I just joined this lovely community and thought I might get some answers here.

My 2yr CR is up for renewal in a few months and I have enough time to file this form in a timely manner but I am planning on starting college back in Germany just for the fact that it's more affordable for me. The time of filing I-751 falls directly into my admissions test in Germany and then later in October starting College. My husband will attend college here in the States since he will receive his financial support from the military for being a veteran.
I am trying to find out if I have to be residing in the USA while my renewal is being processed and if I could provide my biometrics in Germany at the Consulate General. And how long can I actually leave the States for vacational reasons without losing my status.
Is there any regulation allowing me to study overseas, keeping my residency and not being in the military or for "governmental" reasons?

I would truly appreciate your help.

I am not sure how you would file the I-751 from abroad unless you are in Germany because you husband is still in the military and by order supposed to be there.

I believe USCIS/Homeland Security considers applicant/immigrant address to be their residence, thus far more important than simply "tell us where to send your critical immigration documents" type of a thing. They want to know where you live. They need to know where you live, and they also do not send mail to PO Box's for that exact reason.

If you live at the address you wish to change back to, that would be likely a good thing to do.

We are lucky, no address changes the entire process, although they did goof up this address slightly, and my correction attempt, though extended was handled eventually and correctly by USCIS.

Hopefully taking you both separately to discuss the incident which seemed so critical to your interviewer will satisfy her nothing sinister was meant by your answers. Again, good luck!

Really sorry to hear about your rough interview. Not sure in retrospect if changing your address was such a great idea just for going on a vacation. Having your friend pick up your mail while you were gone would have been a better option. Not simply because of the questions you were asked about it, but because changing addresses is such a sketchy thing for USCIS. More often than not they get it wrong!

Anyway, I imagine that when they decide to look deeply at a particular case they run police records, thus the incident you were asked about showed up, but you probably did not say anything about it on the I-751 in regards to question 7 on the form. It was water under the bridge to you at that point, but apparently not to the lady interviewing you.

Hopefully after talking to you and your husband separately things will work out and you will be approved, but I believe if not you will get another shot in front of a judge. Not an option any of us hope for though. Good luck! good.gif

Are there any other field offices besides that one in Atlanta you could get to? I have heard others say they were able to get service by choosing slightly farther afield offices when theirs were not getting the job done. You NEED the stamp! You can save the form right from USCIS' website, and pre-fill it. I would not recommend putting a date on anything until the first day you are eligible to submit. Until then, which sounds like July, you can start the process of gathering your additional evidence.

Even if your process takes longer than a year, you can make an infopass and request an I-551 stamp in your passport. Sucks to wait so long, but that little piece of paper extending your green card is good enough while you are waiting. Hopefully the wait is going to end shortly! good.gif

I listed my US citizen adopted daughter and things got all messed up. USCIS sent a letter wanting $80 for her to do biometrics and put a hold on my wifes I-751.
After many calls and letters they still had the I-751 on hold. I finally called my senator who got things moving again.
I'd also included daughters US Passport and adoption decree and explained she was a USC in the cover letter to no avail.
I think the reason they got things Fooked up was I did put her old A#. Also put USC under immigration status tho.
Bottomline is "It looks like they are ONLY looking for children that have to adjust status.
Difficult not to "List ALL children tho".
I also can't see listing kids from previous marriage.
LOTS of peeps get by listing all. WE sure didn't and it cost us about 3 extra months to fix it.

OH no am now more confused? SO should i Put all children ?( my hubby's kids, my 2 kids and our 10 months old son born to our marriage?

Hubby got 23 and 14 yr.s old daughters who do not live with us.. and i have 2 minor kids who is under the I-130 petition of my husband and our son born to our marriage.

I was worried you had a complicated situation, and of course you do.

Your two minor kids, under the I-130 are in the USA?

If so, and their set to have conditional green cards expire within 90 days of your expiration, then they can be listed and lift conditions under your I-751. If they not, then they will need to file their own I-751 when they reach the 90 days before expiration mark.

As to his two children who do not live with you, in a simpler filing I would say add them, I have read many who listed adult children and had no problems, but for your situation, perhaps not. If you choose to list the two girls from your husbands previous marriage, document that they are US Citizens and do not live you the two of you.

So the big question is are your two children from your previous relationship in the US, and what is the status on their conditional green cards?

This is a topic which has caused much debate on this forum recently. Since experiences and opinions vary so much, you can only listen to the stories presented and then make your own decision. Think of it like a test though --- usually your first answer is the right one.

I would further provide birth certificates of all the children. This is what I would do, I hope it helps. But remember, you need to follow your gut, your heart and your head. And yours alone.

