I was planning on not going to the Ghangzhou interview.  For my fiancée.   Many people told me to go.    Is there risk by not going?

I went to Guangzhou for the interview, to provide moral support for my then-fiancee. It was July and the weather was typical Guangzhou, hot, humid and unpleasant. I was aware that GUZ consulate policy was to exclude the USC. I recalled that the GUZ consulate is a tough one, necessitating front-loading of the initial petition, due to a high-fraud scrutiny. We stayed in the hotel around the corner from the consulate entrance, in the same building as the consulate. I prepared an Evolution of Relationship (EOR) letter, folded it lengthwise and placed it into my passport. My wife then put it on top of her pile of evidence, when the IO asked for her supplemental information, the IO noticed my passport. glanced at the letter, and acknowledged my presence in the area. good.gif

 

I don't know if it made any difference in the outcome of the interview. However, I was able to try to calm my nervous then-finance, and enjoy an expensive cup of coffee in Guangzhou. But I can't help but think that it helped demonstrate to the IO that we had a genuine and ongoing relationship. My wife and stepson had to travel ~ 2,000 km from their home in northern China for the interview and physical. I figured that the least I could do was  to travel the ~12,000 km to be with them in Guangzhou at this momentous event. innocent.gif

 

BTW, I could have sworn that I saw Darnell early one morning in the nice park across the street from the consulate. doing his exercises.laughing.gif

 

The whole visit is now but another memory woven into the fabric of our visa journey and our relationship. Go if you can.yes.gif

I got my REF and I have til July 18,2013 to answer back and they are requiring me to have a prove that we met before 2 years of filling which we didn't , My question is, if I make a trip now and get pics and proves and turn to them, will they accept it as evidence? right now I have hundreds of calls, thousands of texts,money transfer receipt, proof of mailed item thru post office, greeting cards, and emails.. Do you guys know if I have any hope not to be denied?

Sorry, but I think that you answered your own question, "I got my REF [RFE] and I have til July 18,2013 to answer back and they are requiring me to have a prove that we met before 2 years of filling which we didn't ,"  USCIS is asking you for evidence that you meet one of the initial requirements of the K-1 petition, refer to Form I-129F, page 2, part B, question 18:

 

Has your fiancé(e) met and seen you within the two-year period immediately preceding the filing of this petition?

 

You can either wait until they deny your petition, or withdraw your current petition, comply with all of the requirements and re-file a new petition.

B ( the Canadian) and I ( the American) are planning on filing our K1 in a few weeks. I've been doing some research for the past month (aka driving myself crazy) and I think I have most of the process processed. I do have a couple of questions though, some related directly to the K1 and some for after he actually gets here.

1) he's previously married. Do we need a copy of the previous marriage certificate? We already need to get copies of his divorce certificate and birth certificate, so if we will need it at any point in the process I'd rather go ahead and get the trifecta in one go.

2) the dreaded income question. My job is odd. I'm pretty much a contract employee. I wait for a call, go wherever they need me, do the job and get paid very well. However, I can go months between jobs. Jobs can last anywhere from a day to almost two years. However, I'm paid as though I'm a w-2 employee though Im more like I'm a 1099 employee. But again, it's not a steady income. I do this because I like the job, it's always different and I do travel the US a lot. However, I'm not sure how this looks on paper to an immigration officer. I'm under the impression that it doesn't so much matter the amount you make (besides the poverty guidelines) as opposed to the stability of the income. So would it be better if I take a desk job and do the 9-5 for a couple of years to get us together? This is doable, but I just prefer the current to the latter, but would give it up for him to be here.

3) we are planning on Vegas for the wedding. Close family and maybe a few friends in search of the perfect Elvis to do the deed. Anyone else go this route? And if so, any pointers? It will be both of our first times in Vegas. And speaking of weddings, how are/did you guys go about planning when you can't set a date?

4) after he gets here, and before we marry, what does he need to do? Anything? We are planning on waiting until around day 60 or so to hop the flight to Vegas. This is so that we can adjust to us being us, only together instead of a 3 hr time difference through Skype. And before you ask, yes we've spent extended time together, but its always one of us on vacation mode and the other in work mode.

5) after we marry and have the certificate, what do we do? Can someone point me in that direction. I know it's applying for AOS, but I want to see a run down so I know what we need and what to expect.

We are planning on him moving here sometime after the new year. I'm trying to get all our rubber ducks in a row so that we can finally make it happen. I just want to get a clearer picture of the entire process rather than just focusing on getting the visa. That being said, if anyone wants to volunteer to be a hand holder for us, it would be greatly appreciated.

If the petitioner can attend the interview, I would encourage you to do so. As long-time member T-Bone has often said, it always helps to provide moral support, and is viewed as a positive thing by the CO, if the petitioner can attend, or be in the near vicinity. Some consulates, like Guangzhou, do NOT allow the petitioner to attend the interview. Yet, I still flew there, I gave my then-fiancee my passport with a "Evolution of Relationship" letter inserted in it, and asked her to give it to the CO at the start of the interview. The CO understood that I was there to support my partner. Not sure if it helped, but am sure it didn't hurt our case.

