, for details.

2. 2011 Taxes: I have my 2011 tax documents, but what about 2012 taxes ? Obviously filing time for 2012 isn't here quite yet, but our visa process will continue into 2013 and through tax season and after I've filed...at what point during the year 2013 will they start considering 2012 "last years" taxes ? Likely after April 15, 2013 For example, if my fiancee's interview is in June 2013, will they expect her to have my tax information for 2012 ? Likely

3. Remittance Receipts: What are these ? Huh? Are you talking about paycheck stubs? If so, yes. Please elaborate.

4. Engagement Receipt: What is this ? Are you referring to engagement ring receipt? If so, optional, refer to the Guides. Please elaborate.

5. I'm right on the border of the poverty line so I'm going to have a co-sponsor just in case. Do I need to have all these documents for both of us then (sponsor and co sponsor) ? Review the pertinent guides sections speaking about the I-134 requirements, co-sponsors, etc., including the FAQs. Also, review recent threads, this is a frequently asked question on this forum.

Yes, they will want to see employment letters. It may be advisable to write a letter, as you describe, explaining your employment situation. USCIS/DoS have seen all manner of employment situations. The financial information is somewhat time sensitive. You will want to give them as up-to-date information as possible. Submission of "stale" documents may result in an RFE or denial, that would delay your plans.

If I'm in the US and the fiance is in South Africa, is it beneficial or necessary to fly to South Africa for the interview? Just wondering how understanding the consulate is since it is far and expensive. I'm hoping to not go so that I can use that money toward other fees.

It is always beneficial for the USC to be with their fiancé(e) for the interview. If the interviewing embassy/consulate does not allow USC to attend, it certainly adds moral support for your future partner. Some interviewing embassies/consulates allow attendance, some do not, some require it, others it is strongly encouraged. Check the "Embassy Info" tab at the top of the forum page and find the specific info for South Africa.

I was not able to be in attendance at my wife's interview in Guangzhou, China per consulate policy. However, I did fly to Guangzhou and I was able to include a Evolution of Relationship letter in my passport, which I gave to her to present to the CO at her interview. I have to believe that the CO, knowing that I was in Guangzhou supporting my then-fiancee at this important interview, strongly demonstrated that we have a genuine relationship. From personal experience, I understand about the money and distance involved in such a trip. If you can do it, do it.

They are asking for Conversation, Emails and chats

My fiance and i we speak to eachother in foreign language and all our chats are not in english.

Do i have to translate our conversation or it would be Okay to send it over to Vermont center wothout Translating it?

Any document containing foreign language submitted to the Service shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English."
