Hello All,

I am a US citizen living in the USA and my financee is a UK citizen living in the UK. We have not filed a K1 visa yet, we are exploring our options and are looking for calcification on the limitations of both her and myself traveling to visit one another while a K1 Visa is filed and in the process of being reviewed.

Questions:
Can the petitioner travel out side the USA while a K1 is being processed? Yes
- if yes, are there any stipulations and/or pre-authorization clearances needed? No, do you have any currently?

Can the beneficiary living outside the USA, come to visit me in the USA for less than 3 months, on a Visa Waiver? See below
- Are there any restrictions?
- What should my financee declare at immigration?

I would prefer to have responses from couples who have had personal experience with this process or those who know the law.

I did my taxes 2 weeks ago. I tried ordering the tax return transcript at the on-line website for IRS, but it says that my 2012 is unavailable. I have read that some people can order. Maybe they didn't do their taxes as late as I did? Any suggestions? Thanks



Suggest that you wait a bit. We filed our 2012 Fed taxes in mid-February, ordered the tax transcript about third week of March. It arrived in the mail about 10 days later.

1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted. 2. Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet. 3. Form I-129F: Petition for Alien Fiance(e) (see example) 4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it. 5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example) 6. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a. 11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship. 12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact. 13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order. 14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

 


Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case. 




1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file. 2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back. 3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Can the person sponsoring his/her fiancé to the US get or use an affidavit from someone else? Does it have to be an affidavit of the sponsor only?

Can someone give a guesstimate of how long on average it takes for K-1 applications to be processed completely (more specifically Afghanistan)?

Will the Sequester cause significant (>3 months) delays with the process times?

Hard to determine if there is a significant effect of the Sequester on processing times at USCIS, since most of it's budget is fee-generated. It is my contention that the tsunami of DACA applications has inundated USCIS and brought about the virtual standstill of adjudication of all manner and types of visas.The number of applications tendered to USCIS during this "DACA-tsunami" numbered over 469,000 applications in the period between Aug 15, 2012 through March 15, 2013! There has been a recent uptick in approvals, hopefully it will continue.

Specifically I am hoping to expedite any response my fiancee might have to make to her embassy. This may include preparing forms in advance, if those forms are requested by her embassy to be mailed to them prior to setting an interview date.

Based on my research, many forms are to be brought along for the interview, to be handed in the day before, during "document intake". So whatever might need to be mailed, must be different from those. It's unclear to me, even after reading the guides and many forum messages, what might need to be mailed. My fiancee and I would like to prepare those things even before she receives her first mailing from the consulate, so that she can mail them in immediately after she receives it.

I think you guys missed the point-what stood out for me is that they updated their script!  They are saying they are working on Oct 1!  Pria, you probably only have another month to go but fill in your timeline.

As you are aware, if you fill out your timeline, the VJ site will generate an estimated NOA2 date. The OP has yet to fill out their timeline, hence there is no VJ site-generated NOA2 estimate. It can be a useful guide as to processing times and can assist in generating a response.

I am a brand new member here and I am ready to file my I-129 petition but before i do i want to be absolutely sure of a few things:

 

i have two related questions.

 

1.  I notice on the example letter of intent to marry includes the address of filing location. Is this address the USCIS Dallas lockbox or is it the address of the USCIS center that has jurisdiction over your state? The address is of little actual consequence, what is is important is that each of you provide an original, signed letter with your original petition. (We addressed ours to the Dallas lockbox location.)

 

2. I am in Washington State and i believe the Nebraska Service center has jurisdiction over my state. Can someone confirm this for me? All of the I-129F petitions are sent to the Dallas Lockbox, and then sorted out to either the California Service Center (WAC) or Vermont Service Center (EAC) for adjudication. They are the only two centers that adjudicate I-129F K-1 petitions.

After the petition is accepted by USCIS, you  will receive your Form I-797c (NOA1) receipt. The receipt number will have a three letter prefix (likely WAC), followed by a group of numbers. Set up an online account with USCIS to check on the status of your petition,?.. and then the patience-building sessions begin?.. ClockWatch2.gif

I received my NOA1 September 14th 2012 and received my NOA2 (I-797) April 19th 2013.  It says "Notice Type: Approval Notice Valid from 04/19/2013 to 08/18/2013." Does this mean that my fiance has to come to the USA to live with me before 08/18/2013? No, those are the valid dates of your approved K-1 petition.

 

Below on the form that it will take a few weeks for the NVC to process the approved fiance petition and send it to the US Embassy in Brazil where my fiance is from.  I am currently in school and will graduate around December 15th 2013 which is when we originally planned for my fiance Fernanda to come and live with me and then we would get married. 

 

Does anyone know what the exact final date my fiance would have to come to the USA to live with me? Does it go from the date of her interview in Brazil or is it the date on this I-797?  Also, is there ANY way to extend the 6 month time frame because I don't want my fiance to come to the USA to live me with while I am still in school and because she teaching and would like to finish out the year in December.  Once I graduate we will be much more stable financially as well as it will be a perfect time for her to come live with me.  

 

What are your thoughts? Have anybody had any similar experiences or know of any stories about this type of situation?

Boarding passes In both directions, matching pages of passports with stamps (plus the bio page) and photos of us together. Suitable photos of us together with date and locations written on back.

 

These guys must see lots of pictures of couples standing in front of very identifiable monuments. From memory we included the Golden Gate Bridge, Eiffel Tower, Washington Monument and probably Big Ben :-)

Hard to say, it all depends on the determination of the IO at the consulate/embassy. It certainly would be a tough break to get an RFE, with the resultant delay, at this phase of your immigration journey simply due to a perceived "stale" document.

I went to Guangzhou for the interview, to provide moral support for my then-fiancee. It was July and the weather was typical Guangzhou, hot, humid and unpleasant. I was aware that GUZ consulate policy was to exclude the USC. I recalled that the GUZ consulate is a tough one, necessitating front-loading of the initial petition, due to a high-fraud scrutiny. We stayed in the hotel around the corner from the consulate entrance, in the same building as the consulate. I prepared an Evolution of Relationship (EOR) letter, folded it lengthwise and placed it into my passport. My wife then put it on top of her pile of evidence, when the IO asked for her supplemental information, the IO noticed my passport. glanced at the letter, and acknowledged my presence in the area. good.gif

 

I don't know if it made any difference in the outcome of the interview. However, I was able to try to calm my nervous then-finance, and enjoy an expensive cup of coffee in Guangzhou. But I can't help but think that it helped demonstrate to the IO that we had a genuine and ongoing relationship. My wife and stepson had to travel ~ 2,000 km from their home in northern China for the interview and physical. I figured that the least I could do was  to travel the ~12,000 km to be with them in Guangzhou at this momentous event. innocent.gif

 

BTW, I could have sworn that I saw Darnell early one morning in the nice park across the street from the consulate. doing his exercises.laughing.gif

 

The whole visit is now but another memory woven into the fabric of our visa journey and our relationship. Go if you can.yes.gif
