Removing Conditions on Residency General Discussion	Late for Filing I-751 form	Hi there! Hope someone can give light or share their experiences if they had gone through the same situation as me. We just realized that we have failed to remove the conditions from my conditional greencard. It has been a couple of years since the deadline passed. We are now hurrying to fill up the forms and submit it along with the necessary documents. Question: 1. Why do you guys include a cover letter with your submission? Is it so that the forms would look more formal and complete? It is a personal preference to include a cover letter with petitions. Some include it for a more organized look. 2. In the cover letter, should we include the reason why we are filing so late? Yes, you definitely need to show good cause for not filing petition on time. 3. What would be the possible consequences since we filed so late? Worst case: deportation I really don't want to get deported. I have been paying my taxes and has been employed properly ever since I got my greencard. I just made the mistake of forgetting about the conditional status. If you have any ideas or thoughts, I would be glad to hear them. Thank you in advance! This was taken from USCIS website: If you fail to properly file Form I-751 within the 90-day period before your second anniversary as a conditional resident: * Your conditional resident status will automatically be terminated and we will begin removal proceedings against you * You will receive a notice from us telling you that you have failed to remove the conditions * You will receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (we are not responsible for proving that you did not comply with the requirements) The Form I-751 can be filed after the 90-day period if you can prove in writing to the director of the appropriate Service Center that there was good cause for failing to file the petition on time. Removing Conditions on Residency General Discussion	Sending The Package for roc.	Hi everyone. I just want to know from the guys and the ladies in what order did you send your roc package to uscis. I have to send out the years of 2011 and 2012. Should i start with 2011 and then put the year 2012 after the 2011 or should i start with 2012 and then put the 2011 after. I have all the evidence that is needed for the two years. Just wanted to know how the vj members put their roc package together. thanks everyone. IMHO, I don't really think it matters what order you send it. But in my case, I sent them starting with the most recent (2011, 2010, 2009). Good luck with your ROC! Removing Conditions on Residency General Discussion	CR-2 visa filing question	First of all I thank you for your immediate reply, I do appreciate it. As for removing conditions of Cr-1, I still have to ask my mom about her visa, but I think I am filing alone since she has been here for five years already (yes it took me that long to get my papers approved to come here) So I can do the biometrics in the Philippines then? In regards to the interview, does everyone go through it or just some cases where they find the person suspicious? If ever everyone is required to do it, then I might as well go back to the US and do the interview. AFAIK, you cannot do biometrics in the Philippines. The biometrics appointment letter will show the closest local USCIS field office. Although you may reschedule your biometrics date, there really isn't much to change the location. You can always verify if the U.S. Embassy Manila does biometrics for permanent residents removing conditions. With regards to the interview, not all applicants require an interview. Removing Conditions on Residency General Discussion	CR-2 visa filing question	I have a Cr-2 type visa and it expires February 2014. I am planning to abroad to study this June 2013 (I won't be gone for a year only 10 months so i won't file a re-entry permit), and I would like to know if it is possible for me to file I-751 while in a different country? And if so, if an interview was required for me while I am in school, is it possible for me to reschedule that said interview when I come back here in US (I plan to come back here April 2014 during school break)? I'm assuming your biologic parent is removing the conditions on his/her CR-1 visa. Is that correct? If so, you can certainly be out of the country when the petition is sent. However, you will be required to do biometrics at your nearest USCIS field office. There is no way around that. Even if you physically did the biometrics, you cannot choose how long to reschedule a possible interview. USCIS determines that. Hope this helps you some. Good luck with what you decide! Removing Conditions on Residency General Discussion	Complicated Address Situation	Hi everyone! I hope this post does not confuse you! I got my GC last June 2011 and back then we were still living with my in-laws. A couple months later we moved to our own place and I did the change of address with USCIS and I received confirmation of it. However, last week the notice to remove conditions was still mailed to my in-laws and not to our new place. When I file for ROC will it matter? Do I just apply with my current address and will they send it there? Now here's where it gets complicated. I will only be staying at my current place until May because I am only here for school. I graduate May so I am temporarily staying with my in-laws until my husband arrives from deployment. In August when he