Hi Everyone.
We are finalizing the petition for K1 Visa, hoping to send it in early February.
We listed my fiances 6 year old son on the I 129F form. Is there any other form I need to complete in order for the child to be included in her immigration to the U.S.? Do we need to send passport photos of the child too?
I have been reading the guides but they don't address this issue clearly.
Please advise

Hi everybody!

So my fiancé (USC) and I were about to file for I-129f until last week when I got a call for a great job in Europe. It'd be a 1 year contract from March 2013 until March 2014. I just took the interview so I'm not even sure I'll get the job. But we thought we should wait for the answer of the employer and then, if I get the job, wait to file for I-129f until March or April 2013, to be sure I won't get the K1 too early (I wouldn't want to quit before the end of my contract).

But I just read that sometimes it is possible to get an extension of the validity of the K1 Visa. Is that true? Is it easy to get it and do I need to give some kind of serious reason?

That would actually be great, we could file for I-129f right away and then let the process go on and adapt to USCIS' speed.

Did anybody go through the problem of not being able to move to the US within 6 months after getting their K1?

No. The Alien Registration (A#) number can be found printed above the beneficiary's name on the I-797 K-1 petition approval (NOA2), and in our case, was handwritten by the CBP officer at the POE on the back of the Form I-94 (attached to the passport). The Form I-94 number is machine-printed, under the term "Admission Number" on the front of the Form I-94. The Nonimmigrant Visa Number is the red stamped number on the K-1 visa that is affixed in the beneficiary's passport.

Hi guys

I am pretty new to visa journey, but my fiancee and I are in the process of applying for a K1 visa to bring me down to the USA (from Calgary, Alberta, Canada).

We have sent in the paperwork, etc, and received an NOA1. We have set the wedding for August 31st, 2013.

The big question is will we have enough time for this wedding date to work? I just filled out the timeline today, and it is predicting our 129F may be adjudicated between June 22, 2013 and July 30, 2013*.

Is this a pretty good estimate? Or are these playing on the safe side of things?

If you have been in this situation before, please let me know how things turned out!

You may be okay, or you may not. The general recommendation is to NOT make ANY wedding plans until you have the K-1 visa affixed in the beneficiary's passbook, and in the beneficiary's hand.

My fiancé had her document intake today in Guangzhou and everything went smoothly but they didn't take all the documents I thought they would. They didn't take the Letters of Intent to Marry; the Evolution of Relationship; the second set of income documents for the I-134 (the instructions say to submit duplicates) or the second copy of the DS-156.

I'm not sure what to think of this but we'll take them back to the interview tomorrow in case they request them then. Or should I have her set them in front of the CO and ask them why?

Should I be worried?


Have her take all of the evidence and documents to the interview. They may ask for it. It is much better to have it ready for presentation then to not have it. Try to remember the CO is one doing the asking, not the other way around. :blink: Doesn't sound like anything to be worried about.

My fiance intends to visit from Montreal in a few weeks. She has been in Canada for approximately 7 months. She was denied entry because they stated she spent more time than they would like and wanted her to re-establish residents in Canada. They said she "should" remain in Canada for a year...but the official said as he escorted her out of the airport..."wait 5-6 months and you would have no problem getting in"

My attorney has expressed that she show up to the airport for customs with paperwork showing strong ties. She does have a return ticket she is printing and bringing with her,just a carry on luggage enough for the 28 day stay. Also she will have a bank account statement. She lives with her mother, and currently does not have job. She will also bring a copy of the NOA1 to show the official that she is in the process of K-1 visa application and if she does not return or decides to get married while on visit she is commiting immagration fraud.

What other forms of strong ties are valid (i'm taking into account that ever borders official is different and it all depends on how they woke up that morning)

Hey everyone,

I wanting to start my petition for my fiance who lives in Curitiba. We met as missionaries for our church and I have already been back to see her just these last couple of weeks. We have plenty of photos and e-mails so now it is just processing the paperwork.

