When it rains it pours, I tell you *Sighs*....


My fiance heard reports on the news about some filipinas being turned back once they land on US soil even though they had visas. Well, in this situation it was two women with tourist visas.

My fiance (and now I) is worried that she may be detained at the first US port of entry airport because of hearing all this news.

Does she have any reason to fear? Should she be fine? How do they generally look upon those who arrive with fiance visas?

I have something new to worry about now. *Sigh*.... unsure.gif

This process can bring about such unbearable stress at times...


Also--I'm looking for the best flying method. Is there ANY website that would allow ME to purchase HER ticket so that all she would have to do is get an E-ticket from Manila airport or will she be required to buy a ticket from Manila airport herself?


I need advice on these urgent matters, please, as I trust those who went through the experiences much more than anything else.

As far as i know there is no limit, i brought almost 20000 in cash on my poe and i dident have any probs, did have to sign a petiotion, but you wont get charged taxes on it

I am an American citizen engaged to a man from Dromore Northern Ireland.

We are beginning the process of the applying for the K-1 visa so he can come to the US and we can marry.

He has visited me several times in the past year on a tourist visa each time and is planning to come back and spend Christmas and New Year with me as well. All his trips have been less than a month in length so he has never violated any sort of stay duration.

I was told that immigration won't look kindly on these visits and may veto our petition because of them. Is that really true? I understand that if he came over and we got married while he was here they would certainly have cause to question the "spontinaity" of the marriage - but we are not doing that. We are going through the proper channels and starting with the K-1.

Can anyone else give me input into the situation? I would really hate to spend the holidays without him, but I also don't want any suspicions raised by his visits to me as well.

My question is this, if he declared bankruptcy in NI while our K-1 is in process, will it effect the approval process. He doesn't want to make any decisions that might be detrimental to the outcome of the K-1 approval.

My fiance and I are about a week away from filing our K-1 (finally!) and I find myself in a position now (being the petitioner) where bankruptcy is looking like the most viable option, will this effect our K-1 request?

I assumed the request only looks at income (I am employed full-time with a salary that exceeds the specified support limits) as documented in the Affidavit of Support, but I don't want to take any action that is going to preclude or delay our K-1.

I am engaged to a man from Dromore, NI and we are putting together our K-1 packet.

I was married MANY moons ago (1987) and divorced in 1991. I have all the court documents pertaining to the divorce but on the G-325A form it is asking for his birthday. Quite frankly, I can't remember when it is. (Yes, I am old! tongue.gif ) I know the month and date but not the year. We were only married 3 years and for 2 of those we lived in separate states so there really wasn't that much communication.

Any advice on getting the birthdate of a man I haven't spoken to in over 16 years? I really don't think I want to track him down across the country and open that can of worms again for a birthdate.

Any other suggestions?

The adjudicator may, in his or her discretion, waive the applicable time and/or numerical limitations if justification exists for such a waiver, except where the petitioner has a history of violent criminal offenses against a person or persons. The petitioner may request a waiver by attaching a signed and dated letter, requesting the waiver and explaining why a waiver would be appropriate in his or her circumstances, together with any evidence in support of the waiver request.

The petitioner has submitted no supporting documentation explaining why a waiver of the filing limitations would be appropriate. Absent any favorable factors which may outweigh denial, the waiver should not be granted.

My former fiancee was interviewed at US Embassy Manila, approved, and issued a K-1 visa on 16 March 2007. I then learned that she only pretending to be in a relationship with me and had no intention of coming to the US. I canceled the airline tickets I had purchased, and so far as I know, she has never entered the United States. We never married.

On May 3, 2007 I wrote to the Chief, Immigrant Visa Branch, PSC 500, Box 26, FPO AP 96515-1000 USA, and informed them of this situation and suggested that her K-1 Visa be revoked.

I also filed a complaint with the F.B.I. via the fraud web site www.ic3.gov and gave them full details.

I want to preserve my rights to petition USCIS in the future on behalf of my new fiancee and need suggestions on how I should do this.

It was suggested to me to write to USCIS Laguna Niguel with a copy of my ex fiancees NOA, request cancellation of my petition, and request written confirmation from them. I am doing that now.

Has anyone one else been in this situation? Is there anything else I need to do so that I can petition again in the future? Thanks for any suggestions.

Once you come on K1 you AOS and get a 2 year green card. Come on K3 and CR1 you have to file and lift conditions 90 days before your 2 years in the USA. You will have to file I-751 petition and pay fees and have bio appointments again.

Assuming they got approved and arrived on K1 , K3 or CR1 visas they would need to lift conditons after some time. If at the time they go to lift conditons it states on the instructions for the I-751 If you are a widow, widower, or divorced you must still submit the form along with supporting evidence and the death certificate or divorce certificate along with a letter stating your circumstances. It also says a hardship letter stating why your removal from the USA would cause you hardship. So I am assuming as long as they have the proper information they can adjust without the spouse.

Getting a 221(g) is not uncommon in some consulates. It is basically they are going to verify the information that was submitted, do an investigation into the background if something is questionable or waiting for her name checks to complete. Once they complete their investigation, gotten the name checks back completed and cleared then they will contact the applicant. AP does not have a time limit and once they are ready to proceed they will contact your wife to come back or if they kept her passport and she paid a fee they can have it delivered to her via a courrier. Good luck and hope your AP goes fastly.

:help: My fiancee sent only the forms (I-129F and G-325A), photocopies of our passports, passport pics and the cheque!

I just re-read the uscis I-129f form and realized that you had to provide proof of your relationship in the package too and am freaking out! He was under the impression that you presented that evidence at the interview process and they just run a background check at this time!

Our petition was sent maybe two weeks ago and we still haven't received our confirmation letter (with case number) that they've gotten it. Should we wait for the case number and then send a cover letter with all our phone bills, flight itineraries etc? Can you send additional information before you get a RFE?

The base fee for this application is $325.00, or $225.00 if you are under 14 years of age.

There is no application fee if you are filing as a refugee under section 209(a) of the INA.

If you are between the ages of 14 and 79 years, there is also a $70.00 biometric services fee for USCIS to take your fingerprints. If necessary, USCIS may also take your photograph and signature as part of the biometric services. Following submission of your application, USCIS will notify you when to go to an Application Support Center to be fingerprinted.

Submit both application and the biometric service fees with your Form I-485.

cuz you dont want to start in romania and then change her address mid-process.... ( i always believe you should try and make it easy for uscis otherwise it'll potentially slow your case down by accidently being sent the the wrong location or something)

about your fiancee's mom, never ever lie on an application. since she's dead, list her as that, not any other way.

as for the signature, I filled out the form and mailed it to my USC fiance. I'd advise you to do the same.. if you sign for her, that's fraud, and that's a no-no.

(even if you went to a store with say a parent's credit card and their permission to use it, when you have to sign the receipt, you sign YOUR name, not theirs. again, FRAUD.)
