In 1995 I have divorced my ex-and granted the divorced paper. In the State
After two years I got married and filed for I-130 and my new wife got her immigration visa and became a US citizen on 2001.
In 2006 we got divorced.
Now, I am applying for my fiancée I-129F and The USCIS is asking to have signed divorced paper of my first marriage that was ended on 1995.!!
I have the divorced paper from the State court and the USCIS did not ask such a request for my second marriage. How comes they are asking for it today??? Why they did not ask when I married the second time. Why they want it now!!??
what should I do to get the judge signature... after 18 years?

It is of little consequence as to why and when they are asking for these documents now. The bottom line is that USCIS is now requesting this information from you.

Consider obtaining certified copies of each your divorce dissolution(s) from each of your respective State's Division of Vital Records/Health Department. Here is a link that may be of use to you:

I was married and divorced several times in several states over twenty years. I had to obtain certified copies of my divorce dissolution. I submitted photocopies of the certified copies and submit them the USCIS. At our recent AOS interview, I was asked by the CO to examine the original certified copies for comparison with the submitted photocopies. I had brought the originals, just in case. I had no issues as result of submission of the proper documents.

I hate digital cameras! We lost all the engagement pictures that were on the SD card. However, we have few (maybe 4) that were not an engagement pictures. It has my fiancee, myself and few other people. There are couple that includes us only.
In my culture (specially women) are not supposed to hang out with future husband until getting married. But we snapped a few pictures of us together.
I am wondering if this would be enough to prove that we met each other in person. We do not have any airline docs. together since we didn't fly anywhere.
My fiancee will be applying in Kathmandu, NEPAL. Do we have anybody in this forum from Nepal or any other country with the same scenario?
Any advise would be greatly appreciated.

There are other folks that are going through or have gone through Kathmandu, Nepal. It would be easier for them to identify you if they didn't have to read your all of your posting. Consider updating your profile information and including the Non-US citizen country, that way the Nepal banner should appear, and that will make it easier for others from Nepal to identify you.

The problem with writing "NONE" for the middle name field is that doing so can and has resulted in the beneficiary being identified as having "None" for a middle name (e.g. Jane None Doe).

I was informed, via email, that the Moscow embassy does not send documents via regular mail. ( Although the letter I received from NVC did state that they would mail the instructions )

I do not know if this is specific to Moscow.. But I think its important for everyone to know...

Everyone needs a passport to enter the US. If the K-2 is not a USC, with a US Passport, then they need a foreign passport with the K-2 visa inside (given at the Embassy).

Hi guys!

I have a quick question about the I 134. I am unsure of what to put for question 11. "I intend/do not intend to make specific contributions to the support of the person named in item 3. If you check intend, indicate the exact nature and duration of the contributions...."

I looked at the sample form and they had put something like "do not intend, N/A K-1 visa". Are you supposed to put do not intend if it's for a K-1 Visa? I just don't want to mess anything up!! : S Thanks for your help. I really appreciate it!

However my contract ends and I'll be returning to my home country in two months, so I'm worried that I may not be processed in time to interview in my current country. Can anyone advise me on the procedures for changing to interview in a different embassy?

You will likely have to contact the NVC and/or the DoS and/or the respective interviewing embassies/consulates to try to move your upcoming interview. Realize that it will likely further delay your visa process.

Recall the statement after question #20 on the your original Form I-129F petition:

"NOTE: (Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)"

Hello,

I am a US citizen and my fiance is a Canadian citizen. We are trying to plan our travel plans for this summer. I would like to spend time in Canada, and he would like to visit me a little in the States. Is it possible to have approval for our K1 visa, get married in the States (if possible, and start the paperwork for the permanent residency), and then go back to Canada for the summer vacation? We also would like to know if he has to wait until we marry to start the work visa for working in the States or can he start the application as soon as he gets approval for his K1 visa?

I know this sounds complicated, but any help is appreciated. After our vacation this coming summer, my fiance will be moving with me to the States and will be staying there and working for years to come.

