Richard, My Lampros has never been to the states at all, and a good chance he won't til he moves her permanently. He lived in the UK for 7 odd years, so it's not going to be a harsh change... What all did your SO find strange? Curious what his culture shock will be like..hehe.


The fact that it is in a storage facility is pretty much expected. The VSC approved it and (thought) they were done with it. If the NOA2 had been correctly delivered, the file would not be needed for many months, and then would be needed by a different office (the local field office, not the VSC) when they process the AOS. So until then, they need the space for all the other pending cases, so they put it in storage.

I know for a fact, that all the USCIS processing is pretty much moving around big folders of paperwork. It sounds like what they need to do is get the paperwork and then send a copy of the NOA2 from it. It probably will not take 30 days, maybe a week to get it in the mail to you. This is of course, just my speculation.

Thanks Lee... I don't think anything will help really, but thank you. The system is just broken and until it is fixed they are free to respond to things like my inquiry with a form letter saying nothing.

I had to chuckle when I saw that someone started a thread "I am outraged" and in 2 or 3 days had 130 replies... I admit, I didnt read many of the posts... just a small sample... because mainly... everyone is just like us... frustrated, angry, confused etc....

I really do not expect to achieve anything from my letter, Lee. It just was an outlet to vent (which felt good) at least until I get a reply that says more gobbledygook.


I am starting my efforts by working within the system - posting it for others who are interested in taking action to use. I posted this on the "I'm Outraged Thread", and also in the March 2009 VSC thread. I watch your groups to see if and how things are progressing. We used to have an Ombudsman at the office I worked at in the fed. government - if she got enough complaints things did actually shake loose.

The Letter I Sumitted to the USCIS Ombudsman today:

To Whom It May Concern:

In April of this year I applied for a K1 visa for my finance. Because I am a resident of Virginia I was required to submit my application to the USCIS center in Vermont. Since I have applied for this visa, the processing times at the VSC have slowed dramatically (to over 180 days).

When I contacted the USCIS today, they said that the VSC was processing applications from December 30, 2008 and that my application would not be reviewed until October 22 of this year in the best-case scenario (more than 180 days after I submitted my application). Meanwhile, residents of states that feed into the USCIS servicing center in California are being processed within 66 to 100 days.

I find this inequity unacceptable, given that all applicants pay the same application fee. After having researched this issue, I do not think that it is caused by a difference in the efficiency of VSC employees versus CSC employees, but more likely by a misallocation of workloads vis a vis resources by either the USCIS or its subcontractor Northrop Grumman. Furthermore, I do not understand why processing times are increasing while the volume of applications is decreasing (as your office itself noted in its June 2009 report to Congress).

Unless steps are taken to remedy this inequity immediately, which is unlikely given my conversation with USCIS today, I will be forced to cancel my wedding in November of this year. My parents will incur significant financial losses, as well as my family and friends who have already purchased tickets to attend the ceremony and reception. As I am sure you are aware, these misfortunes pale in comparison to some other people standing in line at the VSC under far worse circumstances, while May and June filers begin to be approved at the CSC.

I realize that my application is currently within the USCIS' “normal” processing time. Nonetheless, today when I called for the first time I was told that my application will be adjudicated around October 22, more than 180 days after my submission. Further, it is not "normal" for residents of one state, like Virginia, to arbitrarily receive such significantly inferior service from the USCIS than residents of California or Oregon. Why isn't the I-129F workload distributed more evenly among these centers and why can't files be sent from one center to another when one center falls significantly behind another?

It is infuriating to see large numbers of people who filed their petitions in May and June being approved by the CSC before all of us who filed our applications in January, February, March, and April at the VSC. While I know that the memebership of the primary tracking site for I129F petitions (VisaJourney) does not comprise the entire pool of I129F applicants, its membership pool does represent a statistically valid number of applicants and it is therefore possible to ascertain broad trends in visa processing extracted from its data. On top of this, USCIS' own bulletins display the existing inequity, albeit on a more publicly digestible magnitude.

