Removing Conditions on Residency General DiscussionTempary green card lost
QUOTE (xiuyin @ Jul 27 2009, 09:28 AM) <{POST_SNAPBACK}>
I visited China in May, and lost my card while i was in China. I had to postpone my flight and go to the US embassy in Beijing where I was given a return letter. I returned back to US with the letter safely and smoothly. However I didn't apply for a replacement of the card, thinking i would apply for removal of conditions.

I submitted petition to remove the conditions when i came back to US in June, and just received appointment for biometrics, in which I were asked to bring in green card among other things. I have a photo copy of the card. Now I'm concerned. Are the photo copy of the card along with the return letter from the US embassy good and sufficient? Are there anyone had similary problems like this? Can you share your experience?

Thanks a lot.

You will need to, as dumb and unfortunately expensive as it will be, get a new 2 year green card. It will be asked for at the biometric appointment if at no other time during Removal of Conditions.

Sorry guys no approval letter or online confirmation yet! I am happy for everyone else though. I guess I am not as anxious because I recently learned that my husband and I are expecting our second baby! So that's why I have my mind focused elsewhere. Guess what though, I will update you all as soon as I know.

Removing Conditions on Residency General DiscussionWIC or other State programs as evidence?
The doctor suggested it at the hospital [WIC] program, we just barely qualified, had to wait until wife's employment income stopped to get qualified. It is a neat program, very specific groceries, milk, eggs, cheese etc. But the really cool thing was having a nurse come to the house to help mom get started on caring for baby.

I think it is good evidence, since obviously the State program is closer, and deeply involved with us, so seems like great evidence. Not sure if others have used it or not though.

We have hospital billings too, of course! Insurance being the scam it is, covered about two thirds of the total hospital bill.

Removing Conditions on Residency General DiscussionWIC or other State programs as evidence?
Curious to get feedback from anyone who has used WIC {Women and Infant Children} or other State program documentation for Removing Conditions? WIC coupons for groceries etc including both our names, and the program also included home visits by a nurse specializing in breast feeding doing home visits.

Thinking this would make pretty good evidence, but not sure if others have had any experience or thoughts on the subject?

Waiting for my life insurance documentation to file our Removal of Conditions, and of course thinking over and over, what to include?

thanks

I wouldn't be too worried if just the cover letter wasn't signed, obviously would have been nice to remember that, but the biggest purpose is to organize your submission for the person looking at your I-751.

I would be much more worried about submitting an unsigned I-751 form for example, than unsigned cover letter. Good luck!

Removing Conditions on Residency General Discussionprint or type on form I-751
The I-751 form from USCIS is fillable, and should print much more legibly than any hand written version, but you could go that route. Make sure you get the most up to date form from USCIS! Good luck.

Removing Conditions on Residency General DiscussionPoverty Guidelines?
Other than showing co-mingling of assets, which often involves copies of things like bank records and tax returns, income level does not appear to be an issue for removing conditions as it was for the AOS.

Everything.

1. Birth Cert of child
2. Financial records
3. Residence
4. Witness Affidavits.

Now, I am wondering whether they lost my paper work...

Perhaps resend entire original package, but...

You don't have a child, thus can't produce a non-existent birth certificate.

Add more financial records, can you go online and get past monthly statements from the joint bank account?

For residence information, do you have any old mail, addressed to you, him, or both together going back the two years? Just the envelopes with mailed date stamps showing you lived in the same place, same time?

Find one or two more witnesses for affidavits while also resending the first two?

I don't know, but I would think it was anything but impossible for USCIS to lose your packet and then turn around and tell you they don't have what they need. Did you include a cover letter with your original submission?

Consider putting your A# on the back and/or front of everything you submit for the RFE. Just spit balling ideas here, we are preparing our packet now, waiting for insurance documents before sending. Good luck!

Removing Conditions on Residency General Discussionconfused on part 5 of i-751 for listing childern
QUOTE (* Bituin * @ May 3 2009, 11:02 PM) <{POST_SNAPBACK}>
A lot of people here got confused too in section 5 of the Form including me.In my case, I put my son's name on section 5 even though he was born here in the US coz the instruction doesn't say NOT to include US citizen children anyway.Still confusing me but so far I did not received any notice from USCIS regarding the issue.Just make sure to put US CITIZEN under 'Immigration status'and include a copy of his/her Birth Certificate as additional evidence.Good luck.

When did you submit your removal of conditions paperwork?

I think listing our child, born in to this marriage and thus a USC, as well as my two children who are also USC's is incorrect for section 5 of the I-751, but believe that is what most people do anyway without it being a problem... Grrr vague instructions!
ready4ONEMalePhilippines2009-05-04 01:19:00
Removing Conditions on Residency General Discussionconfused on part 5 of i-751 for listing childern
We are in the same boat. I believe that they mean Section 5 to pertain to listing of children intending to adjust status with the form, however, logically they are asking for a list of all children and many have done just that.

Wish we could get a definitive answer.

