hi everyone.. i am a bit confused on the k1 k2 process. i am recently divorced and am planning on bringing my boyfriend to the states on a k1 and k2 visa for his son.. now my question is do i file two separate i-129 or how do i go about this? i am also going to teh dominican republic in a few days to see my bf and what documents should i ask of him before i come back and what items need to be signed and is a letter of intent to marry needed from me and him? or is just one fine?

I was reading the Moroccan Portal and a couple got denied because he had the I-184 instead of the I-134 in the interview. Seems like they took to long to resend it or communicate that to the consulate and their visa got denied. I'm not in that stage yet but I would like to know this difference before to keep informed of what NOT to do.

Also is there anyway here on VJ that I can post directly to the Portal I follow. Or once I post a new topic under the K-1; will it show under the country I am representing in my petition?

The tried and true method of relationship evidence (i.e., photos, chat session, etc...) states it best, is found in the forum's K-1 Step-by-step visa guide, and is easily accessible through the "Guides" button, at the top of the forum page:

"1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Follow the examples, to avoid any further delays and possible RFEs. Be sure to make a copy of everything that you submit to USCIS.

On getting the marriage license, it will depend on where you're getting married. The K-1 visa itself is only for allowing you in the country.

Good Afternoon.
I am working on my immigration and have a question. We are doing the K1-Visa. Our wedding date is August 30, 2013-so i think my time frame is perfect.
two questions in concerns to this- we are planning a honeymoon to the Virgin Islands. These are owned by the USA-i can still go here right? Also: how long before i can travel back into Canada? Any feedback would be awesome! i do not want to jeopardize my VISA process once I have permission to get married and be in the USA!

After entering the US on a K-1, you can go to the American VI as long as your travel does NOT involve any international stops. As a consequence, many folks opt for a mainland honeymoon, or a domestic trip to Hawaii.

After entering the US on a K-1, you can travel internationally after you have obtained an Advanced Parole authorization, or a Green Card, see Adjustment of Status (AOS) process in the "Guides" section, accessible at the top of the forum page.

"IMPORTANT!
Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain ALL original supporting Evidence since the USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence.

Create a VJ Timeline

Estimate processing time and approval date: Creating a VJ Timeline will allow you to track your case and will generate an estimated approval date for your petition. You can always gain access to many other tools to help you plan how long your Visa Journey will take!

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. My fiance goes for her K-1 Interview January 9th. Her two year residency restriction expires on February 8th.

There are two forms the she is filling out that ask if she has fulfilled the residency restriction. Would the best way to handle this be to say she has fulfilled the 2yrr, and wait for them to question that answer, or to say she has not done so and add an addendum stating that it will be fulfilled in one month?

We tried to time the interview to coincide exactly with the expiration of the 2yrr, but were just slightly off.

90% of K1's were denied? How sure are you of these statistics, because that is a very scary situation. I was under the impression that k1's were a tad bit easier than, say, a B2 Visa.



It's not scary, it's reality. Depending on the fiance(e)'s country, obtaining a K-1 visa can be a daunting proposition. In "high-fraud" countries (their term, not necessarily mine), i.e., MENA, a large part of Asia, Africa, the burden of proof is on the petitioner and beneficiary/applicant to be able to convince the interviewing CO that you are not fake and that your application is not fraudulent. I agree with SupastarsaM, it can be an uphill battle if you are not prepared.

Call USCIS to send your NOA1 to you you might need it in future, however you don't need it for your RFE. A USCIS cover letter will be sent with the RFE to submit with whatever they ask for in the RFE.


You will need the Receipt number that is on your Form I-797c (NOA1). If you got that from the email, you are good to go. That is what you will need in the future.

When you get your petition approved, you will receive a Form I-797 (NOA2) approval notice. You WILL need that notice later on in the immigration process.

Wait for the official RFE notice, furnish the information requested, comply with the instructions and follow the directions. Hopefully it won't delay your petition processing too much.

Don't get too nervous. It took me 7 months and one week for me to get my NOA 2. Nothing was "wrong", they are just "busy". You did not state what service center you application is in. Maybe others in the same center can give you a better idea as to what the real processing time is. In answer to your question, if you choose to contact your representatives, I would contact both of your state representatives (congressperson and senator).

For all of our photo evidence submissions, I printed our digital photos on 8.5x11 plain white copy paper, one per page, with a color laser printer. On the backside I wrote the information in the manner described in the K-1 Visa Guide. I then put the individual prints into Avery Diamond Clear Heavyweight 8 1/2 x 11 Inch Sheet Protectors. I included 5 photos with our I-129F petition submission, another 5 photos for the visa interview, and about 15 for the recent AOS interview. (These were photos of our three visits, marriage photos, family photos, etc.) The IO at the AOS interview wanted to keep them for the file, I was all to happy to comply. We have our memories, and the electronic originals. HTH.