is back we are moving again to another place. How will two change of address during ROC affect my application, like will it mess it up? I worry that my GC will get sent to the wrong place or that the post office will return it to sender. I hope someone can enlighten me and give me the right advice!! Thank you! I would update USCIS with your in-laws address. You're planning on sending in your ROC in March. It may take 6-7 months for the ROC to complete. I don't believe multiple changes to your address will affect your application. However, notices, appointment letters and possible RFEs (God forbid!) may not reach you. So I would definitely use your in-laws address. Removing Conditions on Residency General Discussion	Back in the game	So on the 20th it is time for me to send it my I 751...... I have a few question regarding evidence though. My Hubby and I have obviously lived togetherever since I entered the US,we do have both Leae Contract with both our names on it and our second Landlord (we lived here for 16 months now ) is willing to write a Statement as to us living together. We also have two Car Loans together,both not paid off yet. He is the Beneficiary of my Life Insurance (he is not able to get any due to health issues), he is completley involved with my son's bringing up and is on all school papers listed as my son's father and contact person.My son's teacher wrote a Statement too. We have a joined Bank Account and our Auto Insurance is in both our names plus a few pictures of us together. Now comes the problem, all my Credit Cards are in my name only becaue Hubby's credit is BAD. We also dont have Buddy Lettersbecause my Husband is a 70 % disabled OIF Veteran suffering from PTSD and Depression.He is terrified of crowds and we literally dont have friends that come to our House or we go to theirs...... I am involved at Church and some people know him there ,but they hardly see us together cause as I said he prefers NOT to be around people. His family lives in MN and we haven't seen them since the Wedding........ I do go to his VA appointments when I can and there is tons of evidence to his condition. What else could I possibly send them as evidence ????? We have an absolutley valid Marriage,and with life happening I simply never thought of collecting letters that show our joint address...... Any Suggestions ?? Gotta file on July 20,2011 . Oh also,I saw on here that pretty much nobody gets Interviews anymore for Removing of Conditions?! Why is that ??? I'm a little paranoid when it comes to him.......his father is the Commissioner of the City he lives in and he gets away with pretty much everything.His father even got rid of his jail records in other Custody Cases ( he ha 5 kids with number 6 due this month).The Judge in Texas ( we live in WA the bio father in Texas) is friends with the bio fathers dad and his dad stated that in an e mail he has ent me from his Office.......as soon as that Judge laid hands on the case my Child Support was suspended........... Removing Conditions on Residency General Discussion	Custody Fight and Immigration	My son's bio father who has never seen my boy,cared about him or supportedhim contested the Child Support Orderand asked for a DNA Test.So far so good but he says that he will fight me for Custody if the DNA Test shows he is my son's father,which it WILL show. My son has the US Citizenship based on his bio father being a Citizen .His father ( my son's Grandfather) helped me get all the Documents I needed to prove that all requirments are full filled and my son received his Certificate of Citizenship. I am in the ROC Process as of right now,just got my NOA yesterday. The bio father threatens to have me removed from the Country and such. My Husband and I have VERY strong proof of our marriage being real since ( among other things)I am my Husbands VA assigned Caregiver since he is a disabled Veteran. I am on all his VA papers,we of course filed a joint Tax return ,we own two cars together which we are still paying on,we have a Statement from my sons teacher saying that we raise him together,a tatement from our Landlord that yes we do live together under one roof,joint bank account............ The bad thing is that when I left Germany I left debt there.........I have NO police record there though but there MAY be some civil stuff because of the debt. I obviously also don't have a police record here nor do I have bad credit here. Could my debt in Germany be a problem IF they did some Civil action without my knowledge ? I do have a Twinsister in Germany and no one ever contacted her ( which would have been a very common thing in Germany). Removing Conditions on Residency General Discussion	I-751 July 2011 Filers	Whidbey: I am simply TIRED of always having issues with them.Ever since the K 1 I have issues with the USCIS and I have no idea why.Our Marriage IS valid .Man the VA has asigned me to be my Husbands Caregiver.......how much more evidence do u need ? Plus my sons bio father said several times he wants to get me deported so he doesnt have to pay Child Support.His entire family threatened me with Immigration.So therefore it certainly cant hurt to have Senator Patty Murray involved.She is an advocate for disabled Veterans in our State so thats why I got her involved.All I want is to live in peace and quiet with my family.My Husbands PTSD symptooms spiked up since the RFE and he is terrified.I dont understand how peoplecan get divorced shortly after AOS then