My representative's immigration specialist told me that US CIS has wide liberty in requiring things and denying things. I was worried about cancelling our K-1 and then restarting after reconciling.

You are within the stated limits but you may need to just comply. On your waiver, maybe state up front that you applied for ONLY ONE K-1 and state the date of that K-1.

Seems like I've read this before. The replies all said that the law was trying to inform the fiance and prevent a serial abuser from running through several unsuspecting women. Every reply here says to be upfront and don't lie.

Multiple K petitions


IMBRA states that 2 or MORE (not 1 in the same) petitions need a waiver in subsequent petitions.
A July 21st, 2006 memorandum by Michael Aytes(emphasis added), states:
"B. Filing Limitations
IMBRA imposes limitations on the number of petitions a petitioner for a K nonimmigrant visa for an alien fiancé(e) (K-1) may file or have approved without seeking a waiver of the application of those limitations. If the petitioner has filed two or more K-1 visa petitions at any time in the past, or previously had a K-1 visa petition approved within two years prior to the filing of the current petition, the petitioner must request a waiver. These limitations do not apply to petitioners for a K nonimmigrant visa for an alien spouse (K-3)."


But the database starts at the second petition even if it's for the same beneficiary.
"…Upon approval of a second visa petition under section 101(a)(15)(K) for a fiance´(e) or spouse filed by the same United States citizen petitioner, the petitioner shall be notified by the Secretary that information concerning the petitioner has been entered into the multiple visa petition tracking database. All subsequent fiance´(e) or spouse nonimmigrant visa petitions filed by that petitioner under such section shall be entered in the database. ''(cool.gif(i) Once a petitioner has had two fiance´(e) or spousal petitions approved under clause (i) or (ii) of section 101(a)(15)(K), if a subsequent petition is filed under such section less than 10 years after the date the first visa petition was filed under such section, the Secretary of Homeland Security shall notify both the petitioner and beneficiary of any such subsequent petition about the number of previously approved fiance´(e) or spousal petitions listed in the database."
Yet, a US Citizen re-sponsoring the same beneficiary after a consulate returns the petition is now subject to the multiple petition waiver requirement- even though there is only one applying alien! California Service Center correspondence I have seen recently, informs petitioners that:
"The new IMBRA law requires that a second I-129F filed within two years of the first filing contain a waiver…". Such correspondence refers the petitioner to the Michael Aytes Memorandum of July, 2006. Again, note the absence of the words, "…with respect to two or more applying aliens…".

If 2 years between aproved petitions, no waiver needed.
I went with a K3 because we go through the CSC. They have sat on our I-129F and not given an NOA1 yet. See my timeline. It looks like I-130 is our route by negation of the I-129F.

Why can't some personnell be redistributed to CSC from VSC?
Is there a jinx on us westcoast applicants? What's the deal?
From Washington State we are supposed to go through Nebraska, but they send I-129F's to overloaded Cali now! Argh! Why?

This is how I understand what they are reporting in their processing updates.

USCIS has a processing commitment timeframe for the K visas of 6 months. If they are processing applications within that timeframe, they report a processing date 6 months back from the date of the most recent update (currently June).

Dec-Jan = 1 month
-Feb = 2
-March = 3
-April = 4
-May = 5
-June = 6

So they could be processing applications from May and would still list Dec on the June update. Next month in July they will report they are processing January applications.

CONCLUSION -- You cannot use their processing dates/updates for anything except if they are taking *longer* than their commitment of 6 months. For accuracy of any amount, the updates are absolutely useless! Stick with the Timelines on VisaJourney and keep your records up to date is my suggestion.

It may be Summer vacation time. I have read that Christmas holidays delay things, so maybe Summer too.
As for CSC time, I had mine extend and contract a few times. Then it was approved earlier than projected.

Thanks for clearing that up. I just want to be prepared just incase they do need some kind of evidence, guess its just best to just ask my GP next week when I see him. Im sure the weight thing was just idle chatter.. I mean can they really deny someone with a weight issue.. surely thats discrimination? Hell.. I don't smoke, don't drink, don't do drugs.. its my only vice! lol

Yes, I just said I think I did.. but wasn't sure. I asked my mother when I got back home and she said that ive had chicken pox, mumps and measles when I was little. Im not sure whether or not the doctor put down that I need it or not, just to ask my GP when I see him about the other two shots I need. Do I need to obtain another vaccination record and or some kind of evidence to say ive already had the pox from my GP when I see him?

The weight thing did seem a bit odd to me, just the fact that she was going on about it pretty much all throughout the examination and how she does yoga and all this kinda stuff she was recommending. Could of been just to make conversation while she was taking my blood. Ive never had any medical problems, never been to the hospital once!

Just looking at this from a different angle, you may be aware that the US is going under major health care reform right now (or trying to). Companies are having to pass down expenses to employees and have them pay more out of their paychecks to afford quality healthcare. Therefore many are offering programs to their employees to lose weight or quit smoking to reduce future expense. Even though you may be healthy, it is suggested that there may be longer term problems with high blood pressure, heart attack, etc that could take place. This may go back to the whole managing the expense burden that the USC shows on the I-134 form (whatever it is?). There are many people here without insurance and if anything did happen, taxpayers/hospitals/etc have to eat the cost. Or, she could just be making conversation. smile.gif


Sure, I don't see how that would be a problem in our case though as she more than meets the requirements of the poverty line and intend to have her put me on her health insurance once im there.

Excellent news, well done!

