I wrote down Guadalajara thinking we could get it there, but I know now that it can only be in Ciudad Juarez, Mexico. How do I correct that? Can I give them a call right now to correct it or should I wait until they touch our case and send our NOA2 so they can send it to Juarez instead of Guadalajara?


When your petition is approved and sent to the NVC, they will send it to the correct interviewing embassy/consulate. They should then send you a Department of State, Bureau of Consular Affairs informational letter to that effect.

Please bear in mind, it is their ballgame, their ballpark, and their rules…. :thumbs:

Correct, the initial I-129F petition filing is to show that the petitioner and beneficiary have a genuine and ongoing relationship. through meeting the visa requirements, filing the petition and providing necessary/requisite evidence.

Here is an example of the notarized "Parental Custody Certificate" that we were able to use to obtain permission from the father and provided to the interviewing consulate in Guangzhou:

My fiance and I were introduced to each other by our parents. He's in Vietnam. In Vietnam they have what's called the Ho Khau, basically a residence listing of all who resides in the house. I have a few questions pertaining to his 7 year old daughter.

1. My fiance has never been legally married with his daughter's mother. More a commonlaw marriage. He is listed on her birth certificate. According to Vietnamese law, if the mother has a child and its out of wedlock, the child follows the mother. Therefore, my future stepdaughter is listed with her mother's Ho Khau and not with her father. However, she is listed with his mother because she currently resides there for school. My fiance and his daughter's mother split when his daughter was 2 years old. He's been her primary caregiver. He is not listed at his mother's Ho Khau. So technically, there is no same residency between father and daughter. He does however have school record indicating that he's the the guardian of the child ever since she was old enough to attend. Does anyone experience any issues when child/parent are not listed on the same Ho Khau?

2. I am aware I need to list her on the I-129F form. It also states we need passport pictures of the beneficiary. Does this mean I am to include a G-325A form and passport photo for my future stepdaughter as well? I figured I can send it in as a precautionary stage.

3. What happens if the address does not fit on the line on the form? Vietnamese addresses are long and lengthy :(

Any help would be greatly appreciated :D

I think I can offer some advice for a couple of your questions.

At this point in the petition process, list the child on the I-129F. For a K-2 visa for the child, there is no need for a separate G325A or photo for the child at this time. Photos, and other documents/forms will be necessary later on after NOA2 step, refer to the Guides for more information about that.

For lengthy responses use a supplemental sheet, referencing the specific line of the form. That is what we did for many requisite forms. Chinese addresses, when translated into English are also long (but relatively short when using Chinese characters).

My wife got a notarized letter from her son's father authorizing the son to immigrate to the US. Not sure if that is applicable, or necessary in your situation. YMMV. Check your regional forum and interviewing embassy/consulate info for more details. Hopefully someone with a similar situation that has immigrated from Vietnam will be able to respond.

I have my interview on the 18th of December, and God willing if we get approved, I hope to fly out on the 30th of December. Considering it's Christmas time and the 25th and 26th are public holidays, is it likely that I would get my Visa sent to me in time. I assume if you send something Guaranteed next day delivery, Auspost will honor that regardless of it being a busy time of year. However I don't know if or when the Consulate goes on holiday over the Christmas period. I would like to think they would get my Visa processed and sent straight away after my interview, but is there a likelihood of them leaving it until after Christmas to send me my Visa?

I haven't booked my flight yet, but if I do it is refundable or I can rebook another date, but I have looked at flights all through January and there is very little available with weird routes, lengthy layovers, arrival times after midnight and the prices go up....go figure. I can get a flight on the 30th which is ideal.... 6 hours in LA (plenty of time to get through immigration) and arrival into my new home at 7.15pm.....it's perfect! I don't want to miss out on the ticket and am thinking I should just book it and worst case get a refund if I'm not approved or re-book if there are any delays with the Consulate.

