Today is the day! I'm here at work in Texas and in a couple of hours Len will be starting his interview at the embassy. I'm anxious and nervous. I can only imagine how he's feeling. We're hoping he can get his visa in hand and be here before Christmas. I know that he won't get his visa today - but hopefully he will get it quickly.

Hi pam, your fiance's interview is actually one week before mine. The visa fee is US$100, or JM$7100 payable at any PAYMASTER. He MUST take the receipt with him on the 11th. good luck with the interview.

I hope things go well when you meet in person for the first time, it is all very exciting! Save all your receipts, boarding passes, maybe post a few cards to her before you leave home and once you return (remember to save the postmarked envelopes and bear in mind that they will be submitted as evidence), and remember to take lots of pictures both together and with her friends/family, you will need them if you petition!

Standard US passports are issued with a validity of 10 years, if you a minor (15 or under) they are issued with a validity of 5 years.

Your question is vague, and I was unsure of what form you were referring to, after looking at other posts/questions from your member profile it seems you are filling out the I-129f?

While you may send a complete copy of you passport to fulfill the requirement of the I-129F, you also have the option of sending a copy of your birth certificate (front and back). I sent both; the copy of my B.C. to fulfill the I 129-F requirement and a full copy of my passport as "evidence of our having met in person".

There are so many members here all at different stages of different immigration processes, by being more specific with the title of your post and your question you will get more responses and new members that have the same question are more likely to find the answer as well.

Some of the people that got their NOA1 in July are starting to get their NOA2 from USCIS (some with a NOA1 dates of July 26th!)....weeks earlier then the VJ estimate, which is encouraging. Try the "Attention July Filers thread", the approvals started coming in at around page 165 and they have a spreadsheet that notes the service centers and the number of days between NOA1 and NOA2. There is probably a thread for August Filers too, if you have a look.

For the K-1 visa your fiance petitions for you the I-129F (look at the guides they are very thorough), after your petition is approved by USCIS (this will take plenty of time!), you take an I-134 (affidavit of support) that he has filled out and had notarized to the embassy interview....if he does not meet the financial requirements you'd need a co-sponsor that would provide you with the same I-134 forms for your interview.

This is potentially months down the line, while you want to be sure he meets the requirements, I think this is something to deal with after he submits the petition.

I do not know about your other issues with asylum etc, but (at the moment) for people filing K-1 visa it seems to run an average of between 5-8 month from filing to visa/visa interview, but I would assume these are straight forward cases. And it really varies depending on the service center as well as by the fact that they had a huge number of applications over summer because of the fee increases that took effect in July. People filing in December may have better results?

I think we are all overwhelmed and made a bit sick when we realize that our lives and plans will have to be put on hold while we await approval by a process that puts our fate and emotional wellbeing in some anonymous fastidious bureaucrats hands. But realize you are not alone here, there must be at least a few people here on VJ that have been through your specific situation. Do as much research and reading as you can!

You've made a really good start by finding this site and I wish you the best of luck on your journey.

I read an article, I think it was a link from a post on VJ but I can not find it now....perhaps someone else will post a link for you.

The delay was down to several factor including the fee increase in July and there is a lot of controversy because of the upcoming election and new citizens being unable to register to vote. And I remember something about AOS cases taking 18 months....but I am unsure of the context....hopfully someone else can direct you to the article.

At my interview in London I initially gave them the Affidavit of Support, Pay Stubs, Letter from his employer, proof of my assets/bank statements ($162600) but they still required a tax return also. As the guide says they require a minimum of 2 of the options. It is generally best to have as much information as possible as if they need to ask for anything else it will delay your case. Tax transcripts can be requested by the USC online. He should google them and put in a request quickly.

I am giving a copy of my 2004, 2005, and 2006 tax return to my fiance for his interview because I have read postings from members like RosemarieL here on VJ! This will be a simple thing for me to do to avoid possible problems when my fiance has to go for his interview.

Yes, he should send you a copy of his tax return, they might not ask for it but it is better to be prepared. Some people bring three years just to be safe.