Ive just arrived back from my medical. I went to the ''Bentick mansions'' one. I must say I was a little nervous before going in.

After being buzzed in at the door I went to the counter and was asked to hand over my passport, passport pic and the medical questionare, She then handed me another questionare to fill out whilst I waited in the other room. About 5 mins later another person ushered me into another room and said that I required two shots (mmr + tetnus booster) but that I didn't have to have them now, just as long as I took them before the AOS - which was fine as she told me it would of been £60, whereas im sure my GP will do em for free.

Anyways, next off to see a guy who got me to remove my top and took my chest x-ray, all very easy to do. Once that was done it was off to see another doctor, this time female. She asked if I had chicken pox when I was younger which I said I wasn't sure.. so she told me to check with my GP to find that out, Said that I was overweight (well dur! tongue.gif) and if I had tried diets etc. I asked her with my ''BMI'' being classed as obese would this be a problem in obtaining the K1, she said no but it'll obviously put the cost of insurance and the like up. After asking a few more routine questions I took the old eye test, then was told to take off my top. After examining me it was down with the old trousers... yep two legs.. then underwear down... yep hot dog... then it was back on the table to take my blood pressure - yep all good. Then was the blood part, had a problem finding a vein but after a few minutes got one and bled me dry tongue.gif , that was the end, yippie!

The stuff all gets sent to the embassy within 4 days, and if theres anything wrong they'll let me know... so 4 days and counting!

Overall it was a very painless, and something I wish I hadn't of been so nervous about before hand. It raised a few questions for me so if anyone could answer them i'd appreciate it! Ive made a appointment with my GP for next wednesday to get my shots done, and get him to endorse my passport pic + forms for the police certificate biggrin.gif

If its any help the time between NOA2 and receiving the ''packet'' 3 letter was around 2 weeks for us.

Also As long as they actually have you in their system you can go ahead and download the forms and book a medical for packet 3. Best thing to do is to ring the Embassy to ask if they have assigned you a case number (usually starts with LND, depends where you live) and if you are indeed in the system and they have received your package from the NVC.

As for the NOA2 expiring, I believe thats what the second letter of intent is for, but im sure someone else can give better advice on that.

Do NOT send in the photos, birth certificate, or police record.

The birth certificate is supposedly the long, official type one and I think there's a link on how to get one on the London embassy website.

On one of the forms though it says about attaching the police and birth certificate with the passport photo's... so I don't send anything in at all with these ds forms and checklist - I just take all that stuff with the evidence to the interview? What about the affidavit of support?

Sundrop - Yep I managed to order 2 copys from the GRO website, they only do the long versions on there. I just entered in my details and that was it. Ive no idea what district I was born in, just the county.. im sure that will be ok?

Hey guys and girls,

In reading the IV-15 checklist it says that "Please do not mail any documents to the Embassy. You will be required to furnish all documents on the day of your visa interview." However, on DS-156K it's asking me to attach my police and birth certificate... so which do I do?

Is this IV-15 checklist nothing to do with the DS forms.. as in its not a checklist for that? I send that in seperate?

Also its asking for certified copys of my birth certificate.. im assuming they mean original or? Not sure how you would get a birth certificate certified? Do they mean one ordered from the goverment website online?

Spoke to DOS this morning and they said Packet 3 has been received (so it's finally been logged) and they will be assigning an interview date soon!

when you called did they say "its been logged" or are you just guessing that since they have it ..thats its logged? cause according to everyone i have talked to at dos.. they say they have it but its not been processed yet.. which means we arent qualified for an interview.. when i asked the person abut "logged" she acted like she had never heard that term..

At a guess, and it is just that, but someone with a July/ August wedding date wouldn't be offered the next available interview because there's 5 months til then. Yup, you get 6 months to use the visa and another 90 days to actually get married but if you were interviewed in April/May and received your visa in good time following interview, you would meet your July/ August date assuming you entered as soon as you got your visa and waited til close to the 90 days.

What did you put down as a travel date?

What I want to know is why they're not sticking to the 4-6 weeks quoted time to process your packet from receipt. Even if they gave you an interview in April/ May, at least you wouldn't be sitting in limboland :(


I really hope that isn't the case, we only put that date down as a estimate depending on how long the visa/interview took to get. This is so frustrating!

Yep, but who knows. I kind of got the feeling the guy had pretty much diddly squat on the status of our case even with our case number, makes you wonder if you can even talk to someone who has your case in their hand.. seems not!

Also as you said, im not sure why we're not eligible considering we've sent in all the stuff needed and they've obviously looked at it at some point for them to write the note about our hopefull wedding date. Said they would contact us though if they're missing anything, which is some comfort I suppose.. no news is good news? ... gah I hate this waiting!!! :crying:

Just got off the phone with DOS, who pretty much made us both panic because the lady said that im still not eligible for the interview - which could be because not all the forms have been sent in!? Ive sent both the packet 3 and had the medical in december.
Anyway phoned the embassy and he told me that both the medical and packet 3 has been received (even told us that its noted on the system for a july/august wedding) but that their system is limited and not to panic as they're only just processing it now, and that an appointment letter will probably be sent between middle/end of march. Longer than I thought, oh well :(

The problem is that her tickets to come here are right near that 3 week window, so I don't know if it's possible it could take a shorter period of time, or if we should consider changing her tickets to a later date now. Any advice?


Thanks for the reply, Haole. I'm not too worried about the tickets, they are easily changed without penalty. But just knowing whether to go through the hassle of making the change or not is what has me frustrated.