A word of caution on the wedding/reception thing/married not married issue. There have been tons of threads on this. USCIS can refuse a K1 for acting and looking married, what ever that is, then you have to repay and refile. How about an engagement party period, keep it clean and get married after the arrival in the USA. Other option is get married, come home wait till its approved and arrive in US. I have heard both sides on the K-1 visitor visa issue, yes and no. I would not do it personally. Good Luck what ever you choose.

Seems there are a lot of people trying to play around estimated time frames in order to plan a wedding when the process is not even half over. I understand it can be complicated when families are spread between two countries a half a world apart, but the simplest thing is to GET THE VISA first, then make plans. You have some 6 months after the visa is issued to use it. Then another 3 months to get married once she arrives. That should give you ample time to get a venue and make concrete plans. Too often something stupid happens and then everyone gets really stressed out and you really do not need to go there.

There are plenty of cautionary tales on VJ of people like the OP of this thread who wanted to control the timeline when it isn't possible. The government agencies are on their own schedule and do not care about your plans. As long as you perceive the risks of making plans before the visa is in your fiancée's passport, what anyone posts will likely not make you happy. What happens if you get an RFE? Or there's a delay in getting the interview scheduled?

Thank you for your response. We received the technological NOA1 on like December 4th. Would it often take 3-4 weeks to receive the hard copy?


It could that long considering the holidays and the overload at USCIS. The email message acknowledged that they have have your petition and should have given you a receipt number. You do have your receipt number from your email? Correct? The receipt number is really the important thing about the NOA1. You need that number to contact USCIS about your petition status.

Now comes the 5-7 month wait before NOA2. Take a look at the Guides and see what type of preparations you should do in the meantime.

You sent in a petition, not an application. You are not applying for anything, you are petitioning the government for your fiancee to be given permission to apply for a fiancee visa.

Yes it is required. One year is always required, but most embassies want to see three so may as well submit three years rather than face a delay because they asked for it at interview. If you filed taxes, then this is no problem- call the IRS and ask for tax return transcripts, takes about two weeks to get and is free.

Hi, I just Filed a K1 and it was recieved by vermont on November 15th and I got my NOA I-797C receipt number but when I call they have record of the receipt number but no information as far as processing yet.

Does anyone know what I can expect as far as them getting back to me?

When can I expect a call or follow up letter with what we need to do next?
How long can I expect this whole process to take from begining to end?

My girl lives in Moldova will they contact her for the interview by phone or by mail?

What should she have prepared for before the interview?

I currently do not have a lawyer, should I get one to make the process go by faster, or is it a waste of money?

No. The two main requirements of the I-129F petition are that you are both free to marry and you have seen each other in person within the 2 years prior to filing. You need to visit face-to-face again before filing. The visit can take place anywhere the two of you are able to travel to.

My fiancée will arrive in the middle of February and we will get married at the end of it, filling for AOS in the first dates of March. How long will it take since then? She's gona b getting Master's in Switzerland this fall, will she get the green card in time? As far as I know she cant leave the country before she gets it.

You can file the I-129F petition while they are in the US visiting with you. They can stay as long as the I-94 they received when they entered will allow. They should not overstay their visa. They will return back home to their own country and file for the K-1 visa once the I-129F petition is approved, have their medical and be interviewed. Those things cannot be done in the US.

My opinion is, not to make hard plans or put moneys on stuff which cannot be changed. This process is unusual and has twists and turns. I made general plans and after my wife was approved on her I129f, I firmed up our wedding stuff in Las Vegas. This means you will probably not the best price on air travel either, sorry. Good Luck with your interview. Each step along the way has its own challenges, from the unknown to the GC.

I got my NOA1 in early August, with the timeline saying i should have a decision by Early February. Could I still get an RFE, or would I have likely already had one? I have no reason to think I should have one, just curious...

Our friend's SO enter the US with Marriage Visa. But the agent at the entry port stamped the expiration date of the visa only 30 days out, not 90. How do we correct this issue?

hellow everyone and merry xmas...

i am completing form for K1 visa need advice on below.

+ what is ds-158 do i need to complete this..
+ what is fc-029 do ineed to complete this..
+ my fiancee getting ready sponsor papers which i will be receiving within 15 days due to holidays ahead and my I29F petition will be expired on jan 25 2013. Do i need to apply for an extension because visa interview may take 1 month which will cross the expiry date. who apply for extension in date me or my US national fiancee?

actually i have not received packet 3.5 but downloaded needed forms through net upon lawyer instruction and he has not advised on above forms (my I129F petition is approved.)

As others have said, you cannot do that. If she enters with a K-1, you must marry within 90 days IN the US. Go and get married in Canada and then file for the CR-1. It will be cheaper than a K-1 + adjustment of status and she will be able to work and travel freely because she will get permanent resident status as soon as she enters the US with the spousal visa.
