There is no waiting period per se. Once you marry (your profile notes K-1), you want to file for AOS asap. You should also file for EAD and more importantly AP-advance parole. AP would be approved in 2-3 months after filing, your new spouse can then travel while the GC is still in process



We received EAD/AP combo card as has been described. However, to be on the safe side, we waited until we had the 2-year GC until my wife traveled back to settle important business affairs.

I am sure your congressperson is well aware of the immigration timelines, USCIS is under staffed, and there is nothing a congressperson can do or say to anyone to change that. Even if you do go beyond what is normal processing times, the only thing he can do is inquire on your behalf. You still have a few months before you even need to worry about it. As much as everyone hates the fact that they have to wait, USCIS processes millions of visa petitions every year. It is what it is. Good luck on the rest of your journey.

As long as you supply all the requested items their should be no issues. I would not submit any stale dated materials / forms and intent letter etc. Don't know what "things are either". Will this raise any eyebrows at the NOA level or are the folks really just sifting through to make sure everything is present and accounted for?

I am about to send my fiancee my I-134 and supporting documents, and I wanted to make sure that I haven't forgotten anything. This is what I have so far

1. Completed I-134 (two original copies.) My fiancee's son will be coming here with her, and I indicated this in part 3 of the document. Do I need to complete a seperate I-134 for him as well?

2. Tax returns for last 2 years

3. Letter from employer signed and dated verifying salary.


Should this be enough supporting documentation, and do I need to complete a second I-134 for my fiancee's son too?



If you haven't already, be sure to check for and follow the specific requirements of the interviewing embassy/consulate. There are instances of different requirements for K-2s.

Thank you - yes, I received the e-mail notification of our NOA1 as well as the receipt/case number. I am able to check updates and all that jazz... I just remember reading (somewhere?!) that the hardcopy was needed at the Embassy for the interview.

Incorrect!

Read the GUIDES - the NOA2 needs to be received, saved and presented as requested, NOT the NOA1!

Think about it. The NOA1 is only the acknowledgement by USCIS of receipt of the the initial I-129F petition. The NOA2 is the notification by USCIS that the I-129F petition has been approved.

Hi everyone!

I am the (hopeful!) beneficiary of the K1 Visa process we are going through. My USC has a somewhat complicated mailing situation. His physical address does not/cannot receive mail. We added a separate sheet in our i129f package explaining this, with header, large font and notating the correct address for mailing (a PO Box).

Its been 11 business days since receiving the e-mailed notification of the NOA1 and to date, no hard copy in sight :( What do we do now (obviously in the event that is never shows up)? Can I call and inquire after 30 days, or does my USC have to? Is this where we are subject to some $400 fee to receive a second copy?!

Did you receive your receipt number when you got your email notification? It will start with a EAC or WAC prefix, followed by a series of numbers (I forget how many,)

If you did get it, then you are good to go. It would be nice, though not required to have a hardcopy NOA1 (Form I-797c). With your receipt number you can contact the USCIS and get updates on the progress of your petition.

In contrast, you do need to make sure that you get your official hardcopy NOA2 letter (Form I-797). It will be necessary later on in your visa journey, during the AOS process.

How about credit card debts?? Do they look at that too?? I have like almost $40,000 debts total with my loans, credit cards and auto.. But my annual is $90,000 and i don't support anyone.. So according to poverty guidelines, i think am okay but am just concerned about my debts.. I don't know if they consider that as a factor to determine ability to support.. Got no savings either ??

Yes. You were a naturalized citizen and therefore have an alien registration number. That is exactly what the form is asking for. US born citizens don't have alien numbers, and this is why the example forms don't list one either.

Well from my experenice, we tried the k-1 and was denied,it was sent back and expired,so i just recently returned from China .we got married and next week i will file the i-130.we lost 10 months waiting to see what USCIS was going to do with the returned Petetion.From what i've seen,the cr-1 is about as fast as the k-1.It is cheaper than the k-1...Whatever you do..FRONTLOAD YOUR PETETION...Guangzhouz Embassy never did look at any of the evidence we took to the Interview.

Okay, so me and my gf(now fiance) have pulled the trigger and decided that we do indeed want to spend the rest of our lives together, so today I will be gathering up all the required paperwork to send in. I've read quite a few things on here and sorta understand the entire process already, but I do have a few questions that I can't find the answers for.

I am an America Citizen, she is from China. We've been together for a little over 2 years now. I have visited her twice within those two years, once for a little over 2 weeks and another time this year for 3 weeks. I've kept all our chat message histories, photos together, my phone bills with calls to China, flight tickets, you name it_ I'm pretty sure I got plenty proof of our on-going relationship.

The only question I have is I know I will be responsible financially, but I do not have a bank account to show any statements, (I have never saw a need for a bank account, now might be the time to open one eh? lol), All my checks are deposited into a company issued master-card that I use to access my cash(I'm thinking maybe I can use these statements to show income). My credit history isn't very good at a score of only 550 or so =[ You can say I made some bad decisions in college, but all my personal loans paid off. The only debt I owe is my student loans now, which I have been paying monthly for, for the past few years.

I make a little over 24,000 a year before taxes and I'm only 25 years old, I'm just a little worried I might not qualify financially? I have a little over 3000 saved up and intend to save at least 800 a month to add to it each month. I know by the end of the year I should have at least a little over 10,000 saved.

My real question is do I meet the financial requirements if not what else should I do to help meet those requirements. I do reside in the state of Alaska_

Any tips or information would be greatly appreciated, thank you in advance

You may be okay. Check in the GUIDES K-1 section, in the "What to Send..." area for info about the I-134, financials, FAQs for details. There are some great tips to be found there regarding statments and requirements. There are also links in there that can connect you to the Federal poverty guidelines that USCIS uses to determine your potential eligibility. USCIS is not interested in credit scores. just show 'em enough money, or the capability to produce money. The possible steps you mention, opening a bank account, saving money, are all good things to do.

I am an Indian but living in Italy for studies as i mentioned. Can I go through the process in Italy? It can be done, will likely depend on your residency, and the interviewing embassy/consulates.

Also I see it takes 9 months around from the day I-129F is sent to the day one receives K-1 visa is this the case always? That has been generally the case in the past. However, due to increased workload at USCIS, those times have been extended. How much? Anyones guess, read recent threads in the K-1 progress forum for current issues. Whats the pulse minus time period needed for the entire process? There are too many possible variables to accurately determine a timeframe. I would wait and see if you get an RFE, and if you do send it in at that time. I would also go over your entire package that was initially sent it. If your lawyer doesn't even know that Letter Of Intent is a requirement, it makes me wonder what else they forgot. If you do get an RFE, I would have long talk with your lawyer about getting some of your funds back because of his/her incompetence. Good luck :thumbs:

My case (129F for K1) was received by USCIS (Vermont) on August 20, 2012 (I received the NOA1 by mail on August 22, 2012). I've been waiting for almost 8 months without any news, even though the USCIS's website says that the processing time is about 5 months for 129F (between NOA1 and NOA2).

Two weeks ago I asked for a Service Request and a representative told me that I would have an answer in 15 days or less ....I am still waiting...

Please, there is someone else who is in this long wait (> 7-8 months)?
Is there anyone who received the NOA1 in August 2012 and is still waiting without having received any other notification?

It's been two weeks since our case been approved. We only got a letter I-797. It's saying been forwarded to listed consulate in the letter, but there's no consulate listed in letter. I didn't see any 'NVC number' either. Wondering how I'm gonna to check if it's arrived at NVC or Consulate...hope those who have experiences may help out a bit. Many Thanks!
