PhilippinesFilipinos Against Arizona Immigration Law SB1070
Every group that has come to the US has suffered some sort of civil rights violation. The Irish use to sleep in sewers in NYC and Boston when they first arrived because they were not allowed to have homes rented to them is one example. Blacks actually had a home albiet small but lived better than the Irish for years. The Swedes couldn't work in the quarries because the Finns wouldn't hire them. Its a sad fact but it is just something that naturally occurs when mixing cultures and people.

Racial profiling to prevent illegal immigration? Is it that wrong? Your required to carry your ID by law if you don't have it go get it. A few accidental deportations and people will start carrying what they are suppose to.

PhilippinesFilipinos Against Arizona Immigration Law SB1070
Tahoma's post from the ACLU post states: "People who are afraid that they will be questioned and forced to show papers because of the way they look will be much less likely to report crimes or serve as witnesses."

People who are afraid to show papers--normally don't have any. If you are a legal immigrant than you do have papers or a green card and are required to carry them on your person. If you in your front yard or close enough to the papers or idendification then the police would of course let you retrieve them or assist you in retrieving them. If your at the mall 5 miles from you house without your documentation then your 'in the wrong' to begin with.

The Arizona law does in fact exist--its on the federal level already--this is just the state requiring its officers to support enforcement of the federal laws of the nation. The federal government needs the assistance of states to enforce the federal law--shouldn't be an issue. Minutemen groups patrolling the border is 'constitutional' so why can't the state do the same.

Short of that why doesn't someone offer a better solution for eliminating illegal immigrants in the US? Those that came here illegally should not be allowed to stay by virtue of passing some law giving them amnesty--which is what will eventually happen if the federal government losses its lawsuit against Arizona. And Obama is spiteful that way and can get laws through without a popular poll or vote from the House, Senate, or 'The People' he did it with health care!!!!

PhilippinesFilipinos Against Arizona Immigration Law SB1070
The law hasn't gone into affect yet so if their were hispanics being questioned then there is probably another reason/dispute the police were asking them for identification.

As far 'kano' well it's slang for American or Amerikano... So is it ok if I refer to you as a 'flip' didn't think so. If one is here illegally then they should be rounded up and sent back -- if they violate the law a second time then they should be making big rocks into little rocks or smelting my new personalized license plate... for life-that way there is no chance they'll immigrate illegally a 3rd time--that goes for all illegal immigrants regardless of what country they are from. Make room for them in our prison system by releasing all of our lifers on the Mexican border or any other country with large #'s of illegals here--give them each $200,000 and tell them run to Mexico and never come back ($200,000 is alot less than it cost to keep them for life). Hey Mexico encourages its citizens to come here illegally--we can do the same.

As far as the NaFFAA and El... why don't they try to get their country of origin to change its laws too--which Philippines is alot more restrictive. I can't retire on a visa there unless I invest $50,000 into a third world volatile economy. If I marry a filipina I can't work there because the unemployment rate is so high and I will be taking a job away from a filipino citizen--which I understand completely. Bringing more folks into the US with an unemployment rate of 14% only adds more to unemployment and more people as public charges. NaFFAA members I am sure left the Philippines for a better life -- as my ancestors did. But mine stood up with their lives on the line to break free of British rule. Why doesnt the NaFFAA members stand up to the Philippine government and change things for the good of all the people there--instead of trying to mold this country into what they envision because they don't have the cahones to do it in the Philippines.

I love the Philippines and the filipino people and wish I could be more supportive on this issue you brought up but can't because your position is trying to justify or turn a blind eye to illegal activities. Isn't that part of the problem in the Philippines--too many politicians and police always turning a blind eye because the money is good or they are simply too weak and disorganized to stand up to do the right thing?

PhilippinesFinally the Interview
Finally she had her interview after the 2 month medical delay. Passed!!!

Can't say enough how proud I am of her going through all the paperwork, medical exams, and all the waiting that goes along with it. And thanks to everyone on VJ that has provided advice, moral support, and once in a while a not so tender touch of reality when needed :) it was all appreciated.

We are of course both thrilled and now looking forward to the Visa showing up in the mail.

Anyone have any recent experience on how long Visa is taking in the mail? She lives in Quezon City. Her friends took over two weeks (was a problem with processing they said) another friend of mine just got here a few months ago and hers took 2 days to show up.
dluke77MalePhilippines2010-11-05 10:19:00
PhilippinesQuestions asked at the Manila embassy...
My fiance just had her interview and passed!!! Some of the questions she said her heart dropped. I had told her to just answer the question and if she didn't know just state she is unsure or doesn't know.

What is your name? Whats your fiance's name?
Where is your fiance from?
When did you meet? When did you meet last in person?

Ok those she can be reasonably expected to know.

Has your fiance been married before? Yes
Why did he get divorced? First one they just fell out of love and not sure on the 2nd one.
Does he have any children? Yes
How old? I think he is 16 but he lives with his first wife so I am not too sure.