I believe mozplay gives you a great suggestion! Making a list of the kids in that way, as an attachment to the I-751 is much better than just talking about them in your cover letter since the attachment becomes part of the I-751. And there could be confusion along the lines the Haole experienced since your child together was born in PI but is a US Citizen.

Technically, I believe the form is only asking for none of the children you have. It is meant for children adjusting status along with your petition. Myself I would say mozplay has the best suggestion yet on how to deal with question 5. Good luck!

Next you will either get an approval notice and 10 year green card, or perhaps notice of interview. Other than an RFE, which I would suspect you would have gotten prior to the biometrics, but who knows, those are the two logical next steps in the Removing Conditions waiting game. The best thing to do, the only thing to do, is get the divorce settled and final before filing as Kathryn41 suggested, and please remember it is always best to be honest. And do gather all the evidence you can about when the marriage was actually a happy one.

I have some concerns for you, since it sounds like you and he went to the interview but that was after he moved out with someone else? Not sure, but it seems odd they only asked one question at the interview, and I would recommend thinking back long and hard. You could have a problem with the date of separation and your AOS interview.

It is not clear if he left before you applied for AOS? If so you were at the time swearing you were still together etc. etc. Removing Conditions does not depend on the two of you still being a couple though.

The guides here have helpful instructions for filing Removal of Conditions after divorce. Good luck!

Also remember the filing deadline is 90 days prior to the expiration of your 2 year green card, so best to get things moving in preparation for that. You should not need an attorney, but given what may have been a bit of a dodgy AOS Interview it may boil down to that being your best option.

You don't have a timeline timeline.gif so it is difficult to say how much time you have to delay filing for Removal of Conditions.

It needs to be done during the 90 day period before the expiration date of your two year green card. Not a day before, and you would need to find out via the guides how to deal with filing after that point because USCIS considers you to have abandoned the process and begins immediate proceedings asking you to leave the country. I would avoid that like the plague.

If your deadline is approaching too fast I believe you could simply file the I-751 with the new address listed, I personally can't say if that will cause you a problem or not.

I know I was surprised when I added our PO Box on my wife's form in the mailing address portion, and USCIS actually used it to deliver our NOA1. I had the PO Box prior to filing the K-1 but didn't use it for USCIS since they refused to use them throughout the earlier stages in the process. But I think it indicates the ability of USCIS to use the I-751 as a change of address, since in effect that is what they did.

Others may be able to tell you if you don't need to file the change of address prior to sending, or they will change your address with the acceptance of the I-751 and gloss over your earlier neglect to inform them of your physical address change. We never moved, but all prior mailings were sent to this same physical address since I first filed the K-1.

All of the rights to work, live and travel via the 2 year green card are extended for a year from the date of the cards expiration. Essentially, the NOA1 for Removal of Conditions has modified the 2 year green card in to a 3 year green card.

Your wife would be fine for travel outside of the USA.

We deliberately did NOT include affidavits from family and friends in our packet. My research indicated they are not absolutely necessary, and they do subject the signers to a visit or getting called in for an interview. If we get an RFE we have some folks set up to give us them, but again, I don't think that will occur if your evidence is strong enough on its own.

We sent ours the cheapest way via USPS, certified mail, return receipt, and ours got there on Monday having been mailed on Saturday. No need to pay double, the USPS is an efficient machine!

We payed by check, and our NOA1 was dated 5/11, which was prior to the check being cashed. No worries as long as your check isn't made of rubber! Good luck!

I hope it's enough...

I also have a lot of evidence (photos, response cards, receipts) from our spiritual/religious wedding held in Mexico in 2008 where 50 people attended from the US. This is separate of course from our civil wedding we had here in the US satisfying K-1 requirements. I know there is a lot of debate about whether non legal/financial evidence such as this is even effective at all. My questions is if people think it would HURT in any way to introduce evidence of another wedding (would USCIS be confused by this...since they get confused easily)???


Make sure you have a copy of your marriage certificate from your first wedding, the one in the USA and inside the K-1 90 period to avoid confusion over the second ceremony. Clearly date and label evidence from the second ceremony as such. My thought is it is great evidence!

A few photo's going back to your marriage would be nice to add, not too many, but a few. Didn't see them on your list.

You don't need to send passport photo's with the I-751, that is why you are paying them the extra fee for biometrics.

If in doubt, check the expiration date on the I-751 form available online from USCIS, those are always the most up to date. The form is so short, if that expiration date differs from yours, use it instead.

I contacted my state representatives today. 

 

One of the congressman's liaisons replied to my expedite request.  She stated that she contacted USCIS and, unfortunately, my request does not meet any of the expedite criteria.

My family and I are planning to visit the Philippines this summer (end of June).  Since my stepdaughter is now a U.S. citizen (from what I understand), she must use a U.S. passport to exit and enter the United States.