However the first time I went to Canada to visit ( having never visited before ), they just let me right through ( only questions were why I was visiting, how I met my boyfriend whom I was visiting, etc. ). So I'm crossing my fingers for the same outcome for him seeing as he also has never visited the States. Depends on what POE officer you get though, hopefully we'll get a cheery one ><

However if he needs a reason to how he has ties to Canada, will the fact that he's attending college help?

Hopefully not a stupid question, but I'm currently living in the UK with my fiance and was wondering whether, on all the documents where my address is needed, I should put my current UK address or my family's US address which I'm going to be living at when I move home in September (and where I have all my US mail forwarded through.) I know it's going to be kind of a pain either way but obviously I want to get this stuff sent as soon as possible, on top of which one of my main proofs of meeting/ongoing relationship is the fact that we've lived together for two years so I don't want to put my US address down for fear of misrepresenting that or anything. Has anyone been in a similar situation, and do you have any advice?

Additionally, the step-by-step K1 guide here says that I can submit "a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years" as proof of US citizenship which would probably be most convenient for me but just to make sure, does the wording mean that the passport is valid for 5 years from the filing date or that it was issued for a period or five years to begin with? Mine dates from 2004 and so is due to expire in July 2014, so I wanted to just make sure that the expiration date wouldn't come back to bite me in the rear.

Sorry, I stand corrected….too many forms, days, and mailings have transpired in the year since we were at that stage of the process. If I remember correctly, she initially was mailed the Packet 3 information. On her DS-156, Nonimmigrant Visa Application, she included her email address. From that point forward, she was contacted by consulate via email.

I remember that I was in contact with the GUZ consulate at that time, and provided them our electronic contact information. I found it very helpful to establish dialog with the GUZ consulate IV unit. Additionally, It can be easier for the USC, by way of the DoS visa specialists (202-663-1225, press 1, then 0), to determine the status of the approved petition. For example, when the consulate received the approved petition packet from the NVC, and when Packet 3 was sent from the consulate to the beneficiary. Particularly helpful, since the USA and PRC governments routinely quarantine each other's diplomatic packages (cat and mouse game). This can literally add months to the transit time (and subsequent processing time) from the NVC to the GUZ consulate. Thankfully, there are work-arounds (check the China regional forum for details).

My fiancee's interview was Oct 23, 2012. She was told she passed and no other documentation was needed. We have wait 12 weeks for the visa to arrive, called the embassy, sent e-mails and checked the status on the CEAC website. 3 weeks ago it said "ready" 2 weeks ago it said "issued" and last week it said "refused." We don't understand what happened, how is was approved and then refused? Anyone else have this happen? Now we have been told to wait for the letter from the embassy to tell us why the visa was refused. Can anyone give me some insight on this?

Don't beat yourself up wondering about "what if's, that can drive you crazy. :wacko: You have to wait until you get the RFE letter, and then be ready to fully, timely and accurately respond to the request. You can post the RFE contents (redacting personal information) on the forum, if you want to elicit discussion and comments from other forum members.

Hopefully, this will only be a minor delay in your immigration journey.

So my fiance and I use Kakao Talk and Line. I am able to export the chat logs, but most of the chats are in Japanese or Mandarin.
I know that any document must be in English, so am I suppose to translate all of it? There are more than 30 pages in length.

It is likely not necessary to include or translate all of your chat logs. The site's step-by-step K-1 Visa Guide says it best:

?."Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present."?..

Try to provide a balanced mix of all of the types of evidence listed. What is your interviewing consulate? There are some consulates (i.e., Guangzhou) where "front-loading" your initial petition with as much of the various types of evidence is prudent. Check regional forums for specifics.

We got notified through email and on the USCIS website saying that an RFE got sent out today.
We filed July 27, so at least we now know that our case has indeed been touched!!
Does this mean that this will kick things into high gear? And once we reply to the RFE that things will start rolling?!
My fiance and I both got quite excited mainly because we now know that they are indeed moving along!



While yes, it does mean that your petition is in the adjudication process; it is now currently on hold, and likely in another pile, waiting for your response to the RFE. You should wait until you get the actual RFE letter, and then be prepared to fully, timely and accurately respond to the request. It may be something simple, or not, there is no way to fully determine with the actual letter. You can post the actual RFE letter contents (redacting personal information) on the forum, if you want to elicit discussion and comments from other forum members. The quicker you respond, the quicker your petition gets on down the line.

Hoping it is a minor delay on your immigration journey. :thumbs:

FACT: I sent Western Union receipts along with my I-129F and I got approved.

Worst part is that I do not know why yet. It's been almost 5 months and I received an email yesterday just telling it has been denied and I should receive a letter explaining why. So needless to say I'm freaking out. At first I had no clue why, but after looking through this site, I think I might know. I pretty much only filled out the I-129F form and mailed that in with the fee, nothing else. I figued once the backgroud checks were done they would ask for more info for the interviews. I called USCIS 3 different times and talked to 3 different people asking them what I needed to do, and they all said the only thing I need to do is fill out the I-129F form and mail it in. They also mentioned the requiremens to be eligable, but that was it. I talked to a couple lawyers also, but they wanted a few thousand dollars to handle it. I did not get the letter yet, but should in the next couple days. I don't know why I did not find this site before when searching online. It came up now in my google searces on what to do about a visa denial.

