Heya Good day from New Zealand . I would like to ask some questions pertaining to issuance of K2 visa. Hopefully , there are members here who have children and were issued K2s.

1. As soon as K1 visa is issued. Do you get the same date of issuance for K2 visa ? Refer to the DoS FAQs link below.
2. Do your children get interviewed as well. My sons are 17 years and 13 years old. My stepson did at the US consulate in Guangzhou. Check DoS FAQs link below.
3. When you enter the U.S. and I eventually marry within the few weeks, what happens to the status of my children who have K2 visas. I heard about conditional residency ? What does this exactly mean to them ? Check links below.
4. Related to 3) . Does conditional residency mean that they can enter school as a local student or do they still need to establish physical residency for at least a year or so . We are looking to migrate to California. Check links and info below.
5. Is there anything that you want to add that I need to be mindful with regards to issuance of K2 visa for my children ? See below.

State College residency requirements vary from state-to-state, Google "California State colleges" for specific information. In the last mentioned thread, I posted a comment about our experience with Washington State college residency requirements. YMMV. Those links should give you a lot of information about the K-2 process, and should answer many of your questions. The important initial step is to be sure to list them, where indicated, on the I-129F petition. Then there will be attention to the K-2s at the consulate interview phase.

Hello,

My Canadian Passport expires December 18th 2013. I filled on Jan 10th 2013 and are awaiting initial approval. My question is this; Should I renew my passport before I get my K1 VISA? Or will I not need the VISA in my passport once I'm married? Otherwise I would need the new passport to be available to me for put the K1 in and will be in the passport for five years.

p.s. Can Canadians have interviews in Toronto? Interviews are held at the US consulates in Montreal or Vancouver.

Like all who have seemed to fall into the abyss from July through October, I am wondering what is the correct time that a service request is accepted and what type of action does that trigger? Also, is this the same thing my Congress person's office would do? It may be a good idea for everyone who is out of the range of when they should have been processed to put in a request. Maybe the squeaky wheel gets the grease.

Dunno, the new system was started less than a month ago at the Guangzhou consulate. Follow this link to the Guangzhou consulate:

As with most activities associated with USCIS recently, this hand-off from USCIS to NVC may take longer than usual. At this point, your approved petition is being transferred between two huge bureaucratic Federal executive departments (and their respective agencies) from Department of Homeland Security (DHS-USCIS) to the Department of State (DoS-NVC). Contact the NVC (check flowchart for phone number) in a couple of weeks after receipt of your NOA2 notice to make sure that they received it; and to find out your case file number. The DoS will assign a case file number to your file, they do not use the receipt number from USCIS. Traditionally, things should go quicker at the Department of State. When the NVC has completed their processing you may, or may not, get a letter from them telling you that your case file is being sent on to the interviewing consulate/embassy for further processing. (Some people get a letter, some report that they don't.) Keep calling the NVC a couple of times each week, until they tell you that your case file has been sent on for further processing. After it has left the NVC you should contact a visa specialist at the DoS (202-663-1225, press 1, then 0, for a live operator.) for information about for your case file status.

Somewhere alone the line, the Guangzhou US consulate has recently instituted a new procedure for handling and processing of visa petitions:

Review the consulate's website for further information. I have no knowledge of this new process, or the new company (CGI Stanley) that the consulate is using to process visa applications. Our visas were processed under the old system.

For K-1 visa application, I printed our eight digital photos on plain copy paper using a color laser printer. Dated, identified as per the GUIDES on the back of the photos. Placed each page in an Avery® Presentation Sheet Protector.

The same process was followed for the K-1/K-2 AOS phase of our immigration journey. Since there have been no issues thus far, will likely use the same process for ROC.

Hello.

My NOA2 was given on April 11th. I have the hard copy, which I received on Monday. For whatever reason, the website says that it is still in Initial Review. I'm wondering how I can figure out the status of the petition.

If I'm not mistaken, it goes to NVC next. Would it be at NVC already? I sent them an email to ask, but I feel a bit lost with the out-of-date website information, so I'd love to know what everyone else did to figure out what was going on with their application.

If you have a hardcopy NOA2, you are good to go. Give it at least two weeks before contacting NVC about the status of your approved petition.