 

Our local USCIS office is currently processing N-600 in August 2012.  If we are using their timeline, it would take months for our N-600 to be approved!  We are still hoping our other state reps will work something out.  I cannot imagine our situation being that difficult to resolve.  unsure.png

Hi, I  became a USC on 12/12/12. I filed for my US Passport begining of February 2013 along with my minor daughter of 17 years old (she would turn 18 on May 2013) and she holds a Green Card. I received my US Passport end of February and received a letter requesting I provide my divorce decree and proof of custody. I sent the decree and the sent the affidavit which showed that I had legal custody of my daughter. Passport Information Center received these on March 6. I have been calling the passport office every other weeks for updates but till now they keep saying it is being processed and a note was added since it is past processing time. I also sent out a letter to New Hampshire Passport Office and still nothing. My daughter turned 18 on May 29... and now I am not sure whether she is still elligible to obtain a US passport thru me the US Parent  since she is not a minor anymore and I should file for N-600?? I would think that since I applied when she was a minor shouldn't affect her obtaining a US Passport... not sure.

 

1. Has anyone been in a situation like with the Passport Office?

2. Do I have to file form N-600 for my daughter?

3. Is there a way to contact an officer from the Passport Office (not the agency/information center)

I recently went through a similar situation.

 

My wife had her naturalization on May 28th.  Her daughter (my stepdaughter) fulfilled all the requirements of Section 320 of the Child Citizenship Act of 2000.  Both of them applied for their passports at the Seattle Passport Agency.  My wife had no problems with her passport application.  She submitted her Certificate of Naturalization.  However, the agent denied her daughter a passport.  We submitted 1) her mother's Certificate of Naturalization, 2) her foreign birth certificate and 3) proof of permanent residence...her green card.  Still, the agent requested more evidence.  School records, baptismal certificate.  Of course, we didn't have those documents (as this was not specified in the DS-11 instructions).  He stated that if we couldn't furnish any of those documents, we would need to have her own Certificate of Citizenship or have a maternal dna test performed.

 

Of course, I know that the agent is misinformed.  I quoted Section 320 of the CCA of 2000.  He still insisted on providing additional evidence.  We did plan on have her own Certificate of Citizenship.  However, we'll get our state representatives involved in expediting her N-600 application.  Since there is no biometrics or civics exam (for minors), we hope to have her certificate issued ASAP.  It really irritates me that one person's ignorance of the law will cause so much inconvenience to others.

 

As long as she was under the age of 18, and in your legal and physical custody, and a permanent resident when you became a citizen, she became eligible to receive a US passport.  Therefore it doesn't matter if the passport was applied for before or after her 18th birthday.

 

If you want additional proof of her citizenship status, she may file the N-600 application - she is now over 18 so she should be the one to fill it out.  The date on the certificate should be the date when the parent became a citizen.

 

:thumbs:  Right!  The date on the Certificate of Citizenship should be the date the parent naturalized. 

 

The moment you completed the naturlization process (12/12/12/) is the moment you're daughter became a USC. Even if she doesn't have a US Passport, she still is a USC by law.

We almost went through the same thing, that's why we went to a passport agency instead of a post office. Main advantage is you could have picked up her passport within a day or two and they deal on a daily basis with the child citizenship act. You can read why here:

US Citizenship General DiscussionGetting US PASSport for Illigitimate Minors-ANyone?

Hello fellow Vj members,

I need help or any idea for those who experienced getting a US passport for minor kids here in the US?

Here is my situation. I got my US citizenship last year and is planning to get my 2 minor kids their US passports as well.

My 2 kids are considered illigitimate since i was not married to their biological father. My 2 kids came here thru IR2 being petitioned by my USC husband .

Anyway i called for an appointment to get my kids US passport but then the lady at the post office said i need to have an original copy of death Certificate of my x?

Do i really need to? My x was out of the pic when the kids are growing up . I was a single mom (with DSWD Single Parent ID). i did not have any contact with him and did not even know the real detail of where, how and when he died?

Anybody here had a success getting passport for illigitimate minors?

What documents they u submit for proof that u have sole custudy of ur kids?
Please i would appreciate any ideas.

I have no idea why the postal employee is asking a death certificate of your ex[boyfriend]...NOT ex[husband]. Illegitimate children are under the sole custody of the mother.
If your children were under 18 years of age when you naturalized, they are automatically U.S. citizens. Their citizenship is already established, whether or not you provide their biologic father's civil documents.

I'm sorry I cannot provide a definitive answer. I would definitely print something from USCIS and bring with you to post office. Many employees are out of the loop when it concerns these special circumstances.