Ironically, my fiancé is more peaceful about this issue, noting that the USCIS seems to me no more equitable or effective than its counterpart agency in his largely corrupt country of the former Soviet Union. In fact he advised me to not to send this letter, for fear of the type of retribution one would encounter in his country for voicing concerns about a what seems to be a systemic problem that no one has an interest in or incentive to correct.

As a patriot and former federal government employee, however, I assured my fiancé that things were different in America. I sincerely hope that your office will propose and implement a long term solution to this problem, rather than simply add my letter as a tally mark on a count of "Top Ten Complaints in the Ombudsman E-Mail Box" for inclusion in an annual propaganda piece, like they would in the former Soviet Union. It is hard enough to wait six months plus for adjudication. Adding the knowledge that people in different states are waiting half the time you are for no apparent good reason is like adding salt to an open wound. I hope that future customers do not have to suffer from an inequality that does not seem too complex to solve.

I am a part time student and I also work in a diner, and yesterday I was talking to a somewhat regular customer who tried to tell me it takes 2 days to get a visa to the US, it just depends on where you live. I tried not to laugh in her face, it was pretty hard.


I got once 'Oh, I thought if you married an American you would be let in straight away'. And that was coming from an American who's sister worked for USCIS! If it was only that easy.

@amberL, I have checked the US Embassy in Guatemala website and it actually only takes 3 days to process the visa lol. When I first starting doing research for the visa process I got super excited at this point, then realized that was absolutely ridiculous and would never happen that way haha.

Dave, I dont know, I saw it yesterday... I agree, however... 5 months should be the day... when you call they also tell you that March 5th is the day... I dont care! I filed the service request anyway.


When you call, they don't have a clue...

Let them know that their published, official processing times are available and you are happy to point them to the link, print the article or help them otherwise become more informed. They do NOT in my opinion perform any sort of actual customer support, but exist as a way of keeping the people with pitchforks and torches away.

In my opinion, there should be a service level guarantee with our $455 check. If they do not adjudicate withing the "normal processing time" (or withing 6 months) as of the date we apply, they should have to complete the adjudication *AND* refund the fee (and pay a penalty that escalates starting > 3 months after that). THAT would make them actually meet the service level.

I am again writing you for your assistance to get someone within the governmental bureaucracy to act on my file. Since last writing your office just over a month ago (July 22, 2009) the USCIS have approved no less than 33 couples that have filed their 129F in April (or later) leaving no less than 64 couples that filed their 129F in the month of March, not to mention countless couples from prior months. (Please see the attached sheets for further detail).

Today I am officially outside of the normal processing time of five (5) months as posted on the USCIS website. I called the USCIS (under the new guidelines posted on August 6th) and spoke to a Customer Service person who was unable to give me any detail whatsoever. I asked this representative to connect me with an officer of the USCIS, which she gladly did. I spoke with an Officer Davidoff who in turn entered a referral service request (referral # ETC-XXXXXXXXXXXXX-VSC).

While I appreciate that each 129F is a little different and may require a slightly different processing, I find it appalling that people that have filed a full 30 days (and more) are getting their approvals so quickly while people that have waited patiently, longer are being ignored. To help put this in perspective since I do not believe you have personally been through this agonizing process… and are probably being fed the same rhetoric from the USCIS that I get...

1) 10 out of the last 20 approvals from the Vermont Service Center (see attached) filed their cases in April. 6 of these 10 (60%) are virtually a full 30 days younger than my file.
2) Week Ending August 17th 2009 there were 40 approvals from the Vermont Service Center. Of the 40 approvals, 11 were filed after April 1, 2009. 27% of the approvals are younger than the 64 couples still waiting their approval.
3) Week Ending August 24, 2009 there have been 35 approvals posted so far (it is early in the day as I write this letter). Of the 35 approvals a WHOPPING 21 or 60% are dated as filed in the month of April.

I previously wrote you about the disparity between the two major Service Centers. The California Service Center is routinely approving 129F applications dated Mid-May while Vermont Service Center according to their own website has an official (public) date of March 5th, but in my opinion gathered from data available on the web, approving on average Mid-April applicants.