BTW: Do NOT loose your hardcopy NOA2, it is over $400 for a replacement, and you will need to provide it later on in your immigration journey.

Like the title asks, Should I send my chat history with my i-129F Petition package? I have at least over 800+ Pages of chat history and that makes for an awful heavy package to send and a lot of ink I have to use to print along with a lot of paper.

I have enough supporting documents about my relationship, Phone history, flight tickets, hotel reservations, photos_

So I'm thinking maybe I don't need the chat history to be printed and sent with my petition if I really don't need it, what do you guys think? Should I just go ahead and print all 800 or so pages and send it in with the package? or should I be comfortable with all the proof I currently have?

China is a country where "front-loading" of the I-129F petition is suggested. When I filed my front-loaded I-129F petition, I inserted about 1 or 2 days per week of Skype logs and Yahoo email messages, and redacted quite a few sensitive portions, along with a good and equal mix of photos, boarding passes, hotel bills, passport stamps. Remember that you want to convince the USCIS adjudicator that you and your fiancé(e) have a bonafide and ongoing relationship, they do not need, nor want to know all of the minutiae.

Your relationship claim that you present to USCIS will best be presented if you have a reasonable representation of ALL of the types of evidence mentioned in the VJ K-1 Visa Guides:

"Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items as possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)"

I am not sure how true this holds for the Irish embassy, but the German consulate sent me a letter by mail which contained

- the passport,
- the sealed envelope (it said in big letters "DO NOT OPEN")
- and (also sealed and having a "DO NOT OPEN" sign) a smaller envelope containing the medical for my AOS.

Btw, at the interview they also showed me the envelopes and what exactly they contain, and also explained which ones I am not allowed to open.

I suggest you ask someone from your regional Irish forum, or e-mail the embassy and inquire.

Within a month of arrival, my stepson enrolled at the local state-sponsored community college. For residency, they wanted my proof of residency in the state and proof of him being my dependent. Surprisingly, many of the documents they requested were identical to many I had to provide for these immigration purposes. However, we did have to pay out-of-state non-resident tuition, which was roughly double the resident amount. Last month, after filing my 2012 Fed income tax return and providing that information (claiming him as a dependent) to the college's residency office and a copy of his 2-hr GC, we received an update and it was amended to resident status. That really helps the budget. :yes: For admission, we had to provide the college admissions office with certified and notarized high school transcripts, TOEFL test scores, birth certificate, and a copy of his valid passport with unexpired I-94.

Our plan is to have him attend the local community college for a couple of years, complete his basic studies, and then apply for transfer to a much larger state university. It has been good for him to be able to become acquainted with college culture, life in America, socialization, etc.

Check our timeline, my family received their GCs in November 2012, he started college this past fall quarter (September 2012).

I would suggest that you check the laws/regulations/requirements of your state's colleges for specific information.

It is my contention that the tsunami of DACA applications has inundated USCIS and brought about the virtual standstill of adjudication of all manner and types of visas. The number of applications tendered to USCIS during this "DACA-tsunami" numbered over 469,000 applications in the period between Aug 15, 2012 through March 15, 2013! :wow:

I would be pleasantly amazed if the service centers were not awash (or buried) in paper, and that is not even considering the reported plumbing issues at the CSC.

It is little wonder that folks all over the forum are experiencing delays in the processing of their respective visas.

engagement party photographs in India, is it ok to tell them, sometimes they doubt Indian engagement as marriage and then ask for too many things like guest list and all that. so better to not include engagement pictures or what should be mentioned about engagement.

It is a rather slippery slope. If the IO determines that you are already married, based upon your presentation of the "engagement party" photos, your K-1 fiancée visa may be denied.

I am filling out the form for K1 - visa. On DS 156 form I am confused about the following question:

Has your US visa ever been cancelled or revoked?

When I got my B1/B2 visa renewed, my old one had not expired as yet - so the embassy cancelled the old by stamping " cancelled without prejudice". And gave me a new one.

Should I answer the above question with a yes? the only problem is that there is no space explain that it was not because of some violation etc... but it was "cancelled without prejudice". So I would prefer to write no... would that cause any problems?