If you are seriously interested in needlessly complicating your lives, you could try to do what you are planning. I would suggest that you take the opportunity to check out the "Guides" tab at the top of the forum page. In there, you will find all kinds of great information, including a visa comparison guide and estimated timeframes. Look at the K-1 fiancee and the IR-1/CR-1 spousal visa programs. The K-3 is obsolete, and not used anymore. To keep things simple in your lives, consider the spousal visa programs.

Remember that whichever way you choose, you will be dealing with huge government bureaucracies, on their turf, according to their rules and schedules, and they have no regard for your plans. There are far too many potential obstacles and impediments in the visa process for you to be able to accurately schedule or plan your lives. That is the reality of it. However, the end results are certainly worth the effort.

We were fortunate to be able to run the AOS "gauntlet" in < 4months. Don't know how, don't know why?..... :blink: We then burned some joss to the gods. :yes: But then had a "murky" AOS interview at the Seattle USCIS office, that initially dampened our spirits. We concurrently applied for, and obtained the EAD and AP documents, just in case of a protracted AOS process (which sadly seems like the norm).

YMMV.

1. Because they (your embassy) wants it. Sometimes logic is not the right approach, satisfy the hungry tiger.
2. The petitioner is the supporter not the immigrant. Once you are married and in the USA and have a 6 figure income, what a lucky guy.
3. The petitioner needs to verify the income, and is liable for your support until 40 quarters of earnings are established. That is why many co-sponsors are reluctant.
4. You can supply the bill showing long distance calls, Skype etc. is easier you can print out some conversations, along with cards, letters, emails etc.

I would become more familiar with the K-1 guides and look at the Ireland postings for peculiar items need for your neck of the woods. Also WIKI has some excellent postings on all of this. Some one who did this from Ireland should and will shed light on your situation. A little confusing in the beginning. Hang in there.

Hi everyone!

I have currently been working in China for a year and a half now and have been with my fiancé for a year now. I am sending the I 129f petition this week and have included such evidence as a copy of the apartment contract with both our names where we have been living together for 6 months along with various internet and television bills. Also my current and previous employment contracts in china where I met my fiance and receipts for various gifts spanning a years time with accompanying pictures. We will also go to open a joint bank account and provide a copy off the contract. Does anyone have an idea if this evidence will speed up processing of the I 129f? My Chinese work visa will expire Aug. 31 and I would like for my fiance to be able to go to the US with me around that date. Should I include a letter requesting expedited processing if possible? Anyone been in a similar situation as me?

You may want to be careful of the level and depth of evidence that you include in your I-129F petition. It may have a double-edged sword effect. If USCIS gets the impression that you are already married (i.e, joint accounts, etc.), you may be considered ineligible for a K-1 fiancee visa. Take a look at the great information available through the "Guides" button, located at the top of the forum page, for examples of the type of evidence necessary to demonstrate that you have met the initial requirements of the K-1 visa program. For Guangzhou interview, it is generally recommended to "front-load" the I-19F petition with relationship evidence, i.e., photos, joint travel, etc. However, in your case, the joint account stuff may be a case of a little too much information, too soon.... Hence, the suggestion to carefully review the forum's K-1 Guides for specific information.

Expiration of your Chinese work visa would not likely be considered sufficient criteria for expedited processing. Here is the link to the USCIS expedite criteria:

SzhMli - You need to remember the following:

1. You are constrained by a 90 day window, once your fiancee is in the US.
2. You are dealing with the slowest office of USCIS.
3. You don't know what problems, challenges or delays might alter the timing.

My advice is to - Get your deposits back so you can sleep at night - work solely on the issues that need to be worked on to get your fiancee here - go to a Justice of the Peace when your fiancee arrives - (every city has many of them) and get legally married to meet the requirements - while planning the best wedding in the world together.

This will take the pressure off of you - because it is a fact - you don't know when you can have that big wedding yet!

There are dozens of threads on this very topic. The consensus seems to be that there is too much risk. There are uncounted numbers of places in the 50 U.S. states in which to honeymoon. Save the Virgin Islands trip for when the green card has been issued.

We listed my fiances 6 year old son on the I 129F form. Is there any other form I need to complete in order for the child to be included in her immigration to the U.S.? Do we need to send passport photos of the child too?
I have been reading the guides but they don't address this issue clearly.