So what are my options? Should I get a lawyer?

My background... My Fiance is from the Philippines, and I have known her for 5 years now. I have been supporting her for the past 4, I helped her go back and finish highschool, and she is now in her 3rd year of college. Originally we were going to wait for her to finish college, but I figured it would be better for her to finish here (USA) and get used to the culture, language, and build a network through school. I have a lot of (daily) chat logs from Yahoo, Skype, and emails. I also have a lot of Western Union receipts and Xoom online history of me sending her money. I have visited her and met her family 2 times now and gave her an engagement ring. We are both eligieble to marry and have no criminal background. Also neither one of us have been married before, or have any kids.

I thought I might be asked for clarification or more info, but I did not expect to be denied. Would not providing enough info or documentation result in a denial? I guess worst case is that there is something in her background check that came up, but knowing her as long as I have, I would be very surprised. I feel foolish now if it is just because I did not provide enough info. I waited a few months before mailing the form while trying to make sure it was all I needed.

P.S. When you get your NOA1 (I-797c) acknowledgement of receipt of your petition by USCIS, update your timeline to either the WAC (California Service Center or EAC (Vermont Service Center). The prefix in your receipt number will indicate with one. You sent your petition to the Lewisville, TX lockbox location, not the Texas Service Center (it does not process I-129F petitions). Putting in the correct service center will enable you to get a VJ estimated timeline for your NOA2.

BTW, my then-fiancee and son had to travel over 1,900 km for their successful K-1/K-2 visa interview. Heck, I even made the over 10,000 km trek to join them and support them at the same Guangzhou consulate interview.

The time apart and the distance apart only make the end results of this entire immigration journey all the more sweeter.

Can we have the "wedding" elsewhere and just file for the marriage certificate after we arrive? Sure, as long as your "wedding elsewhere" is in the US, following the local laws, and get the marriage license certified in that jurisdiction.

From your signature, it looks like it took about seven months for you to get the visa. Is that about standard? The timing is very variable.

Hello,

Last week, a day before Thanksgiving, I received a letter from the United States Department of State National Visa Center.
The letter explained that they had received an approved I-129F petition. Is this the NOA2?I believe I am missing the NOA2? I called USCIS and the representative told me
that she could not see if the petition was approved or not, that she was going to fill an electronic form and submit it to the Vermont Service Center. She promised a response within 25 days.

I checked the status online and the status is in the "Initial Process". I received my NOA1 on May 7, 2012 and it was processed at the Vermont Service Center.

Is this going to affect my petition? the USCIS representative told me that once the petition was approved it was send to the NVC and they could not provide any further information, since
the NVC was now in charge of forwading the petition to the US Consulate in Ciudad Juarez, Mexico. My fiancee hasn't received anything yet.

Any advice? :thumbs:


Welcome to the forum, and congratulations!!

Does your letter come from the Department of State (DoS) Bureau of Consular Affairs? Does it list your fiancé(e)s name, the INS (USCIS) receipt number, the DoS Case Number, and the interviewing embassy/consulate? If so, that is an informational letter from the DoS acknowledging receipt of your approved petition from USCIS. It is NOT your NOA2. The Form I-797, Notice of Action, visa petition approval (NOA2) will come from USCIS.

The DoS letter contains some useful information. You will need your Case file number when contacting the DoS Hotline (see K-1 Flowchart in the Guides at the top of the forum page for details) to find out the activity of your visa petition while it is at the DoS.

Since there was a holiday last week, I would give it another week or so, but be sure to follow-up with USCIS Customer Service if you do not receive your official NOA2 notice. You will need it later on in your immigration journey. The USCIS may charge you over $400 to generate a duplicate.

Be sure to update your timeline, it helps everyone that uses this forum.

The time-proven successful method is to carefully follow the printed instructions for Form I-129F, General Instructions, Step 1, #3:


Answer all questions fully and accurately. State that an item that is not applicable with "(N/A)." If the answer is none, write "(none)."

Send it priority mail in the USPS provided envelope. Costs less than $5 and gets there in 2 days. You can send it to the PO Box as long as you do not get signature required.


You CAN send it to the PO Box and get signature acknowledgement of receipt. I have done it for all of USCIS petition/application mailings to USCIS lockbox locations.

In Oct. 2011 when I sent in my initial I-129F petition, I sent it regular mail with return receipt, with no problems. I do not feel that the loss of a day or two in delivery vs. express mail was worth the cost. Kinda like: "hurry up and wait." :clock: Once they send you your I-797c (NOA1) receipt of petition, that is when the long wait of 5-8 months begins… :clock:

Hi,

In from Canada and my boyfriend lives in Kentucky. We are in the process of starting the K1. We just found out about my sponsor needing to make 125% of the poverty guidelines. My boyfriend does not make enough as he is on disability and only makes 14K. Even with adding his assets i dont think he will make poverty level. I make good money here in Canada, would i be able to prove that i can support myself or if i have money in my bank can that be included?
