Try not to worry, if they have cashed your check then you know that they have your case!

USCIS policy is that cases are supposed to be processed in order received but this does not always appear to be what happens, at least not with what people report here. I do not think you should worry about your case being slowed becasue of NOA1...I never got My NOA1 and my case was approved before others that had received the NOA1 within a day or two of their petition being recieved at USCIS...there is not alway rhyme or reason in this process....it is just a waiting game.

Was your fiance able to get your case number off the back of the check? If he did you can check the status of your case online at the USCIS website, there might be a message there that will tell you if/when they posted NOA1.

Definitely call them back in exactly 24 days if you have not received the NOA1 hard copy! Personally, I'd be sure to write down the USCIS operator's name, employee number, time, date, what they told me...keep a log of all calls to USCIS.
While they are on the phone get your case number (if you do not already have it) and have your fiance confirm his entire mailing address with them. I know I said this before but if it is incorrect he MUST fill out a change of address online at the USCIS website, or if the operator does it for him get a confirmation number! This is important because you need to be sure that you receive the NOA2 hard copy.

I suggest that you fill in your Visa Journey time line as soon as you can, it will give you an approximate date that you can expect to hear from USCIS! The date is based on the data entered by all the other VJ members that are currently waiting for their petitions to be approved, so keep yours updated. You can also find members with similar time lines for comparison and probably also find a thread (or start one) that is for people that filed in same month as yourself, this can be a great source of support, especially as the approvals start rolling in.

I know that this is a tough process, it is all so personal and you are left in the dark...dealing with this heartless bureaucracy! But you found this site and that is a huge leap forward, there is so much support and information here, I don't know what we would have done with out it!

It may not be normal but there have been loads of inconsistencies lately so don't worry yourself too much. You had delivery conf from the post office and have you Fiance see if the check was cashed, if he can get the case number off the back you can check your status online and if not you can call USCIS.

I never received NOA1 either, but after 90 days you can call USCIS and they will "help" you, they can give you your case number and while you have them on the line they may be able to confirm your fiance's mailing address...be sure to do this...as you will need the hard copy of NOA2 for AOS. Have they cashed your check? If you paid via personal check you may be able to get your case number off the back the check (it will be 3 letters followed by 10 numbers) (the endorsment on my check was illegible, so this advise was no help to me).

Don't forget though that your finacee will need to obtain police certificates from Germany and West Africa if she stayed their for 6 months or longer which is the case, I believe. So my question is: Is it possible for me to fly to America under a tourist visa (or more specifically, the Visa Waiver Program) simply to visit my girlfriend (with full intention to return back to Australia).... or is it that once the K1 Visa has been issued, the immigration officials at the airport will know I have been issued a K1 Visa, and will therefore not accept me travelling under the Visa Waiver Program?


I know, a bit confusing, and I apologise for that.

Once you get your petition approved by USCIS you have 4 months to get the visa.

Possible solution....go ahead and petition with USCIS like you plan to (although it might be better timing if you wait until April to send in your application) but do not rush to get get the actual visa, schedule the Embassy interview after you get back to Aust. with your fiancee in Dec/Jan.

Can he have a Visa for Marriage in his passport but still enter the UK (in July) on the US to UK Visa Waiver Programme, therefor not yet using the marriage visa? This way you could satisfy the registrar's requirements as the visa will have been granted.

Hopefully someone else will be along soon that can better set your mind at ease.

Please fill in your details, some things DO depend on the Embassy you are going thru and people will be better able to answer your questions in a specific way if they have more detailed information. good.gif In other words...if you tell us where you are...another member may be along that can tell you if their copy of the petition was ever even looked at.

While it is not ideal, what's done is done. You know the petition has arrived at USCIS, that is the most important thing!My feeling is that the exact copy is more for your peace of mind, in case the petition gets lost...that's why it is best to keep your originals. But you already know it is at the service center!
I have read on VJ that after the NOA2 your entire packet is forwarded to the Embassy, so they will have the original and I don't think they are going to nitpick when it comes to your having an exact copy.

The 90 day stay in the US, she was a visitor, so no. She would not list it as a residence.

I would think you can leave the gap, and add a supplement form explaining that you were travelling for 9 months (or in her case 12 months, I guess with the 90 days in the US) and had no fixed residence at that time.

There is NO rule saying you can't apply for a tourist visa, or visit while the K1 is in process. That being said, it is always at the discretion of the embassy issuing the visa (if you can prove ties or not) or the interviewing Immigration officer at your POE if they want to approve and let you in. There is always a chance they will say no.

Personally, I travelled to the USA several times (three times if my memory serves me) while our K1 was in process, and was never even ASKED about our K1 petition...

K-1 Fiance(e) Visa Process & ProceduresWork Permit?
We were recently married on our K1 visa on January 28 and now we're left researching about AOS. I have a burning question...how can my wife obtain a work permit while waiting before the issuance of a green card?

My fiancee in Lima just found out that she can buy a one-way ticket to the
USA after her interview for about 1/2 the price that I can from the USA.
Now Im thinking that she can buy mine too if I western union her the money.
Does anyone have experience saving money in this way? BTW, one way
tickets bought from the USA are highway robbery. I told the American
Airlines agent if I would just buy a around trip ticket for her and just not
use the return and he told me that was fraud and I could be arrested.
After he told me that, the conversation took a bad turn. I was not very
happy. It was after this conversation when we decided to look at
prices from Peru.