I am not sure if this is the answer you were looking for or not? But everyone that earns an income in the US files a tax return (or is supposed to!), even people that work for a company. By providing you with his tax return it is added proof of his income for the I-134 affidavid of support.

I am in the UK with my fiance, we petitioned in July (whilst I was home) and I returned to the UK in early October, I plan on staying until he gets his visa...so I will have said GAP in my employment record. One (perhaps obvious) pro is that it takes a lot of the misery out of the wait! One serious con; in the UK, with the exchange rate being so bad (from an American point of view) and not being able to work we are taking a financial hit.

This is the conclusion we have come to based on our situation.
Every persons financial situation is different. In this process employment history is not the only factor, there are University students and retired people petitioning and getting approvals. While I am sure that being employed at this stage (as the USC) could only be helpful when it comes to the affidavit of support part of the process, I expect that, as long as I have a qualified co-sponsor things should be fine. I think the main concern for the US government is the point that the beneficiary not become a burden on the system, any co-sponsor is entering into the same legal obligation as am I to ensure that this does not happen.....so if I do not meet the requirements and my co-sponsor does then I do not see it being a problem. I do plan to return to work as soon as we return to the US and I expect this will help when it comes to the AOS part of the process, but I think the Embassy will be fine with granting the K-1 based on mine and my co-sponsors I-134.

That being said I have heard of petitioners that are on public assistance being denied, even though they have a qualified co-sponsor. But I do not feel that this has any bearing to our particular situation.

Thanks for the info, guys! It's great to know that I'm not alone in this civil wedding decision. My plan, too, is to do the civil stuff first and save the ceremony for later. I mean--there is a time factor and we all must worry about getting the license before that visa expires.

I must admit--I felt guilty at first having to do this civil ceremony first, almost as if I was cheating my fiance out of a great thing...but, then I realized that it's all about the love. That's all that counts in the end. Besides, it's not as if we had a choice in this matter--we need to marry and fast. The ceremony can wait until later. We actually plan a nice little ceremony in May in my parent's yard--a nice yard ceremony at night, like my fiance and I dreamed of.

I have a busy couple of months ahead: My fiance is flying in on January 18th by herself. I already purchased her a one-way plane ticket in her name from Vayama.com for northwest airlines. In the next few weeks I must send her money for travelling, airport taxes, food money, etc. On top of that, I am moving out of my parent's house next month and into my first apartment, which I plan to have ready before my fiance even arrives. Then, the courthouse wedding and honeymoon. Needless to say, I'm very nervous and excited at the same time, LOL!

Hey, all! My fiance and I, due to budgetary constraints, are unable to have a ceremony for some months. However, my fiance is flying in on January 18 this new year. Her K1 visa expires this March. We need to have a simple civil ceremony in our courthouse in January when she comes.

I have a few questions, however.

Are there any special requirements or documents for such a marriage since my fiance is from the Philippines?

Also, do we have to set an appointment to be married by the judge or can we do it on a same day basis?

How exactly does this process go, if I may ask? Do we simply fill out our forms the day we walk in and are we considered to be married on that very day? Also, where would we file our marriage license info to after our marriage to let the government know that we were married before the visa expiration deadline?

7. Should you want to exit the airport once you have checked in, you will only be allowed to be outside for 10 minutes. You will have to leave your boarding pass with a security officer near the exit. You be given an exit pass. When you enter the airport, you will have to go through a security check again. Return the exit pass to get back your boarding pass.

8. Present boarding pass to guards assigned at the entrance to the terminals.

9. Queue for terminal fee payment. The rate is currently 550 pesos.

10. Queue for Philippine immigration check. Present your passport and boarding passes. Once you have gone past the Philippine Immigration counter you cannot exit the airport.

11. Proceed to the gate assigned to your flight (information found on your boarding pass). Here you will have to submit to another secuity check.