Ok, I am confused...I don't see the official date of March 5th. I do see that on August 13, they posted/published their "official" processing times as of June 30, 2009 which stated that for I129F fiance petition, the processing time was "5 months". This web page also says (the bold is there on the web page too):

IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance.

The Federal fiscal year ends September 30.... and they have a 5 month approval time line now...

So here we sit, end of August... and they are working very well into April... getting ahead of the 5 month goal they have set...
Come September 30 the USCIS will show that they are ahead of the 5 month time line goal set, since the current month they should be working on at that point will be May... and stragglers are just S.O.L. and will probably not be counted for the government's purpose...

This is my theory, for whatever it is worth.


I see we are following the same theory. USCIS has in the past used the "processing time" as a defense - no one was able to put in a request to find out what was going on, because they would simply publish the time for the oldest application (ok, maybe the 2nd or 3rd oldest) that they are working on as the "normal processing time". Now they have made public commitments to reach 5 months for processing time, so they will process applications meeting that time, then I expect that sometime in October, boom, it will be back to the same #######.

As for ppl getting them to make a service request, they will get a letter saying "everything is normal, but we haven't looked at your petition yet and you have to wait". It would not surprise me if they hold these responses, change their processing timeline on Oct 1, to like Dec 2008, and send a response saying "see you are within normal times"

if they spent half the time on fixing basic things that they do patting themselves on the back for creative press releases, you would have had your approval back in June.

I was in my jiu jitsu class and sometime during it I apparently got hit in the face. It was pretty intense last night and I don't remember it happening, but since there is evidence it obviously happened.

It was the first time in years that I can remember ever having a mark on my face. I have them up and down my arms and midsection. It sounds a lot more painful than it actually is. It is nowhere near as barbaric as it probably sounds though.

What is with the April filers getting approved when there are so many March that isn't approved yet?

I have a theory but it's too hard to type in the car


Richard, I don't know what your theory is, but I wanted to point out that according to the USCIS web site, you will be beyond the *published* processing time for K1 petitions at the VSC. I would call them on Monday and demand they put in a service request, and I would get your congressman on their a&@.

(ok, i'm not very tolerant of their #######...their "official" processing times seem to be manipulated to their own convenience. I think it is now "5 months" just so they can claim in a press release that they "met" their previously published goal)

I agree with you...in my opinion the laws against it lead to the real crimes (things that in my mind are about as evil as it comes - forced prostitution, human trafficing, etc...).

The most "unusual" food I've ever had is Indian food...we went to a restaurant in England and I was a bit unsure of it but it wasn't bad at all! My favorite thing was the flatbread..I think they call it Nan bread??

When you apply for the SS # you can then apply for a drivers license too... then of course the marriage license.

The AOS is to be filed ASAP after marriage with the cost of $1010. The AOS needs to begin being filed before the 90 day period so when the k-1 expires the beneficiary is still legal inside of the states. The EAD cost is included in the AOS packet and needs to be refiled every year until you receive the final AOS paperwork but allows you to work until the AOS is finalized, which is a very important fact in my case.

The AP is a different set of papers and I think is another fee NOT included in the AOS packet.

My understanding is that when you file the AOS, you can as an option, at NO COST file both the EAD and AP request. You can choose to file them later, but will then have to pay the fees for them (NOT cheap). So when you file your AOS, file for BOTH the EAD *and* AP.

When will the fees end? not until LONG after we are dead...death and taxes...

Richard, I am growing 7 varieties of chile peppers this summer (sometimes it is as much as 12 varieties), so I *like* it HOT. If my lips are swollen, my nose is running and I am sweating, I am pretty happy. Only one time have I had a serious problem. That was with the "flatliner" boneless wings at Buffalo Wing Factory (in Chantilly, VA). The morning *after* eating a whole order (of 10), I woke up, and it was literally like there was a nuclear meltdown in my stomach. I literally was emanating heat from my stomach!