Well she didn't know exactly the answer and even got the age one wrong. She was approved. My take is that if someone knows every answer as coming from a textbook than how is that better than just being real. She ask me some of the questions like they asked her about brothers & sisters--good thing it wasn't my interview she said or I would have failed miserably :) opps.

PhilippinesImmunization at SLEC
My fiance gave urine sample at third day at St Lukes since first day she was still menstruating. They told her for pregancy test. Then after results came back from sputum test she had to have another pregnancy test--told them impossible for her to be pregnant but of course they won't assume that... and they told her had to make sure before given her two of the vaccines she still needed.

PhilippinesCFO Class Completed & She's on Her Way Tuesday
She got her Visa from Air21 on the 10th (interview was the 5th).

Went to CFO office yesterday and they got her into the class the same day. She needed my work phone # before they would issue her stamp or whatever it is they gave her.

They also made her go home and retrieve a copy of my divorce papers from prior marriage. Not sure why they would need that -- seems pretty silly since the US is pretty tight on document checks and tight/restrictive on 'legal' immigration.

Anyway, for those fiances with prior marriages make sure you bring a copy of those past divorce decress and work phone #'s for significant other to save yourself a trip.

Oh and the good news is she will be here 16 November!!!! The excitement factor just kicked up a notch!!!
dluke77MalePhilippines2010-11-12 09:21:00
PhilippinesDoes your wife think the US is too cold ?
Gina got here 16 November and it was cold albiet in the 60's/70's to her.

The last few days she has been braving it and going out in the morning when I am heading off to work, now its been mid/high 20's this last week, I couldn't figure out why she is standing there breathing out alot until it hit me -- she has never seen her breath before!!! Driving to the mid-west for x-mas holidays so she should get to see a fair amount of snow along the way.

Last night I felt bad though took her out to the fishing pier in 25 degree weather with 15-20 mpg winds striper fishing. She was a brave soul and lasted two and half hours--she didn't say too much about it but I know she was feeling the cold judging by the cold feet against my legs all night.

K-1 Fiance(e) Visa Case Filing and Progress ReportsMay filer has been approved August 7th!
No, I don't consider myself an April filer. I've been told that you use the date on the NOA1 to determine your month of filing and I have also come to the conclusion that that is correct. This is what I've been going by and I think most people go by. When I check on the USCIS website it gives the EAC # and says "We received your information on May 7........I think I'm an early May filer.

Wow! 34 days. It looks like the average on VJ is 10 days. My timeline is updated and accurate. So, it took me 14 days.

34 days!?! I would have been going nuts wondering if they'd received it. How long did it take them to cash your check?? Are you going by the date that you actually received your NOA1 in th email or the date at the top of the document? You go by the date at the top of the document.

Thanks for all your support. You've all been great.

Based on your timeline, aren't you an April filer? You submitted your petition on April 23 and received your NOA1 on May 7.

I always wonder the same... are we April filers or May filers? We sent our package in April and got our NOA1 34 days later in May! I got to the conclussion that we are May filers, as the process officially starts with your NOA1, when the USCIS starts processing your case.

OP, was your adjudication date that appeared on your timeline link accurately? If not, did you got your NOA2 before or after the VJ's estimated date?

K-1 Fiance(e) Visa Case Filing and Progress ReportsApril and May Filers - NOA2 to NVC
I posted this in the June-July NOA2 to NVC thread, but I thought it might be useful here as well.

FYI... When I called the NVC yesterday to check on the status of our package they gave me a number [(202)-663-1225] to call to track the Embassy arrival date of our package. Well, I tried to call this number when I got off from work and I got the postal section. I then called the NVC to ensure I had the number right, and I did in fact have the correct number. However, the hours of operation are not what I was told yesterday. The hours of operation are 8:30 am - 5:00 pm (EST) M-F.

Short and long of it:
Call (202)-663-1225 for Visa Application Arrival status at the Embassy
Be sure you call between 8:30 am and 5:00 pm (EST) Monday through Friday, (if not you'll reach "Carl" in the mail room, and he can't help you)

I hope this helps...

Good evening all. Just have a question regarding about applying for status change. Me and my wife got married before her I-94 expires and she came here on a K1 visa. Her I-94 is not expired yet. But I was wondering can she still apply for status change after her I-94 expires? Thanks for your time.

PhilippinesCommunication with St. Lukes-Manila
My fiancee was flagged for a sputum test during her medical exam at st. lukes in August - a 2 month delay. In a couple of weeks we should be getting the call with the results. Assuming the test is negative, should she travel to manila to coordinate with st. lukes the reschreduled US Embassy interview or can the arrangments via St. Lukes also be done by telephone?

We don't want to uproot her son from his classes to travel to manila and then wait however many days until the interview is rescheduled.