As I have been trying to file the paperwork I´ve been stuck on which Consulate I am suppose to put. Am I suppose to put the consulate in São Paulo since that is the closet one to her or the embassy in Rio since that is where the interview will be?

Also when sending in our letters and e-mails which are all in portugues, do they all need to be translated as well or just her documents?

My fiancee has been showing signs of stress and depression. She hasn't seen a doctor yet but I will convince her to go soon. I was just wondering if it is possible to expedite the visa process if the doctor discovers she is becoming depressed. I believe she is dealing with a lot of stress because of all her responsibilities at home and the poor conditions that she lives in. I believe because of this stress she could be developing depression. If that is the case I foresee extreme hardships on our relationship. I support her financially but if she develops a mental illness such a depression I think it would be hard to pay for those medical costs. But if she was here it would be much easier for me to care for her. I have medical insurance and when we are married it can cover her as well. So I was just wondering what is required to expedite the visa process?

If it matters, I'm from the USA and she is from the Philippines.

Hi,

I'm a Canadian recently engaged to a US citizen from AZ. We're planning to file for the K1 visa soon, but aren't sure whether using a lawyer would be better. My case is a little complicated, so I feel kind of lost about how to proceed.

I currently live with my mom and work part time (not enough to support myself ). However, life at home is very unstable (she is abusive) and has told me that once we file, I have to leave home, even if I end up on the street. I Also must leave most of my possessions for her. So, I don't even know what address to file or where I will be located at any time, as I have no friends or family I could stay with. Would I even be able to visit him during the process without proof of a living place? If So, any chance I could go for many months So I'd at least have a place to stay?

Due to the amount of stress at my end, we figured hiring a lawyer might help. It would take pressure off us and help to ensure this process doesn't take longer than it needs to, due to our lack of experience. Is this a smart move or waste of money? Are there any lawyers you guys could recommend?

Also, what are the current general wait times for Canada to US? I've tried looking and am just confused by the whole thing.

Hello. Good Morning :D I paid hell getting logged on this site. I have no idea why. I guess I'm looking for a little support. My status is still unchanged. From Filing in August. And I'm reading on here. All these things that people are going through. And people fighting. Wow!!
I just made trip two in November. And traveled around . We are getting along just fine. I definately did my homework. I'm wondering how much documentation I should be keeping. Should I be copying every card or letter I send to China. Should I send things just to send them. And get more paper. My girl speaks good English. Our primary commmunication is QQ with cam. It can be quite variable, and Guangzhou often takes their sweet time. If you had your interview on the 1 Feb, today is only seven calendar days since your interview. Have you sent an inquiry email to the GUZ IV unit, confirming that they have your requested additional information? Additionally, it is Spring Festival holiday time in China, I would suggest contacting the consulate in a week or so. Have you inquired about the receipt of the additional information and visa status with a visa specialist at the Department of State?

So, on the question about timing. We will probably send the initial I-129F package to the USCIS on February 15, 2013. She needs to leave Korea July 10, 2013. Is that time frame too much, too little, just enough or doesn't matter?

Meaning can we process it the now and if it get to the Manila Embassy quickly, will they hold it until she comes back to the Philippines? Or can we schedule her interview while in Korea? Or is that NOT enough time to get it seen by the Embassy before she comes back?

She is going back in July but can't be without work for a long extended period of time. Be home in Philippines tops 1-2 months.

Any replies would be greatly appreciated.

Bear in mind, the entire visa process is dependent on the government's (DHS, USCIS, DoS, etc) time schedule, not yours. There are far too many variables and possible delays to be able to make any definite plans. The more complicated you try to make the process, the higher likelihood of delays in your visa journey.

For example, if you submit your I-129F petition in mid-February, without any delays, you may get your petition approved in 5-8 months. Then the visa interview process at the embassy/consulate could take another 3-4 months, barring any problems/delays/issues, etc.; then there is receipt of the visa, then AOS, then ROC. Take a look at other folk's timelines to get some idea of the real time involved in these visa processes. For example, our visa journey took us over 200 days to complete, and that was without any problems/delays/issues.

