You must be talking about the California Service Center. Supposedly the time on the USCIS website tells you the date of applications that they are processing. In other words, according to the site, CSC is processing applications they received in April. However, this is not correct, as we know of many filers on VJ who filed their petitions in July and have been approved in the last week....

The I797 Notice of action here has a recieved date of Nov 13th 2007 and Notice date of November 19 2007 , im trying to estimate the time for the approval , can anyone please help me with this . I would really appreciate the help thank you


I really think the VJ estimate is a pretty good one. I know it's been off for some people, but I think the processing is taking somewhere around 4-5 months normally. Have you filled in your VJ timeline and looked at the estimate there? Otherwise, I'd say roughly 5 months is correct, as the first poster said.

On the USCIS site, it means how old your case has to be before they will do anything about it. Processing time for K1 is about 5 months right now.

Just recieved the notice of action I797 , it came two weeks early , is this a good sign?

My fiance is from Northern Ireland and works in the television industry. Currently he is filming a group of 5 shows for a production group in the US. There is a possibility this will evolve into a year long series however; nothing is concrete at this point in time. We probably won't have a definite on that until Jan-Feb next year. If it does go to series, there is also the possibility he will be issued a work visa since the production group is based in LA.

We were planning to submit our initial packet for the K-1 visa in December when he visits for the holidays. Should we continue to do so knowing there is the possibility of a work visa in the future? And, if we do file for the K-1 and suddenly the company wants to sponsor him for a work visa - will the fact that he has an active K-1 request be a hinderance to this process?

We would hate to wait considering there really are no definites in the picture as far as a work visa is concerned, but we also don't want to complicate the issue should it arise in the near future.

(never had a problem... carry pay stubs, letter from school etc..)


Because it HAS been a problem for my fiance! They told him he visits too often and that the last time he was here it would be the last time he could enter the US without a Visa. He had proof of residency in the UK, but their argument was that he simply spends too much time here.


Was he going for really long trips? I've only heard them make of comments like that when you end up spending like over half to three-quarters of the year in the states (once you add up all the visits)..

anyway, it's always better to err on the side of caution and be armed with all your documents you can muster..

Amazing, yes - and I wouldn't recommend it, as on every subsequent visit, even though it's been almost two years, we still have to travel armed with documents! The big thing that got us through was evidence of the visa application in process and where we were with that.

Questions he was asked: how long are you here for, where are you staying, where are you working, are you looking for work in the US, how much money do you have with you? Essentially, they were determining whether or not he was leaving, whether or not he was working illegally, and how he was supporting himself. If he hadn't had all of the information about his job, financial status, and visa application he would not have been let in.

Last year we were also stopped and questioned due to the expired K-1 in his passport, but that's another story.

My husband visited me three times while the K-1 was in process, each time for the maximum of 90 days. We entered via Newark each time. On the first two trips, he was not stopped or questioned beyond the norm.

On the entry for the third visit, he was stopped, questioned, and cautioned not to try entering again without the visa. Fortunately, we got the visa after that, so we didn't need to worry. During that questioning he was asked to provide ties to the UK (bank account, letter from work, and all of our visa paraphernalia such as the NOAs we'd received, the medical information, and the interview letter from the Embassy). We have also been stopped since then (we didn't pursue Adjustment of Status and currently live abroad) when entering the US; nothing major, just the same where we are asked to show ties to the UK.

There's really no intermediate answer to this. You cannot apply for a K-1 until the divorce is final as all parties must be free to marry.

You could *try* coming to the US for as long as a Canadian is allowed; however, you would still need to return home to get the proper visa when you're eligible to apply. The K-1 process is outlined in the guides above and you can get an idea of the timeframe by looking at the timelines - so make use of the tools on the site.

Sad to say, there is no quick-and-easy way to do this; particularly if you have to wait for a divorce.

Copy the back, even if it's blank, label it, and submit it. Some certificates have information on the back, some don't, so you have to include both sides regardless.