My best guess at this point, is listing US Citizen children in section 5 is not correct, but many if not most filing the I-751 do it anyway. And USCIS glosses over the inclusion of unnecessary information...

But the instruction sheet for the I-751 indicates that section 5 pertains to listing of children who are intending to remove conditions along with the petition.

Hoping for a good answer in the next couple of days ourselves on what to do with section 5!

That way we were able to track our package online and received a confirmation email when it was received by CSC. Good luck!

Removing Conditions on Residency General Discussionhi again..sending 2moro need some advice
Unless you have deep ties to the PI, such as house, business the chances of even getting a visit visa from PI are slim. The reason is exactly the scheme you propose, but hey, I thought of it once myself, found VJ, and now my wonderful wife is here, properly, legally, and to stay. :-)

i just want a real answer!
i have an American bf and he wants to get me a visit visa so that i could get there easily and it just takes a short time. i am a FILIPINA. HE planned that if i get there at KANSAS, we will get married and change my visa into spousal visa.
my question is, is it possible we could marry there even though i just have a visit visa? could he petition a spousal visa from a visit visa?

thanks in advance! "SALAMAT"

If he proposes marriage and files K-1 fiance visa that is the shortest honest route.

Your plan for visit visa but then intending to marry during the 'visit' is illegal, and one reason it is so difficult for persons from PI [and many other places] visit visa's. It is also illegal, as you are misrepresenting your purpose for 'visiting.'

If you love each other, do the right but not easiest thing, file the K-1. Good luck!

I certainly see and understand a lot of the advice regarding covering the entire span of the marriage, but given that, it still seems to me, submissions should emphasize current proof the marriage is ongoing and genuine. Just my two cents and how I plan to weight our submission.

Removing Conditions on Residency General DiscussionI need help... Major problem
Really sorry to hear, hope you can get this sorted out.

If it helps, the guide advises that you should not despair even in the face of rejection at this stage, as you will get your day in court in front of a live judge. Specifically the guide here reads:

On the "don't panic" front -- ultimately the burden of proof is on the CIS to show a fraudulent marriage. Even if CIS denies, the application can be renewed in front of an Immigration Judge (IJ) in Removal Proceedings -- and the IJ's tend to APPROVE those cases.

I have trusted the VJ Guides throughout the process for us, and you can to. Just don't give up! Good luck!

Removing Conditions on Residency General DiscussionI-751: What is the average number of pages sent in application?
Our package is headed towards 60 pages.

No magic formula, we are using just two statements from the bank, plus a little additional bank evidence from late last month showing online account summary and with our debit cards copied to the bottom. Personally I think 3 or more bank statements per year seems like overkill, but then we probably went with overkill on things that seemed important to us!

The important thing, I think, is looking at what you are sending and feeling comfortable it paints a complete picture of the time since your AOS was approved.

Good luck!

Removing Conditions on Residency General DiscussionHad a child during conditional period
QUOTE (medic @ May 6 2009, 07:11 AM) <{POST_SNAPBACK}>
Hi all,

I'm about to file I-751 for removal of conditions and have a question about the 'list all children' in Part 5.

My wife (who is the US citizen) and I had our first child during the two year conditional period. Should I list the child in seciton 5 and what should I put for the childs immigration status?

Thanks,

Mark.

The I-751 Instructions talk only of children adjusting status with the petition, however, conventional wisdom, common practice, and the poor wording on the I-751 in section 5 itself stating 'list all' children means most people include not just children born to the marriage, but also children who are now related via the marriage i.e. step children.

You should include your child born during the conditional period, listing the child as residing at your address, and "US Citizen" for immigration status. Put "None" in the A # box for the child.

Be sure to include the birth certificate as part of the attached proof package! Best evidence in the world. Good luck! good.gif

Removing Conditions on Residency General DiscussionFiling I-751
QUOTE (Liquidsoul @ May 7 2009, 09:27 PM) <{POST_SNAPBACK}>
I just joined this lovely community and thought I might get some answers here.

My 2yr CR is up for renewal in a few months and I have enough time to file this form in a timely manner but I am planning on starting college back in Germany just for the fact that it's more affordable for me. The time of filing I-751 falls directly into my admissions test in Germany and then later in October starting College. My husband will attend college here in the States since he will receive his financial support from the military for being a veteran.
I am trying to find out if I have to be residing in the USA while my renewal is being processed and if I could provide my biometrics in Germany at the Consulate General. And how long can I actually leave the States for vacational reasons without losing my status.
Is there any regulation allowing me to study overseas, keeping my residency and not being in the military or for "governmental" reasons?

I would truly appreciate your help.

:-)

I am not sure how you would file the I-751 from abroad unless you are in Germany because you husband is still in the military and by order supposed to be there.

http://www.uscis.gov.../I-751instr.pdf

Good luck, and probably would be interesting for everyone to know if there is some way to adjust status while one person, the person adjusting status is in their respective homeland while the other is here in the USA.