Essentially, k-1 route (completely..AOS and everything) or nothing...bummer.

I've been trying to find out if we can file for the k-1 visa while she is in Korea up to the point of needing the medical exam and interview. Then schedule the exam and interview (With her in Korea) when she CAN do it..have her go back to the Philippines, exam, interview...plane.

Is that possible? I've seen a lot of time frames of statuses but not really what I'm asking here.

Hello,

Background info: I'm in the States and she is working in Korea but from the Philippines. We want to file for a k-1 visa and have her do everything while in Korea up to the point of needing to schedule the appointment at the Embassy in Manila. Basically, have her schedule the appoint in Korea, go back to the Philippines for one month, do the interview and hopefully fly to the States.

Okay, after that. We will get married quickly but we do NOT want to pay the AOS fee of 1000$ because we are not staying in the States passed January 2015 (or even November 2014). I'm awaiting for a contract to run out then we are both moving back to the Philippines. But, she needs to have a work permit though, so we will file that right after we get married.

My question, is it possible to file the I-765 (work permit) and have that allow her to work until early 2015? Also, can we get away with NOT filing the AOS and just allow the k-1 visa to expire? Or can we file something else so we don't have to pay that fee? She'll be in country just over 2 years then we will BOTH move to the Philippines.

And if that is the case? Can she get back in the country later (10 years down the road)? or would we have to do a k-3 visa or something?

Any help would be greatly appreciated. Thank you all very much.

The appointment packet online lists the poverty guidelines link, which is the I864P. Do we bring the I-864 in addition to the I-134? Also, does the I-134 need to be notorized? It appears that the only documents requiring notary are the Federal and Civil Police Certificates and the Sworn Statement. Is this correct?

However, this was our experience in Washington State:

My wife (then fiancee) had her POE at SeaTac airport on 26 July 2012. She and her son were able to clear CBP after two hours, we rushed down to the King County Recorder's Office in downtown Seattle right before closing time. The clerk asked for our IDs, she furnished her Chinese passport, I furnished by WA State driver's license and $64 cash. We had to fill out some forms, SSNs are NOT required in Washington State. We received our marriage license, however there is a 3-day waiting period until it is valid for use. We were married on 30 July 2012. The rest is history.

Sorry to hear of your getting an RFE. Hopefully it will be something that will be easily remedied. It is hard to say how long it will hold up the process. There is a fair amount of correspondence back and forth…. i.e., you are notified about the RFE, a hard copy RFE letter is generated, it is mailed to you, you quickly prepare your response, following exactly the return instructions, you mail your RFE response, they receive your RFE response package, they sort and deliver your RFE response to the appropriate adjudicator for follow-up. It could be a couple of weeks (hopefully so! :yes: ) or a couple of months (hopefully not! :no: )

Not much had materially changed between the time we submitted the I-134 at the consulate and when we filed the I-864 for the AOS process. I believe that I submitted more current pay check statements, but the rest was essentially the same.

Hi I am New to this process and I am in that situation. I am starting this process by sending the package today or tomorrow. However, I am a college student and I am unemployed at the moment. How would that case be handle? would I have to start working or can I simply use a cosponsor? Also, if I have medical bill still on file would that affect in any way since they have my social security?

Unfortunately, it isn't necessarily right or wrong, it is the way the immigration process is. The interviewing consulate officer has the authority and duty to determine, to their satisfaction, that the intended immigrant will not become a public charge in the US. If you want to get the visa approved, I would suggest that your comply with the consulate officer's request.

Please remember the statement at the end of question 20, on page 2 of the Form I-129F petition:

"NOTE: (Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)"

Additionally, there have been recent forum threads about folks attempting to move their interviewing embassy/consulate, only to have the petition sent to the wrong consulate, resulting in further grief and delays in processing.

I would suggest that you get the items corrected as quickly as you can and wait for an RFE. There is not a very good chance that if you sent in more information to add to your petition, at this stage of the process, that it would get attached to your petition. It is akin to finding and matching up two needles in a VERY large haystack.