12. Wait for boarding announcement at the Pre-Departure Area.

13. Obey safety guidelines given by the aircraft crew. While you are en route to the US, you will be handed immigration forms to fill out. A person travelling on a K-1 visa must ask for the white I-94 Departure Record Card. You will also be handed a U.S. Customs Declaration Form. Read instructions carefully before filling the forms out. Fill them out while on the plane so you will not have to waste time when you get to the airport.



Welcome to the United States: POE Information
Your Port of Entry (POE) will be the first destination you get off at in the United States. For example, your final destination is Baltimore, but to get there, you will have to disembark at Minneapolis and take a connecting flight from there. Your POE is Minneapolis. This is where you will go through Immigration and Customs.

1. Have your passport, I-94, and Customs Declaration Form ready.

2. Queue at any Immigration counters marked "Non-US Citizens/Visitors".

3. Present your passport and I-94 to the INS officer at the counter. He/She will direct you to a room where K-1 and Immigrant Visas are processed.

4. If baggage claim is near the INS office, claim your baggages and check them back in for your connecting flight. Procedure my vary for each airport.

5. Go to the INS processing room for K-1 and Immigrant Visas. Take a number and wait for your turn. When you are called, submit your passport, I-94, and the sealed brown envelope from the Embassy. The INS officer will open the contents and inspect it while asking you questions about you petitioner, your relationship, wedding, and whatever they can think of. Be alert and always have presence of mind. Any sign of uncertainty in your answers may prompt them to give you some trouble. Don't worry too much, though...the procedure is very easy. Ask about your Employment Authorization Document (EAD). Some POEs issue it, some don't. If you are not given one, you can apply for one at your local INS office.

Very Important: Keep your I-94 safe! You will need it.

6. Go through the U.S. Customs counter and present your declaration form. The officer may or may not inspect your baggages. The Customs officer I had on my arrival just looked at my form, asked me what was inside my two boxes (which were already checked-in), looked at my cat's health certificate (and wanted to pet my cat too!) and let me go. Simple!

7. If you are taking a connecting flight, go to the gate number of your flight/pre-departure area and await boarding announcement. There may be additional security checks. You will be like a regular domestic passenger on your connecting flight...no more Immigration and Customs procedures.

8. Upon arrival at your final destination, be ready with your baggage claim stubs and wait for your check-in luggage at the conveyor belt assigned to your flight.

note: fess may increased from 550 to 750 pesos.

OK, I'm confused. I remember now about the terminal entrance fee of the P750.00 you mentioned but both the Vayama site and the people on the phone told me that all taxes and fees are included in the ticket price. Where is this P1,620.00 coming from? Several people have now said this and I just don't understand.

I bought the one-way ticket for her online and she needs to get the e-tickets from the airport when she goes there. So, she has to pay an extra P1,620.00 at the airport? I just don't understand why.

Check the cost of the ticket, and fianal fee. I would think that the taxes are included in the final sale price.
I never had to pay at the counter any tax fee.

If Not, she would pay any remaining amount due at the ticket counter, most likely in Pesos, her countries currency.

Oh, no--the Vayama people assured me all taxes and fees are included in the ticket but someone mentioned something a few months about her needing to pay some sort of terminal entrance fee and a airport security tax of some sort. I just can't recall what they were talking about.

Yeah she needs to pay the P1620 it is not included on the ticket. That is the travel tax, i experienced that before my fiance husband now purchased me a ticket through vayama.com also, i asked him if i do need to pay the P1620 for the travel tax he said that i dont need to pay coz its already included it on the ticket, but when i am in the airport checking in the lady told me to pay the travel tax because it is not included on the e-ticket. So i payed P1620 plus 750 terminal fee. Just give her extra money just in case. I flew through NWA last sept 2007.

Yeah, if there's one thing I've learned from this entire fiance visa process it's that there is NO room for taking gambles with money.

It is true it can't be transfered from K1 to K3, before abandoning K1 and apply for K3 try to find a reason for AP or wait. If you apply for K3 and wait for the process all over again and go to interview you will have the same AP problem because this time it will be more suspicious to CO because you are trying to avoid the previous problem not addressing.
