Hi,

In from Canada and my boyfriend lives in Kentucky. We are in the process of starting the K1. We just found out about my sponsor needing to make 125% of the poverty guidelines. My boyfriend does not make enough as he is on disability and only makes 14K. Even with adding his assets i dont think he will make poverty level. I make good money here in Canada, would i be able to prove that i can support myself or if i have money in my bank can that be included?

The K2 for my fiancee daughter was approved. The American doing the interview stated he was concerned that the other two daughters were being left. He also stated that she only had eight months to apply for them after she arrives here. I thought she would have 1 year from date of issue of k1.

Secondly she said they only asked her her name, age and if she met me in person. Other than that they said congratulations and your passport and visa should arrive in a few days.

One other question. How long do I have to adjust status of the k2's after they arrive here if I do not do it at the time of the fiancee. I ask this because money will be very tight if I change there status before bringing the other two daughters here.

I know it would be cheaper to change the youngest status with mom but I will need an additional 5000.00 to get her other two daughters here.

Any feed back would be helpful.

Your NOA1 is dated 11/19/2012, USCIS wants to see documentary evidence from the period of November 2010 to November 2012. What kind of evidence did you provide for that period? You will likely have to wait until you get an RFE and follow the instructions provided.

I read in some prior posts that obtaining a lawyer for your K-1 visa processing is a waste of time because they slow down the process and have no pull with the embassy. But is there any added security to hiring a lawyer(specifically the online K-1 fiance visa lawyers)when beginning your application. My fiance is coming from a high risk country and I was considering hiring a lawyer online and spending no more than a $1000 for their services.

I thought a lawyer could help me dot all my i's and cross all my t's. This is very important to me and I'm willing to pay for some added security if it exists. However, the forum posts I read have given me second thoughts seeing how I've already purchased a book on filing a K-1 Fiance Visa and have a good understanding of the process.

I like to error on the side of caution when dealing with bureaucracies so does a visa lawyer have advantages?

You choose a rather "prejudiced" forum to ask your question about the utility of a lawyer in generally straight-forward immigration cases. This forum is generally regarded as a Do-it-yourself (DIY) site. As such, most of the folks here do not retain a lawyer. IF your immigration case has complications, or extenuating circumstances, you would do well to retain legal counsel.

In our case, we decided that our money would be better spent on other things than an immigration attorney. The wealth of information and good advice available on this forum, confirmed our choice.

Part E of Form I-129F is generally left blank, unless you had someone else, like an attorney. fill out the petition.

For a good example of what usually needs to be filled in, follow the official form instructions, and take a look at the forum's "Example Forms."

BTW, please avoid using capital letters, they are hard to read, and in internet parlance, you are shouting. B-)

It looks like you may get your interview in Sept/Oct. You may be fortunate, Guangzhou may have a more temperate climate at that time. It was very hot and humid when we had our interview in July 2011. I felt like a dumpling in the steamer.....

Nowhere on the Form I-797C, Notice of Action that I just received does it list a "priority date" or even the word "priority." Can someone please clarify what the actual NOA date is? Is it notice date? Received date? What is it.

There is no priority date for K-1 visas, priority dates are for family-based visas. Your NOA1 date is the notice date printed on the form.

Just had a question. When I was making copies of my birth certificate the front did fine but the back didn't show up with the watermarks so as a precaution I made a copy of every page of my passport. Do you think I should be fine sending both copies in for my I-129F?

Hello All,

My fiance and I applied for a I-129F in early December. I called for a status update last week and learned that my fiance received an alien registration number on December 7th. That's two days after the application was received and about three months before the day that I called for an update.

From posts on this forum, I gather that this is good news; it means that things are moving forward. But I also gather that I could have expected to hear back from the USCIS shortly after the number was assigned.

When I asked about this they told me that the application is still pending; that the California center which is processing my application is backed up and currently processing applications for July of 2012, and that it will likely be a matter of months before I hear anything about the application.

