- Copies of forms of 2007-2008 taxreturns listing both names (3 pages)
- Copies of front and back of Permanent Residence Card (2 pages)
- One photo CD containing 130+ pictures taken between 2006-2009 verifying our ongoing relationship (vacations, trips, family photo`s)
- Copy of Sheraton Hotel bill listing both credit cards being billed. (1 page)
- Copy of letter from Dep. Of Homeland Security to file for a joint petition to remove the conditional basis of my permanent resident status
- Copy of pet adoption contract listing both our names as pet owners. (1 page)
- Copy of pet trainer organization listing both names on same address (1 page)
- Copy of Sears Credit Cards showing joint account. (1 page)
- 2 sworn affidavits by close friends verifying our marriage. (2 pages)


We don`t have our own car and at the moment we still live in our Inlaw`s house so we don`t pay rent...
(I know living with inlaws doesn`t sound that great, but I`m very luck and got the best inlaws in the world smile.gif

Any advice or suggestions would be highly appreciated!!

Hello Laurahlover, I would attach W-2's to the tax forms if you haven't already.

Also, while the CD of extensive photo's is great, not sure it would ever be used by USCIS. I would suggest, even if you include it, print out, with date and time comments several photo's from several periods of time going back to your original issuance of the 2 year green card.

A nice organizational cover letter is also advised if you didn't already create one.

Beyond that, looks like a fairly solid list! Good luck and welcome to this thread, need to kick it into gear to make the May filing list! good.gif

Jane, you are another person I have read about here on VJ lately who has to pay a second I-751 application fee when logically your child came here on the same K-1 you did, or attached to it. Correct?

Got our NOA today. Interesting, because they sent in to our PO Box. Didn't think they would do that, but we included it as the mailing address on the I-751 since we have one, and some of our mail we copied for the packet listed the PO Box.

I even explained a little about naturalization, to which he said he was happy to jump through those hoops like a performing seal because he knows at the end of it he can give USCIS a great big F U, once he's holding his naturalization certificate.

A little more for the ongoing discussion of what USCIS mean's with regards to question 5

Q: Do I include my child on the I-751 or waiver?
A: It depends. If the child obtained permanent resident status based on the alien parent's marriage to a United States citizen and the marriage occurred less than two years before admission or adjustment to permanent residence, the child will also be a conditional resident. If the alien child acquired status at the same time or within 90 days of the alien parent, they can be included on the alien parent's I-751 petition or waiver. Children that entered the U.S. or adjusted status more than 90 days after the conditional resident parent must file a separate form I-751. The alien's children can be included on their parent's I-751 petition if they immigrated at the same time or within 90 days of their alien parent. They are considered to have acquired CR status on the same date as their parent. They can be included in their parent's I-751 petition even if they have turned 21 and no longer fit the definition of "child" under the INA.

This fuel's my assertion that section 5 is strictly for children also adjusting status with the I-751 being submitted, not any other child as is commonly done because of the poor language on the form. Ah well, we included all three children and obviously USCIS more often than not overlooks this common error.

I know they say file 90 days in advance to 2yrGC expiration as a precaution. How long does it usually take to get the 10 yr green card from mailing application to getting approved and in the mail? What happens if they don't get it until after the 2yr has expired? Does that mean the PR has to stop working??
I just know that as long as you have proof that you are filing for the 10yr even after the expiration of the 2yr you can continue living in the US (cause that would be just stupid to say they had to leave...).

Hi BlueRain! As I understand it, the notice you get that your I-751 has been accepted includes language extending the Conditional Green Card for 1 year from either that notice date or the date on the green card. Haven't seen one yet since still waiting for the final piece of our puzzle to send off our package, but you keep the notice with the green card at all times until approval and the 10 year card is received. If processing the I-751 takes longer than a year, you do an InfoPass at your local USCIS office request that your passport get stamped with the I-551. The PR does not need to stop working.

Be careful accepting Haole's advice on this matter. I've asked him for more information about his US citizen child because, by reading his post history on VJ, it's unclear to me how his child acquired US citizenship. Right now, it seems to me that his daughter was a foreign-born child of his spouse who he then adopted when she came to the US. By virtue of some legislation out there, his daughter was able to acquire US citizenship because he adopted her. In that case, she would have had an A# and a foreign birth certificate, which is obviously going to be confusing for the USCIS case adjudicator.

Like I say, I want to get more info from Haole on this matter, but I would not accept his advice at face value. His interpretation of the I-751 instructions for Part 5 is based on his bad experience, and I don't agree with him that his interpretation is correct.

My two kids are natural-born US citizens. They have US state birth certificates, and do not have an A#. I included those birth certificates with my petition, and listed their names under Part 5 of the I-751 with 'N/A' in the A# column for both of them. I think that was the correct thing to do because Part 5 says to list all your children, and the instructions give a reminder to include any conditional resident children who are applying with you to have their conditions removed. There is nothing which says to ONLY list conditional resident children.

Obviously, you have to use your own judgment on this matter and make your own decision, but I'd advise you to think critically, especially about Haole's advice and situation.


I think the form asks for all children, however the instructions say:

Thus it would appear Part 5 is specifically the place to list children removing conditions with the petition, not 'all' children as asked. We have a few days to go before being ready to file, and am completely uncomfortable either way, as the form and instructions literally SUCK on this point...

We have three children, 2 mine from previous marriage, plus our own child together, and would love to list the three, but don't want to fill out the form wrong. Unfortunately the instructions on the form and separate instructions for the I-751 do not mesh.

Thinking critically, I think whoever created the form and instructions failed to real world test them!

Where did you get this advice? I think it would be contradicting if you attach the child's birth certificate of your child when no name is listed on Part 5. Info about your children.