apply for ROC and have no problems while we who have a valid and strong Marrriage get RFE's and have to jump through hoops.They should keep an eye on those people not the ones that have not spent a day apart since they came to the US. Not to even mention all the Anchor baby cases and illegals on Food Stamps.I work in retail and you would not believe how many Customers I get with EBT cards that dont even speak English.I feel for those peoplebecause because it cant be easy to live in fear of Deportation every day of your life ,but give me a break and dont make my life harder just because you lose my evidence. I sent in with the inital ROC appliaction: - Tax Transcripts 2009 and 2010 filing married joointly - Rental Agreements for the first apartment we moved into and for the second we just moved out of,the latter even had a Statement from the Manager stating that we lived there together from March 2010 until present - A letter from my sons teacher stating that we both come to conferences and that my Husband takes as much responsibility for my son as I do - My life insurance policy naming my Husband as Beneficiary ( at that time he had none yet) -Auto Insurance Cards naming both of us - Car Titles to both cars in both our names - Car Loan papers naming both of us - Bank account Statements showing that we have a joing checking and savings account - utility bills in my name and in my Husbands going to the same address - Family Pictures we had taken at a studio and a few unprofessional regular pics of us STILL got an RFE So now with the RFE packet I will send: - Tax Transcripts again -My life insuarnace policy again and my Husbands now that he has one through the VA that names me as the Beneficiary - Car Loan Papers again in both our names - A Statement from our Bank and Auto Insurance as to when Hubby added me ( Bank April 2009 Auto Insurance just before I got my DL in 8/2010) a letter from the Bank that says that ever since April 09 I have been a Customer in good standing with them. ( Its USAAfor Military and Vets only so without Hubby I could not be a Customer there) - Hubbys VA Disability Award naming me and my son as dependants -My letter from the VA that states that I am my Husbands family Caregiver and receive a Stipend for that - A Statement from my Boss and friend that she knows James and that we have a completley normal marriag - W 2s from 2010 and 2011 for both of us going to the same exact address - Copy of our DL's showing same exact address - Copy of our AAA membership cards -Copy of my sons student profile having my Husband listed as father and emergency contact - Copy of my sons IEP listing us as parents and signed by both of us Are RFEs computer generated ???? There is no touch on my case at all. We sent in few Bank Statements because even though I do have access to Hubbys account ( joint account), my money goes to an account in my name only. Reason we did it that way is because Hubby has very bad credit and I had to establish credit. We DO pay all bills together though and Hubby has my Debit card on countless occassions,it really only was for credit score reasons. Which already paid off because the last car we bought two months ago,they wanted to put Hubby and me on it again but then when they ran my info they asked if I wanted to do it in my name only since that would drop the interest from 25.9 % to 10.9 %.Needless to say thats what we did. Same with Utilities, Hubbys bad credit made it the smarter idea to put my name on Cable,Electric and Phones instead of his. Obviously all our Lease Agreements are in both of our names though.......... Really annoyed................................ Removing Conditions on Residency General Discussion	4 year journey at an end	Thank you everybody! Yes, USCIS and me are so close I send them a fruit basket every couple of months. Okay, not quite that far, but they actually were better than I hoped and the whole process smooth. Even when we were warned (here and other forums) against trying to have my wife come over for a visit on her B-2 after we filed for K-1, they didn't even blink. The bizarre thing I remember from the whole experience is that when she finally made the move over here on her K-1, they grilled her (politely of course)for nearly 40 minutes in an office at JFK before they'd let her leave. She thought there trying to find excuses to send her back. Two visits on a B-2 and nothing. Wants to come stay for a while with a document saying she can and suddenly she's a target. Oh well, still much easier than some people deal with. We don't know about citizenship yet. She first wants to make sure that it won't make it harder for her to go back to Russia for visits. Removing Conditions on Residency General Discussion	4 year journey at an end	As you can see from my signature, our long journey has finally come to an end. A little over 4 years after meeting, we have our 10 year GC in hand. Just over 3 years from first filing for K-1. We filed as early as possible at every milepost and lucked out at every turn it seemed. Not a single hiccup the entire way except one lost letter that temporarily extended her GC. We had to get another copy so we could travel. I know the journey is a lot more of a headache for others and I realize how much good fortune we've had. Everyone here has been great with advice along the way! We'll be married for three years this summer and we have a beautiful daughter who is almost two years old. It doesn't get much better!