I called a few times. One person expressed that it is unusual that I have not heard back yet, another said that the case is actually still pending and that I was misinformed by their automatic notification service, yet another told me that the case is still pending and that this wait is to be expected because of the back log in the CA office. sigh....

Is it strange that my fiance received an alien registration number three months ago and that we have still not heard anything back about the next step? Is there anything I can be doing at this point to move the process forward? Be patient and wait.

Thank you for your time. This forum has been an incredible source of useful information and stress relief throughout this whole process.

No, she has to pay attention to the dates on the tourist visa,
as
filing for a fiance visa NEVER gives status inside the usa.

Can come into the USA once a K-1 visa is granted, sure, but filing for a K-1 gives no status in the USA, to remain in the USA.

AOS can stand for 'adjustment of status' - we've a guide for that, and there's a marriage involved - so bear that in mind as a viable option.

On her finance visa she will interview at the embassy where she lives. Just a suggestion, don't try and shop for the easy way, just the fastest way for you as a couple to meet your goals, and the legal avenue. If you are not marrying till next year Finance'e Visa seems fine. We did but would have gotten married first then came to US with a green card after our review. You can continue to work at home, have plenty of time to get organized then come to US, green card in hand.

No he is Haitian, an the mother was Haitian (now decease)the bank rep had him to call the Consulate and he was advised the same thing by the Consulate, but he did not take the name of the Consulate he spoke to. He was advised that the only fee the child will pay is the taxes once departing from the country. I just don't know I don't want anything to delay this process.



I would suggest getting a second opinion from the consulate and this time getting the name of the person at the consulate. Here is the DoS Fees for Visa Services:

Hello,

I recently had to change my address with USCIS. I am the USC, we sent out I-129F last month, myself and my Irish fiance live in Ireland. We had to change our address on file because for some reason they couldn't deliver mail to us here in Ireland. We never received our hardcopy NOA1. We changed our address with USCIS to my mom's address in California and she has begun to receive mail on my behalf and she got the hardcopy NOA1 finally, and all is fine and dandy.

My question is, in one of the letters my mom received from USCIS it is saying that in order to complete our change of address, we have to file an AR-11. I looked at the form and it's called and "Alien's Change of Address Card", so that makes me believe that I don't have to file that because I am a USC and not an alien. I would just go ahead and file one for my fiance but it asks questions like his current US address, and port of entry and stuff. All implying that the alien is already IN AMERICA. Well my fiance is not in the US, does he have to file that? Thanks in advance!

I figure I just bump this up instead of making a new thread.

I'm done with our packet and soon be sending it as soon as I can have her sign it and date it where she needs to. I got a few questions, I don't want no problems and have to get a RFE. So with the packet I'm sending:

6 pictures of us together during various stages of our relationship and 1 with family. Also 1 current.
3 pages of her phone bill which is an American cell phone that I pay for and shows her international calling to my cell. So will show a payment and calling to my cell within' past 3 months.
1 page of toll tickets that I saved when me and her went with my mom and her husband to Nyarit Mexico for a week to show that we traveled together. No photos because all were lost.

Just wondering if this will be enough evidence of a real relationship?

"Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)."

Suggest that you compare what you have to what the Guide recommends.

My fiancée and I are planning to do the K-1 visa route instead of getting married, due my work and small hour windows with Mexican government offices, it's hard for me to get my permission papers.

I do however have a few questions. Most are basic and I have seen many topics, FAQs and even info all been very helpful.

We plan on sending our packet in the middle of April. It will be leaving from CA but how are the service centers dealt with after NAO1, is it random to the CSC and VSC? I rather prefer the Vermont center. Also given this type of visa, what are the projections of the Juarez Consulate MX of approving the visa? What timeframe are we looking at?

Also on photos, how do most send them out? Like place 2-3 in a laminating sheet or like a clear paper pocket. Maybe just in a envelop?

Any info will be appreciated thanks.