About the affidavit, the latest instruction (8/25/08 version) specifically asks for at least 2. I included in my submission just to minimize the chance of RFEs. But it's your call though.

I blew it and did so also and USCIS sent a RFE for $80 for biometrics for my child. They stopped my wifes process until I finally had to get my senator to fix the problem. Took an extra couple months.
Some people get away with it. I didn't even tho I had my daughters BC and US passport and explained she was a US citizen in the original cover letter.

But that is hardly making it clear that they won't be able to figure out that many would add all children of the marriage, even if they are USC's. So... Fixing our form, and glad we had a delay getting insurance documentation [the final touches to our submission.] We would definately have sent off our I-751 with the three kids listed, although none need to remove conditions... good.gif

How hard would it be on the actual I-751 form to change the language to: List all children who you intend to remove conditions with this Petition? headbonk.gif Classic USCIS...

As to the affidavits, from what I have read, they have no bearing on success or RFE for your submission. To my mind they merely subject two or more innocent person's to interogation by USCIS if they so choose. I can get them pretty easily and quickly in the event we get an RFE, but again, from all I have read they are not necessary for a successful I-751 packet. I read the instructions as indicating example ideas, not hard and fast requirements. Sort of a toss up on our part to not include/include them, but again I can get them if needed but won't include them with initial submission.

OK nearly done with our I-751 evidence, here is our revised list. Waiting for a few things regarding life insurance, private and through my work, then hoping to get our filing off by middle of next week! Here is what we have now:

Copy of Judith XXXXXXXXXXXXXXXX Washington State ID and Driving Learners Permits.
Copy partial tax statements for 2007 and 2008, both filed jointly with H & R Block TaxCut. [4 pages]

Copy of IRS 2008 stimulus payment notice addressed to us, front side.
Copy Homeland Security/USCIS I-751 reminder letter.

Thanks Immigrant2009, I read that thread, and already found one tip, I am going to add the W-2's to the 2007 and 2008 TaxCut print out's! Didn't think of that but someone else did in the linked thread, but since I don't have the IRS transcripts, I will add the W-2's. [Note: I used TaxCut print outs in the AOS phase without any issue at all, but am going to double check, I am pretty sure I added W-2's back then.] good.gif

Tomorrow will get a few things from work, like a simple letter showing my wife is the beneficiary of my work life insurance. They already have documentation from the AOS phase that she is also the beneficiary of my larger private life insurance, not sure if I should resubmit that again...

I could get Sworn Affidavits tomorrow as well from a couple of family friends, but not quite convinced it is necessary...

Anything else I may have missed? I noticed the sample cover letter had the sample person resubmitting a copy of their passports along with copies of the conditional green card. Is that advisable or necessary as USCIS has that in our file too? She has not left the country, so no new stamps, and we have not yet gone to San Francisco to update her passport to her married name. Thus it seems both redundant and overkill.

Silke, we haven't moved at any point since filing the original K-1, not entirely out of fear of how badly such things seem to throw USCIS, but sort of lucky on that point ourselves. Perhaps that helped us get the reminder letter? tongue.gif They should get your address right now though, off the removing conditions packet you sent in.

Curious, opinions seem divided on adding two sworn affidavits along with the packet. I am inclined to not include them as I believe our evidence is pretty strong as is. Did you?

My wife and I should have the packet ready to go today since I have the day off, we have to wait until May 1st though to mail it off.

Hi All,

We are putting together our I-751 packet now, and can officially file May 1st! Getting excited here, and of course a bit anxious to once again be put at the mercy of USCIS. So far, so good though as far as our treatment by USCIS through the K-1 and AOS phases of the process, hoping for smooth sailing through this phase too!

Any advice? Tips? Things to know before filing? Any and all input would be much appreciated.

Not sure if a May 2009 filer topic has been started, if not here we go kids!

From my experience that is bologna (hope i spelled that correctly lol). That isnt necessarily true but could depend on when you actually submitted or filed your taxes. Hubby filed his in February and within the month, I requested transcripts, via fax and mail (sent in form 4506) and got replied mail including year 2009.

As mentioned, I believe it has to do with the time you filed but I could be wrong. Try requesting it via mail or fax and see if you'll get the same response. All the best.

Besaangel is correct. I think it depends on when you file your taxes.
I filed mine in February. I requested and received IRS transcripts for 2009 this month. :thumbs:

The cover letter template found on VJ shows only the signature of the US Citizen spouse. Is that all is required. I was thinking it would be good if both of us sign the letter since it is a joint petition.

Anyone sent with both signatures??

We sent ours with both signatures, as I sent I-130 with my wife's AOS.
The USCIS will do a federal background check, regardless if it is beneficiary or petitioner... So, we didn't mind having both signatures on the cover letter. :unsure:

About a week ago we got our biometric appointment for my husband. Notice date was May 10 2010 saying to coem in June 4th. Yesterday we got ANOTHER letter with notice date May 14 2010 saying to come in June 1st. Which day does hubby go to capture his biometrics?

I'd go to the date specified (June 1st) on the May 14th notice, IMO. This is the most current USCIS notice, so I'd follow that date.

We received two separate appointment notices for biometrics, one for 6/4 and one for 6/9. The one for 6/4 came first, then a few days later, the one for 6/9. Should I just go to the first one? We can't take the risk of being turned away, the center is 90 minutes away and I'll have to take the day off of work to go.

I would go on the date specified on the second notice (June 9). They must have rescheduled you. If you're not certain you want travel 90 minutes, and risk possibly being turned away, definitely go on the later date.
Some USCIS offices may allow walk-ins, while others do not. I wouldn't risk a 90-minute travel, IMO.