Not trying to put a damper on your "what if" plans. The general recommendation on the forum is to not make any travel plans until the visa is in your passport, and your passport is in your hands. There are far too many "ifs" and variables that could happen. The big one being.....that you have a successful visa interview. :unsure:

For the I-129F question 16...I kept coming back to this on my form and it still bothers me..do I need to write whatever words have letters like ö or ü in the space there because they arent roman letters? also for where it says "country" do I still write the country name in english or the native language? cuz i mean if they are using that to send things to his house and they want it in native alphabet then you would think you should also write the native language? Cuz I can imagine if , for example, your fiance was from Korea, you would write everything in korean and when you wrote the country you would of course write it in korean meaning..if that makes sense..

Follow the instructions, literally.

Add a supplemental page, referencing the the initial question. That is what we did with no issues. (FYI: Chinese addresses are shorter when in Chinese than in English. :) )

I'm not sure why, but when I try to change my address on the USCIS Online Change of Address, it makes me need the receipt number, but I don't have that because I just sent out the I-129F a few days ago.

You aren't supposed to need a receipt number, but it won't let me get past step 1 unless I give a receipt number.


According to the instructions, if you don't have a pending case (technically, you don't, since they have yet to acknowledge receipt of your petition, you don't have a Form I-797c Notice of Action-Receipt), it seems that you can either fill out a Form AR-11 and snail mail it to them, or wait until you get your Form I-797c, then do it online.

The K-1 visa is a one-way, one-time entry into the US. For him to leave prior to having his Green Card, he will need for have his Advanced Parole, as Operator mentioned in his posting.

If you are able to complete the I-129F K-1 Fiance(e) visa process, immigrate to the USA, get married, file for Adjustment of Status, there is no I-130 associated with the K-1 visa process.

Should you choose to get married prior to completion of the I-129F K-1 Fiance(e) visa process, that will make you ineligible for the fiance(e) visa. You will have to do as baron555 describes, and start all over with the CR-1 spousal visa process.

When to file? When you have properly and completely filled out all the requisite forms, collected all of the necessary information, and followed all of the instructions. Realize that the beneficiary will have to return to their home country to have their visa interview. I know people in the UK have a 3 month limit for how long they can stay in the states on their normal tourist visa. My question is, can he come over here and stay with me for three months, in the same year he will be coming over with the K-1 visa, and then still get to stay 90 days before we have to get married? Or will those 90 days be used up because he was here that long earlier in the year? Any info on this is appreciated, thanks so much!!

There are many variables associated with going with the fiancé(e) or spousal visa process that can affect the time frame of each process. Take a look at the Quick Comparisons, located in the "Guides" section, accessible at the top of the forum page, for a ballpark estimate. If, there was NO immigration involvement with any of the previous marriages?? AND NO domestic violence issues associated with any of the previous marriages?

Then, should not present a problem as long as you are able to present copies of ALL your divorce dissolution certificate(s) obtained from the respective state(s)/county(s) department of health/vital statistics/records/clerk (and are able to provide, for inspection, the original(s) upon request of an Immigration Official). Be sure to fill out the requisite information about ALL of the divorces on the forms as completely as possible. Consider composing a short narrative for you and your fiancé(e) disclosing the details of your previous marriages, discuss fully with your fiancé(e) as that they may be asked about it at an immigration interview.

If you send your tax return, include as forms and schedules?everything. Most folks opt for the tax transcripts. Consider using tax transcripts, available for free from the IRS, and they are accepted by USCIS.

It has been mentioned numerous times in these forums, that folks join through Lagos should provide 3 years of tax records.

We sent in a front and back photocopy of the I-94s that were in my wife and stepson's passports. CBP usually staples the I-94 to a page in the beneficiary's passport, keep it in there.

K-3 visas were for foreign-citizen spouse of a US citizen. K-3 visas are obsolete, and are administratively closed. The currently available foreign-citizen spousal visas are CR-1/IR-1. K-1 visas are for foreign-born fiancé(e) of a US citizen.