PhilippinesFiancee' Visa Interview / VISA Prepaid Debit Cards
This past Monday my Fiancee had her USEM interview, which took very little time and without very many interview questions being asked. Maybe they were in a hurry to get through the interviewees as the Typhoon was approaching that day. Afterwards, she was told to go to the Air21 window to pick up a paper slip, however, she was not informed whether or not the Visa was approved. We are assuming since she was not handed back her passport at the interview they will process the Visa and courier it too her via Air21 but we are not 100% positive. Perhaps I should call for confirmation but other threads indicate that confirmations are not easy to get through the phone portal. Anything you can share is appreciated.

On a side note I would like to send a VISA/MC prepaid debit card to her for expenses and/or emergencies traveling to US. All USA services for this require a SSN, which of course she does not have. Any suggestions here would also be appreciated.

Thanks for your help?

PhilippinesTorn Yellow Envelope
Below is the official response from an e-mail inquiry to USEM. It appears to be only a minor inconvenience. Just one more thing to do in Manila before she departs for USA. Thanks to those who have been helpful.

"This is in reply to your inquiry of October 23, 2010, regarding your visa concerns.

Your beneficiary should submit the visa packet, together with her passport with the issued K1 visa, to the Embassy's Immigrant Visa Unit (Window 34) on any workday, between 9:00 a.m. and 2:00 p.m., to have it resealed. She may also send the documentation by courier delivery service to the Immigrant Visa Branch (Attention: Operations Unit), U.S. Embassy, 1201 Roxas Boulevard, 1000 Manila.

We hope this information is helpful to you.

K-1 Fiance(e) Visa Case Filing and Progress Reportsanother I-134 question
Hello all!

I posted a similar question earlier, but I am still unclear.

I am almost done with my college career, and will begin student teaching in January. I will have a job on the weekends, and will be working part time at the college.

When I submit the I-134, will I need to include letters from both employers even though they are not full time? Do you recommend that I include a letter explaining that I will have a full time job once I graduate?

Thank you all again! Visa Journey has been so helpful!!

Ahh you used a lawyer.... not me. Too much money to spend on someone else messing up work they're going to make me do anyways. You don't need an additional letter of how you met in person unless it wouldn't fit in the box for Question #18 on the I-129F form... and the cover letter is probably the one thing done by the lawyer... and he/she probably passes it off on his/her secretary or paralegal

damg...and for that we are paying 5000$

Wow $5000  That's outrageous. I only recommend a lawyer if it's getting complicated. I was considering it at first because lawyers tend to put the fear in you (no offense to you lawyers out there reading this  ) but then I just decided to go for it. I did plenty of research first. Google = friend

(and everything was paper clipped together if you're wondering...)

- Cover Letter
- Payment in the amount of $170.00.
- I-129F
- I-129F Supplement: Part B, Question #18 labeled and signed by me, explanation of meeting in person
- G-325A and passport style photo (in a ziplock bag paper clipped to each form and labeled with marker) (Petitioner)
- G-325A and passport style photo (in a ziplock bag paper clipped to each form and labeled with marker) (Beneficiary)
- Birth certificate photocopy and US Passport photocopy (I did both)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years (photocopies of my plane tickets, and an envelop of pictures with dates written on the back)

Did next-day delivery on the 6th, and when I got the first NoA by mail I checked the site everyday for the status. Now I'm working on getting my Affidavit of Support done and notarized. I believe I can get it notarized at my bank, but I'm not sure. They said they think they can. I'm going to research it more.

I think thats for CR-1/IR-1 visas. With a K-1 you need pay $100 or equivalent in local currency if they accept it.

PhilippinesDual Citizenship
QUOTE (david2 @ Jul 29 2009, 08:13 AM) <{POST_SNAPBACK}>
If you just got married your wife can not HOLD DUAL Citizenship. The law changed many years ago and the only ones
that can DUAL it are those children that have one of the parents as a U.S. citizen.

To answer your question. First if she becomes a U.S. citizen she looses the right to own property and the Medical from the Philippines. She is not U.S.A certified (LOL) and her connection to the Philippines is only her past not her future.

In my case I want my wife to stay a Philippine citizen and hold Permanent residence here in the U.S.A. that way we can own property in the philippines and she has the best of both worlds. If I die it is then up to her if she wants to break the ties to the Philippiens which I would feel she WILL NOT.

We are build a house in CDO Cagayan De Oro and that is not possible if she was to be a U.S. citizen we would have to put it in her Mom and Dads name. NO THANKS.

Rosie and David

This is incorrect. When a filipino takes the oath to become a US citizen, he or she gives up the Philippine citizenship at that moment. If you check the website of the Philippine embassy, you will find the forms needed to complete to reclaim your Filipino citizenship. It is not a difficult process but you will need to appear at the embassy to retake the oath. You then enjoy being a dual citizen. Check with the embassy, here in Colorado the embassy staff held an event where they came to Colorado for the new passports and dual citizenship processing locally.

You will only be required to pay taxes to the Philippines on money you earn IN the Philippines, not money earned in the US.

Marilyn and Peter.

Philippinesi lost my job.
Just use the cosponsor. Do not lie, if they ask tell the truth, but you don't need to advertise it. Just answer all the questions they ask and there's really no need to volunteer information.

And look for a job because you will need it for the AOS too.
